Voluntary Correction Agreement Introduction The applicant, SEG 55`h LLC, seeks a variance from the maximum height and area limits for a freestanding sign, and for variance from the required minimum setback. A public hearing was held on the application on November 7, 2014, before the Tukwila Hearing Examiner. Represented at the hearing were the applicant, by Robert Rademacher, and the Department of Community Development by Brandon Miles, Economic Development Liaison. Hearing Examiner Decision L14-0013 SEG 5e LLC Sig Page 2 of 7 Aller due consideration of shall constitute the findings this application. 1. The subject prop is located on the north, International Boulevard. uses. Variance evidence presented at the public hearing, the following act, conclusions and decision of the Hearing Examiner on Findings of Fact is addressed as 14227 Tukwila international Boulevard and corner of the intersection of S. 144' Street and Tukwila he property includes a Bartell Drugs and other smaller retail 2. The existing signag on this site includes one freestanding sign and several wall signs. The freestanding sign is approximately 30 feet tall and has an area of 151,428 square feet. The sign was i istalled prior to the site's annexation by the City. 3. In December of 2012, the sign was damaged by an automobile. The City, the property owner, and the al plicant, Bartell Drag, entered into a Voluntary Correction Agreement (VCA) concemi ig the sign. The VCA requires the existing freestanding sign to be removed after complet on of the variance process for the current application. 4. The application is for a variance to allow_ a freestanding sign to exceed the maximum height standard, to encroach into the required setback, and to exceed the maximum permitted sign ar 5. The property is 20ned Neighborhood Commercial Center. (NCC). The Comprehensive Plan describes the NCC zone as being generally focused around key intersections in transportati n corridors, providing a commercial focus for businesses bordering the corridors, wbile mitigating the transportation corridors' impacts on residential areas. The Plan describes the NCC zone as providing a commercial focus for businesses bordering thel corridor. 6. The City enacted a revitalization plan for Tukwila international Boulevard in 1998. As part of the City's implementation of this plan, the City installed pedestrian improvements, including sid ewalks and landscaping (including street trees) along TIB.. A utility cabinet was also insta ed near the site. 7. The application is for a sign that is 15 feet tall (exceeding the maximum height limit of 7 feet), with a total message area of 70 square feet per side (exceeding the maximum 50 feet per side) and located within the required five-foot setback area. 9. The Department has reviewed the application and recommends approval of. a variance from the height limit and setback requirements, but not from the maximum permitted message area (which would be 50 square feet per side based on the street frontage length). 10. At hearing, the applicant indicated- that it had moved the location of the sign because of the location of utilities on the site. It also noted that if the tenant panels were eliminated, and the resulting sign area would be approximately 58 square feet. 11. No public comments were submitted to the Department or the Hearing Examiner on this application. t_ 12. The sign variance criteria are set forth in TMC 19.28.030: The Hearing Examiner may grant a variance to the requirements of this code only when the applicant demonstrates. compliance with the following: 1. The variance as approved shall not constitute a grant of special privilege, which is inconsistent with the intent of this Sign Code. 2. The variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property to provide it with use rights and privileges permitted to other properties in the vicinity . and in the zone in which the subject property is located 3. Granting of the variance will not be materially detrimental to the public welfare or .injurious to property, improvements or environment in the vicinity and in the zone in which the subject property is located 4. The special conditions and circumstances prompting the variance request do not result from the actions of the applicant. S. The variance as granted represents the least amount of deviation from the prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. b. The variance request is not inconsistent with any other adopted City plan or policy, including the Zoning Code, Walk and Roll Plan and/or Shoreline Master Program. The City's Comprehensive Plan and the 2010 amendments to the Sign Code call for transitioning the zone and area to a more pedestrian -oriented environment, and for removal of auto -oriented signage, such as the proposed freestanding sign. However, the existing environment at this location is in transition, and the variance as conditioned would allow for a reasonable transition period consistent with City plans and policies for phasing out tall signs in the NCC zone. 8. The last criterion is whether the variance would result in greater convenience to the public in identifying the business location for which the variance is sought: The variance from height, setback and sign message area would all assist the public in identifying the business location. 9. As conditioned, the proposed variance from height and setback requirement would meet all of the variance criteria, and should be granted. The request for a variance from the message area would not meet all of the criteria, and is denied. Decision The requested variance for height and setback standards is hereby granted with the following conditions: 1. Prior to issuance of a sign permit, the applicant shall remove the existing freestanding sign on the subject property. 2. The applicant shall obtain a separate sign permit for the sign's installation. As part of the sign permit application, the applicant shall provide scaled plans that show the proposed location of the freestanding sign and the location of utilities within ten feet of the sign's location. 3. As part of the sign permit application, the sign shall have a sign and message area that meets the standards of TMC Title 19. 4. Prior to installation of the sign, the applicant or contractor shall call 811 a minimum of 48 hours in advance for utility locates. 5. Due to presence of the above ground utility vault the applicant shall obtain - permission from Seattle City Light for the placement of sign. BEFORE THE, HEARING EXAMINER CITY OF SEATTLE In the Matter of the Application of BARTELLSISEG 56m LLC File: L14-0013 For a variance from the Sign Code ORDER CORRECTING DECISION A clerical error was made in the decision issued in this matter. The error, on page 6, sets out condition 8, and is hereby corrected as follows: 8. This variance shall be valid until September 1, 202-2_2024. Until September 1, 20M 2QZ4, the sign may have refaces and copy changes, provided permits are issued by the City as required by TMC 19.12.020. At no time shall the sign be relocated, re -erected, enlarged, or structurally altered in any way, without first obtaining a new variance. In no way is the City obligated to issue a variance in the future. After September 1, 2= 2024. the sign is permitted to remain AS -IS indefinitely. However, relocation, re -erection, alteration, replacement or change in any way to the sign, including the structure or sign panel/face/copy, will require the sign to be brought into full compliance with the City's sign code. In no way does this condition preclude the property owner from requesting a new variance after September 1, 282024. At the end of the ten year grace period the sign may remain as -vs indefinitely; however additional refaces or copy changes will require that $he sign be brought into conformance with the Sign Code. Please notemodifying the sign height, increasing the sign area, or relocating the sign is not permitted without bringing the sign into full conformance with the City's Sign Code. 3. A freestanding sign that is considered a freeway interchange sign and was legally installed under the previous sign code is permitted to have refaces and copy changes for up to FIVE years from the effective date of the City's Sign Code (8/24/10). At the end of the five year period the sign may remain as -is indefinitely, however any changes to the face or structure of the sign will require that the sign be removed. 4. Freestanding signs that did not comply with the City's previous sign code, for example those that were installed while an area was in King County, are not permitted to have any changes to the face or structure of the sign without bringing the sign into conformance wifh the Sign Code.
