M I N U T E S
Mayor Van Dusen led the Pledge of Allegiance and called the
Regular Meeting of the Tukwila City Council to order.

Mayor Van Dusen presented Verna Aal, Administrative Secretary
for the Fire Department, with a ten year employee service pin.
Those also eligible for 10 year employee service pins,but not
in the audience, are:
Ted Ebert, Lieutenant
David Hansen, Lieutenant
Loren McFarland, Lieutenant
Sam Ruljancich, Firefighter First Class
All four are members of the Fire Department.

Mayor Van Dusen referred a letter from Mayor Roegner of Auburn,
concerning RCW 70.05 on changes to local health requirements.
Mayor Roegner, through the Suburban Mayor's Association, is
opposing the proposed legislation. The legislation proposes
that all guidelines be established by the State Board of Health.
MOVED BY BAUCH, SECONDED BY HILL, THAT MAYOR ROEGNER'S LETTER
AND A COPY OF THE PROPOSED BILL BE ON THE NEXT COMMITTEE OF THE
WHOLE AGENDA.
MOTION CARRIED.
Council President Harris reminded Council of the Wednesday meeting
to continue the investigation on forms of government. The full
time Mayors of Auburn and Redmond will be present.
Councilman Bohrer reported that Council Members Bauch, Harris,
Phelps and himself attended the 1983 Association of Washington
Cities Legislative Conference. They were briefed on the bills
being considered in the morning session and in the afternoon were
able to talk with some of the Legislators. The Binding Arbitration
issue is one the City will want to continue to discuss with
the Legislators to work for its defeat.
Deputy Attorney Woo asked to have discussion on the Peden Lawsuit
added to the Executive Session agenda. He reported on the
proposed Allentown Annexation. The next step is for the City to
pass an ordinance continuing the annexation procedure. It was
stopped in 1980 by a lawsuit filed by King County Fire District
No. 1. The lawsuit has now been dismissed.
MOVED BY HILL, SECONDED BY BAUCH, THAT THE NECESSARY DOCUMENTS
BE DRAWN UP FOR THE NEXT COMMITTEE OF THE WHOLE MEETING ALONG
WITH A MEMEO FROM THE CITY ATTORNEY STATING HIS OPINION ON THE
AFFECT THE ANNEXATION MAY HAVE ON THE 56th AVENUE BRIDGE
AGREEMENT. MOTION CARRIED.

Mr. John Diaz, owner of the Diaz School of Gymnastics was present
with 10 students to put on a demonstration on the gymnastics
training taught at the school. They are new to the Tukwila
area and, at the present time have about 300 students. The art
of gymnastics performed by the girls was enjoyed by all.
Councilman Duffie arrived at the meeting.

TO APPROVE THE CONSULTANTS AFTER CONSULTATION WITH THE PUBLIC
WORKS COMMITTEE.

MOVED BY HILL, SECONDED BY DUFFIE, THAT COUNCIL ACCEPT THE
STAFF'S RECOMMENDATION AND HIRE LEONARD BERNHARDT LANDSCAPING CO.
TO DO PHASE II OF THE IRRIGATION SYSTEM AT THE GOLF COURSE FOR
THE AMOUNT OF $33,869.30.

MISCELLANEOUS
Appearance of
Fairness Doctrine
Councilman Bohrer explained that he discussed, with the City
Attorney, a problem with Appearance of Fairness that he thought
might give Council a problem at a later date, on the P.R.D.
Ordinance. The City Attorney researched the State Law and
found there had been a change. His conclusion is that neither
the City nor any Council Member has any problem with prior
discussions at the Council table. Councilman Bohrer extended
his apologies for including a verbatim transcript to the
January 17th minutes.
Petition: Mayor Van Dusen presented a petition he had received signed
Low water by about 20 citizens that live in the area of So. 149th and
pressure 57th Ave. South. They are requesting that a pressure check
be made as their water pressure is very low. In the event of
a fire there would not be enough pressure to fight it. Mayor
Van Dusen said he has already asked the Public Works Director
to look into the problem.
8:00 P.M. Councilman Phelps arrived at the meeting.
EXECUTIVE SESSION
8:05 P.M.
An Executive Session was requested by the City Attorney to
discuss the Allenbach Lawsuit and the Peden Lawsuit with the
City Council.
MOVED BY HILL, SECONDED BY DUFFIE, THAT COUNCIL GO INTO EXECUTIVE
SESSION AFTER A TEN MINUTE RECESS. MOTION CARRIED.
8:35 P.M. MOVED BY HILL, SECONDED BY DUFFIE, THAT THE EXECUTIVE SESSION
BE ADJOURNED.
Appeal MOVED BY BAUCH, SECONDED BY HILL, THAT COUNCIL AUTHORIZE THE CITY
Allenbach ATTORNEY, UPON HIS ADVICE, TO APPEAL THE LITIGATION OF ALLENBACH
Lawsuit VERSUS CITY OF TUKWILA REGARDING ISSUANCE OF THE BUILDING
PERMIT.
