GEORGE D. HILL, LIONEL C. BOHRER, Council President, DORIS E. PHELPS, JOE H. DUFFIE, EDGAR D. BAUCH. MOVED BY BOHRER, SECONDED BY PHELPS, THAT COUNCILMEMBERS VAN DUSEN AND HARRIS BE EXCUSED FROM THE MEETING. MOTION CARRIED. OFFICIALS IN LAWRENCE E. HARD, City Attorney; ALAN DOERSCHEL- Finance ATTENDANCE Director; BYRON SNEVA, Public Works Director; MAXINE ANDERSON, City Clerk. Mayor Todd reported that he sent a letter to the King County Executive regarding the City's position on the 56th Ave. South Bridge. The return reply stated that he does not totally agree with this position and that his aide would investigate the matter. Also, Mrs. Baker, citizen in the Foster Point area, reported to him that she has received a letter from Mr. Keith Eggan, State Highway Commission. He said that the Federal Highway Administration Bridge Replacement Committee will meet in October and consider the Foster Bridge in its priorities. If it is rated high enough, ap- proval will be given to proceed with design. Council President Bohrer reported a Public Hearing will be held June 3 before the King County Boundary Review Board on the proposed incorporation of the City of Highline. This proposal includes a substantial part of the City of Tukwila's planning area. The City should strongly oppose this action. It is his intent to ask staff for some analysis and status. Council President Bohrer cancelled the scheduled retreat for May 8. Council reset the date to May 17, 1982, 7:00 p.m. Attorney Hard reported that last Thursday a lawsuit was filed against the City by Herman Allenbach. The purpose of the suit is to challenge the new Zoning Code. On Friday, there was a hearing before the presiding judges in the King County Courthouse. The purpose was an effort to get an injunction preventing the City from putting its new zoning code into effect. He was unsuccessful in getting a temporary injunction. At 12:01 a.m., this morning, the new zoning code is now the law of the City. Yesterday (Monday) a Building Permit application was filed by Mr. Allenbach. Staff is reviewing the project to see if it is complete. A Writ of Certiorari has been issued. This means the City must prepare a number of documents about proceedings. It could mean that we have to produce verbatim records of the entire period the code was being reviewed, including the Planning Commission. We are looking at a tremendous expense. He is going to make an effort to limit what the City is going to have to produce. Councilman Bauch asked why the ordinance wasn't published until the following Wednesday. Attorney Hard said he felt the safest position for the City was to wait ten days; then publish it. Councilman Phelps noted that Community Affairs Committee will meet Thursday. They will discuss Golf Course Green Fees and the Interurban Corridor Design Plans. Councilman Bauch reported that the Public Works Committee will meet Wednesday and discuss the 6 -Year Street Plan. MOVED BY BOHRER, SECONDED BY PHELPS, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read an ordinance of the City of Tukwila, Wash., accepting the water mains, including hydrants, and the sanitary sewer mains from Pacific Townhouse Builders, Inc., in accordance with the provisions of Resolution No. 784. MOVED BY BOHRER, SECONDED BY HILL, THAT ORDINANCE NO. 1255 BE ADOPTED AS READ. MOTION CARRIED. It was noted that the information requested by the Public Works Department has not been furnished. This item will be on the agenda again with the approval of Public Works. MOVED BY HILL, SECONDED BY PHELPS, THAT THE PROPOSED ORDINANCE BE READ. MOTION CARRIED. City Attorney Hard read, in its entirety, an ordinance of the City of Tukwila, Washington, amending Ordinance No. 1207 to change the days for City Council Meetings. 36,L3 MOVED BY HILL, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Councilman Hill noted that he doesn't use Monday nights like he thought he would. It turns out that it is nicer to get things out of the way the first part of the week. Council President Bohrer suggested that this item be considered when all members are present. MOVED BY BOHRER, SECONDED BY PHELPS, THAT THE PROPOSED ORDINANCE BE TABLED UNTIL ALL SEVEN MEMBERS ARE PRESENT. MOTION FAILED. MOVED BY BAUCH, SECONDED BY HILL, THAT THE ORDINANCE BE AMENDED BY ADDING A NEW SECTION, MAKING IT EFFECTIVE JUNE 1, 1982. MOTION CARRIED WITH PHELPS VOTING NO. *MOTION FAILED TO ADOPT ORDINANCE AS AMENDED. MOVED BY BAUCH, SECONDED BY HILL, THAT THIS ITEM BE PLACED ON THE MAY 18 AGENDA. MOTION CARRIED. Councilman Bauch said the voucher in question is for motorcycle boots and pants. Are these part of the uniform allowance? Pat Lowery, Police Chief, said they are contractual items. They wear out these items faster than normal. When the new ones are purchased, the old ones are turned in. MOVED BY BAUCH, SECONDED BY PHELPS, THAT THE SUBJECT VOUCHER BE APPROVED. MOTION CARRIED.
