We discussed the unique circumstances of the building design and how the previous signage was installed on the canopy. He reiterated to me that the sign code is very clear about the requirements for canopy edge signs, and that the previous signs on the building do not set a precedent for signs installed in the future. So typically you would be limited to the restrictions on canopy edge signs in the new code. However, there is a provision in the new code whereby property owners in the Tukwila Urban Center can opt out of Section 19.20 of the code, which is the section in which these restrictions are found. Property owners who choose to opt out will be under the provisions of Section 19.22 of the code which are similar to the rules of the old code. The old code w.as less flexible in many ways than the new code, and did not contain a definition of or design regulations for canopy edge signs. Under the old code, the other signs on the building were treated as regular wall signs, even though they were installed on the canopy. Since Section 19.22 does not contain any size restrictions for canopy edge signs or additional information about how they should be treated, we would treat them the way they were treated under the old code — in which case the Xavier sign as you have proposed it would be allowed with no revision. Your options are as follows: - You can revise the plans for the canopy edge sign so that it meets the requirements of the new code, which allows a single row of individual letters not to exceed 12 inches in height. You may submit the revised plans to me via e-mail, and you do not need a new permit for the revision. - If the property owner decides to opt -out in order to continue to use canopy edge signs as in the past, they must follow the steps listed in Section 19.22.020.A of the Sign Code, reprinted here for your convenience: o The property owner of record must submit a letter to the director of DCD notifying the City of the property owner's intent to "opt -out" of Chapter 19.20 within one year of the effective date of this Title, with copies of the opt out letter provided to all tenants on the premise. o The letter must include a map identifying all parcels included in the "opt -out" request and verifying that the premise is located within the TUC. o An "opt -out" request will apply to all buildings, tenants and signs on a premise. o The letter must be accompanied by the fee established in the most current fee schedule. As previously discussed, you may install the sign on the wall face, rather than on the canopy. I understand that the structural issues with the building may make this option less preferable. You may pursue a sign code variance. The specific variance criteria is listed in Section 19.28.030 of the sign code. The fee for the opt -out permit is the same as a regular sign permit ($212) and it must be received by August 24th, 2011. Structurally, the building facade was not designed for signage to be placed on the metal panels over the storefronts. To do so will require blocking to be installed behind the finished interior walls. Also, since these metal panels cannot be simply patched and painted like a dryvit or stucco wall panel can, the storefront facades will end up looking like Swiss cheese as tenants come and go. 2. Architecturally, the building and signage placement was designed under the old sign code provisions to have the tenant signage on the awning fronts to provide maximum exposure to traffic traveling on Baker Boulevard. 3. Fixtures, standards, and all exposed accessories should be harmonious with building design,. The light poles used throughout the front of the building are decorative and echo the angled tower elements. h. Monotony of design in single or multiple buildings projects should be avoided. Variety of detail, form and siting should be used to provide visual interest. The existing building has an L shape that will not be changed. The center section of the L will be chamfered and a small area of storefront along the southeast corner of the building will be pushed forward to provide modulation. The applicant proposes to add metal canopies and a mix of materials to provide detail and interest along the front facade. There will be no detailing along the side and back walls, though they will not be very visible due to the landscaping and adjacent buildings. The three tower elements break up the currently horizontal roofline. 5. Miscellaneous Structures and Street Furniture. a. Miscellaneous structures and street furniture should be designed to be part of the architectural concept of design and landscape. Materials should be compatible with buildings, scale should be appropriate, colors should be in harmony with buildings and surroundings, and proportions should be to scale. Bicycle racks and benches are proposed along the building front and sidewalk. Proposed signage for the site is conceptual. A freestanding sign is located within a landscape island in the front parking lot, see Attachment E. ll signs above the tenant spaces are also expected? Every business may have two signs, one on a wall and one on a freestanding sign or if the -business has two outside walls_it_mayhave twowall_signs instead of a wall and a spot on the freestanding sign. Sizes will be subject to the Tukwila Sign Code b. Lighting in connection with miscellaneous structures and street furniture should meet the guidelines applicable to site, landscape and buildings. No lighting in connection with miscellaneous structures is proposed. Comprehensive Plan Policies In addition to the specific criteria of the Board of Architectural Review, proposed development must show consistency with adopted plans and regulations (TMC 18.100.030.) Below are the specific goals from the adopted Comprehensive Plan that relate to the location of the proposal. (2) Relationship of Structure and Site to Adjoining Area. The existing building will only be significantly altered on the south facade. The utilitarian appearance of the west, north and east walls will be partially screened by landscaping and adjacent buildings. The building's height and form is consistent with other development in the area. (3) Landscaping and Site Treatment. The project provides over 3,000 sf more landscaping on site than is required by code. It meets the parking lot landscape requirements, except for the requirement to have islands at the aisle ends which interfered with the turning radius for emergency equipment. Additional parking spaces could be removed to meet this requirement, though that would increase the parking deficit. Because this is an existing building for which landscape conformance is triggered by design review the BAR has the power to modify the requirement. See Section Two of this report for further discussion. The street trees specified do not meet the TUC street plan and should be replaced by Red Maples. The recycling and trash collection areas are located in the least visible area of the site but must be adequately screened. All landscape areas will have automatic irrigation and the applicant will be required to maintain the landscaping for the life of the project (4) Building Design. The scale of the structure is in harmony with surrounding structures. The materials proposed for the south facade, tile and metal, will be of sufficient quality to be durable and functional. The awnings are sized to be functional and substantial in appearance. The three tower elements transform the existing tilt -up warehouse into a dynamic retail center. The proposed building body, canopy and cornice colors are muted and varied. Mechanical equipment will be screened by the rooftop behind the building's parapet. (5) Miscellaneous Structures and Street Furniture. A conceptual freestanding sign design is shown in Attachment E. A permit was applied for on August 28, 2008 but has not been issued. This site went through design review and the signs for the site are being reviewed comprehensively. I am working with the building owner and architect to approve a comprehensive sign package for the site. Until that review is complete, this permit cannot be issued. According to Tukwila Municipal Code 19.12.090, when work "is started prior to obtaining a permit, the fees specified in the Land Use Fee Schedule shall be doubled, but the payment of such double fee shall not relieve any person from fully complying with the requirements of this code in the execution of the work nor from any other penalties prescribed herein." Prior to issuing your permit, a fee of $250 will need to be paid. I can offer you no certainty that the sign you installed will ultimately be approved. I also noticed that the installation of the sign appears to have dented or damaged the building surface. Finally, the sign was installed without the benefit of an electrical inspection. There are two issues with the application. First, if you are refacing the panels in the freestanding monument sign as indicated on your plans, you will need a separate permit for the reface. I have attached the permit form for freestanding sign installations and refaces. Even though you will be replacing two panels, the permit fee will be only $212, as it will be processed as a single reface permit. Second, as I mentioned previously to you on the phone, many of the wall signs on this building were installed around the time that the new sign code was taking affect. As a result, canopy edge signs have been mistakenly treated as flush -mounted wall signs. I indicated on the phone that I thought we may be able to treat new signs in the same manner. However, upon further review of your plans and a careful reading of the code, I have determined I will not be able to approve the wall sign as it is proposed. I apologize for the confusion, but the new sign code is actually quite clear in this regard, and the previously installed signs do not set a precedent for your current application. A canopy edge sign is defined in the code as "a sign mounted along or above the edge of a canopy and oriented parallel to the building wall." Code section 19.20.050.E.2. limits canopy edge signs to "a single row of individual letters not to exceed 12 inches in height." It appears from your plans that the proposed sign would meet the code requirements for a flush -mounted wall sign. I suggest mounting the sign on the section of the building wall directly above the canopy. If you would like, you can submit revised plans via e-mail. Alternatively, you could revise the plans to meet the requirements of a canopy edge sign. If your client is interested in additional signage, a canopy edge sign would be allowed in addition to the flush -mounted wall sign. Thank you for your patience as we transition to the new code. Conformance will be strictly enforced, and any installed non -conforming or unapproved signs must be brought into conformance at the expense of Tenant. 1. Administration a. All tenants shall provide fascia signage in accordance with these criteria. b. Tenant shall submit to the Landlord's Agent, three (3) prints of detailed drawings showing location of the sign on the storefront or designated space, size, layout, and color of the proposed sign, including all lettering and/or graphics, materials, attachment devices, construction and fabrication details. Tenant shall receive a copy of the sign drawing approved with signature by the Landlord or Landlord's Agent prior to fabrication and installation. c. Tenant's sign contractor is to provide written certification that the sign installation conforms to all applicable codes and ordinances, and that it has been inspected and approved by the controlling agency. d. Tenant or its Agent shall obtain a sign permit from the reviewing jurisdiction for its sign and the installation thereof. f. The Landlord will provide primary electrical service terminating at the point shown on the plans. g. Tenants shall pay for all costs relating to the sign including the installation, final connections, photo cells/timers, and maintenance. h. Upon vacation of premises, Tenant shall arrange for removal of sign and filling of holes with appropriate material so as to create a waterproof assembly. Any damage caused by removal of sign or failure to make construction waterproof shall be Tenant's responsibility. i. In the event of any conflict between Tenant and Landlord as to the application of these criteria, Landlord's decision shall be final and binding. 2. Design & Construction Requirements for Fascia Signs. a. All signs shall be mounted on the canopies of the adjacent leased premises in accordance with Elevation Drawings 1 through 6 and Detail Drawings A and B. If the leased premises do not have a canopy, the sign construction and Tenant Signage Letter Elevation Line must be maintained in accordance with Elevation Drawings 1 through 6 and Detail Drawings A and B. b. A combination of channel letters and tag line sign "capsules" is acceptable fabrication. c. Landlord shall be the sole judge in its discretion as to conformance in accordance herewith. d. Signs shall be of the following construction: i. Illuminated trim -capped or open pan individual channel letters with painted returns. ii. All signs shall be raceway mounted. Design Requirements for Entrance and Service Door Signs. a. White cut vinyl lettering only, shall be permitted on glass doors within the limits set forth herein: i. 144 square inches per entrance in lettering not to exceed two inches (2") in height, indicating hours of business, emergency telephone numbers, security sticker, etc. i. All lettering shall be white vinyl lettering on face of door. ii. Door is typical non -customer type for receiving merchandise at rear. 4. Design & Construction Requirements for tenant panels on Pylon Sign. a. Tenants are allowed advertising on the Pylon Sign as determined by the Landlord or Landlord's Agent in the Lease Agreement. i. Tenant is responsible for providing their own tenant cabinet in accordance with Detail Drawing C. ii. At least 50 percent of the wall area between the height of 2 and 7 feet must be transparent with either an unobstructed view into the business or use or a display window with a depth of at least three feet. 2. Architectural detailing consistent with the building design using changes in color, materials, texture, and variations in the wall plane. 3. Artwork such as mosaic, mural or sculptural relief covers at least 50 percent of the wall surface. If the artwork uses words or images related to the business on site they will be considered part of the sign area. 4. One or more trellises covering at least 50 percent of the wall area between the height of two and seven feet, planted with climbing vines and other plant materials in a planting bed at least two feet in width and provided with permanent irrigation. Signs permitted under this Section may be up to 50 percent of the area calculated in the Table in Section 1. The sign is not permitted to overhang parking areas, service areas or other non -pedestrian oriented areas. Not all buildings will qualify for a projecting or canopy edge sign. Not all businesses will qualify for signage under this section. Under-Awning/Canopy Signs In order to qualify for under-awning/canopy signs an entrance to a business must be provided from a public or private sidewalk. Note: Permanent window signs are not permitted in windows located along private offices, storage space, display windows or windows that are opaque or otherwise do not allow viewing into the business. 2. The applicant or installer is required to schedule the final Sign inspection through the City's Inspection line at (206)431-2451. The 4-digit inspection code needed for scheduling the final Sign inspection is 1510. The applicant or installer does not need to be present for the final Sign inspection It is the responsibility of the installer to obtain the electrical permit and inspections from the City of Tukwila Permit Center at (206) 431-3670. The electrical inspector will need access to complete the Electrical portion of the inspection. GENERAL The issuance of some signage within the City may require a permit from the Washington State Department of Transportation (WSDOT). It is the applicant's responsibility to obtain all required permits from the appropriate government agency. For information on permits that may be required from WSDOT call (360) 705-7296. The issuance of a sign permit shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of this code or of any other ordinance of the City. Permits presuming to give authority to violate or cancel the provisions of this code or other ordinances of the City shall not be valid. The issuance of a permit based on construction documents and other data shall not prevent the Director from requiring correction of errors in the construction documents and other data (TMC 19.12.020 (C)). Pursuant to TMC 19.12.0150, sign permits shall be valid for 180 days from the date of issuance of the sign permit.
