III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this decision, that is by December 24, 2013. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $541 plus retainer. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. MB Page 2 of 3 12/10/2013 Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. The project includes adding (3) new antennas [(2) 2' & (1) 4'], (3) Remote Radio Units, (1) Surge Protector, & (1) hybrid fiber/power cable to the existing 60' monopole. In order for the existing monopole to accommodate the additional antennas, applicant will need to replace the existing antenna mounting system currently located on the tower. The new antenna color will match or will be painted to match the color of the existing monopole. No ground disturbance or expansion of the existing compound is proposed. Existing Development This monopole is preexisting. Surrounding Land Uses The property and the surrounding parcels are zoned TVS. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being modified is preexisting. Previous permits: L99-0062, L2000-012, D07-023, L09-058. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. This decision does not require the use of any new facilities for placement of the new antennas. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards listed under TMC 18.58.070 and 18.58.090. The applicant has not proposed a new generator. 2.Business License Requirement Verizon has applied for a business license (00004523). 3. Only safety signage must be placed on the WCF. The applicant does not propose any signage. 4. Accommodations for parking for maintenance personnel must be provided. Parking is not affected by this modification. 5. Towers shall either maintain a galvanized steel finish or be painted a neutral color so as to reduce its visual obtrusiveness. No change to the existing tower is proposed. 6. The design of all buildings and ancillary structures shall use materials, colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and built environment. No new buildings or structures are proposed. 7. Antennas shall have the same color scheme as the structure they are located on. These antennas will be located on a utility tower, therefore this criteria does not apply. 8. WCF poles and towers shall only have safety lights if required by a government agency. No lighting is proposed. 9. No advertising is permitted on WCF No advertising is proposed. 10. Each service provider shall be limited to an equipment enclosure of 360 square feet. When adding antennas to existing WCF towers, height must not exceed what was approved under the original application to construct the tower. These antennas will be located on a utility tower, therefore this criteria does not apply. 12. Antennas shall be painted to match the color scheme of tower. Antennas and ancillary equipment will be painted to match the existing tower color. 13. Feed lines and coaxial cables shall be located within the tower. Those exposed shall be painted to match tower. Feed lines and coaxial cables will be routed internally within the existing monopole. 14. A new cabinet shall be located within the equipment enclosure that was approved as part of the original application. No new cabinet is proposed, therefore this criteria does not apply. CONCLUSIONS 1. The proposed modifications to the existing antenna will not significantly alter the conditions that currently exist. The height of the tower will not change. 2. As demonstrated in Table B, the project meets all applicable development standards. 3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type I Wireless Communication Facility permit as applied for by Apeiron Real Estate, Inc. for Verizon without conditions. T -mobile antennas are currently collocated on the tower. Tower Status: INADEQUATE (110.2%) With Proposed Upgrade: ADEQUATE (87.9%) TOWER DESCRIPTION The Summit Manufacturing, Inc. monopole consists of two 18 -sided pole sections equaling 60' in total height tapering approximately 0.20 -inches per foot of height from the base. This monopole was designed by Paul J. Ford and Company and erected in 1999. The Client provided us with the original construction drawings. Photos of the site and architectural plans for the proposed revisions were also provided. All geometry, member sizes, and material strengths used in our analysis were based on this information. If anything differs from the information contained in these documents, CG Engineering should be notified to revise our analysis. APPURTENANCE CONFIGURATION The tower was analyzed using the appurtenance configuration specified in the following table. All loading was provided to us from the Client. ANALYSIS CRITERIA A rigorous finite element analysis of this tower was performed to determine its structural compliance with the current design standard, ANSI/TIA-222-G "Structural Standard for Antenna Supporting Structures and Antennas." The tower was modeled using the tnxTower Version 6.1.3.1 analysis program (Tower Numerics Inc., 2013). The parameters in the following table were used in our analysis of the tower based on its location. These represent the most stringent requirements of the local jurisdiction, the original design or Annex B in the ANSI/TIA-222-G Standard. TOWER ANALYSIS RESULTS The following table summarizes the findings from our analysis. The table expresses the actual stress levels in percentage form relative to the code allowable stress values. Stress levels of up to 105% are considered to be within an acceptable tolerance because of the margin of error associated with this type of analysis. These are listed in the table below. In comparing our calculated values with the design loads, we determined that all of the proposed loads remain less than the design loads stated. Therefore, the foundation is deemed adequate to resist the applied loads per the original design. Additionally, foundation analysis calculations were performed to confirm the foundation is adequate. Non -shrink grout shall be provided below the baseplate. With this upgrade, all tower sections, connections, and the foundation system are within their allowable capacities for the applied loads. CONDITIONS OF ANALYSIS This structural analysis is based on the documentation that was available to us. CG Engineering did not perform an observation of this site to verify the accuracy of the provided structure and appurtenance data, and we should be contacted immediately if there are any discrepancies with the information stated within this report. Our analysis is based on the assumption that the structure has been properly installed and is maintained to the minimum standards required by code. We assume the structure has no known deterioration or damage that would adversely affect its capacity. PROJECTPROPOSAL DESCRIPTION Verizon Wireless ("VZW") is a wireless communications company operating on a National level. VZW is licensed to operate in the city of Tukwila by the Federal Communications Commission (FCC). It is VZW's desire to work with the city of Tukwila to ensure its proposed project is consistent with all local ordinances and zoning regulations while providing adequate wireless communications coverage to VZW's customers; including critical communication services for emergency, business, and personal use. Pursuant to Tukwila Municipal Code, Section 18.104.170; Applicant is proposing to add (3) new antennas [(2) 2' & (1) 4'], (3) Remote Radio Units, (1) Surge Protector, & (1) hybrid fiber/power cable to the existing 60' monopole. In order for the existing monopole to accommodate the additional antennas, Applicant will need to replace the existing antenna mounting system currently located on the tower. This proposal will not increase the height of the existing tower. There will be no ground disturbance and no new noise producing equipment proposed associated with the Applicant's proposed modification. 4 City of Tukwila SEAQ Orillia Iv.. TM C 18.104.170 GENERAL REQUIREMENTS THE FOLLOWING ARE GENERAL REQUIREMENTS FOR ALL WIRELESS COMMUNICATION FACILITIES- Applicant's responses to the General Requirements are noted below in bold: (1) Noise — Any facility that requires a generator or other device which will create noise must demonstrate compliance with TMC Chapter 8.22, "Noise". A noise report, prepared by an acoustical engineer, shall be submitted with any application to construct and operate a wireless communication facility that will have a generator or similar device. The City may require that the report be reviewed by a third party expert at the expense of the applicant. N/A -Applicant is not proposing any new noise proposing equipment. (2) Business license requirement — Any person, corporation or entity that operates a wireless communication facility within the City shall have a valid business license issued annually by the City. Any person, corporation or other business entity which owns a tower also is required to obtain a business license on an annual basis. Applicant has current City of Tukwila Business License with the city (attached for reference). In addition, the General Contractor working on the construction for the proposed modification will also file for a Business License prior to the permit being picked up for construction. (3) Signage — Only safety signs or those mandated by other government entities may be located on wireless communication facilities. No other types of signs are permitted on wireless communication facilities. No new signs are proposed to be installed with this modification, unless required by either the FCC and/or the FAA. (4) Parking — Any application must demonstrate that there is sufficient space for temporary parking for regular maintenance of the proposed facility. This is an unmanned facility. Facility maintenance occurs approximately once a month. There is existing on-site parking available, which provides adequate parking for when maintenance is required. The proposed modification will not increase the need for additional parking. (5) Finish — A tower shall either maintain a galvanized steel finish or, subject to any applicable standards of the FAA or FCC, be painted a neutral color so as to reduce its visual obtrusiveness. The proposed antennas, feed lines, coaxial cables, and associated mounting hardware will match the existing monopole to blend with present equipment and surrounding area. 5 City of Tukwila SEAQ Orillia (6) Design — The design of all buildings and ancillary structures shall use materials, colors, textures, screening and landscaping that will blend the tower facilities with the natural setting and built environment. The proposed antennas, feed lines, coaxial cables, and associated mounting hardware will match the existing monopole to blend with present equipment and surrounding area. (7) Color— All antennas and ancillary facilities located on buildings or structures other than towers shall be of a neutral color that is identical to or closely compatible with the color of the supporting structure so as to make the antenna and ancillary facilities as visually unobtrusive as possible. The proposed antennas, feed lines, coaxial cables, and associated mounting hardware will match the existing monopole to blend with present equipment and surrounding area. (8) Lighting — Towers shall not be artificially lighted unless required by the FAA, FCC or other applicable authority. If lighting is required, the reviewing authority shall review the lighting alternatives and approve the design that would cause the least disturbance to the surrounding areas. No strobe lighting of any type is permitted on any tower. No tower lighting is proposed with this modification, unless required by the FCC and/or FAA. (9) Advertising — No advertising is permitted at wireless communication facility sites or on any ancillary structure or facilities equipment compound. No advertising is or will be on-site. (10) Equipment Enclosure — Each applicant shall be limited to an equipment enclosure of 360 square feet at each site. However, this restriction shall not apply to enclosures located within an existing commercial, industrial, residential or institutional building. Applicant is not proposing any changes to the existing ground. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this decision, that is by December 24, 2013. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $541 plus retainer. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. The Hearing Examiner's decision on the appeal is the City's final decision. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being modified is preexisting. Previous permits: L99-0062, L2000-012, D07-023, L09-058. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards listed under TMC 18.58.070 and 18.58.090. The design of all buildings and ancillary structures shall use materials, colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and built environment. No new buildings or structures are proposed. 7. Antennas shall have the same color scheme as the structure they are located on. These antennas will be located on a utility tower, therefore this criteria does not apply. 8. WCF poles and towers shall only have safety lights if required by a government agency. No lighting is proposed. 9. No advertising is permitted on WCF No advertising is proposed. 10. Each service provider shall be limited to an equipment enclosure of 360 square feet. When adding antennas to existing WCF towers, height must not exceed what was approved under the original application to construct the tower. These antennas will be located on a utility tower, therefore this criteria does not apply. 12. Antennas shall be painted to match the color scheme of tower. Antennas and ancillary equipment will be painted to match the existing tower color. 13. Feed lines and coaxial cables shall be located within the tower. Those exposed shall be painted to match tower. Feed lines and coaxial cables will be routed internally within the existing monopole. 14. A new cabinet shall be located within the equipment enclosure that was approved as part of the original application. No new cabinet is proposed, therefore this criteria does not apply. CONCLUSIONS 1. The proposed modifications to the existing antenna will not significantly alter the conditions that currently exist. The height of the tower will not change. 2. As demonstrated in Table B, the project meets all applicable development standards. 3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan.
