You failed to obtain the required permit as provided in this section of the Tukwila
Municipal Code. A Stop Work order was posted at the above captioned site on
March 31, 2011 by the City of Tukwila Building Department.
TMC Chapter:
TMC 16.04.020 Adoption of International Building Code IBC
Specifically:
IBC 105.1 Permits Required. Obtain the required building permit as provided in
this section of Tukwila Municipal Code. Cutting into the slope will require a
retaining wall designed by a licenced enginner.
Specifically:
TMC 16.54..060 Standards. "All grading activities require erosion prevention and
sediment control..." Silt is flowing into the stream and street Right -Of -Way.
Specifically:
IPMC 107.6 Transfer of ownership. "It shall be unlawful for the owner of any
dwelling unit or structure who has received a compliance order or a notice
of violation...to sell, transfer, mortgage, lease or otherwise dispose of
...structure to another..."

FAILURE TO COMPLY WITH THIS ORDER MAY SUBJECT YOU TO A MONETARY PENALTY OF UP TO
$500 PER DAY FOR EACH DAY THAT THE VIOLATION EXISTS UNDER THE PROVISIONS SET FORTH
IN TMC 8.45.100(2).
Appeal Provisions:
Obtain a building permit for a retaining wall. The design and plans of the
retaining wall shall be stamped by a licensed engineer. The Permit should
show the existing and proposed contour lines and temporary and permanent
erosion control measures, per Appendix C Small Site Drainage
Requirements of KC 2009 Surface Water Design Manual. Also, show the
location and size of the trees removed from the slope along with the proposed
new trees to meet TMC 18.54.130 replacement ratios.
Install a silt fence along the bank of the stream and lay down straw
mulch to stabilize exposed soils to prevent erosion and control
sedimentation. Keep the blue tarp over the loose dirt until the building
permit for the retaining zvall is approved.
If property is sold,transfereed, leased or otherwise disposed of a signed
and notiarized statement from the grantee, transferee, mortgagee or
lessee, acknowledging the receipt of notice of violation and fully
accepting the responsibility without conditions for making the
corrections or repairs.

A person may, within ten days of receipt of this notice, file with the City Clerk a written notice of appeal
containing the following:
1. A heading with the words: 'Before the Hearing Officer of the City of Tukwila
2. A caption reading: "Appeal of giving the names of all appellants participating in
the appeal;
3. A brief statement setting forth the legal interest of each of the appellants in the property involved
in the notice and order;
4. A brief statement of the specific order or action protested, together with any material facts claimed
to support the contentions of the appellant or appellants;
5. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside;
6. The signature of all persons named as appellants, and their official mailing address;
7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the
matters stated in the appeal.
8. The appeal fee for violations in the LDR zone is $100.00 and in all other zones is $200.00. Fees
must accompany the written notice of appeal.

Failure to appeal this Violation Notice and Order shell constitute a waiver of all rights to any additional administrative hearings.
