TMC 18.45.195 VIOLATIONS.
A. The foliowing actions shall be considered a violation of this chapter:
1. To use, construct or demolish a structure or to conduct clearing, earth-
moving, construction or other development not authorized under a Special
Permission, Reasonable
Use or other permit where such permit 15 required by this chapter.
2. Any work that is not conducted in accordance with the plans, conditions,
or other requirements in a permit approved pursuant to this chapter,
provided the terms or conditions are stated in the permit or the approved
plans.
On February 9, 2018, | observed vegetation being disturbed and removed on
the east side ofthe property behind the house. A "stop work" notice was
posted on the property on that date, requiring the owner apply for a permit
to work in a sensitive area.
On February 13, 2018, a Special Permission permit application was
submitted. The application was deemed incomplete and required additional
information. A one-year extension was granted until July 11, 2019 to submit
a completed application. To date, this information has not been provided,
and the Special Permit is still considered incomplete.
On February 15, 2018, the owner signed a Notice of Sensitive Area
document, which was recorded with King County on February 16, 2018
under recording #2O18OZl6OUO1S7.The document states that "this
property contains environmentally sensitive areas and/or environmentally
sensitive area buffers, regulated by the Tukwila Environmentally Sensitive
Ordinance and Title 18 of the Tukwila Municipal Code. ..."
Research on Tukwila GIS iMap indicates this property contains a Type 4
Corrective Acion: stream and 50 foot stream buffer area.
Contact a planner to complete the Special Permit application #L18-0014
and to discuss mitigation requirements for vegetation that has been
removed. Submit a completed application and mitigation plan and
complete requirements of the approved permit within the timeline
provided.
A planner is on duty at the Permit Center during business hours 8:3Oam to
4:30 pm Monday to Friday, excluding holidays. The Permit Center 15
Iocated at 6300 Southcenter BIvd, Suite 100. You may also speak to the
planner on duty by calling 206-431-3670 during business hours. Reference
Compliance Date: the Special Permit application #118-0014.
Submit a completed Special Permit application by September 16, 2019
This is a notice that your property is in violation of the Tukwila Municipal Code. You must
complete the corrective action noted above by the compliance date indicated.
FAILURE TO COMPLY WITH THIS ORDER SHALL SUBJECT YOU TO A MONETARY PENALTY
OF UP TO
$250 PER DAY PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PURSUANT

Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City
Clerk a written notice of appeal along with payment of the $300 appeal fee,
containing the foliowing:
1. The Code Enforcement case file number;
2. A brief statement setting forth the names, mailing address(es), and legal interest of
each ofthe persons appealing this notice and order;
3. A brief statement of the specific order or action protested, together with any
supporting facts; and
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and
order should be reversed, modified, or otherwise set aside.
Any appeal of thls Notice of Violation and Order must be filed WITF4IN 10 DAYS of being served this
notice. There will be no other opportunity to appeal thisurder,andnuncomp|kanwewiththbnrder
may result in further legal action.
