HomeMy WebLinkAbout1970 - Easement - Crane Hoist Engineering Corporation - 6707999r 6'07999 E A S E M E N T THIS EASEMENT granted this 13th day of Tiny 1970, to the City of Tukwila, a municipal corporation of King County, Washington, hereinafter referred to as "Grantee by Crane Hoist Engineering Corporation of Washington, hereinafter referred to as "Grantor W I T N E S S E T H: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right -of -way or easement for utility mains and lines with the necessary appurtenances through, over and across the following described property situated in King County, Washington, more particularly described as follows: The westerly 5 feet of the northerly 10 feet of Lot 24, Block 17 of Hillman's Seattle Garden Tracts as recorded in Plats, Vol. II, page 24, Records of King County, Washington; and the westerly 5 feet of Lot 31, Block 17 of Hillman's Seattle Garden Tracts as recorded in Plats, Volume II, Page 24, Records of King County, Washington In addition to the foregoing, said Grantor does by these presents grant unto the Grantee a temporary construction ease- ment through, over and across the following described property situated in King County, Washington, more particularly described as follows: The westerly 15 feet of the northerly 20 feet of Lot 24, Block 17 of Hillman's Seattle Garden Tracts as recorded in Plats, Vol. II, page 24, Records of King County, Washington; and the westerly 15 feet of Lot 31, Block 17 of Hillman's Seattle Garden Tracts as recorded in Plats, Vol. II, page 24, Records of King County, Washington. The temporary construction easement shall commence on the f date of this instrument and will terminate on the date the utilities and appurtenances constructed in said easement have been accepted for maintenance and operation by Grantee. a .1 Said Grantee shall have the right, without prior institution or any suit or proceeding at law, at such times as may be necessary to enter upon said property for the purpose of constructing, repair- ing, altering or reconstructing utility lines or mains or making any connections therewith, without incurring any legal obligation or liability therefor, provided that such constructing, repairing, altering or reconstructing of such utility lines or mains shall be accomplished in such a manner that the fences, lawn, shrubbery, drives and walkways and land contours existing in the right -of -way shall not be disturbed or destroyed, or in the event that they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation and maintenance of the utility lines or mains and so long as no buildings or structures are erected on said easement. Grantee shall protect and save harmless Grantor from and against any claims, suits, actions, losses, damage expense and liability of every kind'and description and for any damage to or loss or destruction of property suffered by Grantor, as a result of Grantee or its agents' negligence occurring in the construction and /or maintenance of said facilities by Grantee. No above the ground stand pipes, hydrants or other appurtenances shall be located within or upon the permanent easement without the knowledge and prior consent of the Grantor. Martin Benchoff and Kenneth Kilhefner to me known to be the President and Secretary respectively, of CRANE HOIST ENGINEERING CORPORATION OF WASHINGTON, the corporation that executed the foregoing instrument, and acknowledged the said instrument to be the free and voluntary act and deed of said corporation, for the uses and purposes therein mentioned, and on oath stated that they are authorized to execute the said instrument and that the seal affixed is the corporate seal of said corporation.
