Cook; his wife here- inafter referred to as Grantor(s) is /are the owner(s) of real estate lying adjacent to South 141st Place in Tukwila, Wash- ington, and, WHEREAS the City of Tukwila, Washington, hereinafter referred to as Grantee is maintaining, improving, widening, paving, M constructing, repairing, altering and /or reconstructing South 141st .4;,- Place Q 00 NOW, THEREFORE, in consideration of One Dollar ($1.00) CD and other good and valuable consideration, the receipt of which is hereby acknowledged, Grantor(s) hereby grant( to Grantee a Temporary Construction Easement during the improving, widening, paving, constructing, repairing, altering, and /or reconstruction Of South 141st Place for any and all purposes relating to said improving, widening, paving, constructing, repairing, altering, and /or reconstruction of South 141st Place The temporary construction easement shall commence on the date of this instrument and will terminate on the date the South 141st Place improvements have been accepted by the City of Tukwila. Said easement shall be over, under, across, along, in and upon the following described real estate: That portion of Lots 30, 31, 32, Block 8, Plat of Hillman's Seattle Garden Tracts, as recorded in plat Volume 11, Page 24, records of King County, Washington, described as follows Beginning at the southwest corner of said lot 30, thence east along said lot line, a distance of 72.50 feet to the true point beginning; thence north 16.00 feet; thence north 20 east to the northeasterly line of said lot 32; thence southeasterly along said lot line 31 and 32 produced to the northwesterly margin of 58th Avenue South; thence southwesterly along said margin to a point which bears east from the true point of beginning; thence west to the true point of beginning. During the period of this easement the City shall have the right of ingress and egress to and from the above described property for the foregoing purposes. DATED this day of 1970. Cook. his wife being the owners of the following described real property situated in Tukwila, King County, Washington: U') C) That portion of Lots 30, 31, and 32, Block 8, Plat of Hillman's CC) Seattle Garden Tracts, as recorded in plat Volume 11, Page 24, t 0 records of King County, Washington described as follows: Beginning at the southwest corner of said lot 30, thence east along said lot line, a distance of 72.50 feet to the true point beginning; thence north 16.00 feet; thence north 20 east to the northeasterly line of said lot 32; thence southeasterly along said lot line 31 and 32 produced to the northwesterly margin of 58th Avenue South; thence southwesterly along said margin to a point which bears east from the true point of beginning; thence west to the true point of beginning. for and in consideration of One Dollar($1.00) and the obligation of the City of Tukwila to readjust and /or replace in kind the existing driveway, walkway, stairway, rockery and retaining wall, and other valuable considerations in hand paid, the receipt of which is hereby acknowledged, do hereby grant an easement to the CITY OF TUKWILA, a municipal corporation of the State of Washington, to con- struct and maintain upon the above described property; cut slopes and fill slopes of 1;5 feet horizontally for each foot of elevation of cut or fill. Such easement is for the purpose of providing and maintaining lateral support for South 141st Place when improved to the Lull width of the right of way in conformity with the existing center line grades, and there is reserved to the Grantor(s), heirs and assigns, the right to remove said slopes at any time upon providing and maintaining other adequate lateral support. THIS AGREEMENT shall constitute a covenant running with the land.
