Mayor Van Dusen led the Pledge of Allegiance and called the Regular Meeting of the Tukwila City Council to order. GEORGE D. HILL, LIONEL C. BOHRER, MABEL J. HARRIS, Council Presi- dent, DORIS E. MOVED BY HILL, SECONDED BY PHELPS, THAT THE AGENDA BE AMENDED TO ADD TO ITEM 7A, BID AWARD FOR THE 1983 STREET REPAIR /OVERLAY PROJECT. MOTION CARRIED. REPORTS Mayor Mayor Van Dusen announced the final closing on the purchase of the Independent Water Company, 1:30 P.M., Thursday, September 9, 1983. Also, a "Meet the Candidate" night will be held at the Tukwila Library at 7 :30 P.M. on Wednesday, September 8, 1983. a. Approval of Minutes: August 15, 1983 b. Councilman Bohrer requested that Items 6c and 6d be removed from the Consent Agenda. MOVED BY HARRIS, SECONDED BY HILL, THAT THE CONSENT AGENDA, WITH ITEMS 6C AND 6D REMOVED, BE APPROVED. MOTION CARRIED. Sewer TV Inspection MOVED BY PHELPS, SECONDED BY HILL, THAT THE BID FOR THE SEWER TV INSPECTION BE AWARDED TO VIDEO SCAN, INC. IN THE AMOUNT OF 38.5¢ PER FOOT PLUS TAX. MOTION CARRIED. MOVED BY PHELPS, SECONDED BY HILL, THAT THE BID FOR THE ASPHALT EMULSION SPRAYER BE AWARDED TO SAHLBERG EQUIPMENT CO. IN THE AMOUNT OF $7,350.00 PLUS TAX.* Councilman Bohrer noted that none of the neighboring cities have such a device. They are all operating the way we are at present. We can rent the machine. Councilman Phelps suggested we rent our equipment to other jurisdictions to recoup some of the money. *MOTION CARRIED WITH BOHRER AND HARRIS VOTING NO. 3 '53 Council President Harris said that Tukwila is not so unique that we need to be the only City in the area with this piece of equipment. MOTION CARRIED. (It was noted that this is a side mounted tool box) MOVED BY PHELPS, SECONDED BY HARRIS, THAT THE BID FOR THE 1983 STREET REPAIR /OVERLAY PROJECT BE AWARDED TO M. A. SEGALE, INC. IN THE TOTAL AMOUNT OF $68,090 PLUS TAX. MOTION CARRIED. MOVED BY MORGAN, SECONDED BY HARRIS, THAT BUDGET TRANSFER NO. 83 -10 BE APPROVED IN THE AMOUNT OF $6,646 AND RECOMMEND THAT COUNCIL AWARD THE BID TO RICHARDS LANDSCAPING.* 39sy MOVED BY HILL, SECONDED BY BOHRER, THAT THE BUDGET TRANSFER MOTION BE AMENDED BY ELIMINATING ALTERNATE NO. 6. MOTION CARRIED. *MOTION CARRIED AS AMENDED. MOVED BY HARRIS, SECONDED BY HILL, THAT COUNCIL FUND THE T -LINE BRIDGE CONSTRUCTION IN AN AMOUNT NOT TO EXCEED $40,000.* MOVED BY HARRIS, SECONDED BY PHELPS, THAT THE MOTION BE AMENDED TO MAKE IT CONTINGENT UPON FEDERAL R -4 FUNDS BEING OBTAINED; COUNCIL WILL COMMIT FUNDING NOT TO EXCEED $40,000 AND THE SOURCE OF THE FUNDS WILL BE THE ARTERIAL STREET FUND FROM THE 1984 BUD- GET. MOTION CARRIED. *MOTION CARRIED AS AMENDED. MOVED BY BAUCH, SECONDED BY HARRIS, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Woo read an ordinance of the City of Tukwila, Washington, regulating political activities of employees of the City of Tukwila, Washington. MOVED BY BAUCH, SECONDED BY HARRIS, THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Councilman Hill said he is not in favor of this. Our admini- strative policy took care of it. He asked what is meant by "an active Part" in Section 1 -B. When you go to work for the City, do you give up some of your Constitutional rights? Councilman Bohrer explained that when the City of Bellevue passed this ordinance they, at the same time, established an administrative policy which interpreted the ordinance. Earlier in the year, Council had a draft of such a policy provided by the Mayor. He noted the four goals and objectives from the policy. He read four items that would be violations and four things that would not. He suggested that it should read "it should be a violation to speak on behalf of or against a candi- date." Another item he would like to see included is that the permitted activities should never occur while dressed in a uniform provided for their function as a City employee. Mayor Van Dusen read a memo on election campaigns that he put out to the City employees. He said that the intent of this ordinance is to protect the employee. Councilman Bauch said that the constitutional rights of an employee are where he lives. We have abuse by employees who do not live here. They try to influence an election which they have no vote in. Councilman Phelps asked about adopting the Mayor's memo and the City Attorney's comments as a definition to the proposed ordinance. Items 6c and 6d Comments, Dangerous Building Code MISCELLANEOUS Request to reduce speed on 55th Ave. So. So. 140th ADJOURNMENT 8:55 P.M. Councilman Hill suggested referencing the memo in the ordinance for clarification. MOVED BY MORGAN, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE TABLED TO THE NEXT COMMITTEE OF THE WHOLE WITH THE CLARIFICATION OF THE DEFINITIONS ATTACHED. MOTION CARRIED WITH BAUCH VOTING N0. Councilman Bohrer noted that the ordinance is patterned after a United States law called the Hatch Act. MOVED BY HARRIS, SECONDED BY HILL, THAT ITEMS 6C AND 6D BE REFERRED BACK TO THE PUBLIC SAFETY COMMITTEE: 6C An ordinance of the City of Tukwila repealing Ordinance No. 849 relating to Dangerous Building Code and replacing with new language. 6D An ordinance of the City of Tukwila amending Ordi- nance 197, Section 2 and Ordinance 1226, Section 5 relating to concealed pistol permits and forfeiture of pistols and declaring an emergency. MOTION CARRIED. Al Pieper, audience, made the following comments on the proposed ordinance on the Dangerous Building Code: 1. The ordinance is not really necessary because the Uniform Building Code specifies the use of the Dangerous Building Code. 2. Section 16.30.010 -there is no such document as the Uniform Building Code for the Abatement of Dangerous Buildings. 3. Same section -it is unnecessary to provide three copies for the City Clerk. 4. Section 16.30.20 (c), Chapter 16.30 is repealed in the title. 5. Section 16.30.030 entire section needs revision. It is broad in scope and Council action is not needed. 6. Section 16.30.040 should state what constitutes immediate danger. 7. Section 16.30.060 -when City employee fails to perform or misperforms an ministerial act, that person assumes per- sonal liability. Councilman Duffie asked if the speed signs on South 140th and 55th Avenue South could be changed from 25 to 20 miles per hour. This should reduce the speeders and make the street safer for the children who have to walk along it to school. Mayor Van Dusen offered to take this to the Public Works Director.
