herein called "Grantor" (s} and CITY OF TUKWILA, a municipal corpora
tion of King County, Washington, herein called "Grantee."

That said Grantor(s.) for and in consideration of the sum of

in hand paid by said Grantee, and other valuable consideration, receipt
of which is hereby acknowledged, does by these presents grant unto
the Grantee a temporary right -of -way or easement to be used only
during construction of utilities on adjacent property, said temporary
easement to cease and determine upon acceptance of the utilities
for maintenance and operation by the Grantee. The said temporary
right -of -way or easement shall be through and across the following
described property situated in King County, Washington, more
particularly described as follows:
This temporary construction easement is through Tax Lot 45 in
Section 25, Twp. 23 North, Range 4 East, W.M., Said Tax Lot is
described as follows:
That portion of the South 2 of the NW 4 of said Sec. 25
described as follows:
Beginning at'the center of said Sec. 25;
Thence West 897.56 ft. to the centerline of the C.M.St.P. &.P.
R.R. R /W;
Thence Sly along said centerline 517.40 ft.;
Thence N 46 West to the Ely margin of S.S.H. No. 5 -M;
Thence Nly along said margin 460 ft. to the true point of
beginning;
Thence East to the Wly line of the P.S.E: R.R. R /W;
Thence Nly along said line to the Nly line of the Sly 990 ft.
of the SE 4 of the NW 4;
Thence W to the Ely margin of the S.S.H. No. 5 -M;
Thence Sly along said margin to the T.P.O,B.
This temporary construction easement'consists of .a 30' strip des
cribed the Wly 30' of the above described property.
Said temporary construction easement shall remain in force
during construction and until such time as the sewers and appur-
tenances have been accepted for maintenance and operation by the
City of Tukwila.

The said Grantee shall have the right without prior institution
of any suit or proceeding at law, at such times as may be necessary,
to enter upon said construction right -of -way for the purpose of con-
structing, repairing, altering or reconstructing said sewer main, or
making any connections therewith, without incurring any legal obliga-
tion or liability therefor; provided that such constructing, repair-
ing, altering or reconstructing of said sewer main shall be accomplish-
ed in such a manner that the private improvements existing in this
right -of -way shall not be disturbed or destroyed, or in the event that
they are disturbed or destroyed, they will be replaced in as good a
condition as they were immediately before the property was entered
upon by the said Grantee.
The Grantor shall retain the right to use the surface of said
right -of -way if such use does not interfere with installation of the
sewer main. However, the Grantor shall not erect buildings or struc-
tures on the right -of -way during the existence of said right -of -way.
The right -of -way, during its existence, shall be a covenant run-
ning with the land and shall be binding on the successors, heirs, and
assigns of both of the parties hereto.
