Violation # 1 TREE REMOVAL IN SENSITIVE AREA WITHOUT PERMIT
Code Reference: TMC 18.45.030 SENSITIVE AREA APPLICABILITY, MAPS, AND INVENTORIES
A. Applicability — ... No person, company, agency, or applicant shall alter a
sensitive area or buffer except as consistent with the purposes and
requirements of TMC chapter 18.45. The following are sensitive areas
regulated by TMC chapter 18.45:
2. Areas of potential geologic instability: class 2, 3, 4 areas (as defined
in the definitions chapter of this title and TMC 18.45.120.a);
TMC 18.54.170 VIOLATIONS.
The following actions shall be considered violations of this chapter:

authorized under or in accordance with an approved Tree Clearing Permit,
where such permit is required, or not in accordance with the provisions of
this chapter. Each tree which is cleared, not replaced, or not maintained
as required by this chapter shall constitute a separate violation.
On November 7, 2018 I observed several trees in the process of being cut
down and removed from behind the building on this parcel. I observed
the downed trees from the public right-of-way on 57th Ave S.
The area behind this building is designated as a Class 3- High hazard
Landslide area as well as a Mine Hazard area (King County/Tukwila GIS
iMap enclosed for reference).
This property is zoned RCM.
Tree Permit #119-0097 application was submitted on September 30, 2019
and a follow-up Notice of Incomplete Application letter was sent to the
applicant Geno Sabra on October 9, 2019.
The Tree Permit application has not been completed or extended within
90 days of this Notice and has now expired.
Corrective Action: Contact City of Tukwila Planning Division at 206-431-3670, or in person at
6300 Southcenter Blvd., Suite 100, during business hours to apply for and
receive a new Tree Removal and Landscape Modification Permit, and to
discuss permitting and/or mitigation requirements for the trees that have
been removed.
Compliance Date: Submit a complete Tree Removal and Landscape Modification permit
application on or before February 21, 2020.
Comply with all requirements and deadlines of the Tree Removal Permit
once approved.
This is a notice that your property is in violation of the Tukwila Municipal Code. You must
complete the corrective action noted above by the compliance date indicated.
FAILURE TO COMPLY WITH THIS ORDER SHALL SUBJECT YOU TO A MONETARY PENALTY OF UP TO
$250 PER DAY PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PURSUANT TO TMC 8.45.120(2).

NOTICE OF VIOLATION AND ORDER - Per TNIC 8.45.070
Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City
Clerk a written notice of appeal along with payment of the $300 appeal fee,
containing the following:
1.The Code Enforcement case file number;
2.A brief statement setting forth the names, mailing address(es), and legal interest of
each of the persons appealing this notice and order;
3.A brief statement of the specific order or action protested, together with any
supporting facts; and
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice
and order should be reversed, modified, or otherwise set aside.
Any appeal of this Notice of Violation and Order must be filed WITHIN 10 DAYS of being
served this notice. There will be no other opportunity to appeal this order, and
noncompliance with this order may result in further legal action.
