to tide plat thereof recorded in Vol. 11 of Plats, Page 24, Records
of King County, Washington
for and in consideration of One Dollar($1.00) and the obligation of
the City of Tukwila to readjust arid/or replace in kind the e::isting
driveway, walkway, stairway, rockery and retaining wall,
and other valuable considerations in hand paid, the receipt of which
is hereby acknowledged, do_hereby grant an easement to the CITY OF
TUKWILA, a municipal corporation of the State of Washington, to con-
struct and maintain upon the above de --criiaed property; cut slopes
and fill slopes of 1 1 /2feet horizontally for each foot of elevation
of cut or fill. Such easement is for the purpose of providing and
maintaining lateral support for _58th Ave. Smith when improved to
the hill width of the right of way in conioriiiity with the existing
center line grades, and there is reserved to the Grantor(s),
heirs and assigns, the right to .r_cmove said slopes at any time upon
providing and maintaining other adequate lateral support.
THIS AGREEMENT shall constitute a covenant running with
the land.

the date of this instrument and will terminate on the date the
58th Ave. South improvements have been accepted by the City

Said shall be over, under, across, along, in
and upon the following described real estate:
The East 100' of
Lot 1 12 Block Hillman's Seattle Garden Tracts, according
to the plat thereof recorded in Vol. 11 of Plats, Page 24, Records
of King County, Washington
During the period of this casement the City shall have the
right of ingress and egress to and from the above described property
for the foregoing purposes.
