SPECIAL MEETINGS/EXECUTIVE SESSIONS

PUBLIC HEARINGS
Public Hearings are required by law before the Council can take action on matters affecting the public
interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2,04.150 of the
Tukwila Municipal Code states the following guidelines for Public Hearings:
The proponent shall speak first and is allowed 15 minutes for a presentation.
2. The opponent is then allowed 15 minutes to make a presentation.
3. Each side is then allowed 5 minutes for rebuttal.
4. Members of the public who wish to address the Council may speak for 5 minutes each. No one may
speak a second time until everyone wishing to speak has spoken.
5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the
question, but may not engage in further debate at that time.
6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss
the issue among themselves, or defer the discussion to a future Council meeting, without further public
testimony. Council action may only be taken during Regular or Special Meetings.
COUNCIL MEETING SCHEDULE
No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given.
Regular Meetings - The Mayor, elected by the people to a four-year term, presides at all Regular Council
Meetings held on the 1 st and 3rd Mondays of each month at 7:00 p.m. and Special Meetings. Official
Council action in the form of formal motions, adopting of resolutions and passing of ordinances can
only be taken at Regular or Special Council meetings.
Committee of the Whole Meetings - Councilmembers are elected for a four-year term. The Council
President is elected by the Councilmembers to preside at all Committee of the Whole meetings for a
one-year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m.
Issues discussed there are forwarded to Regular or Special Council meetings for official action.

PROCLAMATION
WHEREAS, the Revised Code of Washington (RCW) Chapter 38.52 authorizes the
Mayorto exercise emergency powers; and I
WHEREAS, Tukwila Municipal Code (TMC) Section 2.57.030 (1) empowers the Mayor
to proclaim a state of emergency when an incident, whether natural or man-made,
requires immediate responsive action to protect life and property; and
WHEREAS, the novel coronavirus (COVID-19) is a respiratory disease that may result
in serious illness or death and is easily transmissible from person to person; and
WHEREAS, on January 31, 2020, the United States Department of Public Health and
Human Services Secretary Alex Azar declared a public emergency for the novel
coronavirus (COVID-19) beginning on January 27, 2020; and
WHEREAS, on February 29, 2020, Governor Jay Inslee declared a state of emergency
exists in all counties in the State of Washington due to the number of confirmed
cases of COVID-19 in the State; and
WHEREAS, on March 1, 2020, King County Executive Dow Constantine signed a
proclamation of emergency due to the number of confirmed cases of COVID-19 in the
County, thus enabling King County government to take extraordinary measures; and
WHEREAS, the health, safety and welfare of Tukwila residents, businesses, visitors
and staff is of utmost importance to the City and additional future measures may be
' needed to protect the community; and
' WHEREAS, the City may require additional assistance in the future, and a formal
declaration of emergency allows additional resources to flow to the City in a timely
' fashion; and
' WHEREAS, existing conditions related to the COVID-19 warrant the proclamation of
emergency, as defined by TMC Section 2.57.020 and Revised Code of Washington
' (RCW) Section 38.52.010; and

NOW, THEREFORE,1, Allan Ekberg, Mayor of the City of Tukwila, do hereby proclaim a
declaration of emergency within the City of Tukwila; and that during the existence of
said emergency, the powers, functions, and duties of the Director of Emergency
Management and the emergency organization of this city shall be those prescribed by
state law, by ordinances, and resolutions of this city and approved by the Mayor on
March 9, 2020. Said local emergency shall be deemed to continue to exist until its
termination is proclaimed by the Mayor of the City of Tukwila, State of Washington.

ISSUE
Approve Amendment No. 5 to Contract No. 17-070 with OTAK, Inc. for additional engineering services and a time extension.
BACKGROUND
In May 2017, the City entered into a consultant agreement with OTAK for design and permitting services for the Riverton Creek
Flap Gate Removal Project. This project will improve habitat conditions and increase salmonid accessibility to rearing habitat in
Riverton Creek by removing two culverts and flap gates at the mouth of the creek and replacing a section of the at -grade trail with
a bridge over the restored open channel.
DISCUSSION
OTAK is nearing their contract expiration date and has expended approximately 99% of its budget with the following additional
services needed to complete the design and obtain required permits:
• Additional permit support: The City, with limited support from OTAK, submitted the required JARPA and WSDOT permit
applications. However, the City has received a considerable amount of technical comments, and has had to utilize, and will
continue to need, OTAK's multi -disciplinary expertise to coordinate with agencies to resolve the permit comments.
• Final design: This task is being amended primarily to enable design modifications in response to agency permit comments.
The main changes pertain to the following; tribal in -stream habitat comments related to the boulder drop structure, channel
grading, and the large wood structures; WSDOT's structural and site -related comments, including additional reinforcement of
the SR 599 sheet pile wall and modifications to the soldier pile wall on the right bank of the creek.
• Geotechnical investigations: GeoEngineers, OTAK's subconsultant, will perform two additional borings along the right bank
soldier pile wall.
• Bid support services — New task
• Contingency — A $15,000 management reserve contingency is included in the event that limited and pre -authorized additional
services may be required.
FISCAL IMPACT
Amendment No. 5 is for $98,112.00, bringing the total contract amount to $318,452.00, and includes a one-year contract extension
to April 30, 2021. To fund Amendment No. 5, the project will utilize the remaining design budget. A portion of these funds are
eligible for grant reimbursement.

Improve fish access to Riverton Creek and enhance salmon rearing and resting area.

CONTRACT FOR SERVICES
Amendment #5
Between the City of Tukwila and OTAK, Inc.
That portion of Contract No. 17-070 between the City of Tukwila and OTAK, Inc. is hereby
amended as follows:
Section 1: Scope of Services. Work under this contract shall be amended to include
reimbursement for direct expenses and costs associated with the additional contract scope
of services as described in Exhibit A-5, attached.
Section 3. Duration of Agreement, Time for Performance. This Agreement shall be in full
force and effect for a period commencing upon execution and ending April 30, 2021, unless
sooner terminated under the provisions hereinafter specified. Work under this Agreement
shall commence upon written notice by the City to the Consultant to proceed. The Consultant
shall perform all services and provide all work product required pursuant to this Agreement
no later than April 30, 2021 unless an extension of such time is granted in writing by the City.
Section 4: Payment. Payment is hereby changed to include an additional $98,112.00 for this
additional scope of services. See Exhibit B-5. The maximum amount payable under this
contract as amended inclusive of all fees and other costs shall not exceed $318,452.00
without express written modifications of the Agreement signed by the City.
All other provisions of the contract shall remain in full force and effect.

Amendment No. 5
The City has received comments from granting agencies, permitting agencies, and other stakeholders
on the design for the Riverton Creek Flapgate Removal Project. At the request of the City, Otak
provided support to provide responses and to modify the design as necessary to address the
comments. A monitoring plan and a DARPA major modification have also been requested.
In addition, Otak's geotechnical subconsultant has reviewed the revised channel design and they are
recommending a second row of tiebacks in the existing west sheet pile wall. The additional tiebacks
will also address comment from WSDOT. Additional boring investigations were also recommended
to determine soil conditions supporting the proposed east soldier pile wall.
This scope provides additional services to incorporate the changes and additions into the current
design and then advance the design to final bid documents for construction in 2020.
The following table provides a summary of the contract value for the project as modified by
Amendment No. 5.

Scope and Budget Modifications
Task I — Project Management
The scope for this task is increased to provide project management and coordination for an
extended project schedule for anticipated construction in 2020. This includes additional services for
regular status update meetings with the City, project management, and preparation of project reports
and invoices.
Task 4 — Permitting, Environmental Review and Coordination
4.1 JARPA Preparation
Otak will update the JARPA electronic drawing package initially prepared by the City including
overall formatting and adjustment of scales and labels to comply with application requirements.
The Washington Department of Fish and Wildlife (WDFW) has requested a Major Modification to
the original JARPA to incorporate design revisions made to address comments from the Army
Corps of Engineers (ACOE) and Muckleshoot Indian Tribe (MIT). Otak will update the electronic
JARPA drawing package with these design revisions and provide and electronic (pdf) package.
The City will prepare the Major Modification Form.
4.7 Permitting Support
The level of effort originally estimated for developing response to permitting agency comments has
been exceeded based on the comments received. The Task 4.7 scope is increased to provide
additional services for continued permitting support.
Otak will review email correspondence with multiple permitting agencies and will participate in
additional meetings with the City to review agency comments and discuss potential revisions to the
design as necessary. Otak will provide written email responses to Department of Natural Resources
(DNR) and the Muckleshoot Indian Tribe (MIT) to provide basis of design information and revised
drawings to demonstrate how comments have been addressed.
Otak will provide additional services to support the permitting process with WSDOT include
reviewing comments and providing written responses as requested by the City.
4.8 Monitoring Plan (New)
In response to MIT comments, this task provides' details for providing a stream and fish passage
monitoring plan for a tidal flapgate and culvert removal and pedestrian bridge installation project on

Riverton Creek, in the City of Tukwila, King County, Washington. The WDFW and ACOE require
monitoring for culvert replacements with bridge structures and stream modifications to document
proper conditions for fish passage.
This task involves preparation of a culvert and stream monitoring plan based on guidance from
WDFW protocols for monitoring bridge installation and design from the Water Crossing Design
Guidelines (WDFW 2013). Monitoring plan elements will include fish passage data collection:
photographs of the pedestrian bridge and the surrounding banks, qualitative descriptive information,
and the physical measurements for the bridge and nearby streambeds recommended by WDFW.
The monitoring plan will include performance standards for bridge design and function and nearby
streambeds appropriate to the project and the stream systems.
This task includes coordination with the City, WDFW, and the ACOE. This task will also include
coordinating with regulatory agencies and tribal representatives on culvert and stream monitoring
planning, goals, objectives, and plan specifics as needed.
Assumptions:
• Wetland mitigation and monitoring planning is not included in this scope.
• Wetland buffer mitigation and monitoring planning is not included in this scope.
• The culvert and stream monitoring plan will not include riparian or wetland planting plans.
• If needed, up to two (2) two-hour meetings with the City, WDFW, ACOE, and tribal
representatives may be included in this task.
Task 5 — Final Design
The Task 5 work assumes that there will only be one -round of revisions to address WSDOT
comments. If further revisions are required, an amendment will be submitted for authorization of
contingency funds to address the comments.
5.1 Final Design and Plan Sheets
The following changes to the final design and plans will be incorporated at the 90%, 100%, and final
bid document stages.
4 Creek Grading, Trail Restoration, and Bank Armoring Design
Otak will revise the plans and details to address comments from permitting agencies regarding
reducing the boulder drop structure height, adjusting the channel profile and grading, and the
size of the logs for woody debris structures.
Otak will update the structural calculations to incorporate the final geotechnical report
recommendations and design data for submittal to WSDOT.

6 Retaining Wall Design
Otak will review the geotechnical soils data and recommendations for the east soldier pile wall
that will be provided by the geotechnical subconsultant after supplemental explorations under
Task 7. Otak will update structural calculations based on the soil properties at the location of
the wall. The assumption is that the geotechnical findings and recommendations will require
adjusting the pile length by up to 2'. Further revisions to the east soldier pile wall design, such as
an increase in pile depth over 2' or the addition of tiebacks will require additional services and an
amendment will be prepared to authorize contingency funds if requested by the City.
5.2 Specifications
Otak will revise the Division 2-9 Special Provisions and details to address comments from
permitting agencies regarding reducing the size of the logs for woody debris structures.
Otak will also prepare special provisions for verifying the existing sheet pile wall depth per WSDOT
comments.
5.3 Construction Cost Estimates
Otak will revise the quantities and cost estimate to address comments from permitting agencies
regarding reducing the boulder drop structure height, adjusting the channel profile and grading, and
the size of the logs for woody debris structures.
Otak will add construction cost information for verifying the existing sheet pile wall depth per
WSDOT comments.
5.4 Preparation of the Contract Manual (New)
Per Amendment No. 1 scope, The City would be preparing the master Contract Manual including
Division 1 of the Special Provisions. Otak would only prepare Special Provisions for Divisions 2-9
under Task 5.2 to be incorporated in the manual by the City.
This Amendment No. 5 scope adds new Task 5.4 for Otak to prepare the master Contract Manual
including all Contract and Bid Forms, Amendments to the WSDOT Standard Specifications, and
Appendices. Otak will incorporate Special Provisions provided by the City for items designed by
the City such as the landscaping work. The City will provide current boilerplate Division 1 special
provisions and bid form electronic files (doc) that Otak will update and fill in information for this
project. The City will also provide all permits to be included in the appendices.
Otak will submit the Contract Manual to the City for review at the 90%, 100%, and final bid
document stages.

Otak will provide the final version of the Contract Manual for bid advertisement.
Task 7 — Geotechnical Analysis
This task includes a geotechnical evaluation by GeoEngineers, a subconsultant to Otak. Previous
work under Phase 1 and 2 included review of existing data, explorations for the bridge foundation
design, and preparation of a final geotechnical report with recommendations for the proposed
project improvements.
This contract amendment includes scope and fee estimate for additional services to complete Phase
2 of the project. Our specific scope of additional services is presented below.
7.2 Supplementary Borings and Report Amendment (New)
Prepare a draft and final amendment to geotechnical design report for the proposed east soldier pile
wall. Our specific scope of services for the design -level report amendment will include the following:
• Project vicinity map and site plan showing the location of the geotechnical exploration
with
Summary of subsurface soil and groundwater conditions.
Seismic design recommendations based on the current International Building Code
(IBC).
Design recommendations for the proposed soldier pile wall
7.3. Design and Permitting Support (New)
Provide additional consultation to the design team including reviewing the plans and specifications
for conformance to our geotechnical recommendations. If requested, this may also include

The Annual Small Drainage Program repairs and installs needed surface water infrastructure that is identified through
maintenance activities as well as citizen complaints. For the 2020 Annual Small Drainage Program, staff is proposing
the design of six projects for possible construction in 2020.
DISCUSSION
The current MRSC Consultant Roster was reviewed and three firms were short-listed to provide design services. The
firms were KPG, PACE, and Otak. The Summary of Qualifications for project design and construction management
were evaluated from each firm and KPG was selected as the firm that best met the requirements. KPG has designed
the Annual Small Drainage Program since 1991 and Public Works continues to be very satisfied with their work. KPG
also worked on the 2019 Annual Small Drainage Program and is knowledgeable of the sites.
Public Works staff reviewed the list of known system deficiencies and compiled a list of six projects for design in 2020.
One of the projects was substantially designed in 2018, but not constructed due to permitting. The design projects are:
1. 40th Ave S Drainage System
2. Klickitat Dr at 53rd Ave S (replace pipe)
3. S 124th St from 42Dd Ave S to 45th Ave S
4. 57th Ave S at Golden Nugget (rebuild catch basin)

6. 48th Ave S. from S 124th to S 122nd Streets
KPG's proposed fee for the 2020 Small Drainage Program's design contract is $92,472.00 and the 2020 design budget is

CONSULTANT AGREEMENT FOR
ENGINEERING SERVICES
THIS AGREEMENT is entered into between the City of Tukwila, Washington, hereinafter
referred to as "the City", and KPG, Inc., hereinafter referred to as "the Consultant", in consideration
of the mutual benefits, terms, and conditions hereinafter specified.

Proiect Designation. The Consultant is retained by the City to perform engineering services
in connection with the project titled `2020 Small Drainage Program'.
Scope of Services. The Consultant agrees to perform the services, identified on Exhibit "A"
attached hereto, including the provision of all labor, materials, equipment and supplies.
Duration of Agreement; Time for Performance. This Agreement shall be in full force and
effect for a period commencing upon execution and ending December 31, 2020, unless sooner
terminated under the provisions hereinafter specified. Work under this Agreement shall
commence upon written notice by the City to the Consultant to proceed. The Consultant shall
perform all services and provide all work product required pursuant to this Agreement no later
than December 31, 2020 unless an extension of such time is granted in writing by the City.
Payment. The Consultant shall be paid by the City for completed work and for services
rendered under this Agreement as follows:
A. Payment for the work provided by the Consultant shall be made as provided on Exhibit
"B" attached hereto, provided that the total amount of payment to the Consultant shall not
exceed $92,472.00 without express written modification of the Agreement signed by the
City.
B. The Consultant may submit vouchers to the City once per month during the progress of
the work for partial payment for that portion of the project completed to date. Such
vouchers will be checked by the City and, upon approval thereof, payment shall be made
to the Consultant in the amount approved.
C. Final payment of any balance due the Consultant of the total contract price earned will be
made promptly upon its ascertainment and verification by the City after the completion of
the work under this Agreement and its acceptance by the City.
D. Payment as provided in this section shall be full compensation for work performed,
services rendered, and for all materials, supplies, equipment and incidentals necessary to
complete the work.
E. The Consultant's records and accounts pertaining to this Agreement are to be kept
available for inspection by representatives of the City and the state of Washington for a
period of three (3) years after final payments. Copies shall be made available upon
request.

5. Ownership and Use of Documents. All documents, drawings, specifications and other
materials produced by the Consultant in connection with the services rendered under this
Agreement shall be the property of the City whether the project for which they are made is
executed or not. The Consultant shall be permitted to retain copies, including reproducible
copies, of drawings and specifications for information, reference and use in connection with
the Consultant's endeavors. The Consultant shall not be responsible for any use of the said
documents, drawings, specifications or other materials by the City on any project other than
the project specified in this Agreement.
6. Compliance with Laws. The Consultant shall, in performing the services contemplated by
this Agreement, faithfully observe and comply with all federal, state, and local laws,
ordinances and regulations, applicable to the services rendered under this Agreement.
7. Indemnification. The Consultant shall defend, indemnify and hold the City, its officers,
officials, employees and volunteers harmless from any and all claims, injuries, damages,
losses or suits including attorney fees, arising out of or resulting from the acts, errors or
omissions of the Consultant in performance of this Agreement, except for injuries and
damages caused by the sole negligence of the City.
Should a court of competent jurisdiction determine that this Agreement is subject to RCW
4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or
damages to property caused by or resulting from the concurrent negligence of the Consultant
and the City, its officers, officials, employees, and volunteers, the Consultant's liability
hereunder shall be only to the extent of the Consultant's negligence. It is further specifically
and expressly understood that the indemnification provided herein constitutes the Consultant's
waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of this
indemnification. This waiver has been mutually negotiated by the parties. The provisions of
this section shall survive the expiration or termination of this Agreement.
8. Insurance. The Consultant shall procure and maintain for the duration of the Agreement,
insurance against claims for injuries to persons or damage to property which may arise from
or in connection with the performance of the work hereunder by the Consultant, its agents,
representatives, or employees. Consultant's maintenance of insurance as required by the
agreement shall not be construed to limit the liability of the Consultant to the coverage
provided by such insurance, or otherwise limit the City's recourse to any remedy available at
law or in equity.
A. Minimum Amounts and Scope of Insurance. Consultant shall obtain insurance of the
types and with the limits described below:

1. Automobile Liability insurance with a minimum combined single limit for bodily
injury and property damage of $1,000,000 per accident. Automobile Liability
insurance shall cover all owned, non -owned, hired and leased vehicles. Coverage
shall be written on Insurance Services Office (ISO) form CA 00 01 or a substitute
form providing equivalent liability coverage. If necessary, the policy shall be
endorsed to provide contractual liability coverage.

2. Commercial General Liability insurance with limits no less than $1,000,000 each
occurrence, $2,000,000 general aggregate. Commercial General Liability
insurance shall be written on ISO occurrence form CG 00 01 and shall cover
liability arising from premises, operations, independent contractors and personal
injury and advertising injury. The City shall be named as an insured under the
Consultant's Commercial General Liability insurance policy with respect to the
work performed for the City.
3. Workers' Compensation coverage as required by the Industrial Insurance laws of
the State of Washington.
4. Professional Liability with limits no less than $1,000,000 per claim and
$1,000,000 policy aggregate limit. Professional Liability insurance shall be
appropriate to the Consultant's profession.
B. Other Insurance Provision. The Consultant's Automobile Liability and Commercial
General Liability insurance policies are to contain, or be endorsed to contain that they
shall be primary insurance with respect to the City. Any Insurance, self-insurance, or
insurance pool coverage maintained by the City shall be excess of the Consultant's
insurance and shall not be contributed or combined with it.
C. Acceptability of Insurers. Insurance is to be placed with insurers with a current A.M.
Best rating of not less than A: VII.
D. Verification of Coverage. Consultant shall furnish the City with original certificates and
a copy of the amendatory endorsements, including but not necessarily limited to the
additional insured endorsement, evidencing the insurance requirements of the Consultant
before commencement of the work. Certificates of coverage and endorsements as required
by this section shall be delivered to the City within fifteen (15) days of execution of this
Agreement.
E. Notice of Cancellation. The Consultant shall provide the City with written notice of any
policy cancellation, within two business days of their receipt of such notice.
F. Failure to Maintain Insurance. Failure on the part of the Consultant to maintain the
insurance as required shall constitute a material breach of contract, upon which the City
may, after giving five business days notice to the Consultant to correct the breach,
immediately terminate the contract or, at its discretion, procure or renew such insurance
and pay any and all premiums in connection therewith, with any sums so expended to be
repaid to the City on demand, or at the sole discretion of the City, offset against funds due
the Consultant from the City.
9. Independent Contractor. The Consultant and the City agree that the Consultant is an
independent contractor with respect to the services provided pursuant to this Agreement.
Nothing in this Agreement shall be considered to create the relationship of employer and
employee between the parties hereto. Neither the Consultant nor any employee of the
Consultant shall be entitled to any benefits accorded City employees by virtue of the services
provided under this Agreement. The City shall not be responsible for withholding or
otherwise deducting federal income tax or social security or for contributing to the state
industrial insurance program, otherwise assuming the duties of an employer with respect to
the Consultant, or any employee of the Consultant.

10. Covenant Against Contingent Fees. The Consultant warrants that he has not employed or
retained any company or person, other than a bonafide employee working solely for the
Consultant, to solicit or secure this contract, and that he has not paid or agreed to pay any
company or person, other than a bonafide employee working solely for the Consultant, any
fee, commission, percentage, brokerage fee, gifts, or any other consideration contingent upon
or resulting from the award or making of this contract. For breach or violation of this warrant,
the City shall have the right to annul this contract without liability, or in its discretion to
deduct from the contract price or consideration, or otherwise recover, the full amount of such
fee, commission, percentage, brokerage fee, gift, or contingent fee.
11. Discrimination Prohibited. The Consultant, with regard to the work performed by it under
this Agreement, will not discriminate on the grounds of race, religion, creed, color, national
origin, age, veteran status, sex, sexual orientation, gender identity, marital status, political
affiliation or the presence of any disability in the selection and retention of employees or
procurement of materials or supplies.
12. Assignment. The Consultant shall not sublet or assign any of the services covered by this
Agreement without the express written consent of the City.
13. Non -Waiver. Waiver by the City of any provision of this Agreement or any time limitation
provided for in this Agreement shall not constitute a waiver of any other provision.
14. Termination.
A. The City reserves the right to terminate this Agreement at any time by giving ten (10)
days written notice to the Consultant.
B. In the event of the death of a member, partner or officer of the Consultant, or any of its
supervisory personnel assigned to the project, the surviving members of the Consultant
hereby agree to complete the work under the terms of this Agreement, if requested to do
so by the City. This section shall not be a bar to renegotiations of this Agreement
between surviving members of the Consultant and the City, if the City so chooses.
15. Applicable Law; Venue; Attorney's Fees. This Agreement shall be subject to, and the
Consultant shall at all times comply with, all applicable federal, state and local laws,
regulations, and rules, including the provisions of the City of Tukwila Municipal Code and
ordinances of the City of Tukwila. In the event any suit, arbitration, or other proceeding is
instituted to enforce any term of this Agreement, the parties specifically understand and agree
that venue shall be properly laid in King County, Washington. The prevailing party in any
such action shall be entitled to its attorney's fees and costs of suit. Venue for any action
arising from or related to this Agreement shall be exclusively in King County Superior Court.
16. Severability and Survival. If any term, condition or provision of this Agreement is declared
void or unenforceable or limited in its application or effect, such event shall not affect any
other provisions hereof and all other provisions shall remain fully enforceable. The provisions
of this Agreement, which by their sense and context are reasonably intended to survive the
completion, expiration or cancellation of this Agreement, shall survive termination of this
Agreement.

writing and signed by the parties.

PROJECT DESCRIPTION
The Consultant shall prepare final Plans, Specifications and Estimates for the 2020 Small Drainage
Program. The project will include the following sites:
Site 1: 13601 401h Ave S Drainage System
Replace and install new storm drain system approximately 90' of 18" CMP and 80' of 12" concrete
pipe along with three drainage structures. Tie into the existing system at 40`" Ave S. This site may
require an HPA, SEPA and City of Tukwila Special Permissions Permit with project limits within
Type 3 Watercourse Buffer.
Site 2: Klickitat Dr. @ 53`d Ave S Drainage System
Replace and install new storm drain system approximately180' of 18" CMP.. Tie into the existing
system along Klickitat Dr. This site may require an HPA, SEPA and City of Tukwila Special
Permissions Permit with project limits within Type 3 Watercourse Buffer.
Site 3: S 12411 St from 42"d Ave to 45" Ave Drainage System
Install storm drain system approximately 750'on the northside of S 124"' St. Tie into the existing
system.
Sites 4: 57' Ave S @ Golden Nugget Drainage Structure
Bring Type H Manhole up to grade by removing approximately 8' of existing 24" riser rings. Add
48" barrel sections and new manhole ring and cover.
Sites 5: 42"d Ave S Drainage Structure
Install a new drainage structure with bird cage inlet to reduce plugging and overflows onto 42" d Ave
S. This site may require an HPA and SEPA. Project was designed as part of the 2019 Small Drainage
Program, but there were insufficient funds for construction and permitting had not been completed.
Sites 6: 48`h Ave S from S 120' St to S 122"d St Drainage System
Install storm drain system approximately 820' starting the northside of S 124`h St and down 48`" Ave
S. Tie into the existing system along S 122" d St.
The Consultant shall provide necessary surveying, project design, quantity and cost estimates, and utility
coordination required to complete final bid documents. It is anticipated that sites will be bid as a single
bid package for the 2020 Small Drainage Program as budget or other considerations allow.

The Consultant shall provide surveyed base maps with horizontal utility locations, or base maps created
from field measurements, ortho-photography, and GIS data as necessary for each site. If necessary,
surveyed base maps will include right-of-way line work based on available public records. Project
horizontal and vertical datum will be NAD83/2011 and NAVD88 respectively on all sites.
The Consultant shall prepare an easement document, legal description, and exhibit for Site 5. The City will
perform negotiations to obtain signature and record the easement.
The Consultant shall prepare a SEPA checklist, HPA application, and Special Permissions Permit where
required. No additional permits are anticipated.
It is the Consultants understanding that none of the 2020 Small Drainage Program sites require biological

SCOPE OF WORK
TASK 1— 2020 Small Drainage Program Design
1.1 MANAGEMENT/COORDINATION/ADMINISTRATION
• The Consultant shall provide continuous project management and administration for the
duration of the Project. (Estimate 8 months).
• Hold project coordination meetings with the City to update progress and review submittals.
Assume (3) meetings.
• The Consultant shall provide monthly status reports and billings.
• The Consultant shall provide independent QA/QC reviews by senior in-house staff of all
deliverables prior to submittal to the City.
1.2 Previously obtained mapping for Site 5 will be utilized. The Consultant shall prepare a topographic
base map for Sites 1,2,3,4, and 6.
1.3 For Site 1, the Consultant shall prepare 50%, 90%, and final design.
1.4 For Site 2, the Consultant shall prepare 50%, 90%, and final design.
1.5 For Site 3, the Consultant shall prepare 50%, 90%, and final design.
1.6 For Site 4, the Consultant shall prepare 50%, 90%, and final design.
1.7 The Consultant has previously prepared designs for Site 5. Minor updates and revisions are
anticipated after WDFW permitting review and will be included in the Bid Documents.

1.9 The Consultant shall prepare 50% & 90% plan review submittals for all sites.
1.10 The Consultant shall prepare a SEPA checklist for the 2020 Small Drainage Program containing
information on all sites requiring SEPA review. This is anticipated to be Sites 1,2, and 5. Site 5 draft
SEPA was previously prepared, but not submitted during the 2019 SDP Design.
1.11 The Consultant shall prepare HPA Permit Application and coordinate with Washington Department
of Fish and Wildlife to obtain HPA where required. This is anticipated to be Sites 1,2, and 5.
1.12 The Consultant shall prepare City Special Permissions Permit for the 2020 Small Drainage Program
containing information on all sites requiring Special City review. This is anticipated to be Sites 1
and 2 where project site location is within existing Type 3 watercourse Stream buffer.
1.13 The Consultant shall prepare the Contract Specification per 2020 WSDOT Standard Specifications
for the 90% Review Submittal and the Bid Documents.
1.14 The Consultant shall calculate quantities and prepare Engineers Estimate of Probable Construction
Cost for each review submittal and the Bid Documents.
1.15 The Consultant shall distribute 50% review submittals to franchise utility owners to identify potential
conflicts within the Project limits.
1.16 The Consultant shall prepare final Bid Documents for the proposed improvements including the
following:
o Plans shall be prepared with such provisions in such detail as to permit field layout and
construction within a degree of accuracy acceptable to the City and per industry
standards.
o Details will be prepared for items not available as standard details from the City, State,
or WSDOT standard drawings.
o The plans shall illustrate complete details of construction of the proposed
improvements including limits of construction and removals, proposed invert
elevations, rim elevations and required construction materials.
o Drainage designs will be determined through consultation with City staff and from
previous experience rather than detailed basin modeling.
1.17 The Consultant shall provide bid period services to include responses to bidder inquiries, preparation
of addenda, attendance at bid opening, preparation of bid tabulation, and recommendation to award
or reject the apparent low bidder. The budget assumes a straight forward review process with the
low bidder receiving the contract award.
• Assumptions
o No federal funding is anticipated for the Project engineering or construction.
o No utility upgrades are anticipated in the project design.
o Drainage & Water Quality Reports will not be required.
o Geotechnical Engineering services will not be required.

Additional Services
The City of Tukwila may require other services of the consultant. These services could include additional
design, right of way, utility potholing, environmental documentation, construction phase services, or other
work tasks not included in the scope of work. At the time these services are required, the Consultant will
provide the City with a detailed scope of work and an hour and fee estimate. The Consultant will not
proceed with the work until the City has authorized the work and issued a Notice to Proceed.

• Urban Growth Capacity/Urban Lands Technical Team Meeting: Community Development
staff attended the monthly meeting of the Urban Growth Capacity/Urban Lands technical
team on February 8. King County requested feedback on a draft proposed Market Factor
approach. The group also received a presentation on a 3-D model the City of Seattle is using
to visualize development regulations and measure the zoned capacity for new housing units
and commercial space.

Kruller and other City staff attended the Pacific Northwest Economic Equity Summit on
February 28.
• King County Metro Technical Advisory Committee Meeting: Community Development staff
attended the King County Metro Technical Advisory Committee meeting on March 2. The
group discussed upcoming policy updates including streamlining performance measures
about how effectively Metro is operating according to the goals of its Strategic Plan.
• Joint Meeting about Alta SchoolPool: Staff from Administrative Services and Community
Development attended a meeting with Alta Planning, Tukwila School District Transportation
and elementary school social workers regarding potential Alta SchoolPool efforts to connect
students and families safely to elementary schools.

Cottonwood Corner Work Parties: Forest Steward, Heidi Watters and Debbie Gordon will
lead neighborhood work parties every third Wednesday from 10am-12pm starting in March.

EarthCorps and Olena Perry have planned site visits to Cottonwood Corner, Crystal Springs
and Tukwila Park to establish work for 2020 professional crews.
III. Staff Updates
Public Safety
Accepting Applications for the Valley Independent Investigative Team: As we transition to
meet the requirements of the Law Enforcement Training and Community Safety Act
(LETCSA), the Police Department is accepting applications for volunteers to serve on the
Valley Independent Investigative Team (VIIT) as a non -law enforcement representative who
will work alongside the Chief of Police in this effort. The goal is to enhance accountability and
increase trust to improve the legitimacy of policing for an increase in safety for everyone.
Bullyproof Training Workshop: On February 26 Foster High Students participated in a three-
hour training with our Gracie Survival Tactics (GST) instructors during the Bullyproof Training
workshop. Participants were provided with basicjiu-jitsu-based techniques to counter and
control common assaultive behaviors. This is the second year School Resource Officer (SRO)
Joseph Tran has hosted this workshop for students. We hope to expand this training in the
near future to Tukwila community members as well.
Daily Briefings with Regional Partners on Coronavirus: Many City employees are actively
monitoring and coordinating with other regional partners on responding to the Coronavirus
issues. For example, Chief Wittwer and Battalion Chief Jason Konieczka continue to
participate in daily briefings regarding the COVID-19 issues affecting the region.
Project Updates
53rd Ave S: Estimated Completion: May 2020
On March 4 City project staff met with Seattle City Light (SCL), the construction contractor
and the electrical subcontractor in the field to begin the six power service connection works
at four locations. While SCL crews and the electrical subcontractor are on site, they will also
activate and test the new streetlights. Contractor also made several improvements to S. 198th
St, west of 53rd Ave. S., including paving a new asphalt surface on March 5,

The last two weeks have been busy for the crews with the vast majority of bare root plant
material having been installed. There were plant losses that resulted from the recent river
event and the shoreline experienced some erosion as a result of the high waters. Additional
plants will be purchased to compensate for the loss.
• Boeing Access Rd over Airport Way Bridge: WSDOT headquarters has accepted the plans for
the Boeing Access Rd over Airport Way Seismic retrofit. The project was advertised for
construction on March 3 and 9 on Builders Exchange, Daily Journal of Commerce, and the
Seattle Times. A pre -bid meeting is scheduled for March 16 with the bids opening on March
24.
• 42-d Ave S Bridge In-depth Inspection: The City is working with TranTech Engineering and
Fickett Structural Solutions to procure a firm cost estimate and scope of work to perform the

in-depth structural inspection. The inspection will require a boom lift for the structural
members above the bridge deck and a Under Bridge Inspection Truck (UBIT) to access the
structural members under the bridge deck. The inspection will utilize non-destructive testing
to measure the thickness of the steel members and check for cracks in the steel to illustrate if
there are any internal deficiencies in the steel. The funding for design of the replacement
bridge was approved by Council on March 2.
4Culture Grant Application to Create Preservation Plan: Economic Development staff
collaborated with Public Works staff and submitted an application to 4Culture for a grant to
be used to create a preservation plan for the old city hall/school building on Tukwila Hill. We
anticipate 4Culture's decision in April.
