MINUTES
COMMITTEE OF THE WHOLE MEETING
CALL TO ORDER /PLEDGE OF ALLEGIANCE
Council President Seal called the Tukwila City Council meeting to order at 7:02 p.m. and led the audience
in the Pledge of Allegiance.
OFFICIALS
Present were Verna Seal, Council President, Councilmembers Joe Duffie, Dennis Robertson,
Allan Ekberg, Kathy Hougardy, De'Sean Quinn, Kate Kruller.
CITY OFFICIALS
Jim Haggerton, Mayor; Bob Giberson, Public Works Director; Ryan Larson, Senior Engineer; Jack Pace,
Community Development Director; Rebecca Fox, Senior Planner; Mary Miotke, Information Technology
Director; Peggy McCarthy, Interim Finance Director; Evelyn Boykan, Human Services Manager;
Kimberly Matej, Council Analyst; Melissa Hart, Deputy City Clerk.
SPECIAL PRESENTATION
a. 2011 Business Recycler of the Year.
Rebecca Fox, Senior Planner, explained the Tukwila Business Recycling Program offers free assistance
to Tukwila businesses to reduce waste and to start or improve an existing recycling program. Ms. Fox
announced United Stationers Supply (USS) has been selected as the 2011 Tukwila Business Recycler of
the Year. They are a national wholesale distributor of business products, including office products,
computer supplies and office furniture.
In 2011, United Stationers Supply Company's Green Team partnered with the City of Tukwila and Rock
Tenn Recycling to identify ways to enhance their recycling and waste reduction program. Their goal was
to enhance the company's sustainability culture with the full participation of their 53 associates, and in
one year they increased their recycling rate from 51 to 84
In addition to increasing their recycling, USS teamed up with Puget Sound Energy to utilize their energy
efficiency rebate program to become more energy efficient through a complete lighting retrofit project
utilizing more energy efficient light bulbs and light sensors.
Mayor Haggerton presented Ling Weaver, Officer Manager, Dan Phipps, Operations Manager, Larry
Wood, Distribution Associate and Teri Spurgeon, Distribution Associate, with the 2011 Tukwila Business
Recycler of the Year award (which is made from recycled glass).
The City Councilmembers thanked the representatives from United Stationers Supply for their
contributions toward the Company's recycling program.

Council President Seal indicated this item was discussed at the Community Affairs and Parks Committee
meeting on December 12, 2011. The committee members were unanimous in recommending approval.
Evelyn Boykan, Human Services Manager, explained the City of Tukwila, under the administration of the
Human Services Office, has served as fiscal agent and contract manager for the collaborative Joint Minor
Home Repair program since 2005. The success of the program has drawn attention from surrounding
cities. Participating cities include Tukwila, SeaTac, Des Moines, Covington, and the City of Pacific will
also participate in 2012. In 2011, the City of Tukwila provided service to 25 Tukwila families. The Council
is being asked to authorize the Mayor to sign the Interlocal Agreement in the amount of $125,000, which
is funded by Community Development Block Grant funds.

b. An Interlocal Agreement with the City of Renton for the Sounder Commuter Rail Station.
Council President Seal indicated this item was discussed at the Community Affairs and Parks Committee
meeting on December 12, 2011. The committee members were unanimous in recommending approval.
Jack Pace, Community Development Director, explained Sound Transit plans to apply for construction
permits at the end of 2012. This Interlocal Agreement assigns permitting and inspection authority to the
City of Tukwila for the use and construction of portions of the train stop improvements that will occur
within the city limits of Renton. Examples of the improvements that will be located in Renton are portions
of the northbound platform, pedestrian circulation on the east side, and vehicular emergency access.

c. Duwamish Gardens:
Council President Seal indicated this item was discussed at the Community Affairs and Parks Committee
meeting on December 12, 2011. The committee members were unanimous in recommending approval.
1. An amendment to the grant agreement with the Washington State Recreation and
Conservation Office.
2. A design contract with JA Brennan Associates.
Ryan Larson, Senior Engineer, stated the City received grant funding for the design portion of the
Duwamish Gardens Project from the Washington State Recreation and Conservation Office (RCO) in the
amount of $197,299.00, and $52,919.34 from the King Conservation District. Mr. Larson provided an
overview of the project and distributed a color aerial photo of the project site. Upon completion of the
request for qualifications process, staff began negotiating a scope of work and fee from the selected
design consultant. Mr. Larson explained staff has been negotiating with the selected design consultant,
and it was determined additional funding would be necessary to complete the project design. Staff
contacted the RCO and was able to obtain additional grant funds in the amount of $50,045.00 for the
project design.
Don Scanlon, 13410 40 Avenue South, feels the Duwamish Gardens Project will improve the Duwamish
River. He feels this is a very rare opportunity to enhance the environment, and he asked that the site be
targeted as a spawning site for Chinook salmon. Additionally, he feels the completed project should
require a 5 -year inspection by the contractor and a site maintenance plan for continued site maintenance.
The Council asked clarifying questions of staff on the above topic.

d. A resolution establishing legislative priorities for the 2012 legislative session.
The resolution establishing legislative priorities is intended to be utilized as a tool for Councilmembers
when they meet with State Legislators in Olympia in February 2012.
Kimberly Matej, Council Analyst, explained the draft resolution contains new language that identifies the
State Legislative Agenda as a list of priority items and does not preclude the Council from opposing or
supporting additional items that may arise during the session. She explained that because of the input
from staff, additional legislative items have been reviewed and were supported by the Council in the past.
The Councilmembers exchanged comments and conducted a detailed review of the proposed legislative
agenda and requested that staff enhance the language relating to maintaining Streamlined Sales Tax
Mitigation and Environment and Water relating to the SEPA exemption threshold.

Council President Seal announced the Executive Session listed on this evening's agenda at the end of
the meeting has been cancelled.
REPORTS
a. Mayor
Mayor Haggerton commented on the Streamlined Sales Tax Mitigation issue listed on the legislative
priorities list. He explained the formula established by the Washington Department of Revenue is flawed,
in that the City is penalized for the new businesses in Tukwila. Additionally, he feels a request for more
jurisdiction flexibility relating to the Real Estate ExciseTax (REET) funding should also be addressed at
the Legislative Action Conference.
On January 4, 2012 he attended the Suburban Cities orientation meeting, and on January 6, 2012, he
attended the Legislative Coalition Breakfast and Valley Communication Board meetings. Mayor
Haggerton announced the Finance Director position announcement has been advertised and is available
on the City's website.
He stated he received a request from the Association of Washington Cities to sign a letter to Governor
Gregoire supporting her request to change marijuana from a Schedule 1 drug to a Schedule 2 drug. He
explained he would not be signing the letter of support due to the City's current medical marijuana
moratorium, unless the Council chooses to revisit the issue and the moratorium.
b. City Council
Councilmember Duffie thanked Councilmember Ekberg for his service as Council President in 2011.
Council President Seal attended the January 5, 2012 Equity and Diversity Commission meeting.
Councilmember Ekberg attended the 2012 Legislative Coalition Breakfast on January 6, 2012.
Councilmember Hougardy attended the 2012 Legislative Coalition Breakfast on January 6, 2012.
Councilmember Kruller attended the 2012 Legislative Coalition Breakfast on January 6, 2012.
c. Staff
The City Administrator was not present.
d. City Attorney
The City Attorney's presence is not required at Committee of the Whole meetings

e. Intergovernmental
Kimberly Matej, Council Analyst, reminded the Council of the AWC Legislative Conference January 25,
and 26, 2012 in Olympia. The first Council Coffee Chat for 2012 will be Saturday, January 14, 2012 at
Foster Golf Course, 13500 Interurban Avenue in Tukwila. Additionally, the Council Retreat will be the last
weekend in February 2012.
MISCELLANEOUS
Council President Seal requested a discussion of Council representation on regional, state, and national
committees and commissions and /or boards for the 2012 calendar year.
