Also not sure of what the out buildings consist of whether they are sheds garages or residences. If they are gone and no foundations exist then there is not much to inspect. Otherwise typically permits are required for structures sitting on foundations for removal require demo permits. Under this owner's name and residence I could not find any demo permits applied for. Let me know if you have any further questions. Should there be questions concerning the above requirements, contact the Building Division at 206-431- 3670. No further comments at this time. 0 Page 1 12202 45th avenue south City of Tukwila Jim Haggerton, Mayor Department of Community Development Jack Pace, Director August 21, 2012 Sam Rondos 1816 42Id Ave SW Seattle, WA 98146 RE: Boundary Line Adjustment (1-12-020) Removal of Accessory Sheds Dear Mr. Rondos: Thank you for meeting with me on Monday to discuss your boundary line adjustment ("BLA") application. I understand that you have been granted preliminary approval with a condition to remove all accessory sheds. In our meeting you requested that -you be permitted to retain the sheds until you commence construction of the new homes. Unfortunately, the City cannot waive the condition that was placed on your preliminary approval letter requiring that the sheds be removed. Currently, the City views your property as one large lot with a house and detached, accessory sheds. Once your boundary line adjustment is recorded with King County, the City will consider your property to contain three, separate legal lots of record. The accessory sheds will be located on a lot that does not have a principal use, which is not permitted under city code, thus the requirement that the detached structures be removed. Please note, that the City is not requiring that the detached structures be removed at this time. The buildings must simply be removed prior to the City granting final approval of the preliminary approval letter, which must occur before the BLA is recorded with King County. You have until August 15, 2013 to have the BLA recorded with King County and this date could be extended to August 15, 2014. Also, there are other options for you to consider if you do not want to remove the sheds: 1. Revise your application to locate the home and detached structures on one lot. Note that the structures would have to meet setbacks from all new property lines. 2. Relocate the sheds onto parcel 'W'. The sheds would have to meet setbacks. 3. Choose not to go through with your BLA, which will allow the sheds to remain. I am returning to you the copies of your plans that you provided to me when we met. The BLA is not ready for final approval by the City. The preliminary approval is good for one year from the date of issuance, which was August 15, 2012. The expiration date provided in the preliminary approval letter was incorrect. Please note that the preliminary approval will expire on August 15, 2013. As outlined in the August 15, 2012 letter, the City may grant you one extension of not more than 12-months. Thus, if you request an extension prior to August 15, 2013, you might be able to get the preliminary approval extended to August 15, 2014. Jack Pace, Director August 15, 2012 Sam Rondos 1816 42"d Ave SW Seattle, WA 98146 RE: Boundary Line Adjustment (1-12-020) Preliminary Approval Dear Mr. Rondos: The Short Subdivision Committee has completed their review of the above -referenced Boundary Line Adjustment application. Preliminary approval of the BLA is granted, subject to the following conditions. These conditions are to ensure compliance with the City's Zoning, Fire, and Public Works requirements. All conditions must be satisfied prior to final approval and subsequent recording of the BLA documents. The following document(s) was reviewed by the City in granting preliminary approval: 1. Survey prepared Schroeter Land Surveying, received by the City on July 3, 2012. General Conditions v 1. Prior to final approval, the applicant shall remove all detached structures from proposed parcel "B". A demolition permit from the City's building division maybe required. Modifications to the Recording Document The following modifications need to be made to the recording document: ✓ 1. Add the File Number, L124-020 to the face of the BLA. f 2. The dashed setbacks are incorrect. The second front setback for Parcel "A" should be 10 feet, with south and east property lines having a setback of five feet. The rear setback (west property line) for parcels "B" and "C" should be ten feet. 3. Please add the following notes to the BLA document: f • "Any new structures located on the property subject to this BLA must be within 250 AJfeet of a fire hydrant (by path of travel) as approved by the Fire Marshal's Office". • "All new homes shall have automatic fire sprinklers, as approved by the Fire Department." • "Parcels "B" and "C" are subject to Fire, Transportation and Parks Impact Fees at the time of issuance of a building permit for each single family home." %/4. Please place the address number for the new parcels on the face of the plat. When you resubmit, please provide four copies of the BLA document, one document must contain the original signatures of all individuals and entities which have an interest in the property. Additionally, the surveyor's original stamp and signature must be on this copy. Do not fold the copy of the surveyor that has the original signatures. Appeals This BLA application or any condition placed in decision is appealable to the Hearing Examiner. One administrative appeal of the decision on the short plat is permitted. If no valid appeals are filed within the time limit the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (9/5/12). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. The Notice of Appeal shall state specific errors of fact or errors in application of the law in the decision being appealed; the harm suffered or anticipated by the appellant, and the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 4. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. Recordina It is your responsibility to record the City approved BLA document with the King County Department of Records. The BLA is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. Please return one copy of the recorded map back to the City. The City cannot issue building permits until we have the parcel numbers for the new lots. Do not fold or bend the final short plat map that will be recorded with King County. Page 2 of 3 Expiration The final BI.A must be filed with the King County Department of Records by August 15, 2012, exactly 12 months from the date of this preliminary approval or the application will expire. Please keep this date in mind in the coming months. The City is in no way obligated to remind you of this expiration date. The City may grant one extension of not more than twelve months. The request for an extension must be made in writing and must be submitted to the City prior to the expiration of the BIA. If the BlA approval expires, subsequent development permits that are related to the short plat shall also expire and any vesting will be lost.
