DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Type H Wireless Telecommunications Facility does comply with applicable City and state code requirements and has approved that application without conditions. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type II decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by June 6, 2013. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $563 plus retainer. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70CIf no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. The new cell facilities are concealed, building mounted and replace existing facilities. Surrounding Land Uses The property and the surrounding parcels to the north are zoned Tukwila Urban Center (TUC). BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being modified was originally approved by the City in 2000 (L2000-068) through a conditional use permit. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. CONCLUSIONS The proposed modifications to the existing antenna will not significantly alter the conditions that currently exist and will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. 2. As demonstrated in Tables 1 and 2, the project meets all applicable development standards for a Type II WCF. 3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type II Wireless Telecommunication Facility permit as applied for on behalf of Sprint-Nextel without conditions. INFORMATIONAL ITEMS A City of Tukwila electrical permit is required for service to the new MMBS and new BBC cabinet per TMC 16.04.020 (6). Otherwise, no building permit is required. HOLD THE COLD SHRINK TUBE AND COAXIAL CABLE IN ONE HAND SO THAT THE EDGE OF COLD SHRINK TUBE IS IN LINE WITH THE MARK. STEP 5: WITH YOUR FREE HAND, BEGIN REMOVING COLD SHRINK TUBE CORE. THE CORE WILL BE REMOVED BY UNWINDING IN A COUNTERCLOCKWISE DIRECTION WHILE LIGHTLY PULLING THE ATTACHED CORD AWAY FROM THE TUBE. STEP 4: CONTINUE WRAPPING THE CABLE AND CONNECTOR/GROUND KIT USING HALF OVERLAP (0.75 INCH WIDE) LAYERS. STEP 5: WRAP OVER AND PAST THE CONNECTOR/GROUND KIT AT LEAST 2 INCHES. STEP 6: TO TERMINATE THE SELF -AMALGAMATING TAPE, WRAP THE TAPE AT LEAST ONE FULL ROUND OVER THE CABLE STRETCHING THE TAPE TIGHT. CUT THE TAPE USING KNIFE OR SCISSORS AND APPLY THE LOOSE END TO THE UNDERLYING SELF -AMALGAMATING TAPE USING THUMB PRESSURE.
