I, HELEN B. NELSEN, declare that I am the owner in fee of the property
commonly known as 15802 West Valley Road, Tukwila, Washington, legally described
as follows:
A portion of Henry Meador Donation Claim number 46.
Beginning at the intersection of South 158th Street
(also known as Longacres Way) and West Valley Highway
(also known as State Highway 181) running Southerly
230 feet along the East line of West Valley Highway;
thence Easterly 100 feet; thence Northerly 230 feet to
the Southerly border of South 158th Street; thence
Westerly 100 feet to the point of beginning, situated
in King County, State of Washington.
Further, in consideration of issuance of a street use permit in connection
with implementation of design submitted by Auburn Lincoln Mercury, Inc. (Job
#8012), whereby use will be made of a portion of the public right -of -way adjacent
to the aforedescribed property, I hereby covenant in favor of the CITY OF TUKWILA
that within two weeks of receipt of a written request by the City of Tukwila
I shall remove, relocate, modify or otherwise change the planters allowed in the
public right -of -way, and restore the property to its original condition. Also,
within two weeks of receipt of written request of the City of Tukwila, I shall
prune trees and /or plantings, or remove dead trees or plantings within the public
right -of -way, to the satisfaction of the Public Works Director of the City of
Tukwila.
This Agreement shall be a covenant running with the aforedescribed real
properties and shall be binding on the owners, its heirs, successors and assigns.

On this date before me personally appeared HELEN B. NELSEN, to me known
to be the individual described in and who executed the foregoing instrument, and
acknowledged to me that she signed and sealed the said instrument as her free and
voluntary act and deed, for the uses and purposes therein mentioned.
