Weinstein Architectural Design & Planning Amendment No. 7
ISSUE
Execute contract amendment no. 7 to cover FS 52 additional geotechnical Construction Administration (CA),
extended civil CA and architectural CA and administrative fees. Hart Crowser, geotech consultant, was previously
contracted for construction observation services only within the building footprint. Due to site complexities,
observation for the installation of all site work is required. The original Owner -Architect contract fees were based
on generic site data and a 15- month construction schedule and now have been reconciled with the existing
conditions of the site and the project. Due to the complexity of the selected building site and the phasing of site
construction work, the current construction schedule reflects a duration of 18 months. The complexity of both the
site and regulatory environment of this project have also resulted in significant, unanticipated work for our Civil
Engineer. These costs are well within the project budget and staff is not asking for additional budget authority.
BACKGROUND
In April 2017, the Council approved an initial contract for design services with Weinstein AU for $2,089,717.00.
This is well within the combined design budget for the three stations of $3,275,000.00. September 2018,
Amendment No 1. for $395,537.00 was due to modified budgets and eliminated FS 54 from Weinstein AU
contract. December 2018, Amendment No 2 for $383,462.00, for design of the driveway. In April 2019,
Amendment No 3 for $20,950, for acoustical analysis and final driveway design. In May 2019, Amendment No. 4
to provide stormwater detention vault design, shoring and retaining wall design and an inadvertent discovery
plan for $20,840. Amendment No. 5 covered additional soils testing scope in the amount of $29,183.
Amendment No. 6 covered FS 52 Driveway Design, CIP retaining wall design and vault shift, and FS 51 Wetland
Mitigation Coordination in the amount of $67,059, bringing the new contract amount to $3,006,748.
FISCAL IMPACT
Amendment No. 7 is in the amount of $191,697.71 to Fire Station 52. The total contract amount will now be
$3,198,445.71. The amount is well within the project budgets. The following table shows the original
contract amount, all previous amendments, the new contract amount, the owner's contingency and the total.
The Project Management Quality Assurance (PMQA) consultant has reviewed these documents and
provided his concurrence.

CONTRACT FOR SERVICES
Amendment No. 7
Between the City of Tukwila and Weinstein AU, LLC.
That portion of Contract No. 17-068 between the City of Tukwila and Weinstein AU, LLC. is
hereby amended as follows:
Section 1 Project Designation: The Consultant is retained by the City to perform
Architectural Design and Planning services in connection with the project titled Tukwila Public
Safety Plan, Fire Station 51 site.
Section 2 Scope of Services: The Consultant agrees to perform the services, identified on
Exhibit "A" attached hereto, including the provision of all labor, materials, equipment and
supplies.
Section 4 Payment: The Consultant shall be paid by the City for completed work and for
services rendered under this Agreement as follows:
Payment for the work provided by the Consultant shall be made as provided on Exhibit "A"
attached hereto, provided that the total amount of payment to the Consultant shall not exceed
$3,198,445.71 (including estimated expenses) without express written modification of the
Agreement signed by the City. The total amount for this amendment is $191,697.71.
All other provisions of the contract shall remain in full force and effect.

Description of Work
Construction Budget Update
Our authorized scope for Fire Station 52 includes geotechnical construction observation for the elements within
the building footprint (foundations, slabs -on -grade, and underslab utilities).
We understand the City is requesting that we also observe the backfill and compaction for the surrounding site
work, including mass grading, utilities, and flatwork subgrade preparation. Our original budget for construction
($26,480) was just a placeholder and not based on any construction schedule. Since preparing that placeholder
amount, we have received several schedules from the general contractor, with the most recent one dated January
5, 2020. Based on the durations in that schedule, we have prepared an estimate of the associated construction
observation effort. The total cost for the geotechnical construction observation effort is approximately $165,084.
We have approximately $25,000 remaining from the Fire Station 51 budget. We will adjust the budget for that
project and credit the Fire Station 52 budget.
We have received verbal authorization to perform this work and direction to bill against our current authorization.
Based on the contractor's schedule, our current authorization is not sufficient to perform both the authorized
scope and the requested additional scope. This Contract Change 3 increases our authorization to provide these
construction services.

Thank you for the opportunity to provide this additional services proposal, which is an amendment to our Original
Contract dated April 19, 2017 and revised Proposal for Civil Engineering Services dated June 26, 2018. This
proposal is to confirm our understanding of the additional scope of services and compensation for this project. We
look forward to continued work with you on this project.
Description of Additional Services
This proposal is for additional civil engineering services associated with Construction Administration for Fire
Station #52. LPD Engineering's assumed scope of services as described in our June 26, 2018 proposal includes a
pre -construction meeting, review project submittals, up to (8) site meetings and up to (8) RFI's.
Through November 27, 2019, LPD Engineering has supported construction with a number of services that are out
of our previously described scope, including responding to 52 RFI's, designing the PSE/ gas and electric route,
preparing easement exhibits, and making 6 site visits to date.
Construction commenced in Aug 2019. Construction is anticipated to complete at the end of December, 2020 (16
month construction period). As of November 27, 2019 (4 months, 25% of the construction schedule), LPD
Engineering has provided $22,690 related to the Construction Administration Task Items (Basic and CA
services). Our current budget is $22,788.
We have estimated that the contractor has completed approximately 68% of the civil related site work, and has 12
months remaining on the work schedule.
This project has required significantly more services on our part than we normally experience, including, but not
limited to the complexity of the project, sub -contractor methods, contractor methods, requirements to provide
RFI's for all communication, and Inspector requirements.

engineering consulting and drafting services on a lump sum basis. This estimate is meant to be a budget only and
is not a guaranteed maximum.
*The fees provided above will remain valid for six months from the date of this proposal.

Dear Justine:
When the design fees for this project were reconciled against the final construction cost estimate in 2018 (WAU Contract
Amendment #2), the team decided to reduce the MACC that the fee was based on in anticipation that Weinstein A+U would
not have to perform CA on the Administrative wing of the building. The bid alternate that included that work was ultimately
accepted by the Owner and Weinstein A+U is currently performing Construction Contract Administration for the entirety of
the project. This Additional Service Request reinstates that fee based on same construction cost estimate on which the
remainder of the fee was predicated, and at the same rate, as dictated by the Washington State Fee Schedule.
Please refer to the attached breakdown of the original fee revision, which has been marked up to show the corresponding
fee calculations for the deleted Administrative CA work. The total addition to our contract for this work should be $10,996.31.
We anticipate that the costs incurred for this Additional Service will be included in a Contract Amendment 7.

Community Assistance, Delay of Collection of Certain Taxes
ISSUE
Affirm interim emergency policy regarding the remittance and collection of the City's
gambling, admission and entertainment, and commercial parking taxes.
BACKGROUND
On February 29, 2020 Governor Jay Inslee declared a state of emergency regarding the
COVID-19 Pandemic, directing state agencies to use resources necessary to prepare
for and respond to the outbreak. The Mayor issued a Proclamation declaring an
emergency on March 9, 2020. The City Council affirmed the emergency declaration at
its March 16, 2020 meeting.
As result of the Pandemic, the City has closed all City buildings to the public and moved
most City functions to a virtual city hall model. In addition, the Pandemic has resulted in
the temporary closures of businesses throughout the City as well as furloughs, and
layoffs throughout the nation. Most businesses in Tukwila are closed or are working
remotely.
As result of these impacts, the Finance Department has allowed certain taxes to be
remitted late to the City. This is a reflection that some businesses may not have the
ability to file timely due to disruptions in business operations. This is also in line with
Washington State and King County, both of which are allowing certain taxes to be
remitted late due to the Pandemic.
The following outlines the temporary policies Finance has implemented regarding the
remittance of gambling, admission and entertainment, and commercial parking taxes in
the City:
1. Individuals and businesses are provided additional time to remit and report the
gambling, admission and entertainment, and commercial parking taxes. Delay in
collecting the taxes does not relieve a business from the burden of remitting the
taxes when the reopen. Businesses and other entities will need to provide the
City information in writing stating that they desire additional time to submit.
2. Late payments for non-payment after April 1, 2020 are waived through the state
of emergency. 23

3. Businesses and individuals can establish payment plans by calling the City's
Finance Department.
DISCUSSION
TMC 2.57.040 (3) requires the City Council to affirm any rules or regulations related to
the protection of life, environment, and property that are affected by the emergency.
Administration believes that these temporary policies changes are needed in order to
respond the COVID-19 pandemic to help reduce impacts for businesses.
FINANCIAL IMPACT
This would result in delayed collection of these taxes and could affect the City's cash
flow. It should be noted that in many cases the businesses collecting the tax are not
operating thus there may be minimal, if any taxes, to report and remit to the City for the
most impacted months.
RECOMMENDATION
Affirm the emergency policies provided by City Administration. Staff is requesting that
this be placed on the April 20 regular council meeting for final action.

SUBJECT: Temporary Policy to Extend the Remittance and Collection of the Gambling
Activities Tax set forth in TMC 3.08.
PURPOSE: The purpose of this policy is to temporarily extend the remittance and collection
of taxes set forth in TMC 3.08, Gambling Activities Tax (hereafter "Gambling
Tax"). This Policy will take effect on April 1, 2020 and will expire on September
30, 2020 unless otherwise terminated or extended.
SCOPE: This policy temporarily extends the remittance and collection of the first quarter
of 2020 Gambling Tax forth in TMC 3.48.
DEFINITIONS:
1. "Public Health Emergency" shall mean any such emergency declared by the Governor of
the State of Washington pursuant to his or her powers under 38.08, 38.52 and 43.06 RCW,
any such emergency declared by the King County Executive pursuant to RCW 38.52, or
the Mayor of the City of Tukwila pursuant to RCW 38.52.
2. "Gambling Tax" and "Gambling Activities Tax" shall mean the tax set forth in TMC 3.08.
POLICY:
Under TMC 3.08.080 (A), requires remittance of the gambling tax to the City on a quarterly basis,
with the tax for the first quarter (January through March) being due by April 30, 2020. As a result
of the Public Health Emergency, the City of Tukwila shall extend the time for remittance of the
first quarter tax. A person or entity shall submit an email or letter to the City requesting the
additional time and stating the reason for the need. The first quarter gambling tax to the City
shall be due no later than June 1, 2020.

As result of the Pandemic, the City has closed all City buildings to the public and moved
most City functions to a virtual city hall model. In addition, the Pandemic has resulted in
the temporary closures of businesses throughout the City and furloughs, and layoffs
throughout the nation.
Due to the economic disruptions in the community and the disruptions in City
operations, the Finance Department has adopted the following interim policy for all City
water and/or sewer accounts, both commercial and residential. These temporary
policies are consistent with policies adopted by other utility providers in the region, such
Water District 125, Seattle City Light, and Puget Sound Energy.
1. No late fees or penalties for non-payment would be incurred, effective with the
April billing.
2. Effective March 16, water shutoff for non-payment is suspended for occupied
premises. Due to concerns with potential squatting and protection of the City's
utility system, water shutoffs for vacant properties will still occur. Water Shut Off
fees incurred prior to March 16, 2020 would still be due if there is a request to
restore service.
3. Customers can establish payment plans by calling the City's Finance
Department.

DISCUSSION

The policy is one avenue that the City can do to help Tukwila community members
during the COVID-19 Pandemic. As a reminder, the policy only applies to ratepayers
within the City's water and sewer service area. Water District 125 has adopted a similar
policy, as have many other utility providers, such as Seattle Public Utilities, Puget
Sound Energy, and Tacoma Public Utilities.
FINANCIAL IMPACT
The City typically collects $2,000 in late fees per month from late payments, though it is
reasonable to assume there will be additional late fees incurred by utility customers
during the Pandemic due to employment and revenue disruption. This revenue would
be lost. Allowing delayed payments could also result in a cash flow issue for each of the
utilities.
RECOMMENDATION
Affirm the emergency policy provided by City Administration. Staff is requesting that this
item be placed on the April 20 regular council meeting for final action.

SUBJECT: Temporary Policy to Discontinue Water Shut-off for Non -Payment of Water and
Sewer Service Fees and to Discontinue the Imposition of Late Fees on Delinquent
Water and Sewer Accounts
PURPOSE: The purpose of this policy is to temporarily suspend the imposition of past -due
and late penalties on delinquent water and sewer accounts and to temporarily
discontinue the water shut-off on delinquent accounts subsequent to Governor
Inslee's February 29, 2020 Proclamation of Emergency No. 20 05 and subsequent
orders. This policy will be effective on April 1, 2020 and will expire on September
30, 2020 unless otherwise terminated or extended.
SCOPE: This policy applies to all City of Tukwila water and sewer customers.
DEFINITIONS:
1. "Public Health Emergency" shall mean any such emergency declared by the Governor of
the State of Washington pursuant to his or her powers under 38.08, 38.52 and 43.06 RCW,
any such emergency declared by the King County Executive pursuant to RCW 38.52, or
the Mayor of the City of Tukwila pursuant to RCW 38.52.
2. "Water Shut-off' shall mean any notice of water shut-off, the act of shutting -off water,
and any fees, charges, or monetary penalties associated with water shut-off and turn -on
set forth in TMC 14.04.125 and TMC 14.04.130.
3. "Late fees" shall mean any penalty, fee, or charge associated with a delinquent account
as set forth in TMC 14.04.270.

During a Public Health Emergency, the City of Tukwila shall discontinue the issuance of Shut-off
Notices for delinquent water and sewer accounts for the duration of the Public Health
Emergency. In addition, the City shall not apply Late Fees incurred after April 1 delinquent
accounts during the Public Health Emergency.
This policy does not suspend regular monthly utility charges for water and sewer service.
Customers are encouraged to continue making regular payments.

The following procedures are established to allow for community members to continue receiving
water and sewer, utility service, without penalty, during a declared Public Health Emergency.
Notification
A. The Utility Billing Division shall provide written notice of the policy herein to customers
with delinquent accounts. Such notice shall state that all past due amounts are still owed
but that late fees incurred after March 16, 2020 will be suspended, and disconnections

will be postponed for the duration of the Public Health Emergency. Water shut-off fees
for water turnoff prior to March 15 shall still be applied. In order to prevent squatting
and to protect the City's utility system, the City shall still disconnect water of properties
the City determines are vacant.
B. Within thirty (30) days of termination of the Public Health Emergency, the Finance
Director will review delinquent accounts and will work with customers to enter into
repayment plans as in the Director's discretion is appropriate as to each account.
C. Late fees and shutoff shall resume 30-days after discontinue of this temporary policy in
response to COVID-19

Last November, the City Council passed Ordinance 2619, which regulates carryout bags in
retail stores and effectively bans the distribution of single use plastic bags. The goal is for
shoppers to bring reusable bags from home in order to reduce plastics from the waste
stream. The ordinance defines retail broadly to include all types of stores in the city.
The City Council chose an effective date of September 1, 2020 to provide a nine -month
implementation phase that would allow stores to prepare by using up stock, ordering new
bags, and updating point of sale systems. Staff began an implementation and outreach plan
focusing on this 9/1/20 effective date.
In the 2020 session the Washington State Legislature passed, and Governor Inslee signed into
law, ESSB 5323, which will regulate carryout bags statewide and goes into effect January 1,
2021. The state law is essentially the same as Ordinance 2619 in that it prohibits distribution
of single -use plastic bags and requires that stores charge 8 cents for recycled paper bags or
thick plastic bags. While the state law preempts city bag bans as of January 1, 2021, the law is
written such that cities will partner with the state on education and outreach to consumers
and businesses. Cities can also receive violation complaints, which will then be forwarded on
to the Department of Ecology for enforcement.
COVID-19 Impacts
On February 29, 2020, Governor Inslee declared a state of emergency in response to the
growing numbers of COVID-19 cases, directing agencies to use all resources necessary to
prepare for and respond to the outbreak. On March 23, he issued the "Stay Home, Stay
Healthy" order, requiring everyone to stay home and closing all businesses not deemed
essential, now extended through May 4, 2020. This closure is debilitating to businesses who
must now focus on preparing to re -open when the health crisis has passed.

While grocery stores remain open, there is a health benefit to the use of clean, store -issued
bags during the health crisis. The City of Burien implemented a plastic bag ban on January 1,
2020 but suspended it for the duration of the emergency proclamation to protect the health
and safety of grocery and retail workers, as workers were concerned about handling reusable
shopping bags brought from people's homes.
DISCUSSION
Staff is seeking direction from the Council on the plastic bag ban implementation in light of a)
the upcoming state law and b) the COVID-19 emergency. Suggested options to consider are:
Option 1: Leave as is and retain the September 1, 2020 effective date. The City will have
jurisdiction for three months and then enforcement will fall to the Washington State
Department of Ecology, with the City of Tukwila partnering on consumer and business
education.
Option 2: Consider an effective date between September 1 and December 31, 2020, after
which the state law will prevail and the City partnering on outreach as described above.
Option 3: Repeal Ordinance 2619 and redirect outreach efforts on the January 1, 2021
effective date in collaboration with the State.
Staff recommends Option 3. While there is benefit to getting a three month head start toward
the greater goal of waste reduction, the COVID-19 emergency has disrupted city government
and businesses in numerous ways. The City's Economic Development staff have weighed in
to express concern with the September 1, 2020 target date, believing that businesses should
focus efforts on reducing transmission of COVID-19 and preparing for re -opening instead of
spending energy on sourcing new bags and updating point of sale systems as the long
implementation period was intended to allow. Also, many retailers have been closed and so
unable to use up existing plastic bag stock.
The City of Tukwila is striving to help its business community navigate this crisis, and this is
one step that could help in this unprecedented time. Reducing plastic bag waste is still an
extremely important goal and staff can prepare for implementation accordingly in alignment
with the State of Washington.
RECOMMENDATION
Staff is seeking Council direction on the implementation of Ordinance 2619 and may return
with a draft ordinance depending on direction given.

Coronavirus Response Update

Essential Services and City Operations
There have been no changes to essential services and City operations since the last report.
Financial Stability
There have been no changes since the last report. On Monday, April 13, 2020 Finance Department staff will
begin working with the Council's Finance Committee to determine next steps as the City identifies how it will
fully close the financial gap associated with the coronavirus pandemic.
Police StaffinLy and Calls for Service
There have been no changes to Police staffing since the last report. Calls for service are analyzed on a monthly
basis and staff will report April statistics at the end of the month.
Fire StaffinLy and Calls for Service
One operational change has been implemented in order to save an estimated $250,000 in overtime over the
course of a year. On days when there is an unscheduled absence in the fire department that results in 12
firefighters being on shift, as opposed to the usual 13 to 18, the aid unit will be put in service at Fire Station 52 in
place of the engine. Engines require a minimum of three firefighters, while an aid car is two.
Calls for emergency medical services are the highest call volume at Fire Station 52, with more than 72% of the
calls to this station being medic in nature. For reference, approximately 8% of calls are fire related, with the
remainder being a mix of false alarms and other calls. In addition, Fire Station 54's response time to the
neighborhood around Fire Station 52 is very quick and within the City's adopted goals for response times for the
Tukwila community. Fire Station 54 responds to the Old Hill neighborhood often, particularly when Fire Station
52 personnel are at trainings or covering a different area of the City for a variety of reasons.
Calls for service are analyzed on a monthly basis and staff will report April statistics at the end of the month.
Human Services
Human Services staff continue to receive calls on a regular basis and work with various partners to identify and
refer people to additional resources in the area. Additional regional efforts for rental and utility assistance are
beginning to slowly come online. Staff is currently working on a plan to distribute HB 1406 funds per the
Council's action on Monday, April 6, 2020.
Business Recovery
The Great Tukwila Carryout Campaign is currently running, with ad buys with Sound Media and South
King County media. Visit TukwilaWa.gov/Restaurants. Our digital impressions and click through rates
exceed national averages. Technology and Innovation Services Department improved the campaign by
adding an interactive map to the webpage with direct links to the restaurants. The campaign was

intended to end in conjunction with the original Stay Home order, but now that the order has been
extended staff is considering additional ad buys.
2. Economic Development and Parks and Recreation staff continue windshield surveys of businesses to
check for compliance with the Governor's closure of non -essential businesses. Staff contacts businesses
if needed to understand their business operations and inform them about the Governor's order.
3. Economic Development staff continues to stay abreast of new resources available to businesses though
internet research and participation in online meetings.
4. Economic Development staff sent an email to all businesses in the City with information on new
resources.
5. Economic Development staff has begun drafting a business recovery plan. An initial draft for review
should be available next week.
6. Economic Development staff has begun preparing a telephone survey intended to reach the majority of
Tukwila's businesses. The survey should accomplish a number of goals. The City's effort to make a
personal contact will send a positive message to the businesses. The information should help the City
understand the extent to which businesses are open, the state of their recovery plan, their prediction
for reopening and awareness of resources, needs, and interest in participating in collaborative
marketing programs. Calling should start next week. Parks and Recreation staff have offered to help
conduct the surveys.
7. Economic Development staff started work on a collaborative marketing program to encourage
consumers to purchase gift cards for future use at our local businesses. The City has identified a
marketing/PR firm to assist us with the campaign. Our target area for consumers is all of Western
Washington. Any consumer facing Tukwila businesses can participate free of charge, provided they offer
something tangible to purchase now. Several Tukwila businesses have expressed an interest in
participating and are appreciative of the City's efforts. This will move forward depending on interest
from businesses and our ability to use lodging tax funds.
Meeting our Community's Basic Needs
Food Security
City staff are in communication with a variety of partners that serve our community. The Tukwila Pantry, which
usually serves 60 — 80 households a day is reporting they are now serving approximately 500 households per
day. This is an increase from 350 included in the April 6 Coronavirus Response Report to Council. In addition,
City staff are now supporting the Pantry. Three Parks and Recreation Staff and one Community Services and
Engagement Staff are assisting the Pantry in packaging food for families as well as food distribution. The Pantry
has also requested additional staffing support from the National Guard.
Seniors
City staff again supported our senior community through direct food distribution to homebound residents. Staff
calls residents on Monday and Tuesday, to set up a Wednesday meal delivery. This week staff delivered 550 meals
to seniors (multiple meals to each individual), a significant increase from last week where approximately 250 meals
were delivered. In addition, through a partnership with the Food Innovation Network, Halal meals were delivered
this week for the first time.

Students
Technology and Innovation Services (TIS) staff report that approximately 150 of the 300 MIFI hot spots have been
distributed to Tukwila School District and Impact Public Schools 121" through 71" graders. The MIFI hot spots have
the ability to connect multiple devices. Since many of these students live in multifamily housing, it is expected
that more than 150 students are able to connect through the MIFIs.
Public Safety Plan Construction Projects

The Tukwila Scholarship Program was established in 2014. The mission of the scholarship is to provide financial assistance to individuals enrolled for
