DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive .Permit: The City Community Development Director has determined that the application for a Type Il Wireless Telecommunications Facility complies with applicable City and state code requirements and has approved the application with the condition that a fire warning sign be installed on the fibreglas reinforced panel. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §1.8.104.0.10. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by January 29, 2013. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application :must file an appeal pursuant to the procedures and time .limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. The project includes: • Remove/replace three (3) existing panel antennas. • Upgrade with three (3) additional panel antennas • Install one (1) 2' microwave antenna • Remove/replace three existing enclosing shrouds with three upgraded screen shrouds • Add (3) hybrid cable and (6) COVP units (3 near antennas and 3 mounted on the side of equipment cabinet) on existing concrete slab within a fenced compound. Existing installation is approximately 10 feet high on the existing roof. Proposed installation will be approximately 8 feet high on the existing roof. Existing Development This site is an existing warehouse. Surrounding Land Uses The property and the surrounding parcels are zoned Tukwila Urban Center (TUC). Adjacent land uses include warehouse, office, wholesale activities. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being modified was originally approved by the City in 2000 (L2000-068) through a conditional use permit. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. Lighting- Towers shall not be artificially lighted unless required by the FAA, FCC or other applicable authority. If lighting is required, the reviewing authority shall reaiew the lighting alternatives and approve the design that would cause the least disturbance to the surrounding areas. Section 2 of OET Bulletin 65 demonstrates that "for a truly worst -case prediction of power density at or near the surface, such as at ground -level or on a rooftop, 100% reflection of incoming radiation can be assumed, resulting in a potential doubling of predicted field strength and a four -fold increase in (far field equivalent) power density". Therefore the following equation is used: S = EIRP/TrR2 Where S = power density (mW/cm2), EIRP = equivalent isotropically radiated power and R = distance to the center of the radiation antenna (cm) Attached as an exhibit are the MPE (Maximum Power Exposure) calculations using the above referenced formula and the antenna manufacturer vertical pattern information using an assumed worst case power level of 3,000 watts. The calculations show that the maximum MPE at ground level (6' above AGL) occurs with the antenna and the power density is 0.035285 mW/cm2 with an assumed power level of 3,000 watts. This is 3.5285% of the MPE limit for the general population/uncontrolled exposure of 1.0 mW/cm2 as referenced in Table 1 OET Bulletin 65 Appendix A. ENVIRONMENTAL EVALUATION Routine environmental evaluation is required if a PCS broadband facility with building mounted antennas has a total power of all channels in any given sector greater than 2,000W ERP as referenced in "Table 2 Transmitters, Facilities and Operations subject to Routine environmental Evaluation" of Bulletin 66. For the proposed facility, the total power in any given sector is less than 2,000W ERP therefore the WCF is categorically exempt from requirement for routine environmental processing. FCC COMPLIANCE The general population/uncontrolled exposure near the building, including persons at ground level, surrounding properties, inside and on existing structures will have RF exposure much lower than the "worst case" scenario, which is a small fraction of the MPE limit. Only trained persons will be allowed to access the rooftop for maintenance operations. T-Mobile and/or its contractors will provide training to make the employees fully aware of the potential for RF exposure occupational training and they can exercise control over their exposure that is within the occupational/controlled limits. CONCLUSIONS Based on calculations, the proposed WCF will comply with current FCC and county guidelines for human exposure to radiofrequency electromagnetic fields. Nguyen CEI No.: 12-06060 Page I Project Description The existing T-Mobile telecommunication site is located at 1224 Andover Park East in the city of Tukwila, King County, WA. The site currently consist of (3) panel antenna which are located inside (3) RF transparent cylindrical shroud and mounted to the quad -pod supported by roof top timber sleepers. In addition, there are site supporting equipment cabinets located on a concrete slab adjacent to the building. The structural design and analysis for the T-Mobile antenna modification includes replacing (1) panel antenna as well as adding (1) panel antenna in addition to accompanying equipment at each of the (3) sectors. In addition, the panel antenna modification will require larger square RF transparent shrouds which will utilize the existing sleepers on the roof. The proposed loads of the shrouds along with the panel antennas and accompanying equipment transfer through the timber sleepers and directly into the glu-lam roof girders. All loads then continue to the columns or load bearing system of the building then to the foundation and into the soil. I. Design Procedure The information in this report summarizes the requirements for construction of structural elements for the proposed design in conformance with the 2009 International Building Code (IBC). Unless noted otherwise, all means and methods used shall be in keeping with good and generally accepted construction practices and all prescriptive design requirements of the 2009 IBC. As requested, we have evaluated the structural stability of the proposed additional loading for structural code compliance. This analysis derives its applied loads from minimum 85 mph basic wind speed (3- second gust), Exposure "B". Since soil properties are not available, seismic site class "D" was conservatively used for this analysis per 2009 IBC (Section 16). H. Conclusions and Recommendations The proposed RF transparent shrouds, supporting roof structure and their connections are structurally adequate to support the proposed loading of the antenna replacement and accompanying equipment. Please refer to the following calculations and the architectural drawing package for reference of the panel antenna modification. General contractor shall verify all existing dimensions, member sizes and conditions prior to commencing any work. All dimensions of existing condition shown on the calculation are intended as guidelines only and must be verified in field. Any discrepancies shall be called to the attention of the architect or engineer and shall be resolved before proceeding with the work. Contractor shall provide temporary bracing for the structure and structural components until all final connections have been completed in accordance with the plans. M.
