MINUTES REGULAR MEETING This meeting was not conducted at Tukwila City Hall, based on the Govemor's Proclamation 20-28 adopted March 24, 2020 which says in part: 'Any public agency, subject to RCW 42.30, is prohibited from conducting any meeting, subject to RCW 42.30 unless (a) the meeting is not conducted in -person and instead provides an option(s) for the public to attend the proceedings through, atminimum, telephonic access." All participants, including the Mayor, Councilm embers, City Staff, Legal Counsel were not atTukwila City Hall and participated via a remote electronic system. The phone number for public participation that was provided via the agenda distribution process was: 1-253-292-9750, access code 670077847#. CALL TO ORDER/PLEDGE OF ALLEGIANCE/ROLL CALL Mayor Ekberg called the remote Regular Meeting of the Tukwila City Council to order at 7:00 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Andy Youn, Deputy City Clerk, called the roll of the Council. Present at the remote meeting were Councilmembers Verna Seal, Kathy Hougardy, De'Sean Quinn, Kate Kruller, Thomas McLeod, Zak Idan, Cynthia Delostrinos Johnson. CITY OFFICIALS Allan Ekberg, Mayor; David Cline, City Administrator; Rachel Bianchi, Deputy City Administrator; Kari Sand, City Attorney; Meredith Sampson, Assistant Planner; Jack Pace, Community Development Director; Mike Perfetti, Habitat Project Manager; Rick Still, Parks and Recreation Director; Henry Hash, Public Works Director; Cyndy Knighton, Senior Program Coordinator; Lynn Miranda, Planning Supervisor; Vicky Carlsen, Finance Director; Laurel Humphrey, Legislative Analyst; Andy Youn, Deputy City Clerk. APPOINTMENTS Appoint Jovita McConnell to Position #1 on the Public Safety Bond Financial Oversight Committee, with a term expiring 12/31/2022. MOVED BY SEAL, SECONDED BY QUINN TO APPOINT JOVITA MCCONNELL TO POSITION #1 ON THE PUBLIC SAFETY BOND FINANCIAL OVERSIGHT COMMITTEE, WITH A TERM EXPIRING 12/3112022. MOTION CARRIED 7-0. PUBLIC COMMENTS Those wishing to provide public comment had the opportunity to deliver public comments via email by 5:00 p.m. today. Laurel Humphrey, Council Analyst, acknowledged receipt of and read the following written comments received by email: 1. Trina Cook, 15123 Sunwood Blvd, urged the City to update their website with current information regarding COVID-19 and referenced that rates of positive cases in Tukwila are higher than surrounding areas. Approval of Vouchers: #384072-384073; 384074-384139; 200500, 200701-200702 in the amount of $1, 358,104.78. Authorize the Mayor to sign an agreement to fund the preparation of the Transit Oriented Development Housing Strategies Plan with ECONorthwest in the amount of $80,000.00 (grant funds). [Reviewed and forwarded to Consent by the Planning and Economic Committee on 6115120.] Accept as complete the 2018 Small Drainage Project (contract #18-127) with Ceccanti, Inc.; authorize release of retainage, subject to the standard claim and lien release procedures (final cost of project, including retainage: $562,844.94). MOTION CARRIED 7-0. UNFINISHED BUSINESS a. Weekly COVID-19 Report. David Cline, City Administrator, provided an update on the City's coronavirus response and highlighted the following: The City is continuing to refine a reopening plan; 8,000 face masks were provided by King County and are being distributed to the Tukwila School District, Impact Public Schools, and community organizations; The Seattle Southside Chamber of Commerce is coordinating Personal Protective Equipment (PPE) distribution to small businesses. b. A resolution adopting a Six -Year Transportation Improvement Program (2021-2026), and directing the same to be filed with the State Secretary of Transportation and the Transportation Improvement Board. MOVED BY SEAL, SECONDED BY HOUGARDY THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED 7-0. Andy Youn, Deputy City Clerk, read the proposed resolution by title only. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING A SIX -YEAR TRANSPORTATION IMPROVEMENT PROGRAM (2021- 2026), AND DIRECTING THE SAME TO BE FILED WITH THE STATE SECRETARY OF TRANSPORTATION AND THE TRANSPORTATION IMPROVEMENT BOARD. MOVED BY SEAL, SECONDED BY QUINN THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. MOTION CARRIED 7-0, TO ADOPT RESOLUTION NO. 1993. c. An ordinance renewing a six-month moratorium within the Tukwila International Boulevard Study Area in the City of Tukwila on the development of certain uses such as hotels, motels, extended -stay facilities, or auto -oriented uses; setting a date for a public hearing on the moratorium renewal. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RENEWING A SIX-MONTH MORATORIUM WITHIN THE TUKWILA INTERNATIONAL BOULEVARD STUDY AREA IN THE CITY OF TUKWILA ON THE DEVELOPMENT OF CERTAIN USES SUCH AS HOTELS, MOTELS, EXTENDED -STAY FACILITIES, OR AUTO -ORIENTED USES; SETTING A DATE FOR A PUBLIC HEARING ON THE MORATORIUM RENEWAL; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. Page 3 of 5 MOVED BY SEAL, SECONDED BY KRULLER THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Councilmember Idan referenced an email from a business owner regarding a proposed amendment to the ordinance renewing the moratorium. The Councilmembers discussed the correspondence and determined that City Administration should continue to work directly with the business owner to address concerns. Kari Sand, City Attorney, noted the Planning Commission can review proposed changes to zoning regulations and advised that the ordinance move forward as proposed without any amendments. *MOTION CARRIED 7-0, TO ADOPT ORDINANCE NO. 2631. REPORTS a. Mayor Mayor Ekberg had no report. b. City Council Councilmember Hougardy reported the Equity and Social Justice Commission will be holding a virtual meeting on July 9, 2020 for the first time since the start of the pandemic. Councilmember Hougardy attended the Association of Washington Cities (AWC) annual conference that was held virtually. Councilmember Kruller participated in the Association of Washington Cities (AWC) annual conference that was held virtually. She requested a report from the Fire and Police Departments regarding Fourth of July damages and injuries. Councilmember McLeod suggested reviewing ways in which the City can incorporate a greater equity and diversity lens in City business. Councilmember Delostrinos Johnson noted diversity does not appear to be reflected in some of the City's contractors. She reported that in conjunction with Councilmember Idan and City of SeaTac Councilmember Takele Gobena, they are continuing to reach out to King County to bring a testing center to the City. c. Staff David Cline, City Administrator, referenced the CA (City Administrator) report, and Monthly Construction and Budget Report and offered to answer any questions. Councilmember Seal asked foran update on how the City will be impacted if the Tukwila School District does not reopen for the new school year. MISCELLANEOUS Council President Quinn encouraged the Councilmembers to continue directing concerns through him. In response to Councilmember McLeod and Delostrinos Johnson's comments regarding equity and diversity work in the City, he said the City can take actionable steps to implement processes to address some of the historical disparities that exist and highlight the core values of Tukwila. EXECUTIVE SESSION — Potential Litigation —Pursuant to RCW 42.30.110(1)(i)-30 minutes Mayor Ekberg announced the Council will now go into an Executive Session to discuss with legal counsel representing the agency — matters relating to agency enforcement actions, orto discuss with legal counsel representing the agency — litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal orfinancial consequence to the agency pursuant to RCW 42.30.110(1)(i). The total amount of time will be no more than 30 minutes, and no decisions will be made during the Executive Session. No action will be required in the Open Meeting after the Executive Session has concluded. He declared the meeting adjourned as of the conclusion of the Executive Session. The Executive Session will not be extended beyond the announced time, and they will not be returning to open session to adjourn or for any other reason. 8:31 p.m. Mayor Ekberg called for a brief recess to allow the Councilmembers to convene in a separate remote meeting.
