DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Type ii Wireless Telecommunications Facility does comply with applicable City and state code requirements and has approved that application without conditions. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type Il decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by February 13, 2013. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. The Hearing Examiner decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. Existing Development This site is part of the Intergate office complex. This four story building, with at grade integrated parking, was built in 1999 and already has non -concealed, building -mounted wireless facilities mounted on the building. Unincorporated King County has jurisdiction to the west. The nearest property is an apartment building located over 400 feet away and separated by a forested hillside. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being expanded was originally approved by the City in 2002 (L02-009) as a Conditional Use Permit (CUP). Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. Noise - Any facility that requires a generator or other device which will create noise must demonstrate compliance with TMC Chapter 8.22, "Noise". The City may require that the report be reviewed by a third ham, expert at the expense of the applicant. T-Mobile's equipment will meet all applicable noise standards. Project Description The scope of work for this project is to provide structural analysis for the proposed T-Mobile telecommunications equipment installation on the rooftop of an existing telecommunications facility, Building "B", located at 12201 Pacific Highway South in Tukwila, King County, Washington. The site is located on the west side of Tukwila International Boulevard south of the intersection of State Routes 599 and 99. Building "B" is one of three buildings (Buildings "A", "B", and `IC") that comprise the Intergate West Office Complex and is 4 stories in height, exclusive of the at -grade structured parking. This is a three sector site with one antenna per sector. The proposed project is for the addition and installation of (2) new antennas mounted on the existing screen wall on the rooftop at each sector for a total of (9) antennas. The project also proposes the addition of (3) hybrid cables, (6) COVP units, and (9) RRU units. The existing antennas on pipe mounts outside the screen walls are to remain. The structural design and analysis of the proposed T-Mobile installation is for the addition of the new antennas, and the addition of new RRU units that will be placed on the new masts attached to the existing screen wall. The additional gravity and lateral loads of the proposed equipment will transfer to the steel frame of the screen wall. From the steel frame, the loads will transfer to the roof framing, into the walls, then to the foundation and soil below. II. Design Procedure The information in this report summarizes the requirements for construction of structural elements for the proposed design in conformance with the 2009 International Building Code (IBC) and American Society of Civil Engineers (ASCE 7-05). Unless otherwise noted, all means and methods used shall be in keeping with good and generally accepted construction practices and all prescriptive design requirements of the 2009 IBC. As requested, the structural stability of the proposed loading has been evaluated for structural code compliance. The analysis derives its applied wind loads from 85 mph wind speed (3-second gust) and Exposure "C". Since soil properties are not available, seismic site class "D" was conservatively utilized for the seismic analysis per 2009 IBC (Section 16). III. Conclusions and Recommendations The proposed antenna installation and the addition of RRU units to the steel mast attached to the existing screen wall in addition to the building structure are structurally adequate to support the additional loads of the equipment to be installed. Please refer to the following structural calculations and the supporting architectural drawings. The General Contractor shall verify all existing dimensions, member sizes and conditions prior to commencing any work. All dimensions of existing condition shown on the calculation are intended as guidelines only and must be verified in the field. Section 2 of OET Bulletin 65 demonstrates that "for a truly worst -case prediction of power density at or near the surface, such as at ground -level or on a rooftop, 100% reflection of incoming radiation can be assumed, resulting in a potential doubling of predicted field strength and a four -fold increase in (far field equivalent) power density". Therefore the following equation is used: S = EIRP/nR2 Where S = power density (mW/cm2), EIRP = equivalent isotropically radiated power and R = distance to the center of the radiation antenna (cm) Attached as an exhibit are the MPE (Maximum Power Exposure) calculations using the above referenced formula and the antenna manufacturer vertical pattern information using an assumed worst case power level of 2,000 watts. The calculations show that the maximum MPE at ground level (6' above AGL) occurs with the antenna and the power density is 0.03919 mW/cm2 with an assumed power level of 2,000 watts. This is 0.3919% of the MPE limit for the general population/uncontrolled exposure of 1.0 mW/cm2 as referenced in Table I OET Bulletin 65 Appendix A. ENVIRONMENTAL EVALUATION Routine environmental evaluation is required if a PCS broadband facility with building mounted antennas has a total power of all channels in any given sector greater than 2,000W ERP as referenced in "Table 2 Transmitters, Facilities and Operations subject to Routine environmental Evaluation" of Bulletin 65. For the proposed facility, the total power in any given sector is less than 2,000W ERP therefore the WCF is categorically exempt from requirement for routine environmental processing. FCC COMPLIANCE The general population/uncontrolled exposure near the building, including persons at ground level, surrounding properties, inside and on existing structures will have RF exposure much lower than the "worst case" scenario, which is a small fraction of the MPE limit. Only trained persons will be allowed to access the rooftop for maintenance operations.
