Mayor Haggerton announced the purpose of the Executive Session is to discuss Potential Land Acquisition Pursuant to RCW 42.30.110(1)(b). It will last no more than 60 minutes, and no decisions will be made during the Executive Session. Attendees: Jim Haggerton, Mayor; Derek Speck, Interim City Administrator; Shelley Kerslake, City Attorney; Rick Still, Parks and Recreation Director; Peggy McCarthy, Interim Finance Director; Tukwila City Councilmembers Joe Duffie, Joan Hernandez, Allan Ekberg, Dennis Robertson, Verna Seal, Kathy Hougardy, De'Sean Quinn. 6:27 p.m. Rick Still left the Council Chambers. End: 6:57 p.m. CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:05 p.m. and led the audience in the Pledge of Allegiance. CITY OFFICIALS Jim Haggerton, Mayor; Derek Speck, Interim City Administrator; Shelley Kerslake, City Attorney; Jack Pace, Community Development Director; Bob Giberson, Public Works Director; Peggy McCarthy, Interim Finance Director; Mike Villa, Police Chief; Mary Miotke, IT Director; Christy O'Flaherty, City Clerk. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Joan Hernandez, Allan Ekberg, Dennis Robertson, Verna Seal, Kathy Hougardy and De'Sean Quinn. SPECIAL PRESENTATIONS Presentation from Bluefield Holdings regarding habitat project in the City of Tukwila: Barbara Smith, Harris and Smith Public Affairs. Barbara Smith and Scott Lockert from Bluefield Holdings gave an overview of the project. The City of Seattle and Bluefield Holdings, Inc. are working on the final conceptual designs for natural resource habitat projects on City of Seattle owned property along the Duwamish Waterway. There are 12 properties currently under a master lease to Bluefield Holdings, Inc. The first phase of habitat construction will be on four parcels three are on Seattle Department of Transportation property under the Spokane Street Bridge located within the City of Seattle and one is on Seattle City Light (SCL) property referred to here as the Delridge Transmission Line Right of Way, located in the City of Tukwila on the east bank of the Duwamish River. The project in the City of Tukwila is adjacent to the existing King County North Winds Weir habitat restoration site to the south, reinforcing the habitat value of both areas. This habitat project is also being designed to be compatible with continued use and maintenance of the right of way for electrical Tukwila City Council Regular Meeting Minutes October 17, 2011 Page 2 of 4 transmission and distribution. The restoration project in Tukwila will create or restore approximately 2.43 acres of habitat from lands currently occupied by riprap and un- vegetated upland. Combined, with the adjacent King County North Winds Weir restoration project, more than 6.0 acres of habitat restoration will occur. The restoration will create a new off channel inlet that will provide refuge and feeding opportunities for out migrating salmon, juvenile English sole, shorebirds and waders. The restored uplands adjacent to the created inlet will provide food and refuge for a broad range of bird groups. The conceptual design has been developed to maximize the amount of natural, salmon friendly habitat in keeping with the requirements of the Natural Resource Trustees for the Duwamish Waterway. Public access and viewing will be possible from the water, and there are good views from the North Winds Weir public pathway. A long -term stewardship fund will be established to continue all appropriate maintenance of the project to ensure the longevity of the fully functioning habitat. The goal of the project is to create a self- sustaining habitat that will complement any existing natural resources and further enhance the natural ecosystem and support native marsh species. It is anticipated the project will go to construction in 2012. The Councilmembers asked questions and exchanged comments regarding the project and thanked Ms. Smith and Mr. Lockert for the informative presentation. CITIZEN COMMENTS There were no citizen comments. CONSENT AGENDA a. Approval of Minutes: 10/3/11 (Regular Mtg.) b. Approval of Vouchers #358623- 358745 and 111001 111002 in the amount of $4,181,164.99. MOVED BY DUFFIE, SECONDED BY HERNANDEZ THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED. MOTION CARRIED 7 -0. UNFINISHED BUSINESS a. Authorize the design for the Tukwila Urban Center Pedestrian /Bicycle Bridge to be based on the Twin Tied Arch bridge, with no future expansion over the West Valley Highway. MOVED BY HERNANDEZ, SECONDED BY SEAL TO AUTHORIZE THE DESIGN FOR THE TUKWILA URBAN CENTER PEDESTRIAN BICYCLE BRIDGE TO BE BASED ON THE TWIN TIED ARCH BRIDGE, WITH NO FUTURE EXPANSION OVER THE WEST VALLEY HIGHWAY. MOTION CARRIED 7 -0. b. Authorize the Mayor to sign Supplement No. 2 to Contract No. 11 -042 with KPG, Inc., for the 2010 -2011 Small Drainage Program in the amount of $54,376.76. MOVED BY QUINN, SECONDED BY DUFFIE TO AUTHORIZE THE MAYOR TO SIGN SUPPLEMENT NO. 2 TO CONTRACT NO. 11 -042 WITH KPG, INC. FOR THE 2010 -2011 SMALL DRAINAGE PROGRAM IN THE AMOUNT OF $54,376.76. MOTION CARRIED 7 -0. c. Authorize the Mayor to sign an Interlocal Agreement with the Tukwila Metropolitan Park District (MPD) authorizing a loan from the City's General Fund in an amount not to exceed $1,100,000.00. MOVED BY HOUGARDY, SECONDED BY SEAL TO AUTHORIZE THE MAYOR TO SIGN AN INTERLOCAL AGREEMENT WITH THE TUKWILA METROPOLITAN PARK DISTRICT (MPD) AUTHORIZING A LOAN FROM THE CITY'S GENERAL FUND IN AN AMOUNT NOT TO EXCEED $1,100,000.00. A resolution ordering the cancellation of past due accounts receivable and returned check write -offs. MOVED BY HOUGARDY, SECONDED BY DUFFIE THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Christy O'Flaherty, City Clerk, read the proposed resolution by title only. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ORDERING THE CANCELLATION OF PAST -DUE ACCOUNTS RECEIVABLE AND RETURNED CHECK WRITE -OFFS. MOVED BY HOUGARDY, SECONDED BY SEAL THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ.* Peggy McCarthy, Interim Finance Director, explained that collection fees associated with the past -due accounts may be recouped through the collection agency. "MOTION CARRIED 7 -0, TO ADOPT RESOLUTION NUMBER 1748. REPORTS a. Mayor The Mayor attended the October 12, 2011 Suburban Cities Public Issues Committee (PIC) meeting. The PIC made the decision to not forward a position of pro or con regarding Initiative 1183 (an act relating to liquor) to the Board of Directors. Another issue of discussion at-the meeting involved the disposal of pharmaceuticals, and the Mayor can provide a model resolution to the Council if there is interest. The Mayor reported that a 3,000 piece mailing went out to residents announcing a meeting on October 25, 2011 in the Council Chambers from 6:00 -8:00 p.m. regarding noise associated with link light rail. The requirements specify the notification of people living within 500 feet of the location, but the City chose to notify everyone within 1,000 feet of the site. Efforts are being made to provide a permanent solution to noise issues associated with link light rail. Mayor Haggerton referenced the success of the October 13, 2011 Tukwila Urban Access (Klickitat) ribbon "kicking" event. Players from the Sounders soccer team kicked a ball through a red ribbon and into a goal in celebration of the event. The opening of the road was attended by representatives from Senator Murray's, Senator Cantwell's and Congressman Adam Smith's offices. Additionally, the Director of the Transportation Improvement Board, Steve Gorcester, was in attendance. The Mayor complimented Derek Speck, Interim City Administrator, and Joyce Trantina, Executive Assistant, for their exemplary work on the event. The Mayor reported that the October 13, 2011 candidate forum, held at Billy Baroos Restaurant at Foster Golf Course and moderated by former Seattle Mayor Greg Nickels, was attended by approximately 100 people. b. City Council Councilmember Duffie attended the Klickitat road opening event on October 13, 2011. Councilmember Hernandez attended the Klickitat road opening event on October 13, 2011. She also attended the Southwest King County Chamber of Commerce meeting on October 14, 2011, where the program presentation was made by Erin McCallam, President of the Enterprise Foundation, and the Chamber recognized Betty Le from Foster High School as student of the month. Councilmember Hernandez referenced information regarding an Interlocal Agreement with King County Historic Preservation and requested it be considered by the Community Affairs and Parks Committee. Tukwila City Council Regular Meeting Minutes October 17, 2011 Page 4 of 4 Councilmember Seal provided information on the "Building Resilient Children" event sponsored by the Tukwila Police Department on November 5, 2011 from 8:30 am. -12:30 p.m. Domestic violence impacts all people, but children are particularly vulnerable. The Tukwila Children's Foundation has also been involved with this effort to support resiliency in children. Councilmember Hougardy attended the Klickitat road opening event on October 13, 2011. She reported that the Southcenter Mall was packed the weekend after the event. She also attended the Tukwila Pantry luncheon on October 14, 2011. c. Staff Derek Speck, Interim City Administrator, expressed appreciation to the staff from all departments who participated in making the Klickitat road opening event such a great success. He commended Joyce Trantina, Executive Assistant, with doing a great job on logistics. Mr. Speck reported that he and Mayor Haggerton met with representatives from the King County Aerospace Alliance on October 14, 2011. The alliance is composed of those cities striving to keep aerospace jobs in the area. d. City Attorney There was no report. e. Intergovernmental The Council Analyst is not required to attend Regular Meetings. MISCELLANEOUS Allan Ekberg, Council President, relayed that the Tukwila Metropolitan Park District (MPD) will be having a pool tour for community members this Saturday, October 22, 2011 at 9:00 a.m. After the tour at approximately 9:45 a.m., Board members will be in the bleachers to hear from citizens. Mayor Haggerton thanked Derek Speck for serving as Interim City Administrator during this period.
