RESLOCK and MAUDE MARIE RESLOCK, his wife, hereinafter referred to as Grantors,are the owners of real estate lying adjacent to 58th Avenue South in Tukwila, Washington; and WHEREAS, the CITY OF TUKWILA, Washington, hereinafter referred to as Grantee is maintaining, improving, widening, Cq paving, constructing, repairing, altering and /or reconstruct- ing 58th Avenue South. NOW, THEREFORE, in consideration of One Dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, Grantors hereby grant to Grantee a Temporary Construction Easement during the improving, widen- ing, paving, constructing, repairing, altering, and /or re- construction of 58th Avenue South, for any and all purposes relating to the construction of a driveway access from 58th Avenue South in Tukwila, Washington, into the real estate described hereinbelow, in accordance with the engineering plan entitled "Reslock Driveway access" attached hereto and hereby incorporated in this grant of easement. The temporary construction easement shall commence on the date of this instrument and will terminate on the date the 58th Avenue South improvements have been accepted by the City of Tukwila. Said easement shall be over, under, across, along, in and upon the following described real estate: Lot 27, Block 15, Hillman's Seattle Garden Tracts according to the plat thereof recorded in Vol. 11 of Plats, page 24, Records of King County, Washington. During the period of this easement the City shall have the right of ingress and egress to and from the above Easement No. 14- 107 -16 described property for the foregoing purposes. RESLOCK and MAUDE MARIE 1 RESLOCK, his wife, being the owners of the following-des- cribed real property situated in Tukwila, King County, Washington: Lot 27, Block 15, Hillman's Seattle Garden Tracts according to the plat ,;thereof recorded in Volume 11 of Plats, page 24, records of King County, Washington for and in consideration of One Dollar ($1.00) and the ob- ligation of the City of Tukwila to readjust and /or replace in kind the existing driveway, walkway, stairway, rockery, retaining wall, and fence, and other valuable considera- tions in hand paid, the receipt of which is hereby acknow- ledged, do hereby grant an easement to the CITY OF TUKWILA, a municipal corporation of the State of Washington, to con- struct and maintain a fence adjacent to the right -of -way upon the above described property; and to fill and /or seed slopes of 1 -1/2 feet horizontally for each foot of elevation of fill. Such easement is for the purpose of providing and maintaining lateral support for 58th Avenue South when im- proved to the full width of the right -of -way in conformity with the existing center line grades, and there is reserved to the Grantors, heirs and assigns, the right to remove said slopes at any time :providing and maintaining other ade- quate lateral support. THIS AGREEMENT shall constitute a covenant running with the land. ��11..
