Mabel Harris, Council President, led the Pledge of Allegiance
and called the Regular Meeting of the Tukwila City Council to
order in the absence of Mayor Van Dusen.

Mabel Harris, Council President, noted that the Municipal
Code calls for the election of a new Council President at the
second regular meeting in January. She said she has enjoyed
being the Council President. During the year, the 75th
Anniversary of the City, an election was held to see if the
citizens were happy with the form of government they had or
if they wanted a change. This was historic. Hazelnut Park
was dedicated with the play area honoring Mr. and Mrs. Rudolf
Regel. This has been a very interesting year.
COUNCIL PRESIDENT HARRIS NOMINATED MRS. DORIS PHELPS AS
COUNCIL PRESIDENT FOR 1984. NOMINATION SECONDED BY BOHRER.
ALL COUNCIL MEMBERS APPROVED THE NOMINATION.
Mr. Phelps, from the audience, presented his wife with a
gavel to use during her term in office.

c. A resolution of the City of Tukwila, Washington,
authorizing the Mayor to reduce the 1984 Block Grant
Contract for the School Rehabilitation Project by $954.
MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THE CONSENT AGENDA
BE APPROVED AS SUBMITTED. MOTION CARRIED.
Request had been made by William Gossett to allow septic tank
installations on the Shult's property at 14951 57th Avenue
South.
Bryon Sneva, Public Works Director, reported that King County
Health Department has jurisdiction over all sanitary sewer
treatment facilities in King County. The City has no
authority to grant permits for this kind of a system. King
County Health Department will not issue septic tank permits
unless a building permit has been issued first.
Attorney Woo explained that several forms of action could be
taken.
1. Amend the ordinance to change the lineal foot
requirement.
2. Create a special exemption procedure; or
3. Change the zoning code, variance section, to allow the
Board of Adjustment to grant variances for any land use
and regulatory provisions not limited to the zoning code.
He said that, at this point, Council has no choice but to
deny a request for a variance.

MOVED BY HARRIS, SECONDED BY DUFFIE, THAT COUNCIL DENY THE
VARIANCE. MOTION CARRIED.
Mr. William Gossett, 20831 25th Ave. So., Seattle, asked
Council to give him the opportunity to go to King County to
see if they will grant an individual system on this property
according to their codes.
Council President Phelps recommended that Mr. Gossett meet
with Mr. Sneva at the Public Works Department and then go to
the County with the permit application.
MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THE PROPOSED
RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED.
City Attorney Woo read a resolution of the City of Tukwila,
Washington, relating to water mains in Interurban Avenue,
approving acceptance thereof, and authorizing the Mayor to
accept the Bill of Sale.

BE ADOPTED AS READ. MOTION CARRIED.
MOVED BY DUFFIE, SECONDED BY BAUCH, THAT THE PROPOSED
ORDINANCE BY READ BY TITLE ONLY. MOTION CARRIED.
City Attorney Woo read an ordinance of the City of Tukwila,
Washington, setting Council Meeting procedures and repealing
ordinance numbers 1207 and 1259.
MOVED BY MORGAN, SECONDED BY HARRIS, THAT ORDINANCE NO. 1311
BE ADOPTED AS READ.*
Councilman Bauch urged Council to adopt this ordinance. It
is a logical update. It will make the operation of the
Council more efficient.
MOVED BY BOHRER, SECONDED BY MORGAN, THAT THE ORDINANCE BE
AMENDED AS FOLLOWS:
Section 5. A.1 Add "and Planning Department."
A.3 Add "and City Clerk."
A.4 Add "and City Administrator."
A.5 Add "and Sister City Committee."
Section 8.H.5, second sentence should be changed to read "At
Public Hearings where a general audience is in attendance.."

MOVED BY BOHRER, SECONDED BY MORGAN, TO AMEND SECTION I.3.A,
SECOND LINE TO READ, AFTER THE COMMA, "OR IF REQUESTED BY ANY
COUNCIL MEMBER." MOTION CARRIED.
Councilman Bohrer further noted that on page 6, Section
11.C.2, third sentence, the Section B2 should read "A "2.
Councilman Bohrer:
I would also like to respond very briefly to Mayor Van
Dusen's letter to the Council on this ordinance procedure. I
find his letter to us contradictory in itself in noting that
the Council shall determine its own rules and order of busi-
ness, but yet saying, in effect, that he feels he should have
the right to dictate what the agenda is by establishing items
on it. I think there are very many ways that the Mayor has
to make recommendations for legislation and policy to the

Council, not only in his report section but to individual
Council Members, to the Council Committees as well as to the
Council President. And, all I can say is, after he has taken
advantage of all of these avenues that he has available to
him, if the Council still chooses to ignore his recommen-
dations, then he has more than served his statutory duties
under the law and should feel entirely relieved of them. So
I think there are adeqate methods for him to make known his
suggestions and recommendations as required of him by law to
the Council, but it is yet the Council's decision surely
whether they choose to consider them and when.

AMENDED TO CHANGE "(COPYRIGHT 1970)" TO "(LATEST EDITION)."

Councilman Bohrer requested that, once the amendments are
made, and the ordinance is signed, each of the Council
Members receive a copy.
Council President Phelps asked each Council Member to let her
know which Committee they would like to serve on. To prepare
those that would be Chairmen, she would like to see a work
plan from each of the six committees based upon the kinds of
projects and issues that are known at this time and provided
for in the budget.
MOVED BY BAUCH, SECONDED BY BOHRER, THAT THE PROPOSED
RESOLUTION ON THE POSITION CLASSIFICATIONS AND SALARY GRADE
SCHEDULE BE PLACED IN THE FINANCE AND PERSONNEL COMMITTEE.*

Councilman Bauch said he talked with the Finance Director and
the City Clerk and determined that this item was not debated
by Council. Councilman Bohrer noted a memo, dated September
13 from the Mayor. It raises a number of policy issues that
would be at odds with what has been done in the past and
could establish a precedent. He said he would provide this
to the committee and suggest they consider these policy posi-
tions as part of their deliberations.
Councilman Bauch said the committee would look at the labor
settlements for Fire, Police and Teamsters and the cost of
living index. It is all of these items that made administra-
tion arrive at the 5.1% salary increase for the non -union
personnel.

GOES TO THE FINANCE AND PERSONNEL COMMITTEE THERE BE A REPORT
FROM THE FINANCE DIRECTOR INDICATING THE STATUS OF THE
COMPUTER PROGRAM IMPLEMENTING AS WELL AS BACK UP MATERIAL.
MOTION CARRIED.
Council President Phelps thanked her colleagues on the
Council for their confidence in her and the honor they have
bestowed on her. She will do her very best job as the
Council President.

Councilman Bauch expressed concern about the items Council
has put restrictions on in the 1984 Budget and that those
items will be lost throughout the year. He suggested that
the Finance Director provide a document that shows those
items that are controlled by City Council so that anybody
reviewing vouchers or the budget will know immediately which
items Council talked about.
MOVED BY BAUCH, SECONDED BY BOHRER, THAT ADMINISTRATION
PROVIDE DOCUMENTATION TO THE CITY COUNCIL THAT LISTS THOSE
ITEMS THAT WERE RESTRICTED IN THE 1984 BUDGET UNTIL FUTURE
ACTION IS TAKEN. MOTION CARRIED.
Councilman Bohrer said he would like the Park and Open Space
Plan to come back to a Committee of the Whole for discussion
prior to approval.
