Council Chambers Regular Meeting M I N U T E S FLAG SALUTE AND CALL TO ORDER ROLL CALL OF COUNCIL MEMBERS OFFICIALS IN ATTENDANCE REPORTS Mayor Attorney CONSENT AGENDA EXECUTIVE SESSION 7:10 p.m. 7:27 p.m. Mayor Pro Tempore Bohrer led the Pledge of Allegiance and called the regular meeting of the Tukwila City Council to order. Mayor Bohrer said he contacted the County Executive's Office to find out the status of the 56th Avenue Bridge Agreement. The County expects to send Tukwila a draft agreement some time this week. They expect to act on it soon so that the final agreement is executed by August 15. The County has applied to the State for an extention of the July 15 deadline on the grant. Attorney Hard reported that there have been no new lawsuits filed. The Summary Judgment on the Allenbach lawsuit will be heard next week. a. Approval of Minutes: July 6, 1982 b. MOVED BY HILL, SECONDED BY HARRIS, THAT THE CONSENT AGENDA BE APPROVED AS PRESENTED. MOTION CARRIED. An Executive Session has been called to allow Council time to select, from their membership, someone to fill the position of Mayor, vacated with the retirement of Frank Todd. The term will run through 1983. Council must fill the vacancy this evening. MOVED BY HILL, SECONDED BY DUFFIE, THAT COUNCIL GO INTO EXECUTIVE SESSION. MOTION CARRIED. Mayor Bohrer called the regular meeting back to order at 7:27 p.m. COUNCILMAN HILL NOMINATED COUNCILMAN GARY VAN DUSEN TO FILL THE VACATED POSITION OF MAYOR. NOMINATION SECONDED BY COUNCILMAN BAUCH. TUKWILA CITY COUNCIL, REGULAR MEETING July 19, 1982 Page 2 RECESS: 7:33 P.M.- 7:45 P.M. 7:50 P.M.- 8:00 P.M. NEW BUSINESS Mayor Bohrer asked if anyone in the audience wished to comment. No one offered. Mayor Bohrer said that at the Council's retreat in April, the opinion was expressed that Council should consider the change in form of government. The timing should be so that there is no minimum disruption to the terms of those now in office. He asked Councilman Van Dusen if he is elected Mayor would he still feel that this is a reasonable thing for Council to do. Councilman Van Dusen said he still favors an elected position for the office of Mayor. This subject has been discussed several times. He said he hopes that Council will provide input on the issues and have an election where the citizens will have the say so. MOVED BY HILL, SECONDED BY PHELPS, THAT THE NOMINATIONS BE CLOSED AND THAT THE SECRETARY CAST A UNANIMOUS BALLOT IN FAVOR OF MR. VAN DUSEN. MOTION CARRIED. MOVED BY PHELPS, SECONDED BY HILL, THAT COUNCIL RECESS FOR TEN MINUTES. MOTION CARRIED. Frank Payne, Judge, of the Tukwila Municipal Court, administered the oath of office of Mayor to Mr. Gary L. Van Dusen. Mayor Van Dusen introduced his wife, Karen, to the audience. Resolution #827 MOVED BY BOHRER, SECONDED BY HILL, THAT THE PROPOSED RESOLUTION Accepting a BE READ BY TITLE ONLY. MOTION CARRIED. petition to annex to the City Attorney Hard read a resolution of the City of Tukwila, City certain Wash., accepting a petition to annex to the City certain property property within the Tukwila planning area and fixing a time and place for (Foster Park) a public hearing on the subject petition (Joseph Foster Memorial Park). MOVED BY PHELPS, SECONDED BY DUFFIE, THAT RESOLUTION NO. 827 BE ADOPTED AS READ. MOTION CARRIED. Proposed Ordinance- MOVED BY BOHRER, SECONDED BY HILL, THAT THE PROPOSED ORDINANCE Imposing a sales BE READ BY TITLE ONLY. MOTION CARRIED. or use tax City Attorney Hard read an ordinance of the City of Tukwila, Wash., imposing a sales or use tax upon, and to be collected, from those persons from whom the state sales or use tax is col- lected, fixing the rate of tax, providing for the administration and collection thereof, consenting to the inspection of records and providing penalties for the violation thereof. MOVED BY BOHRER, SECONDED BY HILL, THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Alan Doerschel, Finance Director, explained the time line af- fecting this ordinance and the relationship of the City and County with each of them adopting a sales tax ordinance. He said there is no danger of the City losing the sales tax forever even if the County passes the ordinance first. Council has three options: (1) Pass an ordinance in October making the sales tax effective on January 1 with the provision that if the County does not pass it, the ordinance would not go into affect; (2) Wait until October, if it looks like the County is going to implement it, then the City can proceed; (3) Or, wait until the County passes their ordinance, then the City can pass one im- plementing the sales tax for the next quarter. Mr. Doerschel recommended that Council table the ordinance to allow time for rewording the proposal. TUKWILA CITY COUNCIL, REGULAR MEETING July 19, 1982 Page 3 NEW BUSINESS Cont. MOVED BY BAUCH, SECONDED BY DUFFIE, THAT THE MOTION BE AMENDED TO REFER THIS ORDINANCE TO THE COMMITTEE OF THE WHOLE. MOTION CARRIED. MOVED BY BOHRER, SECONDED BY PHELPS, THAT COUNCIL APPROVE THE CLAIM FOR DAMAGES AND REFUND THE PORTION OF THE BUSINESS LICENSE FEE.* Councilman Hill said that once the fee is paid, there should be no refunds made. Councilman Bauch said that this would be setting a precedent. Councilman Phelps noted that T.M.C. 5.04.040 states that "the license fee set forth shall be for the calendar year and each person engaged in business must pay the full license fee..." *MOTION FAILED (There will be no refund made) Council President Bohrer noted that the action taken tonight to fill the Mayor's position created a vacancy on the Council. Council must choose a person to fill this vacancy. He has written a letter to be published in the Hazelnut soliciting application for the office. On August 9, Council can hold an Executive Session to interview the applicants and select the person on August 16. MOVED BY BOHRER, SECONDED BY HARRIS, THAT COUNCIL GO INTO EXECUTIVE SESSION TO DISCUSS LABOR NEGOTIATIONS FOR 1982. MOTION CARRIED. Those attending the session besides Council were Frank Dennis, Labor Negotiator, Dennis Hidell, Council Analyst and Sharon Wylie, Administrative Assistant. 9:04 P.M. MOVED BY HILL, SECONDED BY DUFFIE, THAT THE EXECUTIVE SESSION BE CLOSED. MOTION CARRIED. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THE REGULAR MEETING OF THE TUKWILA CITY COUNCIL ADJOURN.
