Mayor Van Dusen led the Pledge of Alligiance and called the
Regular Meeting of the Tukwila City Council to order at 7:30 P.M.

Mayor Van Dusen reported that the Independent Water Company
purchase agreement is not ready for execution so he pulled
Item 8a from the agenda.

Councilman Bauch requested that Voucher No. 14311 be removed
from payment. It deals with a computer program purchased out
of the Police Department Supplies Budget, he asked for an
explanation. Councilman Bohrer asked to have Vouchers No.
14377, 14382, and 14385 withdrawn. They are for eyeglasses
and they seem unreasonably large. He asked for research on
the acceptable charges under the LEOFF I statute and if there
is any action that can be taken to limit the expenditures.

WITHDRAWN FROM PAYMENT UNTIL A REPORT CAN BE PREPARED.

Councilman Bauch reported that water rates were discussed by
both the Finance Committee and Public Works Committee. It was
recommended that a Public Hearing be held to receive input
from the citizens and business community.

DATE FOR A PUBLIC HEARING ON WATER RATES.

Attorney Woo said federal and state laws require a Municipality
to adopt a lengthy series of procedures and policies where any
land is taken or relocation required. The "T" Line Bridge
Project involves relocation and land acquisition. The purpose
of this resolution is to comply with the laws by allowing the
City to contract either with the State or with an agency
approved by the State to do the acquisition and relocation
requirements set forth. The resolution requires that any
contract must go to the Council for review and approval.
MOVED BY HILL, SECONDED BY BAUCH, THAT THE PROPOSED RESOLUTION
BE READ BY TITLE ONLY. MOTION CARRIED.
A Resolution of the City of Tukwila, Washington, allowing the
Mayor, through the Public Works Director, to obtain a Contract
for "T" Line Bridge Acquisition Services conforming to Federal
and State laws and regulations, providing that no contract may
be executed until review and approval, if any, by the City Council.

Mayor Van Dusen reported on the break of the water line that
serves Southcenter South. It has been determined that, because
of the timeline, it should be declared an emergency and the
City should proceed with the repair.
Mr. Sneva reviewed a report explaining the circumstances that
dictate the need to declare an emergency for the repair or
replacement of the broken water main in the Green River at
South 180th. The City of Kent is now serving the Southcenter
South area through an intertie line with Tukwila's system.
They have notified Tukwila of concern for their inability
to supply water after June 1983 due to their limitations
during the dry season. Further, the Fire Chief has reported
that the present situation is not providing adequate fire -flow
capacity. A fire of any significance would have the ability
to over -run the protection expected from a sprinkler system.
There are other alternatives to get water to the area besides
repairing or replacing the line in the river. An over land
line could be installed or a line could be hung from a pe-
destrian bridge. If an emergency is declared a utility bridge
could be built somewhere in the vicinity of the existing
crossing and it could be operational by July 1, 1983.
Mayor Van Dusen noted that a foot bridge is not part of the
emergency but discussion on it may help Council make a decision
on what route to use to solve this problem.

Don Williams, Recreation Director, showed some aerial photographs
and explained the current proposal for a trail system with a
foot bridge over the Green River to link with the Kent Trail
System. Along the east side of the river the City has a 30
foot trail easement. At the present time Christensen Trail ends
at So. 180th and the proposal is to continue it under the end of the
Frank Zepp Bridge and along the west bank of the river to a
point where it is feasable to build a foot bridge linking the
east and west side trails. At the present time there are no
Recreation grants available.
Mr. Sneva showed a sketch of a laminated arch bridge that could
be used for recreation purposes. It would be about 200 feet
long by 8 feet wide and would accomodate the utilities. The
bridge alonewould cost $63,000, not including construction.
Brad Collins, Planning Director, explained the permit process
and said that in case of an emergency for utilities the permit
process may be expedited. He noted that the goals and policies
of the Shoreline Master Program does support the idea of a
pedestrian bridge across the river. In order to proceed ahead
with a combination utility and recreation bridge the declaration
of an emergency is important. If an Enviroment Impact Statement
is required it would cause a lengthy delay in the project. The
SEPA Guidlines make some provisions for emergencies.
Attorney Woo said it is his opinion that because of great harm
to the public from fire and loss of use of water to this area
a bridge providing for the water and sewer line would fall under
the emergency construction exemption of the Shoreline Management
Act. However, the Department of Enviroment may not agree.

Attorney Woo read, a Resolution of the City of Tukwila, Washington,
declaring an emergency and authorizing the mayor to take immediate
action to have the ruptured water line serving Southcenter South
repaired.

PARAGRAPH IN THE MAIN BODY BE AMENDED BY ADDING "OR REPLACE"
AFTER "REPAIR" AS SUGGESTED BY ATTORNEY W00.
MOVED BY BOHRER, SECONDED BY HILL, THAT THE RESOLUTION BE
AMENDED TO ADD "SUPPORTED BY A PEDESTRIAN BRIDGE" TO THE END
OF THE FIRST PARAGRAPH OF THE MAIN BODY AFTER THE WORD "SEWER
MAINS"
Councilman Bohrer drew a financial table on the black board

Councilman Bohrer suggested that this illustrates a rational for
apportioning costs between Water, Sewer and Recreation.
Councilman Bauch said this project is restoring some respect to
our portion of the river. It is taking a potential for pollution
out of the river and is giving the river back to the people.

Christensen Trail System.

MOVED BY BOHRER, SECONDED BY BAUCH, THAT THE SECOND PARAGRAPH IN
THE MAIN BODY OF THE RESOLUTION BE AMENDED TO READ "THE CITY COUNCIL
MAKES THIS DECLARATION BASED ON THE UNDERSTANDING THAT THE EXPENDITURE
WILL NOT EXCEED $150,000 MOTION CARRIED.
MOTION CARRIED to adopt the Resolution as amended.
MOVED BY BAUCH,SECONDED BY HILL, THAT COUNCIL TAKE A FIVE MINUTE
RECESS. MOTION CARRIED.
Councilman Bauch said Public Works Committee recommended that an
outright grant be made from the Sewer Fund to the Water Fund to
pay for the Water System Capital Improvements. He said the
Finance Committee has a proposed policy recommendation, also
approved by the Public Works Committee, that the Council will
establish depreciation and fund it at budget time. The Finance
Director endorses this policy.
MOVED BY BAUCH, SECONDED BY BOHRER, THAT COUNCIL SPLIT THE
FUNDING ONE -THIRD TO SEWER, ONE -THIRD TO WATER, AND ONE -THIRD
TO RECREATION. MOTION CARRIED WITH HILL VOTING NO. Councilman
Hill said he wanted all seven Council Members to discuss this.

Mayor Van Dusen called the Regular Meeting back to order with four
Council Members present.
Mayor Van Dusen explained that there is no money in the Water Fund
so an alternate source is needed to fund the capital improvement
projects.
Councilman Bohrer, going back to the water line repair, said there
are three uses for the proposed bridges, the water and sewer utilities
will use it and it is going to be used as a recreation facility.
Let the Sewer Fund give a one time grant to the Water Fund for its
share, then a decision will have to be made on how to fund the
recreation share.
MOVED BY BAUCH, SECONDED BY HILL, THAT COUNCIL ESTABLISH THE POLICY
THAT EFFORT WILL BE MADE TO EXCHANGE RIGHT -OF -WAY OF MAULE AVENUE
FOR A STRIP ALONG INTERURBAN AVENUE.
MOTION CARRIED. Council requested a Resolution be drawn stating
this policy.
MOVED BY MORGAN, SECONDED BY HILL, THAT COUNCIL GO INTO EXECUTIVE
SESSION. MOTION CARRIED.
Executive Session called by the City Attorney to discuss the
NAACP Lawsuit.
MOVED BY BAUCH, SECONDED BY HILL, THAT THE EXECUTIVE SESSION BE
CLOSED. MOTION CARRIED.
MOVED BY HILL SECONDED BY BAUCH, THAT THE REGULAR MEETING OF THE
TUKWILA CITY COUNCIL ADJOURN. MOTION CARRIED.
