MOVED BY BOHRER, SECONDED BY PHELPS, THAT COUNCILMAN HILL ACT AS
CHAIRMAN OF THE MEETING IN THE ABSENCE OF COUNCIL PRESIDENT HARRIS.
MOTION CARRIED.
Chairman Hill led the audience and City Council Members in the Pledge
of Allegiance and called the Committee of the Whole Meeting to
order.

(CHAIRMAN),WENDY MORGAN, DORIS PHELPS.
MAYOR GARY L. VAN DUSEN, CITY ATTORNEY DAN W00, DIRECTOR OF PUBLIC
WORKS BYRON SNEVA.
Mayor Van Dusen reported that Mrs. Regel was honored as Citizen
of the Year at a recent Chamber of Commerce event.
Mayor Van Dusen stated the Department Heads will give monthly
reports to him. They will be available for the City Council
members to read.
Mayor Van Dusen stated he received a letter from AWC announcing
a Street Transportation Planning Meeting to be held on March 23
at 2 p.m. at Central Community College. Councilman Bauch will
attend.
Mayor Van Dusen proclaimed the week of April 16 to 20, 1983 as
Planning Week.
City Attorney Dan Woo stated the judge ruled in favor of the City
in the Peden lawsuit. Another action may be brought forward.
The Allenbach suit will be discussed in Executive Session. A
trial date for April 4 has been set.
City Attorney Woo said the NAACP has filed a lawsuit stating
they own some of the property at Southcentral School District.
Dr. Frothingham has asked whether or not the City Attorney will
assist their attorneys in resolving the matter. A resolution
should be made in this matter by April 10. King County is in
process of awarding a contract and it should be resolved by that
date.
MOVED BY PHELPS, SECONDED BY DUFFIE, THAT THE CITY COUNCIL MEET
IN EXECUTIVE SESSION TO DISCUSS THE ALLENBACH LAWSUIT AND THE
NAACP LAWSUIT AT THE END OF THE MEETING. MOTION CARRIED.
City Attorney Woo said he was working on the Purchase and Sales
Agreement. Negotiations are still taking place with Miss Nelsen,
owner of the Independent Water Company.

BE ON THE AGENDA OF THE MARCH 21, 1983 REGULAR MEETING IF THE

Councilman Hill suggested there be a public hearing so people
will know about the annexation. It has been some time since it
was discussed.
MOVED BY MORGAN, SECONDED BY BOHRER, THAT ALLENTOWN ANNEXATION BE
PLACED IN THE COMMUNITY AFFAIRS COMMITTEE FOR DEVELOPMENT OF A
TIME LINE. MOTION CARRIED, WITH PHELPS AND DUFFIE VOTING NO.

Mr. Lloyd Hartong, audience, stated he had petitioned the City for
relief from Ordinance No. 1233. He stated he did not want to put
in a sidewalk because of a question regarding the elevation and
alinements. If he puts in a sidewalk now he would want to be sure
the City would pay to have it put in again if the sidewalk had to
be taken up.
MOVED BY PHELPS, NO SECOND, THAT THE MATTER BE PLACED IN THE PUBLIC
WORKS COMMITTEE. MOTION FAILED, NO SECOND.
Dan Woo, City Attorney, said the City could enter into an agreement
for the construction of a sidewalk in the future. The ordinance
gives the City Council the discretion to give a waiver of exception.
They could enter into an agreement to participate in a late LID or
put in a sidewalk at their own expense.
MOVED BY PHELPS, SECONDED BY DUFFIE, THAT ADMINISTRATION BE DIRECTED
TO MEET WITH MR. HARTONG ON THIS MATTER AND REPORT BACK TO THE
CITY COUNCIL WITH RECOMMENDATION OF ACTION. MOTION CARRIED.

The Committee of the Whole Meeting was called back to order by
Chairman Hill, with Council Members present as previously listed.
Mayor Van Dusen suggested a coupon be issued to residents of the
City to be used as a free pass at the Tukwila Transfer Station
on certain days for dumping residential trash.
MOVED BY BAUCH, SECONDED BY DUFFIE, THAT THE COUNCIL CONCUR WITH
MAYOR VAN DUSEN'S RECOMMENDATION. MOTION CARRIED.
MOVED BY PHELPS, SECONDED BY BOHRER, THAT THE PROPOSED RESOLUTION BE
PLACED ON A SPECIAL MEETING AGENDA ON MARCH 28, 1983.
Ted Finkus, audience, said he felt the City should not go to the
expense of an election if they are not going to change the form of
government.
Mayor Van Dusen explained the Council /Manager and Council /Mayor form
of government.
Council Members expressed their opinions and observations regarding
the type of City government they prefer.

MOVED BY BOHRER, SECONDED BY PHELPS, THAT THE CITY ATTORNEY BE
DIRECTED TO PREPARE A RESOLUTION TO GO WITH THE PROPOSED RESOLUTION
TO DESIGNATE IF THE COUNCIL CHOOSES TO PUT THE MATTER ON THE BALLOT
THAT THE PEOPLE VOTE FOR THE CHAIRMAN OF THE COUNCIL. MOTION CARRIED,
WITH DUFFIE VOTING NO.
