As prescribed by State Law, the Ordinance will not go into effect until five days after publication in the Seattle Times. I anticipate the amendment being in effect next Thursday. Yes, five square feet in the maximum, but the sign can be smaller. Jon is going to complete the City's review of the sign permit and will issue it once the Ordinance becomes effective. I have provided a link to the Council packet which outlines the proposed changes that staff is making to the sign code. For full canopies, staff is proposing that each elevation be permitted to have one, five square foot sign (either illuminated or non -illuminated). A draft Ordinance will be going back to Community Affairs and Parks on April 23rd. The City strives to act on permits within 120-days of submission of a complete application. Given that the canopy signs do not meet code, we would have to deny the permit. I would suggest that you allow the City to act on the permit after the 120-day deadline. Please let me know if this is alright with you. This course of action would save you from having to submit a new application, with a new permit fee. By way of an update, Brandon went to the City Council meeting on February 6th to present information and feedback on the new sign code. Unfortunately, any official changes to the sign code must go through committee before they are adopted by the Council. Our next step in the process will be to present proposed changes, including the change regarding gas canopies, to the Community Affairs and Parks Committee on March 12th. If the committee votes to go ahead with changes to the code, we will write up an ordinance to present to them on March 19th. If all goes well in committee, the changes will be going before the full Council in April. 1 apologize for the inconvenience caused by the length of the process. I have determined that the signs as proposed would not meet the requirements of Tukwila's Sign Code. Your plans must be corrected or amended for the following reason(s): The sign code does not allow signs to be installed on freestanding canopies not attached to a building. TMC 19.20.050.E.1 states that "canopy -edge signs may only be permitted for canopies located above a public entrance to a business." The "Food Mart" sign proposed for the building wall may not extend past the roof eave (see TMC 19.20.050.A.5). This is not a final decision. Your permit application is still under review and may be corrected. You may submit revisions to your submitted plans via e-mail to jonathon.winters@tukwilawa.gov. No new permit or additional fee is required. Any revisions you submit will require additional time to review. If no corrections have not been received by April 5, 2012, your permit will be cancelled due to inactivity. Additional Information: Tukwila City Council may consider changes to the Sign Code to allow signs on freestanding canopies. He informed me of the very unfortunate news about no canopy signs are allowed. I requested two things from him which he said you would be handling (hopefully right away) 1) Something in writing stating "no illuminated or non -illuminated canopy signs are allowed" along with the reasoning. Conoco would require me to submit something in writing because they almost won't believe this when I tell them. It's also for our records 2) Red line the canopy signs from the permit package and approve the freestanding sign/food mart sign. We could then at least start production on those and deal with the canopy sign situation at a later date. If you could complete those items asap that would be great. I'm very nervous to call Conoco about the canopy signs.... Even if I can get a "verbal" ok for all signs that would be awesome. Our current situation is sign fabrication takes 3-4 weeks so I'm pressured to release orders into production. PS: Normally I wouldn't bug so much but this account (76) is really important to our company and Conoco is really stressing for the permit. Anything you can personally do to expedite review/approval I would greatly appreciate it.
