The six homes will be located between 56th Ave South and S. 131st Street. Five (Lots 1, 2, 4, 5, and 6) of the six homes are located on lots that are located within 200 feet of the ordinary high water mark (OHWM) and thus are subject to the City's Shoreline Master Program. In order to build the five homes a shoreline substantial development permit must be obtained. The project had originally received approval of a shoreline substantial development permit in 2006/07. Under that shoreline permit, the applicant constructed much of the needed infrastructure for the six homes. This included installation of an emergency access drive and construction of an alley. Per applicable Revised Code of Washington statutes, the shoreline substantial development permit was only valid until 2012. Once the shoreline substantial development permit expired, the applicant needed to obtain a new shoreline permit for the construction of the five homes on lots within 200 feet of the shoreline. Additionally, since then Lots 7 and 8 were purchased by the city fora mini park. The fence between Tract X and lots four, five, and six shall not block views of the River; therefore, the fence shall have a transparent design. This permit is granted pursuant to the Shoreline Management Act of 1971 and nothing in this permit shall excuse the applicant from compliance with any other Federal, State or local statutes, ordinances or regulations applicable to this project, but not inconsistent with the Shoreline Management Act (Chapter 90.58 RCW). This permit may be rescinded pursuant to RCW 90.58.140(8) m the event the permittee fails to comply with the project as approved and any conditions thereof. PROJECT DESCRIPTION The applicant, High Country Homes, is proposing to construct six homes in the Foster Point Neighborhood. The six homes will be located between 56th Ave South and S. 131st Street. Five of the six homes are located on lots that are located within 200 feet of the ordinary high water mark (OHWM) and thus are subject to the City's Shoreline Master Program. In order to build the five homes a shoreline substantial development permit must be obtained. The project had originally received approval of a shoreline substantial development permit in 2006/07. TUKWILA SHORELINE MASTER PROGRAM - BACKGROUND The City of Tukwila adopted a new Shoreline Master Program (SMP) on August 15, 2011, which was approved by the Washington State Department of Ecology on October 14, 2011 and became effective October 28, 2011. A. Shoreline Environment Designation and Buffer Width Requirements Page 1 of 9 05/02/2013 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone 206-431-3670 • Fax: 206- 431-3665 I Homestead at Foster Points L13-003 The shoreline environment designation for the site is shoreline residential; the purpose of the "shoreline residential" environment is to accommodate residential development and appurtenant structures that are consistent with this chapter. An additional purpose is to provide appropriate public access and recreation uses (SMP, p. 52 and p. 64)." The project is located in the Foster Point Neighborhood. Foster Point is located south of East Marginal Way South (EMWS) and north of Interstate 405. According to the City's SMP, the shoreline area without levees that is zoned LDR and lies from EMWS to I-405 has a buffer equal to the distance required to set back slope of the river bank from the toe to the top of the bank at 2.5:1, plus 20 feet; with a minimum setback of 50 feet from the Ordinary High Water Mark (OHWM) (Id., p. 54). All construction proposed under this shoreline permit will be setback at least 100 feet from the OHWM. The existing private access road was constructed under the previous shoreline permit. Additionally lot 7 and 8 were purchased by the city and the subject site does not abut the River at this time. B. Shoreline Goals and Policies: The following section discusses the Shoreline Master Program goals and policies that apply to this project and are excerpted from Chapter 6 of the City's SMP. Goal 6.3 Economic Development: Goal: Development along the shoreline that fosters the economic vitality of Tukwila while preserving the long-term benefits of the river. Response: The proposed project will construct five homes within the shoreline zone of the Green River. These homes will be built on individual lots and likely each home will be owner occupied. The homes have an estimated construction cost of just over $1.9 million. Policy 5.3.1 states that the City should encourage the design of structures that allows river views to be an amenity. In this case, the applicant will have three homes that will have unobstructed views of the River. The homes will have porches and yards that face the River, again allowing more viewing of the River. Policy 5.3.2 discusses that the development should be designed and located to minimize impacts to areas identified as important for other river uses such as...public access. The project will not impact public access to the river. Prior to recording of the short plat in 2007, the applicant deeded lots 7 and 8 to the City's Parks Department for use as a pocket park. Furthermore, tract "X" shall be dedicated to the City in order for the City's Parks Department to have access to lots 7 and 8. The dedication of the tract "X" will occur prior to the final inspection sign off of the homes.. Goal 6.4 Private Property Rights BM Page 2 of 9 05/02/2013 Homestead at Foster Points Li3-003 Goal: Protect rights of property owners to reasonable use and enjoyment of private property, through appropriate location, access to, and design of shoreline uses. Response: The project will allow the construction of five homes within the shoreline zone. As a condition of the plat, the applicant was required to dedicate tract "X" to the City for access to the two lots which were sold to the City. The project will enhance private property rights by allowing the applicant to move ahead with its construction project. Goal 6.5 Shoreline Design Quality Goal: Enhanced identity of the River as a unique community asset through high quality development and public activities that reflect Tukwila's history and sense of community pride. Response: The project will construct five new homes within the shoreline area of the Green River. In developing the original project, with the original applicant; the City took care to develop a project that minimized impacts to the shoreline area. Two lots were sold to the City which will preserve 13,064 square feet of frontage along the River from possible future development. Thus, open space is preserved along the shoreline. No trees or vegetation will be removed along the shoreline. The design of the homes is consistent with the standards for home construction within the Low Density Residential (LDR) zone. The homes will have a roof pitch greater than 5:12; the homes will use modern materials; and all the homes will meet setbacks. Goal 6.6 Access and Recreational Use Goal: Increase the amount and diversity of opportunities for public recreation and access to and along the river, including visual and cultural access, access to the water's edge, opportunities for small boat navigation and access, and connections to other neighborhood, consistent with the shoreline character. • Policy 5.6.1 • Policy 5.6.2 • Policy 5.6.5 Response: As part of the original project two lots were sold to the City. These two lots will be combined with unimproved right of way portion of S. 133rd Street The two lots, with the area of the unimproved right of way, create a small, passive pocket park in Foster Point. This passive park allows for viewing of the river, fishing, and other recreational activities. • Policy 5.6.9 Three of the five proposed homes in the shoreline area will have views of the river. Windows are provided in all of the homes facing the River. Additionally, small porches will be installed, which will allow viewing. BM Page 3 of 9 05/02/2013 Homestead at Foster Points L13-003 Goal 6.8 Historical Resource Use and Archaeological Protection Goal: Recognition of the river's contribution to Tukwila history and community identify through identification, enhancement, restoration, and protection of sites with historic and cultural value and through development of interpretative and educational programs. • Policy 5.8.3 • Policy 5.8.3 Response: There are no known "unique historic or archaeological features" in the area of the proposed project. As with any development along the shoreline, it is possible that historical or archaeological features could be unearthed during construction. Given the small amount of excavation that will be occurring this seems unlikely. The applicant is required to comply with all local, State, and Federal regulations regarding preservation of historical and archaeological resources. 6.9 Natural Environment and Habitat Use Goal: Restored, enhanced and protected natural environment resources along the river, including trees, wildlife habitat and features with value for long-term public, scientific and educational uses. • Policy 5.9.1 • Policy 5.9.2 Response: The proposed project will not result in a net loss of shoreline ecological function nor will wildlife or vegetation be impacted. No portion of the proposed development will be within 100 feet of the OHWM. No trees or other vegetation is proposed to be removed with the proposed project. The City's Subdivision code requires that one tree be planted on each lot of any plat greater than four lots. 6.10 Water Quality. Surface Water and Flood Control Use Goal: Improved water quality and quantity control programs affecting the Green/Duwamish River that improve the river's quality, provide habitat for fish and wildlife, protect public health and safety, and enhance public enjoyment of the river. Applicable Polices: • Policy 5.10.1 • Policy 5.10.03 Response: Given that the project is significantly setback from the River, no impacts to water quality or quantity are anticipated. The short plat was required to comply with the applicable King County Surface Water Design Manual requirements. Additionally, drainage on individual lots also complies with surface water regulations. None of the lots are located within the floodplain, and per Public Works, comply with all flood management ordinances. BM Page 4 of 9 05/02/2013 Homestead at Foster Points L13-003 3. SHORELINE REGULATIONS: TMC 18.44.130 (B)(3)" Shoreline Administration" states that a substantial development permit shall be granted only when the development proposed is consistent with the shoreline master program. The relevant SMP policies were discussed above. Below is a discussion of the relevant shoreline master program regulations that are incorporated into the zoning code that apply to this permit application. A. Principally Permitted Uses: TMC 18.44.040 (B) permits residential structures within the shoreline zone, providing no structures are located within the buffer area. The buffer area is defined as the area needed to achieve a 2.5:1 slope of the river bank, measured from toe of the bank to the top of the bank, plus 20 linear feet measured from top of bank landward; provided, that in no chase shall the buffer be less than 50 feet. The proposed homes will be at least 100 feet from the OHWM. B. Development Standards TMC 18.44.070 (B) requires that developers, such as the applicant, obtain a shoreline substantial development permit for home construction. TMC 18.44.070 (B) (1) requires that the project comply with the following criterion: 1. The development standards of the applicable underlying zoning district (Title 18 of the TMC). Response: The proposed homes meet all development standards in the LDR zone. 2. New Development and uses must be sited so as to allow natural bank inclination of 2.5:1 slope with a 20 foot setback from the top of bank. Response: All new homes within the shoreline area will be placed at least 100 feet from the OHWM. The subject property does not abut the River as lots 7 and 8 were previously deeded to the city. The location of the proposed new homes are outside the buffer area required to allow natural bank to be inclined at a 2.5:1 slope with a 20 foot setback from the top of the bank. 3. Utilities such as pumps, pipes, etc. shall be suitably screened with native vegetation per the standards in the Vegetation Protection and Landscaping Section. Response: No pumps, pipes or other similar appurtenances are proposed. 4. ° New shoreline stabilization, repair of existing stabilization or modifications to the river bank must comply with the standards of the Shoreline Stabilization Section, TMC Section 18.44.070 (F). Response: Not applicable. The applicant is not proposing any shoreline stabilization work. BM Page 5 of 9 05/02/2013 Homestead at Foster Points L13-003 5. Short plats of five to nine lots or formal subdivisions must be designed to provide public access to the river in accordance with the Public Access Section, TMC Section 18.44.100. Signage is required to identify the public access point(s). Response: Not applicable. The project is not a short plat or subdivision. As part of the initial short plat for the proposed project, the original applicant provided two lots to the City. These two lots have been combined with unimproved right of way to form a small, passive park. When the city develops the park appropriate signage will be provided. • 6. Parking facilities associated with single family residential development or public recreational facilities are subject to the specific performance standards set forth in Off -Street Parking Section, TMC Section 18.44.070(1). Response: Tract "X" that was approved under the old shoreline permit is within 50 feet of the OHWM. Tract "X" is for limited access to the park area by City employees and is to be used for emergency fire access. The surface of Tract "X" is grasscrete, a low impact development technique. The proposed alley is more than 100 feet from the OHWH. No daily parking of automobiles will occur within 50 feet of the OHWM. 7. Fences, freestanding walls or other structures normally accessory to residences must not block views of the river from adjacent residences or extend waterward beyond the top of the bank. Chain line fencing must be vinyl coated. Response: Lots 4, 5, and 6 will likely have fences along their property lines adjacent to Tract "X". The applicant has not proposed any fence designs or locations with the shoreline permit. In order to install a fence adjacent to Tract "X" the fence will be no taller than six feet. Furthermore, TMC 18.50.070 (A) requires that fence material between a height of four and six feet be transparent. This requirement is because the City considers tract "X" to be the fronts for lots 4, 5, and 6. Given that the applicant has not provided any fencing detail, a condition of approval of this shoreline permit to address this situation is required. 8. Recreational structures permitted in the buffer must provide buffer mitigation. Response: Not applicable. 9. The outside edge of surface transportation facilities, such as railroad tracks, streets, or public transit shall be located no closer than 50 feet from the OHWM, except where the surface transportation facility is bridging the river. Response: Tract "X" is not a railroad track or a street, but provides limited access to the park area by City employees and is to be used for emergency fire access. Additionally it appears like grass and an extension of the landscape area. While it is within 50 feet of OHWM, it was approved and constructed under the previous shoreline permit issued in 2007.See response under bullet point six. Except for bridges, approved above ground utility structures, and water -dependent uses and their structures, the maximum height for structures shall be 30 feet. For bridges, approved above ground utility structures, and water -dependent uses and their structures, the height limit shall be as demonstrated necessary to accomplish the structure's primary purpose. Bridges, approved above ground utility structures greater than 35 in height require a Shoreline Conditional use Permit. Response: The three homes within the shoreline zone shall comply with the maximum height requirement of 30 feet. C. Surface Water and Water Quality TMC 18.44.070 D provides development standards for shoreline development. The proposed project will have no impact to surface water quality and shall comply with all applicable surface water requirements. D. Flood Hazard Reduction TMC 18.44.070 (E) states standards for reducing flood hazards along the shoreline. First, the applicant is not installing any new flood protection structures. Additionally, no work is occurring within the floodplain. E. Shoreline Stabilization No shoreline stabilization is proposed. F. Landfill Activities: TMC 18.44.070(1), Development Standards (Section 9.11 of the SMP) addresses clearing, grading and landfill activities in the shoreline jurisdiction. There is no landfill activities proposed with this application. G. Vegetation Protection and Landscaping TMC 18.44.080 provides requirements for landscaping in both the buffer and non -buffer areas of the shoreline environment. No vegetation will be removed or impacted as a result of the proposed project. H. Public Access TMC 18.44.100 addresses public access requirement for the SMP. Public access is required when a development or use would create additional demand for public access through the addition of square footage to an existing building or the intensification in land use through the conversion of a warehouse to a retail or office use. This project will not create additional BM Page 7 of 9 05/02/2013 Homestead at Foster Points L13-003 demand for public access as no additional square footage is being added to the building and the current use is not being converted to a more intense land use. As noted, the previous applicant has provided the City with two lots immediately adjacent to the river. These lots will be used as a passive park by the City's Parks Department. I. Shoreline Design Guidelines This section of the TMC does not apply (TMC 18.44.110) as the proposed structures are residential within the Shoreline Residential Zone. 4. COMMENTS: A Notice of Application was distributed to agencies that may have an interest in the project on March 1, 2013. A copy of the Notice of Application was also posted on the site and mailed to surrounding residences/property owners. Comments were received from King County Flood District. A copy of the Flood District's comments is attached as attachment D. In response to the Flood Districts comments the City required that the applicant update the survey map in order to ensure that all structures are above the flood elevation. A copy of the revised plans was provided to the Flood District on April 23, 2013. The City staff asked that the Flood District provide any concerns to the City by April 26, 2013. No comments were provided to the City as of April 29, 2013. 5. SEPA: The proposed project is similar in scope to the project that was reviewed by the City in 2006/07. The Determination of Non -Significance, which was issued on August 11, 2006, covers the project proposed by Homestead Homes. A copy of the SEPA determination and the staff report are attached (Attachment B). CONCLUSIONS 1. The project is located in the Foster Point Neighborhood and five of the proposed six homes will be constructed within 200 -feet of the OHWM; and, thus are subject to compliance with the City's SMP and Shoreline Overlay District regulations. 2. No work will occur within the floodplain nor will any structures be located within 100 feet of the OHWM. 3. As part of the original project in 2006/07, the applicant conveyed to the City two lots along the River which are intended to be used for public access. Since public access was provided under the previous shoreline permit no further public access needs to be provided under this permit. As part of the original approval, Tract "X" was to be dedicated to the City; this shall occur prior to final inspection sign off of the proposed homes. Tract "X" is intended to be used for emergency access to lots four, five, and six; and for access to the city owned lots. 4. The project complies with the City's regulations regarding stormwater and thus will not impact water quality of the River. 6. All proposed homes will meet the City's single family design standards and development standards within the LDR zone. The applicant has not presented a fence design for the residential fences that will be placed within the shoreline zone. 7. The shoreline environment designation for the project area is "Shoreline Residential" and the construction of homes within the "shoreline residential" zone is permitted. 8. The proposed project complies with the city's Shoreline Management Program and regulations of the Shoreline Overlay District, provided the fence between Tract X and lots 4,5,6 shall not block views of the River. RECOMMENDATION Approve the shoreline substantial development permit with the following conditions: 1. Prior to the final approval of the homes on lots four, five, or six, the applicant shall submit a fence design for approval by the City of Tukwila. I would be more than agreeable to discussing these matters in more general terms, outside the limitations of this individual permitting application, for which the City of Tukwila is solely responsible. Jite, and proposed finished floor eleva•,ions (FFE) ranging from 18.3 feet to 20.5 feet. General Note 11 on the Plan states that "...Vertical Datum Shall be NAV01988...For Projects within a Flood Control Zone, the Permittee shall provide conversion calculations to NGVD 1929." While it is clear from the enclosed PDF image of a portion of the FEMA's effective, adopted Flood Insurance Rate Map (effective FIRM) Panel No. 53033C0957 that the approximate BFE shown at elevation 15.0 feet is consistent with the effective FIRM, and is therefore based on the NGVD 1929 Vertical Datum, it is not clear from which Datum the corresponding FFEs are shown on the Plan. More generally, it is not clear from the Plan and this conversion Note that all site elevation values are actually shown in NGVD29, or in NAVD88, or in both, with conversion calculations provided separately, elsewhere. I say this because more recent flood mapping studies performed by King County in 2007 and submitted to FEMA in 2010 (Preliminary Digital Flood Insurance Rate Maps, or PDFIRMs) are based instead on the NAVD 1988, but show the existing ground surface elevations at the site in the same range of elevations as the proposed FFEs (also enclosed). The PDFIRMs note (enclosed) that the appropriate conversion calculation to use in comparing the two Datum sets at this location is: NGVD29 = NAVD88 3.56' If the site is in fact in what Tukwila designates a Flood Control Zone, and all site and invert elevations shown are labeled after they have been provided with this conversion to NGVD29, this should clearly be noted on the plans. A major construction project in Auburn several years ago ran into this exact problem, with the result that the plans called for the new building to be constructed nearly three feet below the actual BFE. This result was not found or corrected until the project was under construction, with a significant cost and schedule delay added. In addition, the updated analysis of Green River flood frequencies performed as part of the PDFIRM resulted in slightly higher flood elevations over all, with the result that the BFE at this location is approximately 20.0 feet NAVD88, as shown on the enclosure. High Country Homes is the applicant, and the site grading map enclosed with the Notice also lists Toddland, LLC as an applicant for construction of site improvements entitled "Foster Point Homesteads." Thank you for the opportunity to comment on this project The site map Plan shows an approximate Base Flood Elevation (BFE) of 15.0 feet at the site, and proposed finished floor elevations (FFE) ranging from 18.3 feet to 20.5 feet. General Note 11 on the Plan states that "...Vertical Datum Shall be NAVD 1988...For Projects within a Flood Control Zone, the Permittee shall provide conversion calculations to NGVD 1929." While it is clear from the enclosed PDF image of a portion of the FEMA's effective, adopted Flood Insurance Rate Map (effective FIRM) Panel No. 53033C0957 that the approximate BFE shown at elevation 15.0 feet is consistent with the effective FIRM, and is therefore based on the NGVD 1929 Vertical Datum, it is not clear from which Datum the corresponding FFEs are shown on the Plan. More generally, it is not clear from the Plan and this conversion Note that all site elevation values are actually shown in NGVD29, or in NAVD88, or in both, with conversion calculations provided separately, elsewhere. I say this because more recent flood mapping studies performed by King County in 2007 and submitted to FEMA in 2010 (Preliminary Digital Flood Insurance Rate Maps, or PDFIRMs) are based instead on the NAVD 1988, but show the existing ground surface elevations at the site in the same range of elevations as the proposed FFEs (also enclosed). The PDFIRMs note (enclosed) that the appropriate conversion calculation to use in comparing the two Datum sets at this location is: NGVD29 = NAVD88 - 3.53' If the site is in fact in what Tukwila designates a Flood Control Zone, and all site and invert elevations shown are labeled after they have been provided with this conversion to NGVD29, this should clearly be noted on the plans. A major construction project in Auburn several years ago ran into this exact problem, with the result that the plans called for the 3 new building to be constructed nearly ‘nree feet below the actual BFE. This result was not found or corrected until the project was under construction, with a significant cost and schedule delay added. In addition, the updated analysis of Green River flood frequencies performed as part of the PDFIRM resulted in slightly higher flood elevations over all, with the result that the BFE at this location is approximately 20.0 feet NAVD88, as shown on the enclosure. The shoreline area and river bank is grassy with small plants and the area is presently maintained by the City. The first 100 feet has been mowed and is a park owned by the City. In next 100 feet there is bare ground or sparse grass as it has been disturbed by construction as permitted under the land development permit. There was an existing house and out building on the property that have been removed by a permit from the City. There is no armoring on the riverbank and there is not noticeable erosion or slope failure. The soils are well draining silt/sand. There is a tract within the hundred feet area with Grass Crete and there is a paved driveway within the two hundred foot area to service the existing six residential lots. There are no docks, piers decks or other structures near or over the water. There are above ground power poles and underground utilities within the shoreline jurisdiction area. 2. How will your project change the existing condition of the shoreline described above? There will be 6 new houses place on the six existing lots where before there was one house with out buildings. The bare ground will be landscaped and planted with residential type plants. The new residents are all beyond the one hundred foot mark 3. SHORELINE GOALS AND POLICIES The goals and policies listed below are taken from the City's 1995 Comprehensive Plan. Strikeout/underlining has been used to indicate proposed revisions to the original 1995 text to reflect changed circumstances or newer requirements. The goals and policies are found in Chapter 5 of the Comprehensive Plan. The Comprehensive Plan will be amended to reflect these changes to goals and policies. 6.1 Shoreline Environment Designations, Comprehensive Plan Goal 5.1 Goal: Shoreline Environment designations that meet Washington State Shoreline Management Act requirements, and reflect local conditions and Tukwila's long-term vision for its shoreline. The shoreline jurisdiction generally extends for 200 feet on either side of the Ordinary High Water mark, consistent with the Washington State Shoreline Management Act. In order to implement this goal, the SMP proposes three Environment Designations: Shoreline Residential, Urban Conservancy, and High Intensity (as detailed in the Shoreline Environment Section) that comply with the Washington State Shoreline Management Act and function well for the City. This project is under Shoreline Residential Policies: • Policy 5.1.1: Shoreline Residential Environment. In the Shoreline Residential Environment, priority shall be given to the following: o Uses that preserve or restore the natural character of the shoreline or promote preservation of vegetation, open space, flood plain or sensitive area lands; and o Development that is compatible with the natural and biological limitations of the land and water and that will not require extensive alteration of the shoreline or new "hard" structural shoreline stabilization. Where possible the removal of bulkheads, revetments, levees or other "hard" structural shoreline stabilization is required. Hard structural shoreline stabilization may be replaced with alternative bioengineered bank stabilization; and o On publicly owned property, water -dependent or water -related recreational activities that are compatible with the character of the shoreline residential areas. o Maintenance of existing single-family residential development patterns and public open space and recreation uses; o Residential and recreational development that promotes vegetation conservation and enhancement, sensitive areas protection, and maintenance of water quality to assure no net loss of shoreline ecological functions; o Residential and recreational development that contributes to the restoration of ecological functions over time in areas where ecological degradation has occurred. This project preserves the natural character of the shoreline and promotes open space by dedicating land to the City for park use. There is no net loss of shoreline ecological functions. Policies: • Policy 5.2.1: Coordinate shoreline planning and management activities with other local jurisdictions and their plans such as the WRIA 9 Salmon Habitat Plan and the King County Flood Hazard Management Plan to establish region -wide consistency in addressing river issues with regional implications, such as economic development, public access, wildlife habitat, water quality control and flood control. • Policy 5.2.2: Promote river stewardship and increase river awareness through actions which further shoreline goals, such as educational programs, community activities, and partnerships with Tukwila residents, businesses, schools, government, and community organizations. • Policy 5.2.3: Promote and participate in the implementation of the Watershed Resource Inventory Area (WRIA) 9 Plan, including supporting the recommended projects located in Tukwila to improve the habitat functions of the Green/Duwamish River, as well as the Plan policies and goals. Implementation Strategies: • WRIA 9 Salmon Habitat Plan • Tukwila SMP Restoration Plan • King County Flood Hazard Management Plan 6.3 Land Development Use and Economic Vitality, Comprehensive Plan Goal 5.3 Goal: Development along the shoreline that fosters the economic vitality of Tukwila while preserving the long-term benefits of the river. Policies: • Policy 5.3.1: Implement Shoreline Design Guidelines to: o Encourage design that views the river as an amenity; o Guide the design of multiple shoreline uses; o Establish techniques for increasing multiple shoreline use; o Prioritize locations for use; o Encourage removal of invasive species with nonchemical methods and maintenance of native planted vegetation to minimize the presence of invasive species. • Policy 5.3.2: Design and locate all shoreline development to minimize impacts on areas identified as important for other river uses, such as wildlife and aquatic habitat, river vegetation, public access and recreation, historical resource and flood control. • Policy 5.3.3: When no other feasible alternative exists, allow structures for water dependent uses to be placed in the water, or structural reinforcement of the riverbank, only when this provides a significant, long-term public benefit, does not interfere with navigation or flood management, does not cause a loss of shoreline function or is essential to a water-dependent use. • Policy 5.3.4: Prohibit the construction of new flood control facilities unless constructed to incorporate habitat restoration features and work to remove existing shoreline armoring — where possible— to restore habitat functions. • Policy 5.3.5: Recognize and promote the river's contribution to the economic vitality of Tukwila, as a valuable amenity for existing and future businesses which depend on or benefit from a shoreline location. • Policy 5.3.6: Ensure that shoreline development does not diminish the commercial navigability of the River. • Policy 5.3.7: Tukwila Urban Center Development Policy: Design and locate shoreline development in the Tukwila Urban Center to encourage water enjoyment uses that: o Provide for shoreline multiple uses that are consistent with the underlying zoning; o Provide additional benefits, such as riverbank restoration, fishing piers, non-motorized boat launches, river views, or interpretive signs; o Support public access to and along the shoreline; o Provide water-enjoyment uses as transitions between the river and non-water dependent uses; o Encourage efficient use of land, through such techniques as clustering, mixed use projects, cooperative parking or parking located under principal structures, and shared utility and access corridors. o Ensure that new development and re-development in the Urban Center acknowledges the goal of a continuous street facade along Christensen Road and the riverfront and locates parking facilities to the interior of the lot. Implementation Strategies for Policy 5.3.7: o Shoreline Design Guidelines o Development Standards o Tukwila Urban Center Plan • MIC Development Policy 5.3.8: Ensure that non-water dependent shoreline development in the MIC provides for shoreline multiple uses to the extent that site security and the success of industrial operations are not jeopardized; ensures no net loss of shoreline function and provides adequate mitigation for the loss of shoreline multiple use opportunities. • MIC Development Policy 5.3.9: Allow opportunities for commercial and recreational marinas to locate in Tukwila downstream of the turning basin where compatible with existing and future navigability and existing and future ecological restoration projects. Policy 5.3.10: Development outside the Tukwila Urban Center or MIC: Design and locate shoreline development outside of the Tukwila Urban Center and the MIC to: o Provide for multiple shoreline uses; o Provide water -enjoyment uses as transitions between the river and non -water dependent uses; o Encourage efficient use of land through such techniques as clustering, mixed-use projects, cooperative parking or parking located under principal structures, and shared utility and access corridors; o Treat the river as an amenity in the design and location of the project Shoreline was dedicated to the City for park and open space usage 6.4 Private Property Rights, Comprehensive Plan Goal 5.4 Goal: Protect rights of property owners to reasonable use and enjoyment of private property, through appropriate location, access to, and design of shoreline uses. Policies • Policy 5.4.1: Design, locate and manage shoreline uses in a manner which maintains reasonable use and enjoyment of private property. • Policy5.4.2: Design and locate public access in a way that is appropriate for the site, depending on site conditions and private property concerns. • Policy 5.4.3: Special sensitivity is required for residential property; therefore, all single-family residential development of four or fewer single-family residential lots is excluded from requirements to provide private or public access. Single family property owners are not exempt from the responsibility to improve the habitat value of the shoreline environment. • Policy 5.4.4. Maintain flexibility in methods of obtaining public access, to allow for different site conditions and private property concerns that might conflict with public access, such as privacy, safety, and security. • Policy 5.4.5: Obtain additional easement area to permit the improvement of flood control and river habitat by setting back levees or removing revetments and other hard shoreline armoring and replacing with more habitat -friendly flood control levees or other shoreline treatment Shoreline was dedicated to the City for park and open space usage. Policies: • Policy 5.5.1: Require that shoreline development outside of the MIC: o Ensures no net loss of shoreline function; o Is designed to be consistent with Tukwila Shoreline Design Guidelines; o Reflects principles of high quality design, in such areas as site planning, architecture and landscaping; o Includes setbacks, bulk, height, density, landscape buffers and provisions for open space that enhance the shoreline environment. Implementation Strategies for Policy 5.5.1: o Shoreline design guidelines o Shoreline development standards o Tukwila Urban Center Plan • Policy 5.5.2: Require that shoreline development in the MIC: o Is designed to be consistent with Tukwila Shoreline Design Guidelines; o Maintains or enhances the existing visual quality along the river; o Provides trees and other landscaping to buffer industrial uses that are incompatible with other river uses; o Provides amenities that enhance enjoyment of the river by employees. Implementation Strategies for Policy 5.5.2: o Shoreline design guidelines o Shoreline development standards Shoreline was dedicated to the City for park and open space usage. Access tract is to be dedicated to the City for additional easement and access to the river. There is no net loss of shoreline functions. 6.6 Access and Recreational Use, Comprehensive Plan Goal 5.6 Goal: Increase the amount and diversity of opportunities for public recreation and access to and along the river, including visual and cultural access, access to the water's edge, opportunities for small boat navigation and access, and connections to other neighborhoods, consistent with the shoreline character. Policies: • Policy 5.6.1: Retain and improve areas identified as important in the network of public access to the river, including cross-town connections, former railroad right-of- ways and unimproved street -end right-of-ways, historic sites, unique natural features or other areas valuable for their interpretive potential. • Policy 5.6.2: Maintain existing parks along the shoreline and acquire additional park land to increase access and recreation opportunities. • Policy 5.6.3: Incorporate river access requirements to guide the design, location and management of shoreline public access in short plats over 4 lots and all subdivisions as well as multi -family, commercial and industrial development; to identify types of access appropriate and feasible for various site conditions and locations; and to establish strategies, funding sources and priorities for acquisition and enhancement of shoreline public access. Implementation Strategies for Policies 5.6.1-5.6.3: o Shoreline design guidelines o Shoreline access guidelines o Shoreline development standards o Walk and Roll Plan o Parks and Open Space Plan • Policy 5.6.4: Design, locate and manage public access for diverse types and variable levels of intensity in order to minimize impacts on vulnerable features of the natural environment and to minimize conflicts with private property uses. • Policy 5.6.5: Where shoreline development provides public access areas, reserve such areas for use by the public through the means most appropriate for the type, scale and impacts of the development, such as dedication, donation or sale of an easement or right-of-way to the City. • Policy 5.6.6: Support the implementation of the King County Green River Trail, per the existing King County Green River Trail Master Plan as well as pedestrian/bicycle connections with the Trail from properties on the opposite bank and the expansion of this trail where appropriate. Policies for Development outside MIC: • Policy 5.6.7: Require subdivisions, multi -family residential uses and commercial and industrial uses along the shoreline to provide a trail for public access along the river in areas identified for trail connections, consistent with the King County Green River Trail Master Plan, Shoreline Master Program or any other approved access plan. Implementation Strategies for Policy 5.6.7 o King County Green River Trail Master Plan o Shoreline public access standards o Walk and Roll Plan o Parks and Open Space Plan • Policy 5.6.8: Where shoreline public access is provided, ensure that it is designed to be safe and convenient and includes access amenities such as benches, drinking fountains, public parking areas, handicapped access, and appropriate lighting, consistent with the shoreline access guidelines. Implementation Strategies o Shoreline design guidelines •• Policy 5.6.10: Public access improvements should be designed and constructed to: o Look and "feel" welcoming to the public; o Connect to public areas, street ends, and other pedestrian or public throughfares; o Enhance the character of Tukwila; o Avoid conflicts with water -dependent uses; o Provide for public safety and minimize impacts to private property and individual privacy and security; o Require a low level of operation and maintenance; o Ensure that construction (i.e. structures and access pathways) incorporates environmentally sensitive design and materials (e.g., non-toxic, natural materials) • Policy 5.6.11: Improve pedestrian connections between the river, Green River Trail and the Urban Center's commercial, office and residential uses. Policies for Development in MIC • Policy 5.6.12: For MIC properties included in the King County Green River Trail Master Plan or other approved access plan, require shoreline development to provide a trail for public access along the river. • Policy 5.6.13: Where shoreline public access is provided, ensure that it is designed to be safe and convenient and includes access amenities such as benches, drinking fountains, public parking areas, handicapped access and appropriate lighting, consistent with the shoreline access guidelines. • Policy 5.6.14: For MIC properties not included in the King County Green River Trail Plan, require shoreline development to provide public access or a private natural area in lieu of public access, or otherwise mitigate the loss of public access. Policies: • Policy 5.7.1: Design and locate transportation uses within the shoreline jurisdiction to be compatible with shoreline vegetation or other habitat features, turn -outs or parking areas for public access, biofiltration swales to protect water quality, public art or interpretive signs. • Policy 5.7.2: Ensure the transportation uses within the shoreline jurisdiction and within those corridors identified as river cross -connections provide safe, convenient and attractive pedestrian, bicycle and boater access and facilities for public transportation. • Policy 5.7.3: Minimize transportation impacts to the natural environment (such as air, noise, odor or water pollution) and enhance the natural environment wherever possible through planting trees and other habitat features. • Policy 5.7.4: Encourage maintenance of the river's navigability up to the Turning Basin, where this achieves a greater public interest and a balance between costs and benefits to the broader community and impacts to the habitat functions of the river, in recognition of the historical significance of navigation and its importance to the economic vitality of water -dependent uses and the MIC Shoreline was dedicated to the City for park and open space usage. Storm water to be treated and infiltrated. 6.8 Historical Resource Use and Archaeological Protection, Comprehensive Plan Goal 5.8 Goal: Recognition of the river's contribution to Tukwila history and community identity through identification, enhancement, restoration, and protection of sites with historic and cultural value and through development of interpretive and educational programs. Policies • Policy 5.8.1: Ensure that shoreline development reflects the river's important role in Tukwila's history and that long-term public use of the river as an historical resource is protected by providing for the identification, protection and interpretation of unique historic and archaeological features. • Policy 5.8.2: Ensure that public shoreline development reflects the river's natural features and community traditions. • Policy 5.8.3: Ensure that archaeological artifacts and sites are protected when development takes place in the shoreline jurisdiction. No archaeological artifacts were found within the project boundary 6.9 Natural Environment and Habitat Use, Comprehensive Plan Goal 5.9 Goal: Restored, enhanced, and protected natural environment resources along the river, including trees, wildlife habitat and features with value for long-term public, scientific and educational uses. Policies • Policy 5.9.1:Ensure that shoreline development results in no net loss of shoreline ecological function, minimizes impacts on wildlife and that significant vegetation, sandbars, wetlands, watercourses, and other critical areas identified as important for habitat are maintained through the proper location, design, construction, and management of all shoreline uses and activities. • Policy 5.9.2: Ensure that shoreline development and activities protect riverbank vegetation and, where feasible, restore degraded riverbanks in accordance with the vegetation management provisions of the Shoreline Master Program, in order to minimize and compensate for impacts to fish and wildlife habitat. • Policy 5.9.3: Mitigate unavoidable disturbances of significant vegetation or habitat through replacement of habitat and provision of interpretive features consistent with the shoreline access guidelines. • Policy 5.9.4: Support relief from certain shoreline master program requirements for properties affected by habitat restoration projects that result in the movement of the ordinary high water mark. • Policy 5.9.5: Support establishing the Transition Zone as the priority area for habitat restoration projects given its importance for subtidal and intertidal habitats to allow salmonids to gradually adjust to the change between fresh and saltwater conditions. No disturbance of shoreline area took place with land being dedicated to the City for park and open space. Area to be maintained by the City 6.10 Water Quality, Surface Water and Flood Control Use, Comprehensive Plan Goal 5.10 Goal: Improved water quality and quantity control programs affecting the Green/Duwamish River that improve the river's water quality, provide habitat for fish and wildlife, protect public health and safety, and enhance public enjoyment of the river. Policies: • Policy 5.10.1: Design, locate, and manage shoreline development including streets, flood control projects, surface water drainage and sewer systems, clearing and grading activities, and landscaping in a manner which minimizes opportunities for pollutants to enter the river, provides erosion control and otherwise protects water quality. • Policy 5.10.2: Design, manage, and mitigate flood control uses to minimize impacts to other shoreline uses such as trees and riverbank vegetation, public access and recreation, and fish habitat; and set them back from the river, where feasible for the project, with land areas between the water and the levee set aside as open space for public recreation or wildlife habitat. • Policy 5.10.3: Consistent with project feasibility, mitigate unavoidable negative impacts on other shoreline uses owing to flood control uses through such measures as restoration of trees and native riverbank vegetation, provision of public access to the water's edge, interpretive features, or other mitigation of loss of opportunities for shoreline multiple uses. • Policy 5.10.4: Obtain additional easements, where needed, from property owners to set back levees to improve flood control and shoreline habitat functions. Where possible, as redevelopment occurs, replace bulkheads, revetments or other hard bank stabilization with more natural levees, riverbanks or other shoreline treatments, to improve flood control, ecological functions and habitat. Storm for the site is now designed and installed for water quality and quantity control The storm system is designed to be infiltrated. The existing septic system was abandoned and the new homes will be hooked up to the sewer system. C. Policies: • Policy 5.11.1: Design, locate, and manage shoreline uses, such as capital improvement projects and private development, in a manner that does not endanger public health, safety and welfare, and enhances the capacity of the river to provide long-term flood protection, habitat and other benefits and resources to the community and the environment. Identify existing top of bank, landward and riverward toe of levee (or toe of bank if no levee), ordinary high water mark and base flood elevation (i.e., the 100 year flood). 3. For work riverward of the OHWM: Distance work extends into the river and distance to Federal projects and navigation channels. 4. If there is not enough room on the parcel for this buffer, the minimum buffer width is 50 ft.; • Urban Conservancy Buffer —100 ft. non -levee area; 125 ft. in leveed area; • High Intensity Buffer -100 ft. • The Aquatic Environment includes the area waterward of the OHWM and does not have an identified buffer. 5. Show any levee/riverbank maintenance easements. 6. Construction limit lines and areas of clearing/grading/filling. See TMC 18.44.070 J for land altering regulations. Removal of any significant trees or native vegetation in the shoreline jurisdiction requires a Shoreline Tree Removal and Vegetation Clearing Permit. 7. Identify any sensitive areas and their buffers, as applicable. D. CROSS-SECTIONS FOR SHORELINE PROJECTS SHORELINE CROSS SECTIONS at maximum 75' intervals along the shoreline showing: 1. Existing and proposed elevations and improvements; 2. Limits of the applicable shoreline buffer and 200 foot shoreline jurisdiction, as measured from the OHWM; 3. The top of bank elevation, landward catch point toe of levee, riverbank toe, ordinary high water mark and base flood elevation (i.e., the 100 year flood as determined by the Federal. Emergency Management Administration - FEMA), and levee/ riverbank maintenance easement and the location of the top of bank at a 2.5:1 slope. E. LANDSCAPE PLAN: 1. Landscape planting plan by a Washington State licensed landscape architect or an approved biologist. Plans must indude the type, quantity, spacing and location of all plantings, soil preparation and amendment, irrigation, weed management, mulching and maintenance plan. Invasive vegetation must be removed and native vegetation planted. Maximum size 24" x 36". See TMC 18.44.080 for requirements. 2. Show all existing trees over 4" in caliper, indicating those to be retained, those to be removed and any tree protection measures required. Any trees removed over 4" in caliper are subject to the replacement requirements of TMC 18.44.080 B.4. 3. Provide notes on landscaping sheets that address consistency of landscaping with requirements of TMC 18.44. F. CIVIL PLANS: 1.
