Washington municipal corporation, (hereinafter referred to as
the "City" and Elling Halvorson and Frank R. Lindell, or
their successors, assigns or tenants hereinafteer referred to

WITNESSETH
WHEREAS, the Owner is the owner of a tract of land
described as follows:
The Northeasterly 252 feet of the Northwest one acre of
the Southeast 1.86 acres of Lot 14, also the
Northwesterly 10 feet of the Northeasterly 119.11 feet
of the Southeast 0.86 acres of Lot 14, Fostoria Garden
tracts, according to plat recorded in Volume 9 of Plats,
page 95, King County, Washington, excepting easements of
record and non delinquent installments on Local
Improvement Assessments (LIDS 0290261320004805 0479 and
LIDS 0290261320004706 0479).
WHEREAS, the Owner agrees not to protest the development
of roadways and storm drains for future LIDS adjacent to
above described property.
1. Binding Effect. This Agreement shall be binding
upon the parties, their respective heirs, legal
representatives, assignees, transferees and successors.
2. Recording. This Agreement shall be recorded with
the King County Auditor as required by Chapter 35.91 RCW and
the cost of said recording shall be paid by the Owner.
3. Entire Agreement. This Agreement supersedes any
previous municipal agreements regarding design, installation
or bonding of any improvements by Owner on Owner's property.
This Agreement contains the entire understanding between the
parties hereto, and no other agreements, oral or otherwise,
regarding the subject matter of this Agreement shall be
deemed to exist or to bind any of the parties hereto or to
have any other force or effect.
