The conduit will be extended via directional boring and bore pits will be spaced out along the project run. II. GENERAL INFORMATION Project Name: Southcenter Bridge & Green River Trail Conduit Extension Applicant: Jeremy Haug, PE of Contour Engineering, LLC for SEFNCO Communications Location: The site is located along the Green River trail in the vicinity of I-405 and Interurban Avenue. The project extends from approximately Southcenter Boulevard at 66th Avenue South to Fort Dent Way and over the pedestrian bridge to the Family Fun Center. Zoning and Comprehensive Plan Designation: The project is primarily on public right of way (WSDOT and City of Tukwila) with the exception that the landings for the pedestrian bridge are on a city -owned parcel zoned RCM -to the north and a privately owned parcel zoned CLI to the south. The surrounding properties are zoned LDR, RCM, C/LI and TUC. The following information was considered as part of review of this application. 1. SEPA Checklist dated January, 2012. 2. Shoreline Substantial Development Permit application (File L13-002). 3. Civil plan sheets C1-4 prepared by Contour Engineering dated 1/9/13. 4. Shoreline site plan sheets SP1 -3 prepared by Contour Engineering dated 1/8/13. 5. Shoreline Substantial Development permit file #L13-002. This proposal involves utility -related installation and construction of communication lines on lands covered by water. IV. BACKGROUND/PROPOSAL This application is for a portion of a larger project to install 4" communication conduit along a utility corridor. The conduit will be installed via directional drilling; bore pits will be installed at intervals along the project's length. The conduit will be installed adjacent to the Green River Trail as it runs along the northwest bank of the Green River. The trail and conduit extension are principally in city -owned right-of-way. The application notes that a portion of the right-of- way is under WSDOT control. The conduit will also cross over the Green River Trail pedestrian bridge. The north side of the bridge is on a city -owned, undeveloped parcel (not right-of-way) and the south end of the bridge is a public access easement on privately -owned and developed property. V. REVIEW OF THE ENVIRONMENTAL CHECKLIST The following lists the elements contained within the Environmental Checklist submitted for the proposed project. The numbers in the staff evaluation correspond to the numbers in the Environmental Checklist. If staff concurs with the applicant's response, this is so stated. If the response to a particular item in the checklist is found to be inadequate or clarification is needed, there is additional staff comment and evaluation. A. BACKGROUND: 1-5. Concur with checklist. 6. The construction will follow issuance of a SEPA determination and after obtaining all required permits from the City of Tukwila or other agencies. 7-11. Concur with checklist. 12. The site is within the shoreline of the Green River. B. ENVIRONMENTAL ELEMENTS: 1. Earth: a -g. Concur with checklist. h. The project scope was modified after the initial submittal to include extending conduit along the Green River trail pedestrian bridge. a(3-6). Concur with checklist. b(1-2). Concur with checklist. Surface water design and construction shall be per the King County Surface Water Design Manual as adopted by the City of Tukwila. All impacts associated with drainage will be mitigated as part of the construction permit. Best Management Practices must be followed to ensure that no construction debris enters the storm drainage system. All impacts related to construction debris will be mitigated as part of the construction permit. 4. Plants: a. Concur with checklist b. Tree removal in the shoreline requires a shoreline tree clearing permit. The project does not include or authorize clearing of any trees. c -d. Concur with checklist. 5. Animals: a -b. Yes — This area is part of the Pacific Flyway, a primary corridor for migratory bird species. Chinook Salmon, Steelhead Trout, and Bull Trout/Dolly Varden are all listed as "threatened" under the Endangered Species Act and all three fish use the Green-Duwamish River system for rearing and migration. c -d. The project must meet City of Tukwila noise ordinance requirements. Construction activity is exempt from noise permitting requirements during daytime house (7am- lOpm). Compliance with applicable local, state and federal noise regulations will mitigate any potential adverse noise impacts associated with the project. 8. Land and Shoreline Use: a. The work occurs in the public right of way and one two parcels. One parcel is owned by the City of Tukwila, the other parcel is owned by a private property owner. Surrounding land uses include residential, freeway and highway, public recreation trail, vacant land, and retail development. b -d. Concur with checklist e. The majority of the project is within public right-of-way. The north side of the pedestrian bridge is zoned RCM and the south side of the bridge is zoned CLI. f. Concur with checklist. g. COMMENTS: On February 27, 2013 notice of application was posted on the site and published in the Seattle Times. The optional DNS process in WAC 197-11-335 was used; a thirty day comment period was required due to the Shoreline Substantial Development Permit application. Clarifying questions were asked by Karen Walters of the Muckleshoot Tribe. She advised that, based on the work window, the contractors may see tribal members fishing in the vicinity. No other comments were received during the single integrated comment period and this DNS will be issued without a second comment period. VII. CONCLUSION The proposal can be found to not have a probable significant adverse impact on the environment and pursuant to WAC 197-11-340 a Determination of Nonsignificance (DNS) is issued for this project. This DNS is based on impacts identified within the environmental checklist, attachments, and the above Final Staff Evaluation for Environmental Checklist File No. E13-001, and is supported by plans, policies, and regulations formally adopted by the City of Tukwila for the exercise of substantive authority under SEPA to approve, condition, or deny proposed actions. The proposed project will extend 4" PVC conduit approximately 1,100 LF along the Green River Trail from Southcenter Blvd to Fort Dent Way. Conduit will be installed via underground directional boring with several bore pits required along the alignment. There will also be approximately 6 vaults spaced along the conduit run with one at each end of the alignment. From Fort Dent Way, the conduit will be further extended approximately 310 LF along the Green River Train directly attached to the pedestrian foot bridge where it will then terminate on the SE side of the bridge. 11. Give sufficient information for a person to understand the precise location of your proposed project, including a street address, if any, the tax lot number, and section, township, and range. If a proposal would occur over a range of area, provide the range or boundaries of the site(s). Provide a legal description, site plan, vicinity map, and topographic map, if reasonably available. General Project Description Summary The proposed utility project is to extend a 4" communication conduit along the Green River Trail from Southcenter Boulevard to Fort Dent Way. The conduit will be extended via directional drilling so bore pits will be required and spaced out along the project run. Currently, the project area is within Tukwila public right-of-way, except at two locations where the bore path will cross WSDOT right of way, beneath the bridge spans of SR 181, and the westbound 1- 405 on and off -ramp. The bridge abutments and retaining walls are the only structures within the project area. The Green River Trial is an asphalt paved trail which follows along the river and crosses beneath the two bridges. The conduit path will be located along the northwest side of the trail with the bore pits designed to be outside of the paved path. Vegetation will be re -planted and/or re- established at bore pit locations. This project will not add to or increase the intensity of the area and will not add any new impervious surfaces. No modifications to the shoreline of the Green River are proposed so there is no loss of shoreline function. No pedestrian access to the trail will be impeded by the project. "No net Toss" response 1. The existing shoreline and riverbank area are currently vegetated with native deciduous trees and brush. The slope of the bank is approximately 2:1 which is covered with blackberry, brushes and other type's vegetation. No visible evidence of erosion exists within the 200' shoreline area. An existing asphalt paved pedestrian pathway (Green River Trail) exists just above the top of slope. An existing underground utility corridor along the pathway exists which also includes light standards along the path. Two bridges span the river in the project area. The Washington State Shoreline Management Act (SMA) requires protection of the natural resources and ecological functions of the shoreline environment. Ecological functions are processes that characterize the river and its shoreline and form habitats for water- and land-based wildlife and vegetation. Ecological processes depend on the geology, soil type, topography, climate, and other physical characteristics in the region. In the Green/Duwamish River watershed, key ecological processes include: • river flows, tidal fluctuations and saltwater influences; • creation, transport and deposition of sediment (for example scouring of soils, and erosion and formation of mud -flats or beaches); • transport of nutrients (from decomposition of plants and other organic materials); • provision of woody debris from fallen limbs and trees along the banks or in the water (the trunks and branches help form pools for fish); and • water quality (such as vegetation that can help to filter out pollutants that are washed into the river from parking lots and vegetation that can help reduce temperatures in the river, important for fish, especially salmon). These physical and biological processes comprise the ecological functions of the shoreline. The state guidelines that implement the SMA, adopted in 2003, establish the standard of "no net loss" of shoreline ecological functions for land uses and development within the shoreline jurisdiction. The No Net Loss standard is designed to stop the introduction of new negative impacts to shoreline ecological functions resulting from new development. Tukwila's Shoreline Master Program (SMP) defines no net loss as a: "...standard intended to ensure that shoreline development or uses, whether permitted or exempt, are located and designed to avoid loss or degradation of shoreline ecological functions that are necessary to sustain shoreline natural resources." In other words, the existing conditions of the shoreline ecological functions should not deteriorate due to new permitted development or new land use. A loss of ecological function can occur when a physical condition such as vegetation along the shoreline is removed or when habitat is altered through the construction of a dock or pier or other structures over this habitat. In order to maintain shoreline ecological functions, negative impacts must be mitigated to restore an equivalent amount of ecological function. The approach to mitigation must follow the mitigation sequencing steps adopted in the SMP (see next page). It should be noted that the SMA and the City's SMP also require improvement of shoreline functions, and therefore, some re -vegetation of the shoreline will be required in proportion to the scale of the project, regardless of whether there is a net loss to ecological functions. PROJECT DESCRIPTION: The proposed project is to extend a PVC utility conduit along the Green River Trail. Part of a much larger project, this portion of work occurs within the shoreline jurisdiction. A shoreline permit is necessary because the work is valued above the exemption for cost limits and involves work over the water where the conduit is attached to a pedestrian bridge. The conduit will be used for fiber optic cabling. The new 4" conduit will be installed adjacent to 1,100 linear feet of trail and attached to the pedestrian bridge over the Green River where the Green River and Interurban Trails intersect. It will be installed via directional drilling rather than open trenching. Bore pits will occur along the length of the corridor and will be off the paved path. The bore pits will not result in the addition of impervious surface. The pit locations will be restored to pre -construction conditions after the work is complete. The Green River trail is a nineteen mile asphalt trail from south Seattle to south Kent. At Fort Dent Park, the Green River Trail intersects with the Interurban Trail. The Interurban Trail starts at the north end of the pedestrian bridge and continues to the south for fourteen miles ending in the town of Pacific. A utility easement already exists adjacent to the trail where this work is proposed. The Shoreline Substantial Development Permit application and site plans are found in Attachment A. 2. TUKWILA SHORELINE MASTER PROGRAM - BACKGROUND The City of Tukwila adopted a new Shoreline Master Program (SMP) on August 15, 2011 which was approved by the Washington State Department of Ecology on October 14, 2011 and became effective October 28, 2011. A. Shoreline Environment Designation The shoreline environment designation for the project is Urban Conservancy. The purpose of the Urban Conservancy Environment is to protect ecological functions where they exist in urban and developed settings, and restore ecological functions where they have been previously degraded, while allowing a variety of compatible uses. The shoreline buffer in this portion of the Urban Conservancy environment is 100 feet (non-residential areas without levees). The actual amount of area needed to achieve a 2.5:1 slope may be less than 100 feet, depending on the character of the river bank and can only be determined on a site - by -site basis. (From the Tukwila Shoreline Master Program, pg. 67) B. Shoreline Goals and Policies: The following section discusses the Shoreline Master Program goals and policies that apply to this project and are excerpted from Chapter 6 of the City's SMP. Goal 6.3 Economic Development Goal: Development along the shoreline that fosters the economic vitality of Tukwila while preserving the long-term benefits of the river. Response: The placement of an underground utility in a utility easement adjacent to the public trail will not impact the river or be a detriment to the river. 6.6 Access and Recreational Use, Comprehensive Plan Goal 5.6 Goal: Increase the amount and diversity of opportunities for public recreation and access to and along the river, including visual and cultural access, access to the water's edge, opportunities for small boat navigation and access, and connections to other neighborhoods, consistent with the shoreline character. • Policy 5.6.6: Support the implementation of the King County Green River Trail, per the existing King County Green River Trail Master Plan as well as pedestrian/bicycle connections with the Trail from properties on the opposite bank and the expansion of this trail where appropriate. Response: The fiber conduit is within an existing utility corridor adjacent to the trail. There is no impact to the trail or increase of impervious surface due to this project. The applicant has stated there will be no closures of the Green River Trail. However, it is conceivable that a work perimeter will be established around equipment that may extend onto portions of the trail. One location of proposed bore pit is within the asphalt portion of the Green River Trail and appears • to be within an existing utility vault. Any impact will not close the trail and will only be temporary. 6.9 Natural Environment and Habitat Use Goal: Restored, enhanced and protected natural environment resources along the river, including trees, wildlife habitat and features with value for long-term public, scientific and educational uses. • Policy 5.9.1: Ensure that shoreline development results in no net loss of shoreline ecological function, minimizes impacts on wildlife and that significant vegetation, sandbars, wetlands, watercourses, and other critical areas identified as important for habitat are maintained through the proper location, design, construction, and management of all shoreline uses and activities. Response: The applicant prepared a no net loss analysis (NNL), which is attached as part of Attachment A to this staff report. The NNL addresses the mitigation sequencing criteria in the SMP. To minimize or avoid impacts, aside from the bore pits, all work is taking place underground. b. Minimizing impacts by limiting the degree or magnitude of the action and its implementation by using appropriate technology or by taking affirmative steps to avoid or reduce impacts. The proposed project will minimize any impacts as it will not change the existing condition of the shoreline. The project involved bore pits rather than open trenching to minimize impacts. c. Rectifying the impact by repairing, rehabilitating, or restoring the affected environment: The area of the bore pits will need to be re -planted with a native grass seed mix or native plants. d. Reducing or eliminating the impact over time by preservation and maintenance operations; Minimal maintenance is required for the conduit. e. Compensating for the impact by replacing, enhancing, or providing substitute resources or environments; and It is expected that there will be no direct impacts to existing habitats or ecological processes. f. Monitoring the impact and the compensation projects and taking appropriate corrective measures. There are no direct impacts therefore there is no anticipated need for corrective measures. 3. SHORELINE REGULATIONS: TMC 18.44.130 B3 Shoreline Administration states that a substantial development permit shall be granted only when the development proposed is consistent with the shoreline master program. The relevant SMP policies were discussed above. Below is a discussion of the relevant shoreline master program regulations that are incorporated into the zoning code that apply to this permit application. A. Permitted Uses: TMC 18.44.050 identifies permitted uses in the Urban Conservancy environment - utilities are permitted inside the buffer area. This project does not involve the placement of structures and will not increase the presence of people in the area outside of the construction period. The applicant stated that no work would be done on the trail and that that trail would not be closed. While the plan set shows one bore pit within the paved trail area, a site visit to the area revealed that this location is a preexisting vault. The City of Tukwila Public Works Department and the applicant verbally confirmed that there would be no trail closure for this project. Tukwila Municipal Code 18.08.020 states that all lands not classified according to the classification in TMC 18.08.010 on the official zoning map, and all lands, if any, of the City not shown on the official zoning map, shall be considered unclassified and, pending future classification, shall be subject to the restrictions and regulation of the LDR District. Therefore, the zoning standards for this area are LDR. B. Standards: These include setbacks, site configuration, height restrictions and lighting standards. As this project does not involve the construction of structures, setbacks, site configuration and height restrictions do not apply. 2. Setbacks and Site Configuration: As structures are not proposed, these standards do not apply. 3. Height: The underground utility installation has no height therefore these standards do not apply. 4. Lighting: No lighting is proposed; these standards do not apply 5. Surface Water and Water Quality: No new structures or impervious surfaces are proposed; these standards do not apply. 6. Flood Hazard Reduction: No flood hazard structures as included in this proposal. 7. Shoreline Stabilization: The project does not trigger the need for shoreline stabilization. 8. Archaeological, Cultural and Historical Resources: The Duwamish and Muckleshoot tribes were provided notice of application. The Muckleshoot tribe asked clarifying questions. No known historical resources are located in the area of the project. Should the developer uncover archeological resources, work shall stop immediately and the City of Tukwila, the Washington Department of Archaeology and Historic Preservation and affected Indian tribes shall be notified and the standards of TMC 18.44.070G apply. 9. Environmental Impact Mitigation: Projects are required to be designed so as to cause no net loss to shoreline ecological functions. No net loss has been addressed above under the discussion of the consistency of this project with shoreline goals and policies. A SEPA Determination of Non -Significance was issued under land use file E13-001. 10. Off Street Parking and Loading Requirements: No parking, loading or storage facilities are proposed. 11. Land Altering Activities: No clearing, grading, landfills, or dredging will occur. 12. Marinas, Boat Yards, Dry Docks, Boat Launches, Piers, Docks, and Over -water Structures: Does not apply. 13. Signs in Shoreline Jurisdiction: Does not apply. C. Vegetation Protection and Landscaping TMC 18.44.080 provides requirements for landscaping in both the buffer and non -buffer areas of the shoreline environment. The tree protection and retention requirements and the vegetation management requirements apply to existing uses as well as new or re -development. The work is occurring within an existing utility corridor. There are no trees that will be impacted by the project. The extent of landscaping required under TMC is based on the size of the project; for smaller projects, the Director will determine a reasonable amount of landscaping to be carried out based on the scope of the project. TMC 18.44.080 Clp(2) states that utility easements shall be landscaped with native groundcover, grasses or other low -growing plants as appropriate to the shoreline environment and site conditions. The bore pits are located adjacent to the trail. The areas where the pits are proposed are either grassy or contain shade tolerant shrubs; in a few locations, where the bore pits are under or adjacent to an overpass, there is no vegetative growth. Because the area of disturbance is minimal, the applicant did not provide a planting plan. Where bore pits are located in grassy areas, the area should be reseeded with a native grass mix. In areas with herbaceous plants, the disturbed areas should be replanted with native herbaceous plants. An appropriate plant palate would include a mix of western sword fern, wood sorrel and fringecup. The areas that are under the overpass and do not have plant life do not require any mitigation. D. Environmentally Sensitive Areas within the Shoreline Jurisdiction TMC 18.44.090 provides requirements for development within environmentally sensitive areas. The proposal occurs adjacent to the Green River Trail which is relatively flat and does not contain steep slopes, wetlands, watercourses or their buffers. E. This project will not create additional demand for public access as there is no building and the current use is not being changed. F. Shoreline Design Guidelines This section of the TMC does not apply (TMC 18.44.110) as no structures are being constructed. G. Shoreline Restoration TMC 18.44.120 does not apply. This is not a shoreline restoration project. 4. COMMENTS: Clarifying questions were asked and answered during the Notice of Application period by Karen Walter, Watershed and Land Use Team Leader for the Muckleshoot Indian Tribe. Her comments are attached. No other comments were received. 5. SEPA: A Determination of Non -Significance was issued on April 9, 2013. A copy of the SEPA determination and staff report is included in the file CONCLUSIONS 1. The project site is located adjacent to the Green River Trail; the majority of the project occurs in the right-of-way which doesn't have a zoning designation. The parcels on either end of the pedestrian bridge are zoned RCM and is C/LI. The proposed project is consistent with the land use and zoning designations. 2. The plans show one bore pit within the paved portion of the Green River Trail. This location has an existing underground utility vault within the trail. 3. The City of Tukwila adopted a new Shoreline Master Program (SMP) on August 15, 2011; it was approved by the Washington State Department of Ecology on October 14, 2011 and became effective October 28, 2011. 4. The shoreline environment designation for the project area is Urban Conservancy, with a buffer width of 100 feet. 5. No structures are proposed for the project. 6. The proposed project is consistent with the goals and policies of the SMP. 7. The project has analyzed the no net loss provisions of the SMP and will avoid all direct impacts to the ecological functions of the shoreline. The bore holes will disturb grassy areas, small shrubs in the shade areas, or unplanted dirt beneath the bridges. Grassy areas will be replanted with a native grass see mix, unplanted dirt areas will return to preexisting conditions. Areas that disturb shrubs will be replanted with a mix of native plants. 8. The proposed project is consistent with the applicable development standards of the SMP. 9. A Determination of Non -Significance was issued on April 5, 2013. 6. RECOMMENDATION Approve the shoreline substantial development permit with the following conditions: 1. No closure of the Green River Trail is permitted; 2. No new bore pits will be allowed within the paved portion of the Green River Trail. 3. Grassy areas shall be replanted with a native grass seed mix. The Washington State Shoreline Management Act (SMA) requires protection of the natural resources and ecological functions of the shoreline environment. Ecological functions are processes that characterize the river and its shoreline and form habitats for water- and land-based wildlife and vegetation. Ecological processes depend on the geology, soil type, topography, climate, and other physical characteristics in the region. In the Green/Duwamish River watershed, key ecological processes include: • river flows, tidal fluctuations and saltwater influences; • creation, transport and deposition of sediment (for example scouring of soils, and erosion and formation of mud -flats or beaches); • transport of nutrients (from decomposition of plants and other organic materials); • provision of woody debris from fallen limbs and trees along the banks or in the water (the trunks and branches help form pools for fish); and • water quality (such as vegetation that can help to filter out pollutants that are washed into the river from parking lots and vegetation that can help reduce temperatures in the river, important for fish, especially salmon). These physical and biological processes comprise the ecological functions of the shoreline. The state guidelines that implement the SMA, adopted in 2003, establish the standard of "no net loss" of shoreline ecological functions for land uses and development within the shoreline jurisdiction. The No Net Loss standard is designed to stop the introduction of new negative impacts to shoreline ecological functions resulting from new development. Tukwila's Shoreline Master Program (SMP) defines no net loss as a: "...standard intended to ensure that shoreline development or uses, whether permitted or exempt, are located and designed to avoid loss or degradation of shoreline ecological functions that are necessary to sustain shoreline natural resources." In other words, the existing conditions of the shoreline ecological functions should not deteriorate due to new permitted development or new land use. A loss of ecological function can occur when a physical condition such as vegetation along the shoreline is removed or when habitat is altered through the construction of a dock or pier or other structures over this habitat. In order to maintain shoreline ecological functions, negative impacts must be mitigated to restore an equivalent amount of ecological function. The approach to mitigation must follow the mitigation sequencing steps adopted in the SMP (see next page). It should be noted that the SMA and the City's SMP also require improvement of shoreline functions, and therefore, some re -vegetation of the shoreline will be required in proportion to the scale of the project, regardless of whether there is a net loss to ecological functions.
