Decision on Substantive Permit: The City's Hearing Examiner has determined that the application for a
conditional use permit complies with applicable City and state code requirements and has approved the
application subject to the following condition:
1. The applicant shall resolve the issue of the lot line between Tract 9 and 10 with the King County
Assessor's office prior to the issuance of the building permit. If the lot line between Tract 9 and 10

III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 3 decision pursuant to Tukwila Municipal Code
18.104.010. Other land use applications related to this project may still be pending. No administrative
appeals are permitted. The decision of the Hearing Examiner is final and can only be appealed to Superior
Court pursuant to RCW 36.70C.

Introduction
The applicant seeks a conditional use permit to increase the footprint of an existing
church structure at 13045 Macadam Road South. A. public hearing was held on the
application on November 14, 2012 at the Department of Community Development, 6300
Southcenter Boulevard, Tukwila, WA. Represented at the hearing were: the Department,
by Brandon Miles, Senior Planner, and the applicant, Israelite Church, by Larry Griffin.
No members of the general public testified at the hearing.
After due consideration of the evidence presented at the public hearing, the following
shall constitute the findings of fact, conclusions and decision of the Hearing Examiner on
this -application.

Findings of Fact
1. The application is for a conditional use permit to allow an increase in the footprint
of an existing church structure which houses Israelite Church (Church) and is located at
13045 Macadam Road South. The site is accessed from S. 131't Street.
2. The property has been used as a church since the mid-1970's and was annexed to
the City of Tukwila in 1989. Prior to annexation, King County issued permits to the prior
church use at this site.
3. The proposal is to add a bathroom to the structure which will meet the standards
of the Americans with Disabilities Act (ADA). The 360-square foot addition would be
located near the front of the existing structure.
4. The existing church is located within the Low Density Residential (LDR) zoning
district. Within the LDR zone, churches and other religious institutions may be permitted
as conditional uses.
5. The existing church has a congregation of about 30 members. The existing
parking lot is unpaved but has space to accommodate approximately 50 vehicles. No
other improvements aside from the ADA bathroom, are proposed.
6. The King County Assessor's Office records show the subject property to be two
parcels, "Tract 9" and "Tract 10," as described on page 3 of the staff report. However, a
boundary line adjustment was recorded in 2002 which eliminated the lot line between
Tracts 9 and 10. If the tracts were still separate parcels, the proposed addition would
extend over the lot line between them.
7. The Department has reviewed the application and recommends approval. The
Department has determined that no changes to capacity or parking demand will occur on
account of the bathroom addition, so the existing parking lot is not required to be brought
up to current development standards. No public comments were submitted to the
Department or to the Hearing Examiner concerning the application.
8. The criteria for the granting of a conditional use permit are set forth in TMC
18.64.050:
1. The proposed use will not be materially detrimental to the public
welfare or injurious to the property or improvements in the vicinity of the
proposed use or in the district in which the subject property is situated;
2. The proposed use shall meet or exceed the performance standards that
are required in the district it will occupy;

3. The proposed development shall be compatible generally with the
surrounding land uses in terms of tragic and pedestrian circulation,
building and site design,
4. The proposed use shall be in keeping with the goals and policies -of the
Comprehensive Land Use Policy Plan,
5. All measures have been taken to minimize the possible adverse impacts
which the proposed use may have on the area in which it is located.
Conclusions
I. The Hearing Examiner has jurisdiction over this application pursuant to TMC
18.104.010. TMC 18.64.050 contains the criteria for the grant of a conditional use
permit, each of which are considered below.
2. The proposed addition to the existing church would not be materially detrimental
to the public welfare or injurious to properties or improvements in the vicinity or district.
The 360-square foot bathroom would not expand the church's capacity or create
additional impacts. This criterion is therefore met.
3. The proposed addition would meet the applicable standards, including air and
water quality standards and noise standards. The addition would also be required to
comply with applicable LDR development standards before issuance of a building permit.
4. The proposed use would be compatible with the surrounding land uses with
regard to t uffic and pedestrian circulation, building and site design. The addition would
not increase traffic or change the pedestrian circulation in the area, and the building and
site design are being altered only to add the 360-square foot ADA bathroom area. The
County records concerning the existence of two separate. parcels are required to be
corrected prior to the issuance of the building permit, to ensure that the records reflect the
addition's location with regard to the lot line. With this condition, the proposed use
meets this criterion.
S. The proposed use would be consistent with the applicable goals and policies of
the City's Comprehensive Plan. Goals 7.1 and 7.5 call for a sense of community and
creation of the neighborhood gathering spots, and the proposed church use is consistent
with these goals. Policy 7.1.3 provides for human services within residential zones, and a
church use may further provision of human services within the LDR district.
6. No adverse impacts have been identified and no increase in the capacity of the
church will result from the addition.

7. The proposal as conditioned meets the criteria and the conditional use permit
should be approved.
Decision
The conditional use permit is hereby approved, subject to the following condition:
The applicant shall resolve the issue of lot line between Tract 9 and 10 with
the King County Assessor's office prior to the issuance of the building
permit. If the lot line between Tract 9 and 10 still exists, then the applicant
shall submit a lot consolidation application that shall be recorded prior to the
issuance of the building permit.

BACKGROUND
On April 31, 2012, the City received a Conditional Use Permit (CUP) application from All City
Construction, on behalf of Israelite Church, to increase the footprint of the existing church structure at
13045 Macadam Road South (Attachment A). In 1989, the subject property was annexed into the City of
Tukwila as part of the Riverton annexation. According to King County records, a church has been in
operation on the site since the mid- 1970s (Attachment B)
The Church never obtained a CUP from the City of Tukwila, nor was such a permit available from King
County records. The City recognized the Church as being a non -conforming use. Tukwila Municipal
Code (TMC) 18.06.590 defines a non -conforming use, "[as] the use of land which does not conform to
the use regulations of the district in which the use exists." TMC 18.70.040 further adds that a non-
conforming use must have been lawfully established. In this case, the use appears to have been lawfully
established given the fact that King County issued permits to the use, prior to annexation of the property
by the City.
The applicant is proposing to add a small addition to the existing church. This work requires that a CUP
be obtained for the addition (TMC 18.70.100). Per TMC 18.70.100 Conditional and Unclassified Uses:
"A legal use does not become nonconforming because the zone in which it is located is changed to a zone
which requires a conditional or unclassified use permit for the use, or because the use is changed from an
allowed use to a conditional or unclassified use within the same zone; provided, however, the use may not
be expanded nor may buildings be enlarged, altered or modified without first obtaining a conditional or
unclassified use permit if required pursuant to requirements of TMC Chapters 18.64 or 18.66."
The proposed addition triggers the requirement to obtain a CUP as churches and other religious
institutions are permitted within the Low Density Residential (LDR) zone subject to the approval of a
CUP.
FINDINGS
Vicinity/Site Information
Project Description
The applicant is requesting that the Hearing Examiner approve a conditional use permit to permit a small
building addition to an existing church structure. The addition will be a bathroom that meets the
standards required by Americans with Disability Act (ADA), and will not increase the capacity of the
church operation.

Existing Development
The subject property is located at 13045 Macadam Road South and according to the official zoning map is
zoned Low Density Residential ("LDR"). Boundary Line Adjustment was recorded between Parcel A
(subject site) and Parcel B (property to the north of the subject site). As part of this boundary line
adjustment the lot line between Tract 9 and 10 (both part of Parcel A -subject site) was removed. See
Attachment C. However according to King County Assessor' records, the subject property is shown as
two parcels:
• Parcel 734160-0125 (Tract 9) is located at the corner of Macadam Road South and S. 131Sc
Street. The main church structure is located on this parcel.
• Parcel 734160-0130 (Tract 10) is located just north of the main building. The applicant
has indicated that this parcel is currently used for parking. The proposed building addition
will extend onto this parcel.

If Tract 9 and 10 are two separate lots then the existing church building does not meet setbacks. The
church has access via S. 131 st Street. The parking area is currently graveled.

Surrounding Land Uses
The existing church sits on the west side of Macadam Road South. Surrounding land uses are single
family homes. Light industrial uses are located east of Macadam Road South. The topography in this area
essentially acts as a barrier between the single family homes and these light industrial uses.

Topography
The topography of the site is generally flat.
Vegetation
Vegetation on the site consists mainly of ornamental grass. Some trees are located on the west side of the
existing structure. These trees will remain.

Access
Access to the property is from S. 13 Vt Street on the west side of the existing structure.
CONDITIONAL USE PERMIT DECISION CRITERIA
The applicant is requesting that the Hearing Examiner permit a small addition to an existing church
structure. In the following discussion, the CUP review criteria found in TMC 18.64 are shown in bold,
followed by City staff s comments. For the applicant's response to the CUP criteria see Attachment D.
1. The proposed use will not be materially detrimental to the public welfare or injurious to the
property or improvements in the vicinity.
Based on King County records, it appears that the existing church has been in operation since the mid-
1970s (Attachment B). The City has received no complaints regarding the existing church. The proposed
addition will add an ADA bathroom to the existing church and thus the capacity of the church will not be
expanded (Attachment A). As stated in Attachment D, the church has about 30 members of varying ages.
The church has stated that it has the ability to accommodate 50 parking stalls on its site. These parking
stalls are not on asphalt or concrete nor are the stalls marked; hence, the parking is non -conforming.

TMC 18.70.080 governs the standards for non -conforming parking lots and states, "Nothing contained in
this Off -Street Parking and Loading Regulations of this Title shall be construed to require a change in
any aspect of a structure or facility covered thereunder, including, without limitation, parking lot layout,
loading space requirements and curb cuts, for any structure or facility which existed onn the date of
adoption of this Title. " The section goes on to state the specific requirements when a proposed project
triggers an increase in the parking demand on the site (TMC 18.70.080 (B-C)). Staff has concluded that
adding ADA bathrooms, as proposed by the applicant, will not trigger an increase in parking demand.
Additionally, as previously stated, the church has been in operation prior to adoption of the City's current
Zoning Title, which was 1995 and TMC 18.70.080 is clear that upgrades to the parking lot are not
required.

2. The proposed use shall meet or exceed the performance standards that are required in the
district it will occupy.
All uses that a uses, activities, and operations within the City shall comply with 1) standards adopted by
the Puget Sound Air Pollution Control Agency for odor, dust, smoke and other airborne pollutants, 2)

TMC Chapter 18.22 "Noise" and 3) adopted State and Federal standards for water quality and hazardous
materials.
The applicant is proposing a small building addition, which should not impact air quality or release
pollutants into the environment. The project will be required to comply with the City's noise regulations
during construction and during its regular operations.
At the time of construction the applicant will be required to meet all development standards within the
LDR zone.
3. The proposed development shall be compatible generally with the surrounding land uses in
terms of traffic and pedestrian circulation, building and site design.
The applicant has been operating a church on the site for over 30 years. There have been no complaints
regarding traffic or noise from the existing operation. The proposed addition is to add an ADA bathroom
to an existing church structure. The addition will not increase traffic. Pedestrian circulation to the church
is poor, but given that the proposed addition is to only add an ADA bathroom no upgrades to pedestrian
connections from the adjacent public streets are required.
It is unclear why King County Assessor's office still recognizes the site as two separate parcels, even
though the boundary line adjustment recorded in 2002 eliminated the lot line between Tract 9 and 10 (See
Figure 1). If Tract 9 and 10 have not been consolidated then the proposed building addition will be
constructed over an existing lot line. The applicant will need to resolve this issue with the King County
Assessor's office prior to the issuance of the building permit. If the lot line between Tract 9 and 10 still
exists, then the applicant will need to submit a lot consolidation application that will need to be recorded
prior to the issuance of the building permit.
4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land
Use Policy Plan
The LDR zone permits churches within the LDR zone, subject to the approval of a CUP by the Hearing
Examiner (TMC 18.10). The Comprehensive Plan has several goals and policies that are relevant to the
proposed project:
• Goal 7.1 the City's Neighborhood Quality should, "...[F]oster a sense of community...". A church
within a residential zone helps to establish a sense of community within a specific geographical
boundary.
• Policy 7.1.3 encourages the City to consider human services within residential zones. Churches
typically provide a wide range of human services functions within a community. The applicant
discusses this briefly in Attachment C.
• Policy 7.3.1 states, "[that] the City shall maintain a comprehensive land use map that supports the
preservation and enhancement of single-family and stable multi -family neighborhood; eliminates
incompatible land use; and clearly establishes applicable development requirements through
recognizable boundaries." The church will meet all applicable development standards within the
LDR zone.
• Goal 7.5 encourages the creation of "Neighborhood Gathering Spots." The proposed church will

create a neighborhood gathering and social spot.
5. All measures have been taken to minimize the possible adverse impacts, which the proposed
use may have on the area in which it is located.
There are no identified adverse impacts associated with the proposed use. Again, the applicant is
proposing to add to an existing church structure. The addition will not increase the capacity of the church
on the site. The project will be required to meet all applicable development standards.
PUBLIC COMMENTS
The public comment period ends on November 13, 2012 and no comments have been received by
November 9, 2012.
CONCLUSIONS
1. Religious institutions are permitted within the LDR zone provided a conditional use permit is
approved by the Hearing Examiner (TMC 18.10.040 (3)).
2. According to King County records the church has been in operation since the mid- 1970s.
3. The church is consistent with the City's adopted Comprehensive Plan Goals and Polices. The
church design will be consistent with the single family homes in the area.
4. The applicant is proposing a small addition to the existing church structure in order to provide
ADA bathrooms. The addition will not increase the capacity of the church.
5. The existing lot line between Tract 9 and 10 appears to have been eliminated as part of the
Boundary Line Adjustment recording number 20020621900001. However this change is not
reflected in King County Assessor's maps. The issue will need to be resolved before issuance of a
building permit for the addition.
6. The parking area currently does not meet code with regards to surface and layout. Given that the
parking lot is non -conforming and that the project will not increase the parking demand;
modifications to the parking lot to bring up to current standards are not required.
7. The proposed use will not generate any noise, glare, or odors that may impact adjacent properties.
A church has been in use on the site for well over 30 years with no identifiable impacts to the
adjacent uses.
RECOMMENDATION
Staff recommends approval of the Conditional Use Permit with the following condition:
The applicant shall resolve the issue of lot line between Tract 9 and 10 with the King County Assessor's
office prior to the issuance of the building permit. If the lot line between Tract 9 and 10 still exists, then
the applicant shall submit a lot consolidation application that shall be recorded prior to the issuance of the
building permit.

Dear Mr. Miles:
I am writing to respond to CUP Application in reference to extending the existing building an
additional 360 sq. ft. (W-12'-O" x L-30'0"), for the purpose of New ADA Restroom Installation and
upgrade.
In the words Pastor Alvin Horton founder of Israelite Community Church of God In Christ, " The
Doors to Church was opened in December of 1975, The order of service is as Follows:
Tuesday: 7:00 PM Prayer and Bible Study
Friday: 8:00 PM Evangelistic Service
Sunday: 9:30 AM Sunday School
Sunday: 11:OOAM Morning Service
I have a Small congregation totaling 30 member's including children. The Church highest peak is
during Sunday Morning Service, where the range of people attending are between the ages 20
years old and 25years old.
The Church has on -site Parking to accomodate 50 vehicles, which is more than adequate in
providing parking for the member's.
One of the auxiliary of the Church is the Outreach Ministering Team. They operate the food bank
where food is given out on a once a week basis to those in need. Outreach also provide back to
school supplies to children. Another function of the Outreach program is Giving out toy's and food to
the needy families during Thankgiving and Christmas Holidays."
"As A Pastor it has always been my goal to be an asset in the community in which, I serve through
the Church Ministry. I have communicated with some of the residents in the area, They welcome me
and is happy that I am in the Community, The have no concerns about church having Service's, I am
positive that extending the Church will have no negative impact on the adjacent properties."

The conditional use pen -nit hearing for the Israelite Church Conditional Use pen -nit has been scheduled for November 14,
2012 at 9:30 A.M. The Hearing will take place at the offices of the Department of Community Development which are
located at 6300 Southcenter Blvd, Suite 100. I would encourage you and members of the church leadership to attend the
hearing to answer any questions that may arise.
I also wanted to bring to your attention another issue that will need to be addressed prior to issuance of the building
permit application. According to King County records, it appears that the church is located on two parcels (see attached
photo). The proposed addition is not permitted to extend over the property line located between these two parcels. In
order to address this situation you will need to submit an application to combine the lots into one lot. I have included the

Response to CUP Criteria
Dear Mr. Griffin:
The City had previously informed you that the public hearing for the Israelite Church Conditional Use
Permit (CUP) was scheduled for September 11, 2012. In that phone conversation the City followed up
on the City's request to have the response to the CUP criteria, which was provided with the application,
expanded to provide more background on the church and its operations. The phone request was the
third request to have this information provided to the City. The first request was in the Notice of
Complete Application that was mailed to you on July 5, 2012 and the second request was made when
we met on July 31, 2102.
As of today, the City has yet to receive the expanded response to the CUP criteria. Thus, it is premature
to hold the public hearing on September 11th until the expanded response is provided. Here are some
things to consider in your expanded response to the CUP criteria:
1. Provide a better discussion of the use. What takes place on the property? When does the
attendance at the church peak. Background on the history of the church would be good to
provide.
2. Outlined the number of users at the church during peak times and discuss the parking situation.
Are there enough parking spots? If needed, how is parking managed?
3. Are measures utilized to reduce impacts to adjacent properties? If so, what measures are taken?
4. Anything else worth mentioning, which would help the Hearing Examiner understanding the
proposed use?
Please understand that it is your responsibility to "sell" your project. The information provided is
insufficient for the Hearing Examiner to have an understanding of your proposed project. The
application will not be scheduled for hearing until the expanded response to the CUP criteria is provided.

of meeting state mandated time requirements.
This determination of complete application does not preclude the ability of the City to require that you submit
additional plans or information, if in our estimation such information is necessary to ensure the project meets

I am hoping to schedule a hearing for the application in the second week of August. In order to make this

referenced herein for the sole purpose of submission to the. City of
Tukwila ("City"). This Certificate is issued at the request of the City and

Certificate of Sewer Availability/Non-Availability ("Certificate").

the District's service area, for the sole purpose of submission to the King County Department of Development
and Environmental Services, King County Department of Public Health, City of Seattle, City of Tukwila, City
of Burien and/or City of SeaTac. This Certificate is between the District and the applicant only, and no third
person or party shall have any rights hereunder whether by agency, third -party beneficiary principles or
otherwise.
2. This Certificate creates no contractual relationship between the District and the applicant and
its successors and assigns, and does not constitute and may not be relied upon as the District's guarantee that
sewer service will be available at the time the applicant may apply to the District for such service.
3. As of the date of the District's signature on this Certificate, the District represents that sewer
service is available to the Property through sewer systems that exist or that may be extended by the applicant.
The District makes no other representations, express or implied, including without limitation that the applicant
will be able to obtain the necessary permits, approvals and authorizations from King County, City of Seattle,
City of Tukwila, City of Burien, City of SeaTac or any other governmental agency before the applicant can
utilize the sewer service which is the subject of this Certificate.
4. If the District or the applicant must extend the District's sewer system to provide sewer
service to the Property, the District or applicant may be required to obtain from the appropriate governmental
agency the necessary permits, approvals and authorizations. In addition, the governmental agency may
establish requirements that must be satisfied as a condition of granting any such permits, approvals or
authorizations, which may make impractical or impossible the provision of sewer services to the Property.
