WHEREAS, Developers develop

marketing center on the above described property and in order
to do s0 it is necessary that provision be made for water and
sewage services and for storm drainage,
'�O W, THEREFORE, T.7e Developers and the City of
T-ukrlila agree as follows:
1. Developers at their expense will install facili-
ties for sanitary sewers, water and storm drains, all of which
shall meet the engineering standards of m

2 Developers will agree to include their prop-
erty within a Local improvement District to be formed for the
purpose of providing sanitary
sewage Y wage services for the prop-
ove described and for surrounding property.
3. On a temporary basis sanitary sewers will make
use of a holding tank provided such system is approved by the
1• =__g County Health Department.
4 Developers shall receive the approval of the-
Washington Rating Bureau regarding the adequacy of existing
water lines for fire prevention requirements and will hold
the City of Tukwila harmless from any loss because of inade-
quate water service for fire protection.
5. The City of Tukwila will issue necessary
building permits to enable Developers to begin construction
immediately.
6. Issuance of building permits for second phase
construction shall be contingent upon Developers' fulfilling
the terms of this agreement.

TO: The Honorable City Council of the City of Tukwila:

(2) the area within the proposed District,
do hereby petition the City Council of the City of Tukwila to
order a Local improvement District under the petition method,
the assessment district for which does not extend beyond the
termini of the improvement.
The nature of the improvement shall be the construction
of sanitary
laterals and trunks to serve Lots 14, 15, 16,
17 and surrounding area of Fostoria Garden 'Practs, as recorded
in Volume 9, page 95, Records of Plats, Ring County, Washington,
situated in Ring County, Washington.
This construction will consist of sewer mains, manholes,
side sewers and appurtenances related to sound sewer construction.
All of the cost of the improvement shall be allocated
and borne by the property within the improvement District.
The City of Tukwila shall cal for bids for sanitary
sewers and appurtenances, as designed by a city employed engineer,
to serve the area within the proposed L.I.D. boundary.
Included in the cost of this improvement shall a,

Professional services necessary for the imorovement; c, asoar-
taining the ownership of lots or parcels of land included;
d, appraisals; e, assessmenf. roll; f, advertisinc mailing,
posting, publishing -all not ices; g, taxes and administrative
costs; h, acquisition of rights of wa2; i, financing;
j. all other expenses incidental thereto as required or provided
by the law of the State of Washington or ordinances of the City
of Tukwila.
