Scholes here- inafter referred to as Grantor(s) is /are the owner(s) of real estate lying adjacent to S. 147th Street in Tukwila, Wash- ington, and, NT WHEREAS the City of Tukwila, Washington, hereinafter CC) referred to as Grantee is maintaining, improving, widening, paving, constructing, repairing, altering and /or reconstructing S. 147th Street. NOW, THEREFORE, in consideration of One Dollar ($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, Grantor(s) hereby grant(s) to Grantee a Temporary Construction Easement during the improving, widening, paving, constructing, repairing, altering, and /or reconstruction Of S. 147th Street for any and all purposes relating to said improving, widening, paving, constructing, repairing, altering, and /or reconstruction of S. 147th Street The temporary construction easement shall commence on the date of this instrument and will terminate on the date the S. 147th Street improvements have been accepted by the City of Tukwila. Said easement shall be over, under, across, along, in and upon the Northerly 4 feet of the following described property: Lot 19, Tri Vista Terrace according to plat recorded in Vo. 53 of Plats, Page 28, in King County, Washington. During the period of this easement the City shall have the right of ingress and egress to and from the above described property for the foregoing purposes. DATED this,;?,�N� day of 1970. Scholes being the owners of the following described real property situated in Tukwila, King County, Washington: Lot 19, Tri Vista Terrace, according to plat recorded in Vol. 53 00 of plats, Page 28, in King County, Washington O �D I for and in consideration of One Dollar($1.00) and the obligation of the City of Tukwila to readjust and /or replace in kind the existing driveway, walkway, stairway, rockery and retaining wall, uu► 61 h o t C�►StL'tr tr 0 1 �)o r th Loe.sT Gorne; and other valuable considerations in hand paid, the receipt of which is hereby acknowledged, do hereby grant an easement to the CITY OF TUKWILA, a municipal corporation of the State of Washington, to con struct and maintain upon the above described property; cut slopes and fill slopes of 1 1 /2feet horizontally for each foot of elevation of cut or fill. Such easement is for the purpose of providing and maintaining lateral support for S. 147th Street when improved to the Lull width of the right of way in conformity with the existing center line grades, and there is reserved to the Grantor(s), heirs and assigns, the right to remove said slopes at any time upon providing and maintaining other adequate lateral support. THIS AGREEMENT shall constitute a covenant running with the land.
