THIS AGREEMENT made this 22nd day of October 1970
1 by and between the CITY OF TUKWILA, a municipal corporation
of King County, Washington, hereinafter termed "Grantee" and
George Forsyth

hereinafter termed "Grantor",
WITNESSETH of One thousand eight hundred andd�

That the said Grantor for valuable consideration /does by these
presents grant unto the Grantee a perpetual right -of -way or easement
for utilities with the necessary appurtenances through, over and
across the following described property situated in King County,
Washington, more particularly described as follows:
This utility easement is through Tax Lot 45 in Section 25,
Township 23 North, Range 4 East, W.M., said Tax Lot is described
as follows:
That portion of the South 1/2 of the NW 1/4 of said Section 25
described as follows:
Beginning at the center of said Section 25;
Thence West 897.56 feet to the centerline of the C.M.St. P. P.
R.R. R /W;
Thence Southerly along said centerline 517.40 feet;
Thence North 46 0 27 1 30" West to the Easterly margin of S.S.H.
No. 5 M;
Thence Northerly along said margin 460 feet to the true point of
beginning;
Thence East to the Westerly line of the P.S.E. R.R. R /W;
Thence Northerly along said line to the Northerly line of the
Southerly 990 feet of the SE 1/4 of the NW 1/4;
Thence West to the Easterly margin of the S.S.H. No. 5 -M;
Thence Southerly along

This easement consists of a 5 foot permanent strip described
as the Easterly 5 feet of the Westerly 15 feet of the above
described Tax Lot.
That said Grantee shall have the right without prior institu-
tion of any suit or proceeding at law, at times as may be necessary,
to enter upon said property for the purpose of constructing, repair-
ing, altering, or reconstructing said utility, or making any connec-
tions therewith, without incurring any legal obligation or liability
therefor; provided that such constructing, repairing, altering, or
r.. reconstructing of said utility shall be accomplished in such a manner
O that the private improvements existing in this right -of -way shall not
be disturbed or destroyed, or in the event they are disturbed or des-
troyed, they will be replaced in as good a condition as they were im-
mediately before the property was entered upon by the Grantee.
The Grantor shall retain the right to use the surface of said
easement, so long as said use does not interfere with the installa-
tion and maintenance of the utlity and so long as no permanent build-
ings or structures are erected on said easement.
This easement shall be a covenant running with the land and shall
be binding on the successors, heirs and,.asigns of both parties hereto.
