Mayor Todd, presiding, led the Pledge of Allegiance and called
the Regular Meeting of the Tukwila City Council to order.,

REPORTS
Mayor Mayor Todd reported &t received a letter from Attorney Hard
requesting that his/ 'vi or fie City be terminated on September
1. He has made a couple of suggestions for Council consideration. Mayor
Todcbsked Council to consider this at their earliest convenience.
Council President Bohrer said that three Labor Negotiators have
been selected and will be interviewed by the City Council at the
next Committee of the Whole Meeting. About June 1 the person or
firm will be hired to negotiate new Labor Contracts.
Councilman Van Dusen referred to a memo he received from Don
Williams, staff member, concerning the limited number of parking
stalls around City Hall. He suggested a parking policy and con-
struction of the lower parking area as previously planned. Mayor
Todd noted that this would be included in the 1983 Budget.
Councilman Van Dusen said that City and Staff Members' cars should
not be parked in front of the main entrances to the building.
Councilman Duffie asked about the vacant lot on Southcenter Blvd.
that is being used as a used car lot. There are 10 cars parked
there for sale. Further, can the City post rules in the City Park
so the public will know what can be done there. There is a Frisbee
course set out in the Tukwila Park. This can be dangerous to
other visitors to the park. When they hold their tournament, they
ask people to leave. If rules were posted, it might help this
problem.

TO THE PARK COMMISSION TO ESTABLISH RULES FOR THE TUKWILA PARK.

Attorney's Report Attorney Hard reported that the State of Washington Court of
Appeals issued its decision on the Schmid vs. City of Tukwila
Lawsuit. The Trial Court decision was reversed and the case
dismissed. The affect of the decision is to declare that the
City's waiver process was proper and that the City Council acted
properly in its consideration. Further, the Trial Court erred in
directing the City to do something that is clearly a legislative
function. Mr. Schmid has the right to ask the State Supreme Court
to review this. They will have to reconsider it.
Finance Director's Mr. Alan Doerschel, Finance Director, reported on a meeting he
Report on Sales Tax and Councilman Harris attended on the new Sales Tax legislation.
The new law is almost identical to the 1970 legislation. An
important difference is that when you implement the law, it must
be at the beginning of a quarter and must be filed two months
prior to the start of the quarter. This is to allow citizens,
if they desire, 30 days to collect signatures to override the
Council's decision. If King County implements the Sales Tax
before a City does, the City cannot do so later on. Cities have
only seven days in which to act after the County has approved
collection. The half cent sales tax would double the sales tax
collected by the City (approximately $4.2 million). There is no

limitation on the use of these funds. Councilman Harris noted
that if the City enacts any portion of the sales tax, we will
lose 35% of the Motor Vehicle Excise Tax. It is very important
to coordinate with the County Council to see what they plan to do.

AT THIS TIME. MOTION CARRIED WITH VAN DUSEN VOTING NO.
Council President Bohrer asked how the vacancy occurred. Mayor
Todd said the vacancy occurred by the expiration of the term of
office of one of the members. He said he was reluctant to recom-
mend Mr. Gerry Knudson for the position as they have a business
relationship; however, Mr. Knudson comes very highly recommended
by others. Mr. Brad Collins explained that the Mayor expressed
an interest in appointing a member that represents the business
community. Mr. Knudson represents both the business community
and the residential area. Mr. Collins said he strongly endorses
Mr. Knudson. He is very open, fair and objective and will be a
good advocate for the interests of the City on this body. The
term of Mr. Orrico has expired; he was a very good participant
on the Planning Commission.

Appointment to Councilman Phelps said Mr. Knudson has the knowledge to deal
Planning Commission with problems along the Interurban Corridor as it develops.

Councilman Harris said she is hesitant as this puts the Mayor
in the position where there could be a question on appearance
of fairness. Mayor Todd said Mr. Knudson would excuse himself,
as any member would, when discussing something causing a conflict
of interest.

Council President Bohrer said that dedicated volunteers are dif-
ficult to come by. Where we have them and they have performed
well, we should retain them if they are interested in continuing.
Councilman Hill said he is in favor of having two representatives
from the Business Community on the Planning Commission.

City Attorney Hard read an ordinance of the City of Tukwila,
Wash., fixing the amount, form, date, interest rate, maturity
and denominations of Local Improvement District No. 30 Bonds
and directing the issuance and sale thereof to Foster Marshall,
Inc. of Seattle, Washington.

Mr. Doerschel said that upon the request of John Urbina, Foster
Marshall, the ordinance should be tabled for two weeks. It is
felt that the rates will be a little lower.

ADOPTED AS READ.*
Mr. Don Williams, Recreation Director, recommended that the
ordinance be amended to provide $4.50 Senior /Junior rate for
9 holes and leave the 18 holes at $5.00 on weekends. The
Community Affairs Committee declined to recommend a special
residential rate. They did approve the Senior /Junior weekend
rates be from October 1 through March 31, during the winter
season.

AMENDED TO DELETE "9 OR" FROM THE $5.00 RATE ON THE FIFTH

Mayor Todd questioned the term "on Social Security." There
are a lot of Seniors that may not have the benefit of Social
Security. Councilman Phelps said the intention was to make
three classifications: Juniors, Seniors, and the Identifiably
Disabled on Social Security. Mayor Todd noted that a person could
be identifiably disabled but not on Social Security.
MOVED BY PHELPS, SECONDED BY HARRIS, THAT THE ORDINANCE BE
FURTHER AMENDED UNDER THE $5.00 RATE BY REMOVING "AND IDENTIFIABLY
DISABLED (ON SOCIAL SECURITY)" AND INSERT AN "AND" BETWEEN JUNIOR,
SENIOR. MOTION CARRIED.

ORDINANCE AS AMENDED.

Mayor Todd called the Regular Meeting back to order with Council
Members present as previously reported.
MOVED BY BOHRER, SECONDED BY HARRIS, THAT ADMINISTRATION BE DIRECTED
TO SEND A LETTER TO KING COUNTY ACCEPTING THE FORWARD THRUST FUNDS
AND THE CONDITIONS IMPOSED.*
Councilman Hill expressed concern about building parks and who is
going to maintain them. It takes personnel. If Council is going
to accept the funds, they need to realize they are accepting the
responsibility for maintenance.
Councilman Phelps said there are two options as the result of
discussion by the Community Affairs Committee. One is that the
money be used for matching funds. If received, this money would
then be used for the McMicken Park; or the three projects listed
in the agenda packet could be identified and constructed. The
limitation on the money is that the project must be completed
in 1982 if possible. It is Council's intention from past dis-
cussions that the McMicken Park remain a natural area with the
lower portion somewhat developed.

Mr. Byron Sneva, Public Works Director, explained that the City
has spent funds on Grady Way Bridge design. It is now time for
the two cities to confirm their capabilities in funding the con-
struction portion. The application will then be sent to the
funding authority. It is in the best interest of the City to
proceed as soon as possible.

TO SEND THIS LETTER (assuring City of Tukwila support and that
Tukwila is ready to fund its 10% share of the total cost) TO

Councilman Hill said that once this project is complete, we
can proceed with the connection from Grady Way to Southcenter
Blvd. Mayor Todd explained that this project is a joint
project; the next phase will be entirely in Tukwila. Councilman
Phelps reminded Council that the Puget Sound Council of Governments
and the major funding agencies gave a very high priority rating
as a regional traffic link to the westerly portion of Southcenter
Blvd. and its connection with I -5.
Councilman Van Dusen said this project will solve Renton's prob-
lems and we are going to get them.
Mayor Todd said the railroad has agreed to pay $50,000 toward
construction. They are responsible for the bridge supports.
Council President Bohrer asked if there are funds in the 1982
Budget for this project. Mr. Sneva said there are funds for
pre construction amounting to $91,000. It is estimated that the
pre- construction will cost about $25,000.
Mayor Todd said he wanted it made very clear that this letter
commits the City to participate in the project to the amount of
$800,000. It is not a small item. We are committing to 10%
of the cost of the project should the project be funded 80% by
the Federal Government.
Council President Bohrer said the City has no plan for financing
this project. We need a plan before we proceed. We are currently
in a stressed budget situation.
Mayor Todd suggested interim financing to be covered by sales tax.
Mrs. Joanne Davis, audience, asked who is going to do the inspections
and the maintenance and how much is this going to cost. What is
the City's obligation? Mayor Todd said the City would be better
off with a new concrete, steel- reinforced structure than the one
there now. There should be no problem with maintenance of the
new bridge.

City Attorney Hard read a resolution of the City of Tukwila,
Wash., authorizing the Finance Director to make a segregation
on the original assessment roll for LID 29.
