In the absence of Mayor Van Dusen, Council President Harris led
the Pledge of Allegiance and called the regular meeting of the
Tukwila City Council to order.

MOVED BY DUFFIE, SECONDED BY HILL, THAT COUNCILMAN BAUCH BE
EXCUSED FROM THE MEETING. MOTION CARRIED.

Clerk; BRAD COLLINS, Planning Director.
Councilman Duffie reported on tours he took of the Bon Marche
and the Farwest Paint Company. He said they were both very
interesting businesses to visit. He suggested that Council
set a Saturday and invite people to "Meet your Councilman."
Attorney Woo reported that the only pending actions are the 2
Allenbach cases, the Highline Incorporation Lawsuit and the
NAACP Lawsuit.
Councilman Phelps reported on the Puget Sound Water Quality
Conference she attended. The four topics discussed in panel
discussions were: (1) Toxic chemicals in urban enbayments;
(2) Water quality concerns such as dredge spoils, oil spills,
runoff and shellfish contamination; (3) Long -term issues in
Puget Sound; (4) The institutional setting.

Councilman Bohrer asked to have Item 6c, Consultant selection
for the 1984 Residential Street Project, withdrawn from the
Consent Agenda.

Proposed resolution- Councilman Hill noted that the Public Works Committee discussed
acknowledging charges the Davis water leak sometime ago. There are several other water
incurred due to leak services besides the Davis' that are in the right -of -way.

(Davis) Council President Harris said that the City is going to have to
treat all customers the same. We do not want to write a resolution
that will set a precedent so that the City is responsible for
every residential water leak in a right -of -way. The wording
of the resolution does not commit the City.

Proposed resolution- Attorney Woo noted that sometime ago an agreement was drawn up
acknowledging charges for the Davis" to sign, but Mrs. Davis elected not to enter into

THAT THE CITY DOES NOT ACCEPT ANY RESPONSIBILITY FOR ANY LEAKS
IN WATER LINES INSTALLED IN THE RIGHT -OF -WAY FOR PRIVATE RESI-
DENTS.*
Councilman Bohrer noted that the Mayor's letter to Mrs. Davis
dated August 17, 1982, said that the City cannot arbitrarily
lower the water bill without a more substantial reason. Ted
Freemire's letter of May 13, 1983, said that, in his opinion,
the service line at the Davis residence is the total responsibility
of the property owner and not of the City of Tukwila. We need
some justification why the City should be responsible for the
water leak.
Council President Harris noted that no place does it say the
Finance Director has a right to lower anyone's water bill. The
law states that everybody must be treated equally. He is asking
Council to make a formal decision.

Mayor Pro Tem Harris called the regular meeting back to order
with Council Members present as previously reported.
NEW BUSINESS
Proposed resolution- Councilman Morgan said, to her knowledge, the Finance and Per
adding the position sonnel Committee has not met to discuss the addition of the
of City Administrator City Administrator position to the Wage and Salary Plan. Council

Councilman Bohrer said (verbatim): I think the action is an
appropriate one. I think this position is a very important one
for the City so the consideration of what the responsibilities
and duties are and how we select that person should be one that
receives some considerable attention. I do not find that the
job description, the position description that is before us is
consistent with the position specifications, and I do not find
that the position description for the City Administrator really
includes any real definition of administrative functions, if
you will. They are almost totally missing from that description,
so I find, in turn, that this position description does not really
satisfy what I expected of this position. I am not at all happy
with the process that is very sketchily outlined for selecting
the position. I think is is a far more important position than

is being given credit for here, and the process needs to be very
carefully considered on how the person will be selected. I would
like to see all those issues addressed in the Finance and Per-
sonnel Committee before this issue comes back to the Council.
Councilman Phelps said (verbatim): I have an additional comment
to make to the Finance and Personnel Committee as they deliberate
what they are doing here should the motion pass. At the September
26 meeting, although the minutes are not complete on my comments,
I had mentioned that the selection for this position, in my
opinion, should be similar to that for the Police Chief, at the
time that we used -where a committee of people sat in on the
final selection, made recommendations to the Mayor for the person
selected, and I think that was comprised of representatives from
the business community and some interested and concerned citizens.
In that process, somebody from the School District, I believe, was
even included in it -in the Police selection; but at any rate,
that's the tone of the selection process that I favor. We had
talked at the last meeting, also, about getting, from the very
beginning, citizen input to, say, the salary, the job description,
and the advertising, and that sort of thing. But, I think that
is an unnecessary delay to the process. Those are legitimate
functions of the Mayor and the Council to set salary and to set
advertising and the preliminary selection process.
Councilman Morgan said the committee will probably deal with the
City Administrator and the Public Works Director separately.
The entire issue relates to the salary of each position and the
decision whether it is appropriate, at this time, to create the
higher grade in the salary plan or whether there are alternative
means of handling setting a salary for a City Administrator. She
said she had requested that a proposed budget be presented this
evening for the hiring of the Administrator and suggested that
it is also an item for discussion at the Finance and Personnel
Meeting.

BE READ BY TITLE ONLY. MOTION CARRIED.
Attorney Woo read an ordinance of the City of Tukwila, Wash.,
repealing Ordinance No. 849 and TMC Chapter 16.30, relating
to Dangerous Building Code, in its entirety and replacing with
new language.
MOVED BY HILL, SECONDED BY PHELPS, THAT ORDINANCE NO. 1300 BE
ADOPTED AS READ. MOTION CARRIED.
MOVED BY HILL, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE
BE READ BY TITLE ONLY. MOTION CARRIED.
Attorney Woo read an ordinance of the City of Tukwila, Wash.,
amending Ordinance No. 597, Section 2 (1969), and Ordinance
No. 1226, Section 5 (1981) relating to concealed pistol permits
and forfeiture of pistols and declaring an emergency.
MOVED BY HILL, SECONDED BY DUFFIE, THAT ORDINANCE NO. 1301 BE
ADOPTED AS READ. MOTION CARRIED.
Councilman Bohrer said he asked to have the consultant selection
for the 1984 Residential Street Project removed from the consent
agenda because he had some questions. He noted that there is no
one attending this meeting from administration who can speak on
this or any other matter except the Dangerous Building Code. He
said he wanted to know what the City's policy is on the repeated
hiring of consultants that the City has had on jobs.

Councilman Phelps said she discussed this with Mr. Sneva. The
policy of the department is to review the consultant's proposals
as they are submitted for the various projects and to evalute them
on the spread sheet included in the packet. The format is re-
vised for each project depending on its scope. Selecting a new
firm for the sake of using a new firm is no wiser than contracting
with the same firm for every project. If we have a firm and they
rate in the top three and have done a good job in the past, why
not use them again.

ACCEPT STAFF RECOMMENDATION FOR SEA, INC. AS THE CONSULTANT
FOR THE 1984 RESIDENTIAL STREET PROJECT. MOTION CARRIED.
MOVED BY HILL, SECONDED BY DUFFIE, THAT THE REGULAR MEETING OF
THE TUKWILA CITY COUNCIL ADJOURN. MOTION CARRIED.
