Mayor Haggerton called the Special Meeting of the Tukwila City Council to order at 5:03 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Joan Hernandez, Allan Ekberg, Dennis Robertson, Verna Seal, Kathy Hougardy and De'Sean Quinn. APPOINTMENTS Equity and Diversity Commission: Confirm the appointment of Charlie Penor to Position #7 on the Equity and Diversity Commission, with a term to expire 7/31/2013. MOVED BY HERNANDEZ, SECONDED BY DUFFIE TO CONFIRM THE APPOINTMENT OF CHARLIE PENOR TO POSITION #7 ON THE EQUITY AND DIVERSITY COMMISSION, WITH A TERM TO EXPIRE 7/31/2013." Mr. Penor said he lives and works in Tukwila and hopes to make a positive impact through his work on the Commission. *MOTION CARRIED 7 -0. Civil Service Commission: Confirm the reappointment of Ronald Johnston to Position #2 on the Civil Service Commission, with a term to expire 12/31/2017. MOVED BY QUINN, SECONDED BY ROBERTSON TO CONFIRM THE REAPPOINTMENT OF RONALD JOHNSTON TO POSITION #2 ON THE CIVIL SERVICE COMMISSION, WITH A TERM TO EXPIRE 12/31/2017. MOTION CARRIED 7 -0. Library Advisory Board: Confirm the reappointment of Marie Parrish to Position #3 on the Library Advisory Board, with a term to expire 12/31/2013. MOTION CARRIED 7 -0. Confirm the reappointment of Linda McLeod to Position #5 on the Library Advisory Board, with a term to expire 12/31/2013. MOVED BY EKBERG, SECONDED BY QUINN TO CONFIRM THE REAPPOINTMENT OF LINDA MCLEOD TO POSITION #5 ON THE LIBRARY ADVISORY BOARD, WITH A TERM TO EXPIRE 12/31/2013. MOTION CARRIED 7 -0. CITIZEN COMMENTS There were no citizen comments. Mayor Haggerton asked Joyce Trantina, Executive Assistant in the Mayor's Office, to give an update on City volunteers. Ms. Trantina relayed that the City has 450 registered volunteers who provide approximately 10,000 hours of service per year to the community. Some examples of service include delivery of Meals on Wheels, transportation for senior citizens, and athletic coaches for youth. The City of Tukwila is fortunate to have so many willing volunteers in the community. CONSENT AGENDA a. Approval of Minutes: 12/5/11 (Regular Mtg.); 12/12/11 (Special Mtg.) b. Approval of Vouchers #359170 359306 and #111100; 111201 111203 in the amount of $3,029,849.26 MOVED BY DUFFIE, SECONDED BY HERNANDEZ THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED. MOTION CARRIED 7 -0. UNFINISHED BUSINESS a. A resolution expressing sincere gratitude to Joan Hernandez for her service as a Councilmember. MOVED BY DUFFIE, SECONDED BY SEAL THAT THE PROPOSED RESOLUTION BE READ IN ITS ENTIRETY. MOTION CARRIED 7 -0. Mayor Jim Haggerton read the proposed resolution in its entirety. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, EXPRESSING SINCERE GRATITUDE TO JOAN HERNANDEZ FOR HER SERVICE AS A COUNCILMEMBER. MOVED BY HOUGARDY, SECONDED BY DUFFIE THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ.* Mayor Haggerton relayed that, upon adoption, the resolution will be signed by all Councilmembers and the Mayor and be presented to Councilmember Hernandez. The resolution reads in part, "On behalf of the citizens of Tukwila, the Mayor and Councilmembers express their sincere thanks to Joan Hernandez for her 24 years of dedicated service as a City of Tukwila Councilmember." Councilmember Duffie presented Councilmember Hernandez with a glass gavel from the Mayor, City Council and City Staff. The inscription reads, "Determine that the thing can and shall be done, and then we shall find the way." (Abraham Lincoln) Kimberly Matej, Council Analyst, expressed that this quote exemplifies the tenure of Councilmember Hernandez. Tukwila City Council Special Meeting Minutes December 19, 2011 Page 3 of 6 On behalf of the City Council, Councilmember Hougardy gifted Councilmember Hernandez with a photo journal to memorialize her years as a Councilmember. Councilmember Hernandez expressed her honor and privilege at the opportunity to serve the City and thanked the staff for their quality service. She was given a standing ovation by the audience. *MOTION CARRIED 7 -0, TO ADOPT RESOLUTION NUMBER 1757. 5:22 pm Mayor Haggerton called a brief recess for a cake and coffee reception in honor of Councilmember Hernandez, to include a slide show presentation of her achievements and accomplishments as a Councilmember. 5:41 pm Mayor Haggerton reconvened the Regular Meeting b. A resolution supporting the Tukwila School District Levy. Title: Proposition 1 Replacement of Expiring School Programs and Operation Levy. Public comments will be accepted. MOVED BY SEAL, SECONDED BY DUFFIE THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Christy O'Flaherty, City Clerk, read the proposed resolution by title only. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, EXPRESSING ITS COLLECTIVE POSITION SUPPORTING APPROVAL FOR RENEWAL OF THE TUKWILA SCHOOL DISTRICT SCHOOL PROGRAMS AND OPERATIONS LEVY. MOVED BY QUINN, SECONDED BY HOUGARDY THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ.* Mayor Haggerton called for public comments. Ed Hougardy, Tukwila School District Advisory Board member, stated that the school district has 2,800 children of multiple cultures and 60 different languages. Approximately 37% of the students qualify for English as a Second Language (ESL) services, and 27% of the district budget is funded by this levy. Adoption of this resolution emphasizes the importance of the levy to the Tukwila community. Mary Fertakis, Tukwila School Board member, expressed appreciation to the Council for supporting this resolution. There is great concern due to possible cuts to education at the State level, which will leave the district facing cuts of 25% to service levels. Councilmember Seal commented that the resolution includes the language "and urges all eligible Tukwila voters to support the school levy." *MOTION CARRIED 7 -0, TO ADOPT RESOLUTION NUMBER 1758. c. A briefing on Tukwila Village draft deal terms. Derek Speck, Economic Development Administrator, provided an update on the Tukwila Village project. On June 6, 2011 the City Council selected Tukwila Village Development Associates, LLC (TVDA) as the developer for Tukwila Village. Since that time the City and TVDA have been negotiating a development agreement and TVDA has been performing due diligence and design work for the proposed development. The City and TVDA have also been negotiating with the King County Library System (KCLS) in order for a KCLS branch library to be built on the site. The City, TVDA, and KCLS are nearing completion of negotiating the main terms that would be included in a development agreement. A proposed development agreement is tentatively scheduled to come to Tukwila City Council Special Meeting Minutes December 19, 2011 Page 4 of 6 the Council in February 2012. The next steps are to finish negotiations and draft the development agreement. Since those steps will consume significant time and resources, this is a good opportunity for Council to provide feedback to ensure the City is moving in the right direction. TVDA has proposed a development with, as a minimum, the following uses: King County Library Branch Police Resource Center Office (medical /dental) Retail Indoor Community Commons Outdoor Community Plaza Age- Restricted Apartments Non -age Restricted Apartments 8,000 square feet 2,000 square feet 20,000 square feet 7,000 square feet 2,000 square feet 20,000 square feet 300 units 80 units Phase 1 of the project will involve the property north of South 144 Street. Phase 2 will be the property south of South 144 Street. If TVDA constructs the site and frontage improvements for the library parcel, that would occur during Phase 1, although KCLS could construct its building at a later phase. Tori Peterson, 4451 South 156 Street, emphasized the need for adequate parking at the facility Thomas McLeod, 13017 37 Avenue South, stressed the importance of the new library being one that is inviting and warm that will encourage people to go there. From his standpoint, some of the neighboring libraries are sterile and unwelcoming. He would like this to be a priority for the development. Abshir Mahamed, 12910 East Marginal Way, commented that the library should be aesthetically pleasing and provide for multi- faceted uses. He would also like to see the indoor plaza open to the outdoor plaza to accommodate a variety of events and activities. The Councilmembers asked questions regarding various aspects of the presentation and offered the following comments: support for a 10,000 square foot library; inclusion of a Neighborhood Resource Center (NRC) as part of the project; the Development Agreement must contain language that protects the City in the event of unanticipated issues with the developer; recognition that the City has already made significant financial contributions to the project, to include enforcement of new laws regarding rental housing, nuisances, and panhandling; funding for the NRC will involve a long -term City commitment by way of police staffing; there are no funds budgeted for improvements on South 144 th Street; Tukwila Tukwila City Council Special Meeting Minutes December 19, 2011 Page 5 of 6 Village will be an entry point for new immigrants and must be welcoming; all four sides of the library should be aesthetically pleasing; the residual land value approach is reasonable; and the City of Tukwila and the King County Library System share the same taxpayers. Bill Ptacek, King County Library Services Director, expressed that this project has been in the works for a long time, and KCLS has been committed to providing a high quality library at Tukwila Village. They believe they have funding for an 8,000 square,foot library and are working to secure funding for a 10,000 square foot facility. However, they cannot guarantee that at this time. He emphasized that the better the deal they can get on the land purchase, the more money KCLS will have to put toward the new library. Bryan Park, Tukwila Village Development Associates, LLC appreciated hearing the feedback this evening and stressed their long -term commitment to the project. He relayed that an increase in the height limit by 5+ feet for the buildings would be beneficial. Mr. Speck reiterated that he would be returning to the Council in February 2012 with a draft development agreement. REPORTS a. Mayor Mayor Haggerton commended Council President Ekberg and the Council for the work accomplished during a very busy year. He also expressed to Councilmember Hernandez that he wishes her the best in a very well earned retirement. b. City Council Councilmember Duffie thanked Councilmember Hernandez for her years of service. Councilmember Hernandez attended the holiday event at the Tukwila Municipal Court on December 13, 2011. Council President Ekberg acknowledged Councilmember Hernandez as a faithful servant to the public. Councilmember Robertson relayed that he will miss Councilmember Hernandez. Additionally, he thanked Council President Ekberg and City Administration for their work on the Metropolitan Park District. He expressed that the amount of work involved had not been anticipated, and it is important to be mindful of the challenges when considering a Regional Fire Authority. Councilmember Seal referenced meeting Councilmember Hernandez 15 years ago and has appreciated her mentorship and encouragement over the years. She will miss her dearly. Councilmember Hougardy thanked Council President Ekberg for his leadership this past year. She also thanked Councilmember Hernandez for her wisdom and mentorship. Councilmember Quinn expressed that Councilmember Hernandez is "special" and he has the greatest respect for how she has handled the business of the City. He also thanked Council President Ekberg for a great job in dealing with a multitude of changes this year. c. Staff David Cline, City Administrator, expressed appreciation at the opportunity to work with Councilmember Hernandez. He also relayed that new Councilmember orientation has begun, and any Councilmember is welcome to tours of City facilities and meetings with staff. d. City Attorney Shelley Kerslake, City Attorney, extended congratulations to Councilmember Hernandez on her retirement and relayed that she has been a pleasure to work with and a "class act." MISCELLANEOUS Councilmember Hernandez thanked the Council for the well wishes as they are the legacy she is leaving behind. Mayor Haggerton conveyed that he has a great deal of involvement with regional committees, and it is evident that Tukwila Councilmembers are extremely hardworking and dedicated. He thanked the Council for the excellent job in dealing with the City's business in 2011.
