Special Meeting Council Chambers Between the Tukwila City Council and the com- missioners of Fire District Number 1 CALL TO ORDER DISCUSSION TUKWILA CITY COUNCIL M I N U T E S 395' Mayor Van Dusen called the Special Meeting with the City Council and the Commissioners of Fire District No. 1 to order. The meeting is called to discuss the agreement to provide fire and emergency medical services if the area known as Allentown/ Duwamish is annexed to the City of Tukwila. Fire Chief Hubert :Crawley, Tukwila; Fire Chief Tom Keefe, District No. 1. Attorney Dan Woo, Tukwila; Attorney Clark Snure, District 1. Attorney Clark Snure, representing District 1, reviewed the final draft of the agreement and noted where the current changes had been made. In paragraph 3, authorized Commissioners' expenses were added. He explained that the departments are not really merging; they are operating by contract. If the annexation is completed, the three commissioners will no longer be with District 1 as they all live in the proposed annexation area. Three new commissioners will have to be elected. The district, remaining out of the annexation, will still levy taxes within their geographic area. The Fire Commissioners will levy the taxes each year and, under the contract, pay the City for fire protection provided to their area. So long as there is part of the District remaining out of the annexation, there will be a Board of Commissioners. It is estimated that the Fire Com- missioners will operate on about $15,000 per year. The total District budget for last year was $389,000. It is in the agree- ment that the City will provide secretarial services as needed for the Board of Commissioners. Attorney Snure suggested that January 1, 1984 be set as the ef- fective date for the agreement. Attorney Woo kited that paragraph 14 provides for an annual joint meeting to review the operation of the Fire Department during the preceding year and to discuss the operating budget and capi- tal needs. The 10% figure in paragraph 3 is the amount of the budget the District would retain for the purchase of capital equipment and improvements for the District. The District is re- taining the inventory and public facility. This would assure that the inventory is kept up to date. Any purchases will be worked out between the City and the District. Discussion fol- lowed on how much would be generated by the 10% and if it could be changed if it was found to be incorrect. Attorney Snure suggested that paragraph 3, page 2 be amended to read, after the fiture 10 "or such other percentage as mutually agreed upon annually." The City Council and the Commissioners agreed to this addition to the contract. Attorney Woo noted that the attachments are not available at this time. Attachment 1 contains the legal description of the real property; attachment 2 to this agreement contains a list of the major equipment and personal property referred to in paragraph 6; and attachment 3 sets forth the subjects to be discussed at the annual meeting. Attorney Snure explained that the Tukwila Civil Service Commission is to provide a list that will show the indi- vidual personnel by name in a ranking order. He said they would like to have that list attached to this agreement. Attorney Woo said he understands there are still a few changes to be made. He would prefer we wait and attach the final list. MOTION CARRIED AND THE THREE COMMISSIONERS ALSO AGREED. MOVED BY HILL, SECONDED BY HARRIS, THAT THE PROPOSED RESOLUTION BE READ IN ITS ENTIRETY. MOTION CARRIED. City Attorney Woo read a resolution of the City of Tukwila, Washington, authorizing the Mayor to sign an agreement for fire and emergency medical services between the City of Tukwila and King County Fire Protection District No. 1. MOVED BY HILL, SECONDED BY DUFFIE, THAT RESOLUTION NO. 880 BE ADOPTED AS READ. MOTION CARRIED. Commissioners MOVED BY GARNETT, SECONDED BY HARRIS, THAT THE COMMISSIONERS ACCEPT THE AGREEMENT AS READ.
