E A S E M E N T
THIS AGREEMENT made this 2 7 `l day of
19 10 by and between the
CITY OF TUKWILA, a municipal corporation of King County,
Washington hereinafter termed "Grantee" and
B.N.P. Company
and
hereinafter termed "Grantor
WITNESSETH:

That the said Grantor for valuable consideration does
by these presents grant unto the Grantee a perpetual right
of -way or easement for utilities with the necessary appurtenances
through, over and across the following described property
situated in King County, Washington, more particularly described
as follows:
This sewer easement is through Tax Lot 52 in Section 25, Township
23 North, Range 4 East, W.M., said tax lot is described as follows:
That portion of Government Lot 6 in the SW 1/4 of said Section
25 between the Easterly margin-of S.S.H. No. 5 -M and the Westerly
margin of the P.S.E. Railroad right -of -way south of a line running
S. 88 0 31'00" East, 171.38' from a point N. 1 °38'20" East, along the
Easterly margin of S.S.H. No. 5 -M, 473.64 feet from the intersection
of the Southerly line of said Government Lot 6 and said Easterly.
Highway Margin.
This easement- consists of a 10 foot permanent strip described
as the Westerly 10 feet of the Southerly 60 feet of said Tax Lot 52.
TOGETHER WITH a 30 foot temporary construction easement descri-
bed as the Westerly 30 feet of the Southerly 60 feet of said Tax Lot
52.
Said temporary construction easement shall remain in force dur-
ing construction and until such time as the sewers and appurtenances
have been accepted for maintenance and operation by the City of Tukwila.

That said Grantee shall have the right without prior institution
of any suit or proceeding at law, at times as may be necessary, to enter
upon said property for the purpose of constructing, repairing, altering,
or reconstructing said Sewer Main, or making any connections therewith,
without incurring any legal obligation or liability therefor; provided
that jsixck constructing, repairing, altering, or reconstructing of said
sewer main shall be accomplished in such a manner that the private
improvements existing in this right -of -way small not be disturbed or
destroyed, or in the event they are disturbed or destroyed, they will
be replaced in as good a condition as they were immediately before
O Q the property was entered upon by the Grantee.

The Grantor shall retain the right to use the surface of said
r easement, so long as said use does not interfere with the installation
and maintenance of the sewer main and so long as no permanent buildings
or structures are erected on said easement.
This easement shall be a covenant running with the land and shall
be binding on the successors, heirs, and assigns of both parties hereto.
The Grantee, anything notwithstanding, agrees that auto and truck entry and
exit across this permanent and temporary easement will not be blocked at any time.
