L. C. BOHRER, JOE H. DUFFIE, MABEL J. HARRIS (COUNCIL PRESIDENT), GEORGE D. HILL, WENDY MORGAN, DORIS PHELPS. MOVED BY HARRIS, SECONDED BY HILL, THAT COUNCILMAN BAUCH BE EXCUSED FROM THE MEETING. MOTION CARRIED. OFFICIALS IN MAXINE ANDERSON, CITY CLERK; TED FREEMIRE, SUPERINTENDENT OF ATTENDANCE PUBLIC WORKS; DAN W00, CITY ATTORNEY. REPORTS Mayor Mayor Van Dusen reported that the final Public Hearing on the Pietro Park and Ride site selection would be held on September 21 at 7:00 p.m. at the Tukwila City Hall. Tukwila's night at the Kingdome ball game will be September 28. The Segale Corporation is furnishing food for the first 70 people, commencing at 5:30 p.m. Dan Woo, City Attorney, announced a claim has been filed by Dennis Elledge against the City, claiming he was bitten by a police dog during an arrest. a. An ordinance of the City of Tukwila, Washington, regulating political activities of employees of the City of Tukwila, Washington was read by City Attorney Dan Woo by title only. MOVED BY HARRIS, SECONDED BY PHELPS, THAT THE ORDINANCE BE ADOPTED AS READ. "It is not a violation of the ordinance to: S96d MOVED BY HARRIS, SECONDED BY PHELPS, THAT THE ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED, WITH HILL AND DUFFIE VOTING NO. Councilman Bohrer said he thought the Administrative Policy Procedure that was with the ordinance when it was considered last week would accompany the ordinance and be referred to in Section 1(B) of the ordinance. City Attorney Woo said the ordinance should stand alone and he had taken out reference to the Administrative Policy. The policy would be legislative history. The language could be incorporated in the ordinance. MOVED BY PHELPS, SECONDED BY MORGAN, TO AMEND THE MOTION AND DIRECT THE CITY ATTORNEY TO INCLUDE AS GUIDELINES THE EXAMPLES OF WHAT CONSTITUTES AND WHAT DOES NOT CONSTITUTE A VIOLATION OF THE ORDINANCE AS SET FORTH IN THE MAYOR'S PROPOSED ADMINISTRATIVE POLICY. MOVED BY BOHRER, SECONDED BY PHELPS, THAT THE REGULAR MEETING RECESS FOR FIVE MINUTES. MOTION CARRIED. The meeting was called back to order by Mayor Van Dusen, with Council Members present as previously listed. City Attorney Woo explained his compliance with the motion, stating the following would be added to Section 1(B): "An employee takes an active part whenever he or she acts on behalf of, takes direction from, or works for a candidate or campaign organization, or where the employee is involved in distributing literature or materials prepared by and on behalf of a candidate or campaign organization. "The following are examples intended to provide guidance in distinguishing between permissible and inpermissible activities. 1. Express a verbal or written opinion to fellow employees, neighbors or citizens about a Council or Mayoral candidate, except while on duty or in uniform. 2. Talk to a candidate regarding campaign issues. 3. Attend meetings, which are open to the public generally, held by a candidate and ask questions of the candidate at such meeting. 4. Post a campaign sign in the employee's residence or yard. "It is a violation of the proposed ordinance to: 1. Go door -to -door endorsing or opposing a candidate as a member of a campaign organization, under the direction of that organization, or on behalf of such organization. 2. Prepare campaign signs or literature on behalf of or for a campaign organization. 3. Speak on behalf of a candidate at a rally organized by a campaign. 4. Attend or participate in a strategy planning meeting of a campaign organization. 5. Express verbal or written opinions ofa Council or Mayoral candidate while on duty or in uniform." Councilman Duffie explained his reasons for voting against the motion. MOVED BY PHELPS, SECONDED BY DUFFIE, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Woo read a resolution of the City of Tukwila, Washington, accepting the terms of the labor contract agreement negotiated with the International Association of Firefighter's Union Local No. 2088 representing the Tukwila Firefighters for the years 1983 -84 by title only. MOVED BY HARRIS, NO SECOND, THAT THE LABOR CONTRACT GO BACK TO NEGOTIATIONS. MOTION FAILED, NO SECOND. MOVED BY HILL, SECONDED BY DUFFIE, THAT THE RESOLUTION BE ADOPTED AS READ. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THE COUNCIL GO INTO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING THE FIREFIGHTERS CONTRACT WITH THE CITY ATTORNEY. MOTION CARRIED. MOVED BY HARRIS, SECONDED BY PHELPS, THAT THE COUNCIL ADJOURN THE EXECUTIVE SESSION. MOTION CARRIED. The Regular Meeting of the City Council was called back to order by Mayor Van Dusen, with Council Members present as previously listed. MOVED BY BOHRER, SECONDED BY DUFFIE, THAT THE RESOLUTION BE TAKEN OFF THE TABLE AND DISCUSSED. MOTION CARRIED, WITH HARRIS VOTING NO. *MOTION CARRIED, WITH HARRIS VOTING NO. MOVED BY PHELPS, SECONDED BY DUFFIE, THAT THE BUDGET TRANSFER BE APPROVED. MOTION CARRIED, WITH HARRIS VOTING NO. MOVED BY HARRIS, SECONDED BY HILL, THAT PUBLIC WORKS BE AUTHORIZED TO PREPARE CONSTRUCTION PLANS FOR 1984 RESIDENTIAL STREET IMPROVEMENT PROJECT. Councilman Bohrer asked for verification that there would be no expenditures in 1983. Mayor Van Dusen said there would be no expenditures in 1983. *MOTION CARRIED. MOVED BY HILL, SECONDED BY DUFFIE, THAT THE PUBLIC WORKS DIRECTOR BE ALLOWED TO DISPOSE OF FIVE VEHICLES DESCRIBED IN HIS MEMORANDUM. MOTION CARRIED. Mayor Van Dusen announced the UNITED GOOD NEIGHBOR DRIVE is ready to begin. Staff has been urged to participate and he would like to see the City Council Members participate in the Drive. The Regular Meeting was called back to order by Council President Harris (Mayor Pro -Tem) with Council Members present as previously listed. MOVED BY BOHRER, SECONDED BY DUFFIE, TO APPEAL THE DECISION OF THE SUPERIOR COURT IN THE HIGHLINE, INC., LAWSUIT AND SOLICIT PARTICIPATION OF THE OTHER PARTIES. MOTION CARRIED.
