SPECIAL MEETING FLAG SALUTE AND CALL TO ORDER ROLL CALL OF COUNCIL MEMBERS OFFICIALS IN ATTENDANCE Appointment to the position of City Attorney ADJOURNMENT 7:15 P.M. M I N U T E S 4/ City Hall Mayor Van Dusen led the audience and City Council Members in the Pledge of Allegiance and called the Special Meeting of the Tukwila City Council to order. EDGAR D. BAUCH, L. C. BOHRER, WENDY MORGAN, DORIS PHELPS (Council President), CHARLIE E. SIMPSON. City Clerk Maxine Anderson, Planning Director Brad Collins, Fire Chief Hubert Crawley, Assistant Planner Rebecca Fox, Public Works Superintendent Ted Freemire, Police Chief Pat Lowery, Public Works Director Byron Sneva, Director of Parks and Recreation Don Williams, City Attorney Dan 1ioo. Mayor Van Dusen read a letter from City Attorneys Larry Hard and Dan Woo resigning from the position of City Attorney effective February 1, 1984. They thanked the City for the privilege of serving as the City Attorney. Mayor Van Dusen asked for the appointment of John D. Wallace and Larry C. Martin of the law firm of Ogden, Ogden and Murphy as City Attorney. COUNCILMAN HARRIS ARRIVED AT THE MEETING AT 7:05 P.M. MOVED BY PHELPS, SECONDED BY HARRIS, THAT THE CITY COUNCIL CONCUR WITH THE MAYOR'S RECOMMENDATION AND APPOINT JOHN D. WALLACE AND LARRY C. MARTIN OF THE LAW FIRM OF OGDEN, OGDEN AND MURPHY AS CITY ATTORNEYS. Councilman Harris said she did not concur with the charges for LID's as outlined in the contract. Councilman Bauch concurred with Councilman Harris's remarks. MOVED BY BAUCH, SECONDED BY MORGAN, TO AMEND THE MOTION AND DELETE ALL REFERENCES TO LID FEES IN THE CONTRACT WHILE THE CITY SEEKS OUT ANOTHER ATTORNEY FOR LIDS. Mr. Wallace said they would concur with the exclusion of LID fees and it can be a subject of future negotiation. *MOTION CARRIED. Councilman Bohrer said one of the issues that frequently arises is the difficulty for the City Attorney, when the Mayor and the City Council are not in agreement, to give an opinion. He asked how the City Attorney would deal with such an issue. Mr. Wallace said they are the City Attorneys and will give their opinions in accordance with their interpretation of the law. If it is a controversial issue they will make the decision in writing and send it to administrative and legislative branches of the City. He said they would offer discussion on the pros and cons of the issue. Mr. Wallace said P•lr. Martin will attend most of the meetings; however, both of them will be here some of the time. *MOTION CARRIED, AS AMENDED. MOVED BY BAUCH, SECONDED BY MORGAN, THAT THE SPECIAL MEETING ADJOURN.
