The temporary construction easement shall commcncc on
the date of this instrumnrlt and will terminate on the date the
58th Ave. South improvements have been accepted by the City

and upon the following described real estate:
.Lots i3 yl7, Block i'/ Hililiian's Seattle Garden Tracts, according
to the plat thereof recorded in Vol. 11 of Plats, Page 24, Records
of King County, Washington
During the period of this casement the City shall have the
right of ingress and egress to and from the above described property
for the foregoing purposes.

for and in consideration of One Dollar ($1.00) the obligati -on of
the City of Tulkwila to readjust and /or replace in kind the existing
driveway, walkway, stairway, rockery and retaining wall, and grade
yard_to the level of the new sidewalk grade.
and other_ valuable considerations in hand paid, the receipt of which
is hereby acknowledged, do hereby grant an easement to the CITY OF
TUKWILA, a municipal corporation of the State of Washington, to con-
struct and maintain upon the above described property; cut slopes
and fill slopes of 1 horizontally for each foot of elevation
of cut or fill. Such easement is for Lhe purpose of providing and
maintaining lateral. support for 58th A South when improved to
the f-uli width of the right of way in contormity with the existing
center line grades, and there is rescr_vod to the Grantor(s),
heirs and assigns, the right to remove said slopes at any time upon
providing and maintaining other adequate lateral support.
THIS AGREEMENT shall constitute a covenant running with
the land.
