PUBLIC COMMENTS
Joe Duffie, 5332 South 1401h Street, referenced the City Administrator's Report in the agenda packets and
asked that the City consider different ways tnkeep the community informed regarding projects. He
requested that the City Administration and Public Works staff hold a meeting with the community to
discuss the Public Works Shops Master Plan.
Greg Sherlock, 12435 Tukwila International Boulevard, distributed handouts to the Council and explained
he has been experiencing ongoing noise pollution issues with Sabey Data Center since 2005. He
reported he has reached out bnTukwila Code Enforcement, Police, and Administration for mitigation and
has not received asuccessful resolution. Heasked that the City Attorney provide awritten evaluation of
Tukwila Municipal Code Chopter8.22.O5O "Noise" regarding his noise nomp|aint, and asked
Administration to provide direction ashowhich department is responsible for remedying noise complaint
issues.
Following discussion from the Council, David Cline, City Administrator, confirmed he will be following up
on this issue.
AoneetSidhu.4S42South 14OmStreet, distributed handouts tothe Council and requested that the City
modify the allowable footprint area for single-family residences. Tukwila limits the building coverage to
35% of the lot area but also includes five additional restrictions. Surrounding jurisdictions use a standard
formula of35-4D% of the total lot area to calculate the maximum building footprint covenago, with no other
provisions orrestrictions. Mr. Sidhu requested that the City allow property owners to include the
easement area to the total lot area (for which property owners are taxed) when calculating the maximum
buildable footprint,
Jack Paca, Community Development Uin*obzr, indicated staff will review the issue. If code amendment
is found to be necessary, it will be added to the department's workplan for 2020 as part of their standard
code updates.

Phase 2.
Andy Youn, Acting City Clerk, announced this is a quasi-judicial matter, with the City Council acting as the
decision -maker based on the information and record presented at this meeting, similar to the process
used bvahearing examiner orjudge. Quasi-judicial matters donot follow the standard Council agenda
process of Council Committee, Committee of the Whole and Regular Meeting. The Council isbeing

Ms. Youn stated that testimony at a quasi-judicial hearing is taken under oath. She asked those in
attendance in the audience who are planning on testifying to raise their right hand and then asked, "Do

Councilmember Idan clarified he lived in Phase 1 and the issue before the Council tonight is Phase 2.
AnnMarie Soto, Assistant City Attorney, confirmed the Council is considering the Final Plat application for
Osterly Park Townhomes — Phase 2, which is separate from Phase 1. She indicated Councilmember Idan
has disclosed any potential conflicts he may have, and it is up to him to decide whether he feels he can
boanimpartial deoiaionmakeronthis matter.
Councilmember Idan stated while he does not need to recuse himself, he will be doing so to prevent any
appearance of conflict of interest. He also stated he does not have any interest and does not stand to
lose orgain by this matter.

Jaimie Reavis, Senior Planner, referenced into the record a copy of a letter dated November 4, 2019,

project site on September 11, 2019 pursuant to the requirements of TMC

PROJECT DESCRIPTION
Mr. Mike Overbeck is requesting final plat approval for the second and final phase of the Osterly Park
Tnwnhnmes. Phase proposes tVsubdivide three existing parcels into 16 unit lots, with tracts and
easements for ingress, egress, utilities, and recreation spaces. Development inPhase 2includes 1bnew
townhomes, a third story addition of two dwelling units to the building on Lot 24, a recreation space with
play equipment for children, frontage improvements on 341h Ave S, completion of the L-shaped access
road providing a through -connection from S 1441h St to 34th Ave S, and associated landscaping, utilities,
and street lighting.
This project has involved several land use permits over the past 10+ ynum, including a rezone and
Comprehensive Plan Amendment for one ofthe existing parcels making upthe project nite.SEPA
environmental raview, design revimw, preliminary subdivision approvals, major modifications hothe design
reviews, and avariance.
The OsbedyPark Townhmmeewas the first townhouse project 0zreoeiveP|anningCommiasionopprove|
following the March 2OO8adoption mfOrdinance 21S8bythe Tukwila City Council. Ordinance 2199aUows
development of zero lot line and fee simple townhouses. A townhome is a type of residential development
in which individual dwelling units are attached along at least one common wall to at least one other
dwelling unit. Each townhouse occupies space from the ground to the roof and has direct access to
private open space. Similar to a detached single-family home, townhomes are most often developed and
sold to include the structure and the land on which it is located. The land on which an individual
townhome is located is called a unit lot. A unit lot is part of a larger parent lot, to which the standards of
the underlying zoning district are applied, including minimum lot area, lot area per unit, setbacks, and
perimeter landscaping.
Phase
The original project approved by the Planning Commission in November 2009 included an approximately
1.7-acre site with 31 townhouse units along with required landscaping, guest parking, utilities, access,
recreation areas, and frontage improvements. The Planning Commission subsequently approved a
Phasing Plan and a Design Review Major Modification for the pjentin2O12toaUowconstruotionofthe
project in two phases. Phase 1 included construction mfeight hzwnhomea. private access lane and utilities
to serve the first eight hownhomes. and a temporary recreation space. Phase 1 received Final Subdivision
Approval from the Tukwila City Council in 2016, after which the plat map and Codes, Covenants and
Restrictions (CC&Rs) for Phase 1 were naoorded, and the first eight hownhomoswere constructed.

The applicant applied for aDesign ReviewK8ajorModifioadontoUheoi ina|dengnrovieminJuly 2018to
change the design, reducing the total area of the development and reconfiguring the unit |ots, aocasa, and
recreation spaces. The number of townhomes in Phase 2 was reduced from 23 townhomes as originally
approved. down to 15hownhomee.The Design Review Major Modification, updated Subdivision
Preliminary Approval for Phase 2.and aVariance and Design Review toadd a third story tothe building
on Lot 24 were approved by the Tukwila Planning Commission in January 2019.
Site Description
The project site is located between Tukwila International Blvd and Military Rd S, near the southeastern
corner ofS 1441h Stand 34m Ave G. Phase 2 of the project is made up of three existing tax parcels: two of
the parcels are vacant, and one is developed with a 4-plex condominium building located at 14424 34th
AveS.
Existing Development
Phase included eight new townhomes on individual unit lots, a shared recreation space, and an access
and utilities tract. Mr. Overbeck has constructed one of the two -unit townhouse buildings included in
Phase 2.asallowed within the HDR zone and inconformance with the approved design review received
by the Planning Commission. &1r. Dvedbeok's plan iabosell these units aasoon as his final subdivision
plat is recorded with King County. Uti|itiea, nidewm|k, and the first lift of asphalt pavement have been
constructed mspart ofthe Public Works Permit for Phase 2.
Surrounding Land Uses
The Osterly Park Townhouse development site is located within the High Density Residential (HDR)
zoning district, which allows for up to 22 dwelling units per net acre. The HDR zone is intended to provide
a high-denoih/, multiple -family district that is also compatible with commercial and office areas.
Surrounding areas are zoned for multifamily development (MDR, HDR) or mixed -use residential and
commercial development (NOC). The site is within walking distance to many neighborhood destinations,
including grocery stooes, schuu|s, and parka.
Topography
The area where the townhomes will be constructed is relatively flat. However, there is a drop down from
the townhouse development area to the parking lot of Lot 24, on which the 4-plex condominium building is
located. Access to Lot 24 and the other 4-plex properties located at 14420 and 14422 34th Ave S is from a
separate driveway off 34th Ave S. The grade of this access driveway slopes down from 34th Ave S to a low
point on Lot 24, which sits three to five feet below the grade elevation of the townhomes. A retaining wall
with a 6-foot tall wooden fence has recently been constructed by Mr. Overbeck on the north side of S
144th Lane. This fence separates the townhouse development from the 4-plex properties located at 14420
and 14422 34t' Ave S, as well as separating Lot 24 from the rest of the development. Stairs proposed on
the east and north sides of Lot 24 are to connect residents of Lot 24 to the shared parking and recreation
spaces within the rest ofthe plat.
Access
There will be two access points to the Osterly Park Townhomes from public streets for vehicular and
pedestrian traffic. These include driveways and sidewalk connections off 34th Ave S and S 144th Street.
Vehicular access tothe condominium building on Lot 24will remain via a separate driveway off 34mAve
S. which provides access toall three buildings located at 14420-14424 34mAve S. Pedestrian access to
the Osterly Park Townhomes private access road, the shared recreation space, and two parking spaces
will be available to the residents of Lot 24 via stairs with gate entries through the wooden fence on the
north and east sides ofthe property.
CONCLUSIONS
1. The applicant has submitted the required materials for review of the proposed final subdivision
plat for Phase 2ofthe {}sber|yPark Townhomes.
2. The final plat was distributed for review by the Fire Department, the Public Works Oepartment,
and the Building and Planning divisions within the Department of Community Development. One
of the parcels proposed to be subdivided has three outstanding liens, one of which is from the
City of Tukwila. The applicant has paid off the lien from Tukwila and is in the process of being
released. The other two liens on the property are from King County. These liens shall be released

prior to the Finance Director's signature on the plat and referral of the plat to the Mayor and City
Clerk for signature.
3. The Fire Department, Public Works Department, and the Building and Planning Divisions
reviewed the final plat and have provided written comments and approval. The Public Works
Director has signed Sheet 1 of of the plat. Additiona||y, managers from Valley View Sewer
District and Water District #125 provided written approval and as -built plans for Phase 2 of the
plat.
4. The proposed final plat bears the required certificates and statements of approval, and has been
signed by the Director of Public Works, and the Director of the Department of Community
Development. The certificate for the Tukwila Finance Director signature can be signed once
existing liens on the property have been released, The final plat will not be referred to the Mayor
or City Clerk until these liens have been released and the final plat certificate is signed by the
Tukwila Finance Director.
5. The facilities required to be provided by the applicant have either been constructed, or have been
included in the bond. Landscaping for Phase 2vvi|| be required to be installed as part ofbuilding
permits for the new tovvnhomes.
G. The plat is in conformance with the latest preliminary subdivision approval issued in January 2019
and is in conformance with state and local laws in effect at the time of the preliminary plat
approval.
RECOMMENDATIONS
Approval of the Final Subdivision oppUoaUon, pending completion of the following items:

provided. Per the agenda procedures, 15 minutes will be allowed for the applicant report (Mike
Overbeck, applicant).
Mike Overbeck, 4620 South 148m Street, explained the Osterly Park Townhomes project has been
ongoing for the past 12 years. He is the only zero lot line townhome subdivision in Tukwila to his
knowledge. He has received positive feedback about this project from numerous sources. Mr. Dverbeok
indicated the project has run into delays after Phase 1, due to a neighbor withdrawing their agreement to
share an easement. He has spent the past years correcting the resulting land use issue. Mr. Overbeck
has constructed a building and intends to sell these units as soon as his final subdivision plat is recorded
with King County. He expressed his desire to get back to work on building and asked for the Council's
support on this project.
The Acting City Clerk asked if either staff or the applicant had any other comments. Per the
agenda procedures, 5 minutes would be allowed by each for rebuttal.

Burhan Sved, 14481 34m Lane Gouth, shared he is o property owner in the Osbady Park Townhomeaand
asked who imresponsible for enforcing Covenants, Conditions and Restrictions (CC&R). Residents have
been experiencing issues with rental units, broken lights, and other violations. He emphasized the need
for stronger oversight and enforcement ofcommunity standards.

safety concerns asthe development has seen increased foot traffic.

In response toclarifying questions from the Council, VickvCarlsen. Finance Oirechrr, explained that half
of the additional seismic retrofitting funds will come from the General Fund and half from the utility funds.
Most of the costs will be offset by a reduction in the 2020 budget for the SCORE (South Correctional
Entity) facility and debt service infuture years.

Mayor Ekberg attended a Sound Cities Association networking dinner with a special panel ofretiring
K8oyora' and an Elected Officials Reception through the Master Builders Association.
b. City Council
Counui|membarSeal attended a South King Housing and Homelessness Partners Executive Board
meeting where they continued todiscuss implementation ofHB-14OB. She participated in a Sound Cities
Association discussion onhomelessness governance and attended aLEOFF1 board meeting.
Council President Hougardy met with leadership from Greater Seattle Partners to discuss the importance
oflocating businesses hoTukwila.
Councilmember Quinn emphasized the importance of having a standard response when residents raise
health and safety issues.
Councilmember Kruller reminded the Council that nominations for Sound Cities Association Regional

through Sound Cities Association) workshop will be held on potential impacts to city policies related to
homelessness. Councilmember Kruller reported that she recently provided a tour of the City to Brittney
Kohler, Program Director of Transportation and Infrastructure through the National League of Cities.
Councilmember Idan reported meeting with Teens for Tukwila last week and asked for an update on
when Metro will be providing transit tmthe Tukwila Community Center.
c. Staff
David Cline, City Administrator, referenced the CA(City Administrator) report and monthly Public Safety
Plan update, and offered toanswer any questions.
The Councilmembers discussed updates from the CA report and highlighted the importance of holding
contractors and partners accountable for adhering toproject time|ines,Counci|memberDuinnsugQeoted
publishing the CA report on the City website or having a phone recording of the report available.
d. City Attorney

MISCELLANEOUS
Councilmember Seal reported there is an increase in the amount of graffiti around the City and asked for
anupdate onthis issue.
Councilmember Kruller shared she recently drove by the Heiser site and came across an individual who
was trespassing on the property, Tukwila Police did not respond to her call. Bruce Linton, Police Chief,
indicated he would look into the matter.
Councilmember Kruller spoke to the importance of equity in recognizing long-term employees who are
leaving the City.
Counci|momberQuinn reported the Community Development and Neighborhoods Committee recently
approved grant funds for cameras at Cascade View Park. The Committee worked collaboratively with
Administration tofind funding.
