Brad Collins, Planning Director, reviewed the changes made in Draft Five. Page I. Index Add 19.08.140, Planned Shopping Centers(Mall). (Following code numbers will be changed.) Page III. The title "Shopping Centers(Mall), Planned" has been changed from "Planned Business Centers." Page 1 No subsequent changes. Add'99.08.140, Planned Shopping Center (Mall)." (Following code numbers will be changed.) 19.08.040 Billboard. The words, "its structure and component parts have been added to line two. 19.08.050 Exposed Building Face. The words, "together with one -half the vertical distance between eaves and ridge of a pitched roof above it have been added to line three. Subsection b. MOVED BY HILL, SECONDED BY BOHRER, THAT THE WORDS, "PRIVATE IMPROVED VEHICLE" AND THE "WAY" ON "ROADWAY" BE DELETED. MOTION CARRIED. 19.08.090 Height. a) and b) have been added as well as the word "boundary." Page 4 Add Planned Shopping Center (Mall) "and renumber the rest of the sections. The definition reads: "Planned Shopping Center (Mall) shall mean a multiple tenant retail development as defined in T.M.C. Section 18.06.730 (Shopping Center Mall, Planned)." 19.08.150 Portable Sign. The words, "operating in their normal course of business was added to the end to help define signs affixed to motor vehicles. No substantial changes. 19.12.020 Application Procedure. In line 10, the word "its" has been changed to "his." No substantial changes. (G), "published under date of 1971" was changed to "current edition." No substantial changes. 19.12.110 Maintenance and Removal of Signs. Subsection (B). Everythingafter the first sentence was added by the City Attorney. The last sentence is revised to read, "The owner shall be charged an amount equal to the City cost for removal and storage, but in no event shall the fee be less than $50." MOVED BY HILL, SECONDED BY BAUCH, THAT 19.12.110 (B) BE AMENDED AS PREVIOUSLY STATED AND THAT "$50 "BE INCORPORATED IN 19.28.020. ALSO, ADD "OR MAINTENANCE" TO LINE 1, 19.12.110 (B). MOTION CARRIED. No substantial changes. There were a number of editorial changes made by the City Attorney. 19.20.030 Permits Revocable. Line 2, "obtained on an annual basis" was deleted by the City Attorney. Fourth line, delete "and add a period,and capitalize the "I" in "if." 19.20.040 Hold Harmless Agreement. Following "The owner" add "and /or the permittee following the word "shall" add "agree and at the end of the sentence add "prior to the issuance of any permit." MOVED BY HILL, SECONDED BY BAUCH, THAT COUNCIL CONCUR WITH THE REVISED WORDING IN CHAPTER 19.20. MOTION CARRIED. 19.22.010, change the word "title" to "code" in the first sentence. In 19.22.040, (C) the changes were made by Council. Councilman Hill questioned the use of "Planning Director" in this section. It is putting a load on one individual to make these decisions. MOVED BY HILL, SECONDED BY BAUCH, THAT THE WORD "DIRECTOR" BE CHANGED TO "COMMISSION" IN 19.22.010, 19.22.030, 19.22.040 (A) AND (D). MOTION CARRIED. 19.24.010, sixth line, the words "and real estate directional signs" were deleted from this section and added in a new sen- tence at the end of the paragraph. MOVED BY HILL, SECONDED BY BAUCH, THAT COUNCIL ACCEPT THE CHANGE ON PAGE 18. MOTION CARRIED. No subsequent changes. 19.28.010 (C) is changed per Council request. All of the wording after "Planning Commission" was added. There were changes in (F) per Council recommendation and an "and added to the last line after the word "streets." 19.28.010 (K) was added per Council recommendation. 19.28.030 (C), a second sentence was added to the "Exceptions." MOVED BY BAUCH, SECONDED BY HILL, THAT COUNCIL APPROVE THE WORDING OF 19.28.030 (C). MOTION CARRIED. Mr. Collins said it should be made clear that under the require- ments of this section all nonconforming signs shall be brought into conformance with the requirements of this code or shall be removed. Council President Bohrer suggested that the following sentence be added to subsection (C); "At which time any nonconforming permanent signs shall be brought into con- formance with the requirements of this code or shall be removed." MOVED BY BAUCH, SECONDED BY HILL, THAT COUNCIL APPROVE THE ADDITION OF THE PREVIOUS SENTENCE TO SUBSECTION (C). MOTION CARRIED. No subsequent changes. Section V, title should read, "SHOPPING CENTERS (MALL), PLANNED." 19.32.020 Shared Directional Signs. Language was corrected per recommendation of the City Council. 19.32.040 Billboards -Area Restrictions. Revised per recommendations of the City Council. Councilman Bauch noted that this item should be considered again by a full Council. 19.32.070, "above average grade" was deleted from the third line. There were other editorial changes. Editorial changes only. 19.32.140 (B) Exception: (1), word "first" replaced by "ground" and added "ground floor exposed building face." (2) New section added per Council recommendation. Section V, title was changed to "SHOPPING CENTERS (MALL), PLANNED." 19.32.150, second sentence, "in a planned shopping center (mall)" was added per Council request. Mr. Collins recommended that the sentence "Any permitted free- standing sign shall be limited in height to thirty -five feet, provided that no freestanding sign shall be higher than the planned shopping center mall building which it identifies" be deleted from the second paragraph. He suggested that the fol- lowing be inserted in line twelve: "Any freestanding sign shall be allowed per Section 19.32.140 (C)." MOVED BY HILL, SECONDED BY BAUCH, THAT COUNCIL CONCUR WITH THE WORDING RECOMMENDED BY THE PLANNING DIRECTOR. MOTION CARRIED. Section VIII Freeway Interchange Businesses, Councilman Bauch asked to reserve the right to question VIII when a full Council is in attendance. It has never been discussed by Council. 19.36.020, the words "or his designated representative" were added after "Planning Director." The intention is for the Building Official to continue to enforce the provisions of this code at the directions of the Planning Director. Exhibit A is referenced on page 3, 19.08.070. Exhibit B (not shown) is referenced in 19.32.040, page 23. The Sign Code will be brought forward at the discretion of the Council President.
