Res. establishing policy to exchange the Maule Ave. right -of -way for an equal strip along Interurban Ave. TUKWILA CITY COUNCIL SPECIAL MEETING MINUTES City Hall The Special Meeting of the Tukwila City Council was called to order by Mayor Van Dusen. EDGAR D. BAUCH, L. C. BOHRER, JOE H. DUFFIE, MABEL J. HARRIS (COUNCIL PRESIDENT), GEORGE D. HILL, WENDY MORGAN. MAXINE ANDERSON (CITY CLERK), ALAN DOERSCHEL (FINANCE DIRECTOR), TED FREEMIRE (PUBLIC WORKS MAINTENANCE SUPERINTENDENT), PAT LOWERY (POLICE CHIEF), BYRON SNEVA (DIRECTOR OF PUBLIC WORKS), DAN WOO (CITY ATTORNEY). Mayor said a change in title should be made. The title should read: Resolution 854 of the City of Tukwila, Washington establishing a policy to exchange the Maule Avenue right -of -way for a strip of equal width along Interurban Avenue. The wording in the sixth paragraph should be changed to reflect the change in the title. MOVED BY HILL, SECONDED BY HARRIS, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. The City Attorney read a resolution of the City of Tukwila, Washington, establishing a policy to exchange the Maule Avenue right -of -way for an equal strip along Interurban Avenue by title only. MOVED BY HILL, SECONDED BY DUFFIE, THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. MOTION CARRIED. Approval of resubmitted MOVED BY BAUCH, SECONDED BY HILL, THAT THE RESUBMITTED VOUCHERS vouchers. NOS. 14414 THROUGH 14416 TOTALING $330.87 BE APPROVED AS PRESENTED.* Prop. Res. authorizing Mayor to negotiate execute agreement to purchase assets of Independent Water Co. Councilman Bauch said the matter of limiting eye care to $100 has been taken to the Firemen's Board. The guide for non -union employees is $100. He suggested a policy be adopted by the City setting the eye care fee at $100. *MOTION CARRIED. MOVED BY BAUCH, SECONDED BY BOHRER, THAT A RESOLUTION ESTABLISHING THE $100 FEE ON EYE CARE BE PRESENTED FOR CONSIDERATION AT THE NEXT MEETING OF THE CITY COUNCIL. MOTION CARRIED. MOVED BY HILL, SECONDED BY HARRIS, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. The City Attorney read a resolution of the City of Tukwila, Washington, authorizing the Mayor to negotiate and execute an agreement to purchase the assets of the Independent Water Company by title only. MOVED BY HARRIS, SECONDED BY HILL, THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. City Attorney Woo said July 1 at 1:30 p.m. is the effective date of the purchase. Councilman Bohrer said he would like to see Mr. Pain's (Attorney for Ms. Nelsen) letter of March 18, 1983 which is referenced in Attorney Carlson's letter dated March 21, 1983 and refers to changes requested by Mr. Pain. *MOVED BY BOHRER, SECONDED BY HARRIS, THAT THE PROPOSED RESOLUTION BE PRESENTED AT THE FIRST REGULAR MEETING. ROLL CALL VOTE: HILL, DUFFIE, BAUCH VOTING NO; BOHRER, HARRIS, MORGAN VOTING YES; MAYOR VAN DUSEN VOTED YES TO BREAK THE TIE VOTE. MOTION CARRIED. TUKWILA CITY COUNCIL SPECIAL MEETING March 28, 1983 Page 2 Prop. Resolution 855 proposing abandonment of its current plan of govt. adoption of Council Manager form of govt. Prop. Res. requesting County Auditor to call Spec. Election to consider the issue of whether the City Should adopt a new form of govt. Prop. Resolution 856 requesting Co. Auditor to place on ballot of 5- -18 -83 Spec. Election, on an advisory basis only, the question of whether the voters shall, under Council Manager form of govt., vote directly for Mayor. Prop. Res. requesting Co. Auditor to place on ballot of 5 -17 -83 Spec. Elec. an Advi- sory question of whether under the Council Mayor form of Govt. a full -time salaried Mayor should be employed. ,3f7 MOVED BY HARRIS, SECONDED BY MORGAN, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED, WITH HILL AND DUFFIE VOTING NO. City Attorney Woo read a resolution of the City of Tuwila, Washing- ton proposing abandonment of its current plan of government, and adoption of the Council Manager form of government by title only. MOVED BY HARRIS, SECONDED BY BOHRER, THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. ROLL CALL VOTE: HILL, DUFFIE, BAUCH VOTING NO; BOHRER, HARRIS, MORGAN VOTING YES. TIE VOTE. City Attorney Woo said the legal opinion is that in case of a tie vote on a resolution pertaining to the mayor's office, the Mayor can vote to break the tie. MAYOR VAN DUSEN VOTED YES. MOTION CARRIED. Councilman Morgan said a vote of yes on the foregoing resolution does not mean that individual is necessarily in favor of the Council Manager form of government. It means this will give the citizens the opportunity to vote for the type of government they would like. MOVED BY HARRIS, SECONDED BY MORGAN, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED, WITH DUFFIE AND BAUCH VOTING NO. City Attorney Woo read a resolution of the City of Tukwila, Washington requesting the County Auditor to call a special election to consider the issue of whether the City should adopt a new foam of government by title only. MOVED BY HARRIS, SECONDED BY BOHRER, THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. ROLL CALL VOTE: HILL, DUFFIE, BAUCH VOTING NO; BOHRER, HARRIS, MORGAN VOTING YES. TIE VOTE. MAYOR VAN DUSEN VOTED YES TO BREAK THE TIE VOTE. MOTION CARRIED. Councilman Bohrer said it is his opinion that if the Council Manager form of government is adopted the new City Council can put this matter on the ballot. He felt the issue on the ballot should be a simple one. MOVED BY BOHRER, SECONDED BY HARRIS, THAT FURTHER CONSIDERATION OF THE PROPOSED RESOLUTION BE FOREGONE AND COUNCIL PROCEED TO THE NEXT ITEM ON THE AGENDA. MOTION CARRIED. MOVED BY HILL, SECONDED BY DUFFIE, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Woo read a resolution of the City of Tukwila, Washington requesting the County Auditor to place on the ballot of the May 17, 1983 Special Election, an advisory question of whether, under the Council -Mayor form of government, a full -time, salaried Mayor should be employed by title only. MOVED BY HILL, SECONDED BY DUFFIE, THAT THE RESOLUTION BE ADOP AS READ. Councilman Bohrer said this is a decision the City Council should make. By putting this item on the ballot it will confuse the issue. This is a budgetary item. Mayor Van Dusen said he had asked to have this put on the agenda. The discussion of a full -time mayor has been an ever present question of what do the people want. It would not take away from the power of the City Council. It is an advisory matter. *MOTION FAILED.
