SUBJECT: Appointment to Public Safety Bond Financial Oversight Committee
DISCUSSION
Pursuant to Ordinance No. 2509, the City Council established a Public Safety Bond Financial
Oversight Committee to independently represent taxpayers concerning the City's
expenditure of revenues received from the sale of general obligation bonds. On October 3,
2016 the City Council adopted a Charter for the Public Safety Bond Financial Oversight
Committee which established a membership of five individuals to be appointed by the City
Council and requires meetings no fewer than twice per year.
Positions #1(resident) became vacant on April 1, 2020 and the incumbent decided not to
reapply. Ms. McConnell submitted an application on June 9, 2020.
Position terms now run through December 31 of the expiration year to match the other City
boards and commissions and to align with the timing of the Public Safety Bond Financial
Oversight Committee's timing of its election of Chair and Vice -Chair, which is intended to
occur at the first meeting of each calendar year.
The Financial Oversight Committee was planning to meet on March 24, 2020, but the meeting
was postponed as part of the City's response to COVID-19 public health concerns. Staff is
preparing to get a virtual meeting on the calendar and would like to have the vacancy filled so
the individual can participate.
Recommendation
Staff is seeking a Committee recommendation on the application, and if approved, it will be
placed on the July 6 Regular Meeting agenda.

In my role as a Product Manager; I need to have a clear understanding of Financial data, Financial
market analysts and Financial targets.
I have served on Long Range Business Planning team for Boeing. This is our yearly event of
planning and to have appropriate budget in place for the following year.

I have volunteered as a basketball coach for the Tukwila Community Center on/off since 1995.
Through my employer (Boeing) I have organized events during the Holiday season such as; Adopt
a Family, Create and Deliver Stuffed Stockings and provide meals.
I organize the annual "The Presley Project." I gather friends and community together to create
no -sew blankets and donate to local hospitals. We donate roughly 100 blankets each year during
the holiday season.
Organized the Black Lives Matter March on June 7th at Tukwila Community Center.
Hobbies/Interests:
Exercising; Running, CrossFit and Kickboxing
Organizing community events such as; All High School Alumni gatherings, Black Lives Matter
Marches and The Presley Project.

I was born and raised in Tukwila. I am the youngest of 9 and we are all Foster High School
graduates. My oldest daughter graduated from Foster in 2019. 1 have one daughter enrolled at
Showalter Middle School and one daughter enrolled at Tukwila Elementary school.
I believe my history with the community and qualifications for this open position will serve Tukwila
well.

SUBJECT: An update on House Bill (HB) 1923: Transit Oriented Development Housing
Strategies Plan, Scope of Work, and Contract
ISSUE
Staff is seeking Council approval to authorize the Mayor to sign a professional services contract
with ECONorthwest for $80,000 to prepare Tukwila's Transit Oriented Development (TOD)
Housing Strategies Plan. A grant from the WA Department of Commerce through HB 1923 will
be used to fund the work.
BACKGROUND
The State legislature passed HB 1923 providing $5 million in grant opportunities to increase
residential building capacity in Washington communities with awards up to $100,000 per
jurisdiction. The goal of a housing plan developed using this funding source "must be to
encourage construction of additional affordable and market rate housing in a greater variety of
housing types and at prices that are accessible to a greater variety of incomes, including
strategies aimed at the for -profit single-family home market."
Staff applied for the grant at the end of September 2019 after receiving approval to move
forward by the Community Development and Neighborhoods (CDN) Committee, and the City
was awarded the full $100,000. Council approved and authorized the Mayor to sign an
Interagency Agreement with the WA Department of Commerce to accept grant funding at the
December 2, 2019 Regular Meeting.
Tukwila's scope of work with WA Dept. of Commerce outlines how the $100,000 in grant funds
is allocated:
$20,000 - Preparing a sub -regional framework, which will help cities understand the
housing stock and housing needs in south king county. This portion of the grant award
will be pooled with Auburn, Burien, Federal Way, Kent, and Renton, and each City is
contributing grant funds towards this effort.
$80,000 - Funding the TOD Housing Strategies Plan for Tukwila:
o review and evaluation of the Tukwila's existing housing documents
o an assessment of barriers and strategies to encourage higher density
development in the TOD zone (see attached Figure 1)
o consideration of strategies to minimize displacement in the TOD zone
o a robust public engagement process throughout the planning effort
o and the incorporation of findings into a Transit -Oriented Development Housing
Strategies Plan

DISCUSSION
ECONorthwest was selected to prepare the TOD Housing Strategies Plan for Tukwila within
areas one-half mile from the Tukwila International Boulevard Station. The following summarizes
the draft scope of work for the project contained in the attached contract for services with
ECONorthwest:
• Task 1: Public Involvement to Shape and Inform Proposed Strategies
o Building on the established community vision, and housing work done in 2017,
conduct outreach to local apartment owners, developers, real estate agents,
nonprofit housing advocates, and local community and religious groups about
housing barriers and opportunities.
o Community outreach will take a variety of forms in order to best capture
representative feedback.
o Create outreach and education materials.
Task 2: Assessment & Housing Policy Framework
o The assessment task will evaluate and summarize all available goals, policies,
and data that impacts the TIB station area. The assessment task will also
summarize an evaluation of zoning, development standards, and design
standards to identify barriers to supporting TOD, accommodating future growth,
and realizing community identified outcomes. The Housing Policy Framework will
identify policy, regulatory, and program interventions to advance the City goals
and community desired outcomes of the TIB station area.
• Task 3: Opportunities, Barriers, and Displacement Mitigation report
o This task will identify policy, regulatory, and program strategies to advance the
City goals and community desired outcomes of the TIB station area, including
strategies to mitigate displacement that might occur from new development in the
area.
• Task 4: Transit -Oriented Development Housing Strategies Plan
o This task will summarize all work from previous tasks in a final Transit -Oriented
Development Housing Strategies Plan for the TIB station area. This strategy will
include recommendations that advance City and community goals for increased
residential development, enhanced community stability, and growth
accommodation in the TIB station area. This strategy can serve as a roadmap for
the City of Tukwila to identify a clear path forward to implement the goals and
policies in the Housing Element and the Comprehensive Plan.
o The plan must obtain City Council approval by April 2021.
FINANCIAL IMPACT
Grant funded. No financial match needed. Staff time will be needed to manage the grant.
RECOMMENDATION
Forward this item directly to the Consent Agenda of the July 6, 2020 Regular Meeting. This
action will authorize the Mayor to sign a Professional Services Agreement with ECONorthwest
through June 2021 for $80,000 to fund the preparation of the TOD Housing Strategies Plan.

PROFESSIONAL SERVICES AGREEMENT
(Includes consultants, architects, engineers, accountants, and other professional services)
THIS AGREEMENT is entered into between the City of Tukwila, Washington, hereinafter
referred to as "the City", and ECONorthwest, hereinafter referred to as "the Consultant", in
consideration of the mutual benefits, terms, and conditions hereinafter specified.
1. Project Designation. The Consultant is retained by the City to perform planning services in
connection with the project titled Transit -Oriented Development Housing Strategies Plan.
2. Scope of Services. The Consultant agrees to perform the services, identified on Exhibit "A"
attached hereto, including the provision of all labor, materials, equipment and supplies.
3. Duration of Agreement; Time for Performance. This Agreement shall be in full force and
effect for a period commencing upon execution and ending June 30, 2021, unless sooner
terminated under the provisions hereinafter specified. Work under this Agreement shall
commence upon written notice by the City to the Consultant to proceed. The Consultant
shall perform all services and provide all work product required pursuant to this Agreement
no later than June 30, 2021 unless an extension of such time is granted in writing by the City.
4. Payment. The Consultant shall be paid by the City for completed work and for services
rendered under this Agreement as follows:
A. Payment for the work provided by the Consultant shall be made as provided on Exhibit
"B" attached hereto, provided that the total amount of payment to the Consultant shall
not exceed $80,000 without express written modification of the Agreement signed by the
City.
B. The Consultant may submit vouchers to the City following the acceptance of each
deliverable by the Department of Commerce. Such vouchers will be checked by the City
and, upon approval thereof, payment shall be made to the Consultant in the amount
approved. Deliverables and invoices from the City shall be submitted to Commerce for
acceptance and grant payment not more often than quarterly. Payment to Consultant will
consequently similarly be not more often than quarterly.
C. Final payment of any balance due the Consultant of the total contract price earned will
be made promptly upon its ascertainment and verification by the City after the
completion of the work under this Agreement and its acceptance by the City.
D. Payment as provided in this section shall be full compensation for work performed,
services rendered, and for all materials, supplies, equipment and incidentals necessary
to complete the work.
E. The Consultant's records and accounts pertaining to this Agreement are to be kept
available for inspection by representatives of the City and the state of Washington for a
period of three (3) years after final payments. Copies shall be made available upon
request.

5. Ownership and Use of Documents. All documents, drawings, specifications and other
materials produced by the Consultant in connection with the services rendered under this
Agreement shall be the property of the City whether the project for which they are made is
executed or not. The Consultant shall be permitted to retain copies, including reproducible
copies, of drawings and specifications for information, reference and use in connection with
the Consultant's endeavors. The Consultant shall not be responsible for any use of the said
documents, drawings, specifications or other materials by the City on any project other than
the project specified in this Agreement.
6. Compliance with Laws. The Consultant shall, in performing the services contemplated by
this Agreement, faithfully observe and comply with all federal, state, and local laws,
ordinances and regulations, applicable to the services rendered under this Agreement.
7. Indemnification. The Consultant shall defend, indemnify and hold the City, its officers,
officials, employees and volunteers harmless from any and all claims, injuries, damages,
losses or suits including attorney fees, arising out of or resulting from the acts, errors or
omissions of the Consultant in performance of this Agreement, except for injuries and
damages caused by the sole negligence of the City.
Should a court of competent jurisdiction determine that this Agreement is subject to RCW
4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or
damages to property caused by or resulting from the concurrent negligence of the Consultant
and the City, its officers, officials, employees, and volunteers, the Consultant's liability
hereunder shall be only to the extent of the Consultant's negligence. It is further specifically
and expressly understood that the indemnification provided herein constitutes the
Consultant's waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the
purposes of this indemnification. This waiver has been mutually negotiated by the parties.
The provisions of this section shall survive the expiration or termination of this Agreement.
8. Insurance. The Consultant shall procure and maintain for the duration of the Agreement,
insurance against claims for injuries to persons or damage to property which may arise from
or in connection with the performance of the work hereunder by the Consultant, its agents,
representatives, or employees. Consultant's maintenance of insurance as required by the
agreement shall not be construed to limit the liability of the Consultant to the coverage
provided by such insurance, or otherwise limit the City's recourse to any remedy available at
law or in equity.
A. Minimum Amounts and Scope of Insurance. Consultant shall obtain insurance of the
types and with the limits described below:
1. Automobile Liability insurance with a minimum combined single limit for bodily
injury and property damage of $1,000,000 per accident. Automobile Liability
insurance shall cover all owned, non -owned, hired and leased vehicles.
Coverage shall be written on Insurance Services Office (ISO) form CA 00 01 or a
substitute form providing equivalent liability coverage. If necessary, the policy
shall be endorsed to provide contractual liability coverage.
2. Commercial General Liability insurance with limits no less than $12,000,000 each
occurrence, $2,000,000 general aggregate. Commercial General Liability
insurance shall be at least as broad as ISO occurrence form CG 00 01 and shall
cover liability arising from premises, operations, stop -gap independent contractors
and personal injury and advertising injury. The City shall be named as an
additional insured under the Consultant's Commercial General Liability insurance
policy with respect to the work performed for the City using an additional insured
endorsement at least as broad as ISO endorsement form CG 20 26.

3. Workers' Compensation coverage as required by the Industrial Insurance laws of
the State of Washington.
4. Professional Liability with limits no less than $2,000,000 per claim and $2,000,000
policy aggregate limit. Professional Liability insurance shall be appropriate to the
Consultant's profession.
5. Excess Umbrella habili . policy with limits of $5,000,000 per occurrence and in
the auureuate.
4.6. Franchisee may use any combination of primary and excess coverage to meet
required total limits.
B. Public Entity Full Availability of Contractor Limits. If the Contractor maintains higher
insurance limits than the minimums shown above, the Public Entity shall be insured for
the full available limits of Commercial General and Excess or Umbrella liability
maintained by the Contractor, irrespective of whether such limits maintained by the
Contractor are greater than those required by this Contract or whether any certificate of
insurance furnished to the Public Entity evidences limits of liability lower than those
maintained by the Contractor.
C. Other Insurance Provision. The Consultant's Automobile Liability and Commercial
General Liability insurance policies are to contain, or be endorsed to contain that they
shall be primary insurance with respect to the City. Any Insurance, self-insurance, or
insurance pool coverage maintained by the City shall be excess of the Consultant's
insurance and shall not be contributed or combined with it.
D. Acceptability of Insurers. Insurance is to be placed with insurers with a current A.M.
Best rating of not less than A:VII.
E. Verification of Coverage. Consultant shall furnish the City with original certificates and
a copy of the amendatory endorsements, including but not necessarily limited to the
additional insured endorsement, evidencing the insurance requirements of the Contractor
before commencement of the work. Upon request by the City, the Consultant shall
furnish certified copies of all required insurance policies, including endorsements,
required in this Agreement and evidence of all subcontractors' coverage.
F. Notice of Cancellation. The Consultant shall provide the City with written notice of any
policy cancellation, within two business days of their receipt of such notice.
G. Failure to Maintain Insurance. Failure on the part of the Consultant to maintain the
insurance as required shall constitute a material breach of contract, upon which the City
may, after giving five business days notice to the Consultant to correct the breach,
immediately terminate the contract or, at its discretion, procure or renew such insurance
and pay any and all premiums in connection therewith, with any sums so expended to be
repaid to the City on demand, or at the sole discretion of the City, offset against funds
due the Consultant from the City.
9. Independent Contractor. The Consultant and the City agree that the Consultant is an
independent contractor with respect to the services provided pursuant to this Agreement.
Nothing in this Agreement shall be considered to create the relationship of employer and
employee between the parties hereto. Neither the Consultant nor any employee of the
Consultant shall be entitled to any benefits accorded City employees by virtue of the services
provided under this Agreement. The City shall not be responsible for withholding or
otherwise deducting federal income tax or social security or for contributing to the state
industrial insurance program, otherwise assuming the duties of an employer with respect to
the Consultant, or any employee of the Consultant.

10. Covenant Against Contingent Fees. The Consultant warrants that he has not employed or
retained any company or person, other than a bonafide employee working solely for the
Consultant, to solicit or secure this contract, and that he has not paid or agreed to pay any
company or person, other than a bonafide employee working solely for the Consultant, any
fee, commission, percentage, brokerage fee, gifts, or any other consideration contingent
upon or resulting from the award or making of this contract. For breach or violation of this
warrant, the City shall have the right to annul this contract without liability, or in its discretion
to deduct from the contract price or consideration, or otherwise recover, the full amount of
such fee, commission, percentage, brokerage fee, gift, or contingent fee.
11. Discrimination Prohibited. Contractor, with regard to the work performed by it under this
Agreement, will not discriminate on the grounds of race, religion, creed, color, national origin,
age, veteran status, sex, sexual orientation, gender identity, marital status, political affiliation,
the presence of any disability, or any other protected class status under state or federal law,
in the selection and retention of employees or procurement of materials or supplies.
12. Assignment. The Consultant shall not sublet or assign any of the services covered by this
Agreement without the express written consent of the City.
13. Non -Waiver. Waiver by the City of any provision of this Agreement or any time limitation
provided for in this Agreement shall not constitute a waiver of any other provision.
14. Termination.
A. The City reserves the right to terminate this Agreement at any time by giving ten (10)
days written notice to the Consultant.
B. In the event of the death of a member, partner or officer of the Consultant, or any of its
supervisory personnel assigned to the project, the surviving members of the Consultant
hereby agree to complete the work under the terms of this Agreement, if requested to do
so by the City. This section shall not be a bar to renegotiations of this Agreement
between surviving members of the Consultant and the City, if the City so chooses.
15. Applicable Law; Venue; Attorney's Fees. This Agreement shall be subject to, and the
Consultant shall at all times comply with, all applicable federal, state and local laws,
regulations, and rules, including the provisions of the City of Tukwila Municipal Code and
ordinances of the City of Tukwila. In the event any suit, arbitration, or other proceeding is
instituted to enforce any term of this Agreement, the parties specifically understand and
agree that venue shall be properly laid in King County, Washington. The prevailing party in
any such action shall be entitled to its attorney's fees and costs of suit. Venue for any action
arising from or related to this Agreement shall be exclusively in King County Superior Court.
16. Severability and Survival. If any term, condition or provision of this Agreement is declared
void or unenforceable or limited in its application or effect, such event shall not affect any
other provisions hereof and all other provisions shall remain fully enforceable. The
provisions of this Agreement, which by their sense and context are reasonably intended to
survive the completion, expiration or cancellation of this Agreement, shall survive termination
of this Agreement.

Task 1: Public Involvement to Shape and Inform Proposed Strategies
• Building on the established community vision, and work done in 2017, conduct outreach to local
apartment owners, developers, real estate agents, nonprofit housing advocates, and local
community and religious groups about housing barriers and opportunities.
• Community outreach will take a variety of forms, in order to best capture representative feedback.
Options include:
o Online/written surveys
o One-on-one interviews
o Focus groups
o Public meeting in TIB community
Create outreach and education materials for the groups mentioned above as well as for City Council.
o Includes content for website.
o City of Tukwila will provide support for translation/interpretation for materials and meetings.

community identified outcomes. The Housing Policy Framework will identify policy, regulatory, and program
interventions to advance the City goals and community desired outcomes of the TIB station area.
Specific actions in this task include:
• Review and evaluate available data, goals and policies on the TIB area, including:
o Tukwila's Comprehensive Plan Elements and Background Reports on Housing and the
Tukwila International Boulevard District
o PSRC's Growing Transit Communities document about the Tukwila International Boulevard
transit community.

Review and evaluate existing and proposed zoning, development standards, and design standards
o Assess existing and proposed development standards, including recreation space and parking
requirements for multifamily development.
o Review draft zoning code revisions prepared by Placemakers for the TIB area.
o Evaluate existing and proposed multifamily design guidelines and suggest revisions that lead
to better placemaking and outcomes for community members.
Review and evaluate existing development incentives
o Document and assess the effectiveness of the current tools and incentives the City uses to

o Tools and strategies to preservation of existing affordable housing and the development of
new rent -regulated affordable housing.

BACKGROUND
The Small Drainage Program constructs drainage projects throughout the City that are too large for city
staff to complete but are smaller than a typical capital improvement project. The 2018 Annual Small
Drainage Program provided drainage improvements at seven locations:
1) Tukwila Int'I Blvd —Pipe abandonment 5) S 180t" St — Catch basin retrofit
2) Interurban Ave S — Catch basin retrofits 6) S 180t" St Abutment Wall — Levee repair
3) Strander Blvd Bridge — Levee drainage repair 7) Todd Blvd — Catch basin retrofit
4) Gilliam Creek Flap Gate — Outfall maintenance access
DISCUSSION
The Notice to Proceed for Contract Number 18-127 with Ceccanti, Inc. of Tacoma, WA was issued on
September 19, 2018 and construction was physically completed on April 12, 2019. The final affidavits of
Wages Paid were received in April 2020.
FINANCIAL IMPACT
The 2018 construction budget was $600,000, which included a 10% contingency. King County Flood Control
District contributed $65,378 to the project. The original contract amount was $543,836.40, and one change
order was executed for $48,957.66. Retainage is being held by the City in the amount of $26,830.47.

Staff provided an update on the PW Fleet & Facilities tenant improvements at 60% design,

design timeline has been slightly affected from COVID-19, but is currently scheduled to
return to Committee with 90% design in August 2020.

Coronavirus Response Update
July 6, 2020
Essential Services and City Operations
There are no changes to essential services or City operations since the last report.
The City is continuing to refine a reopening plan corresponding with the State's "Safe Start" phased approach to
reopening the state. It should be noted that only in Phase 3 do they recommend re -opening customer -facing
government services, and even at that time telework is still strongly encouraged for non -customer facing
positions.
Financial Stability
At the May 18 City Council meeting the Council approved various measures for the mayor to implement to
address the revenue shortfalls associated with the coronavirus pandemic. The Council continues to receive
regular updates on the implementation of the financial measures associated with the coronavirus pandemic.
Police Staffing and Calls for Service
There have been no changes to Police staffing since the last report.
Fire StaffinE and Calls for Service
There have been no changes to Fire staffing since the last report.
Human Services
Human Services continue to serve Tukwila residents at a higher than normal rate. Staff has begun providing
rental and utility assistance to residents for the month of July and continues to work with local partners to

Business Recovery
Business Re -Openings
As of June 30, King County continues in Phase 2 of Washington's "Safe Start" four phase business reopening
plan. Nearly all types of business activities are allowed but some are at reduced capacity such as retail,
restaurants, card rooms, etc. All businesses must follow physical distancing, sanitation, and other safety
procedures. Bars, theaters, nightclubs, and larger gatherings will be allowed in Phase 3. Given the recent
increase in COVID-19 infections in King County and Washington State, it is less clear when we will enter into
Phase 3.

Business Resources
During the week of 6/29 staff sent an email to all businesses with more updates and resources.

The Seattle Southside Chamber of Commerce is participating with chambers and business organizations across
the region to distribute PPE provided King County to small businesses. The PPE includes cloth face coverings,
disposable masks, and hand sanitizer. They will host a distribution for small businesses at Starfire Sports on
Wednesday, July 8'. The Chamber also provided 1,000 face coverings for the Tukwila Pantry.
Meeting our Community's Basic Needs
Food Security
The Pantry continues to serve a consistent amount of families each week, in the 1,000 range. The City's
community engagement manager continues to support the Pantry with assistance in food distribution. The
Pantry has indicated they are in need of additional volunteers ono food distribution days, which are Saturdays,
Tuesdays and Thursdays.
Seniors
City staff again supported our senior community through direct food distribution to homebound residents. Staff
calls residents on Monday and Tuesday, to set up a Wednesday meal delivery. The numbers of meals and
households remains consistent at around 60 households and 475 meals.
Students
To date, we have deployed over 500 MyFi devices to families that need the service. The hotspots are free for
families that have need, and the service plan lasts for 6 months with unlimited data. Families can connect up to
10 devices on one mobile hotspot.
Public Safety Plan Construction Protects
There have been no changes to the Public Safety Plan projects since the last report.
Compliance with the Governor's Order
There have been no changes to compliance issues since the last report.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUKWILA, WASHINGTON, ADOPTING A SIX -YEAR
TRANSPORTATION IMPROVEMENT PROGRAM (2021-
2026), AND DIRECTING THE SAME TO BE FILED WITH
THE STATE SECRETARY OF TRANSPORTATION AND
THE TRANSPORTATION IMPROVEMENT BOARD.
WHEREAS, pursuant to the requirements of RCW Chapters 35.77 and 47.26, the
City Council of the City of Tukwila has previously adopted a Transportation Improvement
Program and thereafter periodically modified said Transportation Improvement Program
by resolution; and
WHEREAS, the City Council has reviewed the work accomplished under said
program, determined current and future City street and arterial needs and, based upon
these findings, has prepared a Six -Year Transportation Improvement Program for the
ensuing six calendar years (2021-2026); and
WHEREAS, on June 22, 2020, a public hearing was held regarding the City's Six -
Year Transportation Improvement Program;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. Program Adopted. A Six -Year Transportation Improvement Program
for the calendar years 2021 to 2026, attached hereto as Exhibit A, is hereby adopted.
Section 2. Filing of Program. The City Clerk is hereby authorized and directed to
file a copy of this resolution, together with the exhibit attached hereto, with the Secretary
of Transportation and the Transportation Improvement Board of the State of Washington.

The project will focus on providing TDM services at selected activity centers (e.g.
business parks, commercial and residential multi -tenant buildings, educational
institutions) and/or congested corridors in Tukwila, Renton, SeaTac, and Kent to
reduce drive alone travel and traffic congestion in south King County. A key strategy
will include the development of partnerships with embedded organizations in the
communities we are serving to facilitate more effective outreach and improve long-
term program outcomes.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, RENEWING A SIX-MONTH MORATORIUM WITHIN
THE TUKWILA INTERNATIONAL BOULEVARD STUDY AREA IN THE
CITY OF TUKWILA ON THE DEVELOPMENT OF CERTAIN USES
SUCH AS HOTELS, MOTELS, EXTENDED -STAY FACILITIES, OR
AUTO -ORIENTED USES; SETTING A DATE FOR A PUBLIC
HEARING ON THE MORATORIUM RENEWAL; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila has adopted a Comprehensive Plan in compliance
with the Growth Management Act; and
WHEREAS, the City of Tukwila is currently updating its Zoning Code to comply with
its adopted Comprehensive Plan; and
WHEREAS, the Tukwila International Boulevard Study Area (`TIB Study Area"),
shown on Exhibit A, is generally bounded by 42nd Avenue South on the east; South 160th
Street on the south; International Boulevard and Military Road on the west, and South
133d Street to the north; and
WHEREAS the TIB Study Area consists of mixed zoning that includes commercial
and residential zones with a stepped edge that follows the boundary of the multi -family
zoning districts up to the Mixed Use Office District at approximately South 133rd Street;
and
WHEREAS, within the TIB Study Area's existing Neighborhood Commercial Center
(NCC) and Regional Commercial (RC) zoning districts there are certain uses that in the
future may not be allowed or may be allowed with conditions: and
WHEREAS, the owners and operators of three crime -infested motels pleaded guilty
to conspiracy to maintain drug involved premises, and when the three motels and an
adjacent motel within the TIB Study Area were closed. the violent crime rate in the Study
Area was cut nearly in half and

WHEREAS, the City of Tukwila finds that hotels, motels, and extended -stay hotels and
motels (hereafter, collectively referred to as "extended -stay facilities") in the TIB Study
Area generate higher than typical rates of crime; and
WHEREAS, the City of Tukwila spent millions of dollars acquiring the three
government surplus motel properties and purchasing an adjacent fourth motel site and
razed the buildings to better serve the public health and safety in the TIB Study Area; and
WHEREAS, the Comprehensive Plan goals and policies for the TIB Study Area are to
create a pedestrian oriented, walkable destination, and auto -oriented services, uses and
developments are not in keeping with those goals and policies; and
WHEREAS, the City of Tukwila is in the process of updating its land use regulations
to comply with the goals and policies of its adopted Comprehensive Plan for the TIB Study
Area and has budgeted for a Work Program, shown on Exhibit B, to address the changes
that will bring consistency between the City's Comprehensive Plan and Zoning Code; and
WHEREAS, the City desires to ensure the public has many opportunities to provide
input on this matter; and
WHEREAS, the City of Tukwila conducted a three-day workshop in February 2017 on
the future improvements and land use regulations for the TIB Study Area and preliminarily
determined hotels; motels; extended -stay facilities; and auto -oriented commercial uses,
including, but not limited to, gas stations, car washes, vehicular repair or services,
vehicular sales or rentals, vehicular storage, commercial parking, and drive- throughs,
should be regulated differently than currently regulated; and
WHEREAS, on July 17, 2017, the Tukwila City Council adopted Ordinance No. 2543,
which declared an emergency necessitating the immediate imposition of a six- month
moratorium prohibiting within the TIB Study Area's NCC and RC zoning districts the
development, expansion, intensification or establishment of any new hotel, motel,
extended -stay facility, and auto -oriented commercial uses including, but not limited to,
gas stations, car washes, vehicular repair or services, vehicular sales or rentals, vehicular
storage, commercial parking, and drive-throughs; and
WHEREAS, on September 5, 2017, the Tukwila City Council conducted a public
hearing, heard testimony regarding the City's moratorium, and declared findings; and
WHEREAS, Ordinance No. 2543 was set to expire on January 16, 2018, and the
neighborhood input and planning process was not yet completed; and
WHEREAS, on January 8, 2018, the Tukwila City Council held a public hearing on an
ordinance renewing the six-month moratorium on certain types of new or expanded land
uses and on January 16, 2018 adopted Ordinance No. 2565; and

WHEREAS, Ordinance No. 2565 was set to expire on July 15, 2018; however, due
to the significant level of the proposed rechannelization and zoning work needed, the
code amendments were not yet completed; and
WHEREAS, on June 25, 2018, the Tukwila City Council held a public hearing on an
ordinance renewing the six-month moratorium on certain types of new or expanded land
uses and on July 2, 2018 adopted Ordinance No. 2579; and
WHEREAS, Ordinance No. 2579 was set to expire on January 10, 2019; however,
additional analysis and review of the rechannelization options were needed; and
WHEREAS, on November 26, 2018, the Tukwila City Council held a public hearing
on an ordinance renewing the six-month moratorium on certain types of new or
expanded land uses, and added a clarification regarding the ability for businesses to
continue renewing their business licenses, and on December 3, 2018 the Council
adopted Ordinance No. 2595; and
WHEREAS, Ordinance No. 2595 was set to expire on July 9, 2019; however, the
City still needed additional work on the TIB rechannelization and mitigation options as
well as revisions to the Zoning Code and the proposed TIB Design Manual; and
WHEREAS, on May 28, 2019, the Tukwila City Council held a public hearing on an
ordinance renewing the six-month moratorium on certain types of new or expanded land
uses and on June 3, 2019 adopted Ordinance No. 2606; and
WHEREAS, Ordinance No. 2606 was set to expire on January 9, 2020; however,
additional review of the final TIB rechannelization evaluation report and the associated
zoning code amendments was needed; and
WHEREAS, on November 25, 2019, the Tukwila City Council held a public hearing
on an ordinance renewing the six-month moratorium on certain types of new or expanded
land uses in the TIB Study Area, and on December 2, 2019 adopted Ordinance No. 2620,
renewing the six-month moratorium on certain types of new or expanded land uses in the
TIB Study Area; and
WHEREAS, on March 2, 2020, the Planning and Economic Development
Committee recommended the Planning Commission consider zoning code
amendments that would eliminate the need to renew the moratorium; and
WHEREAS, due to the COVID-19 pandemic, Governor Inslee issued several
proclamations, including Proclamation 20-25, "Stay Home — Stay Healthy," on March
23, 2020, which prohibited in -person public gatherings; and
WHEREAS, because adoption of the zoning code amendments prior to the
moratorium's expiration was deemed an essential action during the COVID-19
pandemic restrictions, the Planning Commission held a virtual public hearing on April
23, 2020, to consider zoning code amendments for the TIB Study Area, and decided to
continue the hearing to a future date so that additional notification of the proposed code
amendments could be published and to ensure the public could meaningfully
participate; and

WHEREAS, on April 27, 2020, the Tukwila City Council discussed concerns regarding
public accessibility and participation related to the restrictions on public gatherings during
the COVID-19 pandemic; and
WHEREAS, Ordinance No. 2620 is set to expire on July 9, 2020, and the Tukwila
City Council desires to renew the TIB Study Area moratorium for another six months in
order to provide for the time needed for the COVID-19 pandemic -related restrictions to
be eased so the public can meaningfully participate in the TIB Study Area zoning code
amendment process; and
WHEREAS, a public hearing regarding this proposed ordinance was held on June 22,
2020; and
WHEREAS, the City desires to preserve the status quo for the protection of the
health, safety and welfare of City residents, as it relates to development in Tukwila, until
these matters are more fully considered;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Findings. The recitals and findings set forth above are hereby adopted
as the City Council's findings in support of the moratorium renewal imposed by this
ordinance.
Section 2. Moratorium Renewed. Pursuant to the provisions of Article 11,
Section 11 of the Washington State Constitution, RCW 35A.63.220, and RCW
36.70A.390, the City of Tukwila hereby renews a moratorium prohibiting within the NCC
and RC zoning districts of the Tukwila International Boulevard ("TIB") Study Area in the
City of Tukwila the development, expansion, intensification or establishment of any new
hotel; motel; extended -stay facility; or auto -oriented commercial uses including, but not
limited to, gas stations, car washes, vehicular repair or services, vehicular sales or
rentals, vehicular storage, commercial parking, and drive-throughs. No land use
approval, building permit, construction permit, or other development permit or approval
shall be issued for any of the uses listed above while this moratorium is in effect. Nothing
in this moratorium shall prevent an existing business from renewing their business
license. Any land use approval, development permits or other permits for any of these
operations that are issued as a result of error or by use of vague or deceptive
descriptions during the moratorium are null and void and without legal force or effect.
Section 3. Definitions. As used in this ordinance, the following terms have the
meanings set forth below:

A. "Hotel" means a building or buildings or portion thereof, the units of which are
used, rented, or hired out as sleeping accommodations only for the purposes of
transitory housing. Hotel rooms shall have their own private toilet facilities and may or
may not have their own kitchen facilities. Hotels shall not include dwelling units for
permanent occupancy. A central kitchen, dining room and accessory shops and
services catering to the general public can be provided. No room may be used by the
same person or persons for a period exceeding 30 calendar days per year. Not included
are institutions housing persons under legal restraint or requiring medical attention or
care.
B. "Motel" means a building or buildings or portion thereof, the units of which are
used, rented, or hired out as sleeping accommodations only for the purposes of
transitory housing. A motel includes tourist cabins, tourist court, motor lodge, auto
court, cabin court, motor inn and similar names but does not include accommodations
for travel trailers or recreation vehicles. Motel rooms shall have their own private toilet
facilities and may or may not have their own kitchen facilities. Motels are distinguished
from hotels primarily by reason of providing adjoining parking and direct independent
access to each rental unit. Motels shall not include dwelling units for permanent
occupancy. No room may be used by the same person or persons for a period
exceeding 30 calendar days per year. Not included are institutions housing persons
under legal restraint or requiring medical attention or care.
C. "Extended -stay hotel or motel" means a building or buildings or portion thereof,
the units of which contain independent provisions for living, eating and sanitation
including, but not limited to, a kitchen sink and permanent cooking facilities, a bathroom
and a sleeping area in each unit, and are specifically constructed, kept, used,
maintained, advertised and held out to the public to be a place where temporary
residence is offered for pay to persons for a minimum stay of more than 30 days and a
maximum stay of six months per year. Extended -stay hotels or motels shall not include
dwelling units for permanent occupancy. The specified units for extended -stay must
conform to the required features, building code, and fire code provisions for dwelling
units as set forth in the Tukwila Municipal Code. Nothing in this definition prevents an
extended -stay unit from being used as a hotel or motel unit. Extended -stay hotels or
motels shall be required to meet the hotel/motel parking requirements. Not included
are institutions housing persons under legal restraint or requiring medical attention or
care.
D. "Auto -oriented commercial uses" means the use of a site for primarily the
servicing, repair, rental, sales or storage of vehicles, or the servicing of people while in
their vehicles such as restaurant drive-throughs. Typical uses include, but are not limited
to, gas stations; battery, tire, engine body repair shops; vehicular sales or rentals lots;
and commercial parking.
Section 4. Effective Period for Moratorium Renewal. The moratorium renewed
herein shall be in effect for a period of six (6) months from the effective date specified
within this ordinance and shall automatically expire at the conclusion of that six (6)-
month period unless the same is extended as provided in RCW 35A.63.220 and RCW
36.70A.390, or unless terminated sooner by the City Council.

Section 5. Public Hearing. Pursuant to RCW 35A.63.220 and RCW 36.70A.390,
and following adequate public notice, a public hearing was held on June 22, 2020, to
take public testimony regarding the City's moratorium.
Section 6. Work Program. The Director of Community Development is hereby
authorized and directed to address issues related to appropriate zoning regulations within
the TIB Study Area of hotels, motels, extended -stay facilities, and auto -oriented
commercial uses in the Tukwila Municipal Code, including that work which is outlined in
Exhibit B which is attached and incorporated herein by this reference.
Section 7. Corrections by City Clerk or Code Reviser. Upon approval of the City
Attorney, the City Clerk and the code reviser are authorized to make necessary
corrections to this ordinance, including the correction of clerical errors; references to other
local, state or federal laws, codes, rules, or regulations; or ordinance numbering and
section/subsection numbering.
Section 8. Severability. If any section, subsection, paragraph, sentence, clause,
or phrase of this ordinance or its application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity of constitutionality of the
remaining portion of this ordinance or its application to any other person or situation.
Section 9. Effective Date. This ordinance or a summary thereof shall be published
in the official newspaper of the City, and shall take effect and be in full force July 9, 2020.

The City Administrator Report is meant to provide the Council, staff, and community an update on
the activities of the City and on issues that concern Tukwila. Please let me know if you have any

1. Intergovernmental Update
• King County City Managers/City Administrators Meetings: City Administrator David Cline
participated in weekly calls with the King County City Managers/City Administrators on June
10,17and 24.
• Meetings with Tukwila School District: Mayor Ekberg and City Administrator David Cline
met with Tukwila School District Superintendent Dr. Flip Herndon on June 10 and 16
regarding issues impacting the City and the School District.
• Sound Cities Association Mayors Meetings: Mayor Ekberg participated in Sound Cities
Association Mayors meetings on June 12, 16 and 23.
• Association of Washington Cities Virtual Annual Conference: Mayor Ekberg,
Councilmembers Hougardy and Kruller, City Administrator David Cline and Legislative
Analyst Laurel Humphrey participated in the Association of Washington Cities Virtual Annual
Conference sessions held June 23 - 25.
• Urban Lands Capacity/Buildable Lands Technical Committee: Community Development
staff participated in the monthly meeting of the Urban Lands Capacity/Buildable Lands
Technical Committee. Cities are continuing their analyses of achieved densities and capacity
for new residential and commercial growth. This data will help inform King County as they
start work on setting growth targets for the next round of Comprehensive Plan updates.
• Regional Transit Committee: Community Development staff attended the monthly meeting
of the Regional Transit Committee, where King County Metro provided an update on ongoing
measures taken to respond to the pandemic. Ridership data shows the highest ridership
decreases are during morning and evening commute periods. Metro will continue to operate
the Saturday network on a weekday schedule, to focus on all day routes rather than weekday
peak service. Additional fallback service has been added to address crowding over social
distancing thresholds, but no other changes are expected to service until September.

Ridership levels have remained higher in South King County than in East and North King
County. Metro will be discussing cuts to the transit network in the coming year and gave a
preview of the anticipated budget shortfalls that will be part of that discussion.
II. Community Events
• Senior Outreach: The Senior Adult Program is averaging 70 clients a week with over 500
meals being delivered with the Operation Senior Meal Drop Program. The regular Meals on
Wheels Delivery is happening every week as well with 25 on the call list. Ninety fresh meals
prepared by Fare Start funded through King County Senior Levy dollars were delivered to the
Tukwila Pantry by Senior Staff on June 22. Foot Care began again on June 18 with 13 clients.
III. Staff Updates
Public Safety
• Valley Independent Investigation Team Non -Law Enforcement Interviews: Chief Linton,
Deputy Chief Drever and Council President De'Sean Quinn interviewed volunteer applicants
interested in serving as the Non -Law Enforcement representative to the Valley Independent
Investigation Team.
• Police Regional Coordination: Chief Linton continues to meet weekly with Valley chiefs in the
COVID-19 coordination efforts.
• Fire Regional Coordination: Chief Wittwer continues to coordinate with regional partners
regarding the COVID-19 issues affecting the region.
Project Updates
• Boeing Access Rd over Airport Way Bridge: Estimated Completion: December 2020
The City has resubmitted an updated traffic control plan to WSDOT for their review and is
waiting for the response.
• 53rd Ave S: Estimated Completion: July 2020
All utility poles were removed by CenturyLink. The contractor is back on site working on
punch list items.
• PW Fleet & Facility Paint Booth Demolition: Estimated Completion: July 2020
Demolition work began on June 22.
• 42nd Ave S Bridge Design: Two of the four firms were interviewed on May 10 and the City is
still in the review process. Once a design firm is selected, negotiations will take place and the
design contract will be presented to Council for award.
• 2020 Overlay & Repair: A reduced 2020 Annual Overlay Program went out to bid on June 23.
Bids are due by July 7.
• 2020 Bridge Inspections: In August the Southcenter Boulevard Bridge over the Green River,
Pacific Highway Bridge over the Duwamish River, and the Fort Dent Bridge over the Green
River are scheduled to receive an Under Bridge Inspection Truck inspection and the Green

Traffic Calming/Residential Safety: Preparing plan proposal and public notice for safety
revisions on 53rd/52nd.
Office of Financial Management's Population Estimate for 2020: Community
Development staff reviewed the Office of Financial Management's population estimate for
2020, based on housing unit construction and demolition data provided to them in April. A
net of 181 housing units were added to Tukwila's housing stock in the OFM reporting period
(April 2, 2019-April 1, 2020). Based on the number and type of dwelling units built in Tukwila,
the OFM estimates that there are an additional 430 people to Tukwila's population estimate,
for a total population of 21,360.
Tukwila Village: The Food Innovation Network announced the name of the food hall at
Tukwila Village: Spice Bridge selected in recognition of the theme of a global food hall. The
property owner anticipates it will open to customers in September.

FREE MEALS DELIVERED TO SENIORS
If you are 60+ years of age and live in Tukwila, you can get up to 7 frozen meals a week. Halal meals are available. This service is provided during
the COVID-19 shutdown by Tukwila Parks and Recreation and King County Veterans Seniors and Human Services Levy. Staff will contact you on
Monday or Tuesday to take orders for Wednesday delivery.

cost to you. If you live in Tukwila, Burien, SeaTac or Boulevard Park, and are at high -risk for COVID-19, a senior or have no ability to make
