I. PROJECT INFORMATION Project File Number: L13-001 Applicant: Eric Clayton, Integra Telecom Type of Permit Applied for: Special Permission from the DCD Director requesting a Critical Area Sensitive Area Ordinance Deviation to allow permanent utility equipment in wetland and creek buffers Project Description: Integra Telecom is proposing to install fiber optic utility service within the City of Tukwila. The portion of the underground installation proposed along 133rd Street is within critical area buffers. Temporary impacts within these buffers include a 25 square foot area for placement of a temporary bore pit and a permanent "hand hole" for utility access. Location: 1. At the southbound on ramp to SR599 within a category III wetland buffer. 2. At the northeastern corner formed by the intersection of S133 St and S 131" Place within a Category IV wetland buffer and within the Southgate Creek stream buffer. Associated Files: PW 12-088 II. DECISION SEPA Determination: The SEPA Responsible Official has determined that the project is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application for a Special Permission to deviate from the City's Sensitive Areas Ordinance does comply with applicable City and state code requirements and has approved that application based on the findings and conclusions contained in the staff report, and subject to the following conditions: SM Page 1 of 3 H:\L13-001 Integra Telecom\L13-001 Integra Telecom NOD.doc 02/19/2013 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone 206-431-3670 • Fax: 206-431-3665 1. No vehicle parking, including parking on paved areas, is allowed in sensitive steam and wetlands and their buffers. The "no parking" areas are generally along South 133rd Street from SR 599 through South 130 Place and are shown on the map included as Attachment A and highlighted in blue, green and purple -gray. 2. The area adjacent to the SR 599 on ramp shall be reseeded with a native grass seed mix. 3. The permanent "hand hole" installation shall be mitigated with the planting of 10 2 -gallon red osier dogwood along the Southgate Creek stream edge. A three foot planting area around each plant shall be grubbed out to remove the reed canary grass root system. The area should not be mulched. 4. Integra shall perform an annual inspection and provide an annual monitoring report of the plantings along Southgate Creek. The monitoring report shall note if any mitigation plantings have failed to thrive. Any plants that are not thriving shall be replanted under the same guidelines of this mitigation requirement. Monitoring shall continue until each original and any replacement plants have survived for three consecutive years. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Planning Commission decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision; that is by March 5, 2013. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $563. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing SM Page 2 of 3 H:\L13-001 Integra Telecom\L13-001 Integra Telecom NOD.doc 02/19/2013 Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS may be included in such an appeal. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Stacy MacGregor, who may be contacted at 206-433-7166 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact the King County Assessor's Office for further information regarding property tax valuation changes. Integra Telecom has applied for a special permission decision under the Sensitive Area Ordinance to do work within wetland buffers at the following two locations: 1. At the southbound on ramp to SR599 within a category III wetland buffer 2. At the northeastern corner formed by the intersection of S133 St and S 1315` Place within a Category IV wetland buffer and within the Southgate Creek stream buffer. SEPA The SEPA official has determined that the project is categorically exempt under WAC 198-11-800 Categorical Exemptions: (23) Utilities. The utility -related actions listed below shall be exempt, except for installation, construction, or alteration on lands covered by water. The exemption includes installation and construction, relocation when required by other governmental bodies, repair, replacement, maintenance, operation or alteration that does not change the action from an exempt class. (a) All communications lines, including cable TV, but not including communication towers or relay stations. BACKGROUND Integra Telecom is proposing to install fiber optic line underground along public right of way from Interurban Avenue at South 133rd Street to South 131st Place and overhead from South 131St Place to South 120t1i Street within the City of Tukwila. The underground portion occurs within two sensitive area wetland buffers and a sensitive area stream buffer; the cabling will be installed using underground boring techniques to minimize permanent and temporary impacts to the buffers. A 25 foot square temporary bore pit is proposed on the north side of 133rd Street at the highway ramp. This bore pit is within a category III wetland buffer and will be located between the street curb and an eexisting fire hydrant. The area currently consists of mown grass; the applicant has proposed returning it to its preexisting condition. A "hand hole" (a permanent 5' x 5'access panel) will be located on the north side of South 133rd Street at 13151 Place. This location is within a category IV wetland buffer and the Southgate Creek stream buffer and between an existing chain link fence and the unimproved road shoulder. The area current consists of mown reed canary grass, an invasive wetland plant. SM Page l of 4 H:\L13-001 Integra Telecom \L13-001 Integra Telecom SR.doc 02/19/2013 i00 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone 206-431-3670 • Fax: 206-431-3665 DECISION CRITERIA Section18.45.030 (C) of the Tukwila Municipal Code (TMC) states that "The City shall not approve any permit or otherwise issue any authorization to alter the condition of sensitive area land, water or vegetation or to construct or alter any structure or improvement in, over, or on a sensitive area or its buffer, without first ensuring compliance with the requirements of TMC Chapter 18.45." Compliance requires evaluation of the construction as a permitted use subject to administrative review and approval by the Director according to the following criteria of TMC 18.45.070 (5). TMC 18.45.070 (5) Essential Utilities a. Essential utilities must be constructed to minimize, or where possible avoid, disturbance of the sensitive area and its buffer. The location of the utilities is based on preexisting conditions and linkages to existing infrastructure. Routing the fiber cabling along the south side of the street would not remove it out of the sensitive areas buffers. The permanent construction impacts have been minimized by proposing underground boring rather than open trenching. b. All construction must be designed to protect the sensitive area and its buffer against erosion, uncontrolled storm water, restriction of groundwater, movement, slides, pollution, habitat disturbance, any loss of flood carrying capacity and storage capacity, and excavation or fill detrimental to the environment. Best Management Practices must be followed to ensure that no construction debris enters the storm drainage system. All impacts related to construction debris will be mitigated as part of the construction permit and subject to erosion control conditions detailed by the public works department. The temporary impacts can be minimized by ensuring that no construction vehicles or worker vehicles park within the sensitive areas and their buffers and the only equipment used within the sensitive areas are the minimum necessary to complete the work. c. Upon completion of installation of essential utilities, sensitive area and their buffers must be restored to pre - project configuration, replanted as required an provided with maintenance care until newly planted vegetation is established. In addition, mitigation to offset impacts to sensitive areas or their buffers must be carried out in accordance with the standards and mitigation ratios of this chapter. The temporary bore pit area adjacent to the SR 599 on ramp shall be reseeded with a native grass seed mix. The permanent "hand hole" installation can be mitigated with the planting of 10 2 -gallon red osier dogwood along the Southgate Creek stream edge. d. All crossings must be designed for shared facilities 1 order to minimize adverse impacts and reduce the number of crossings. The will be no new crossings or changes to existing crossings. TMC 18.45.090 (C) states that "applicants shall demonstrate that reasonable efforts have been examined with the intent to avoid and minimize impacts to wetlands and wetland buffers." The applicant has designed the project to minimize impacts to the buffers. The project occurs entirely within existing roadways and roadway edges and utility corridors. Underground boring is proposed to minimize temporary and long-term construction impacts. Replace planting of native grass mix and mitigation planting of native shrubs along the creek are included. TMC 18.45.090 (E3) states that "Maintenance and monitoring of mitigation shall be done by the property owner for a period of no less than five years and for ten years when the mitigation plan includes establishing forested wetland and/or buffers. Maintenance shall be carried out in accordance with the approved mitigation plan. A monitoring program shall include annual monitoring and replacement planting of any plants that have failed to thrive. COMMENTS A Notice of Application was mailed on February 5, 2013 to the applicant and to departments and agencies with jurisdiction pursuant to TMC 18.104.090. No comments were received. CONCLUSIONS 1) Installation of the fiber optic cabling is permitted use subject to administrative review and approval per TMC 18.45.070 (5). 2) The scale of the project and the resultant nominal increase in impervious area should not restrict the natural movement of groundwater beyond the restrictions to ground water already in place due to preexisting development and public streets. The project is subject to Best Management Practices for erosion control. Parking should not be permitted within the sensitive area buffers, including along the street, other than the minimal equipment necessary to bore for the cabling. 3) Mitigation will be required. Any site disturbance at the SR 599 on ramp location will be reseeded. The permanent "hand hole" will be mitigated with planting of native plants along the creek edge. 4) There are no changes to existing stream crossings. 5) The impacts to the buffer, consisting of fiber optic cable and an access vault along an existing street and utility route, are kept to an absolute minimum. 6) Long-term monitoring will be required. RECOMMENDATION Staff recommends approval of the Special Permission permit with the following condition: 1. No vehicle parking, including parking on paved areas, is allowed in sensitive steam and wetlands and their buffers. Ten (10) 2 -gallon red osier dogwood (Cornus stolonifera) has been planted along the edge of Southgate Creek. These plants were located approximately mid -slope along this ditched stream to allow for suitable hydrology patterns and to allow for the shrubs to eventually overhang the stream corridor. 2. As a part of the planting of these red osier dogwoods the planting area was cleared of blackberries (Rubus spp.). Reed canarygrass (Phalaris arundinacea) was also removed from the area around the red osier dogwoods. With the completion of these implementation actions the following performance maintenance program should be undertaken to meet the requirements of the SEPA Determination. 1. Monitor the survival and establishment of the installed red osier dogwood for a minimum of three growing seasons following initial installation. Monitoring may be extended to meet the performance criterion. Performance Criterion #1: As defined by annual plant counts 100% of the initially installed or supplementally installed red osier dogwood shrubs shall exhibit survival for three consecutive years. 2. Provide the City with annual monitoring reports documenting plant survival establishment, along with any supplemental actions. Each report shall also include photo documentation of the restored stream edge area. As such, the following provides an outline of the specific elements required by 18.45.090C. 1. Avoiding the impact altogether by not taking a certain action or parts of an action; Discussion: The installation of the of the fiber optic line utility service is required to meet the increased public demand within the City of Tukwila and adjacent areas. The design of the project has avoided any permanent impacts associated with the critical area or critical area buffers identified along the utility corridor. In particular, the majority of the fiber optic line shall be installed using underground boring techniques rather than open trench to avoid permanent and the majority of temporary impacts. Temporary project related impacts shall be limited to only 25 square feet for the unavoidable placement of a temporary bore pit. 2. Minimizing wetland and wetland buffer impacts by limiting the degree or magnitude of the action and its implementation, by using appropriate technology, or by taking affirmative steps to avoid or reduce impacts; Discussion: The design of the fiber optic utility line installation has avoided and minimized unavoidable project related impacts to the associated critical area buffers by limiting all actions to within identified existing, established and managed public roadway and utility corridors. Furthermore, the installation of the fiber optic line will utilize underground boring methods along the entire length of the critical area buffers. Temporary project related impacts shall be limited to only 25 square feet for the unavoidable placement of a temporary bore pit. Rectifying the impact by repairing, rehabilitating or restoring the affected environment; The present condition of the critical area buffers within the limits of the identified fiber optic utility line corridor has been created and managed as a part of the development of public roadways and public utilities. These buffer areas are regularly managed and dominated by a mowed lawn plant community. Unavoidable, temporary project related impacts within the critical area buffer shall be limited to 25 square feet. Following the installation of the fiber optic utility line the temporary impact area shall be restored to the pre -project conditions to ensure protection of local water quality and to protect against adverse erosion. 4. Reducing or eliminating the impact over time by preservation and maintenance operations during the life of the action; Following the installation of the fiber optic utility the temporary impact area associated with the temporary bore pit shall be re -filled and restored/re-seeded to ensure protection of local water quality, to protect against adverse erosion, and to match pre - project site conditions. 5. Compensating for the impact by replacing, enhancing, or providing substitute resources or environments; and/or No permanent impacts are proposed for the installation of the fiber optic utility line. The minimal, unavoidable temporary impacts associated with the bore -pit shall be restored following installation to ensure protection of local water quality, to protect against adverse erosion, and to match pre -project site conditions.. 6. Monitoring the impact and taking appropriate corrective measures. The onsite construction crews shall implement routine erosion control actions during installation and undertake appropriate corrective measures if required. The normal procedure is to close on the near side of the inter- section any lane that is not carried through the intersection. However, when this results in the closure of a right lane having significant right turning movements, then the right lane may be restricted to right tum only, as shown. This procedure increases the through capacity by eliminating right tums from the open through lane. 3. Prohibit turns as necessary for traffic conditions. 4. Extend device taper (U3) across shoulder — recommended. 5. Closing lane in advance of flagging location when multiple lanes are on approach leg — recommended. 6.
