Preliminary approval of the BLA is granted, subject to the following conditions. These conditions are to ensure compliance with the City's Zoning, Fire, and Public Works requirements. All conditions must be satisfied prior to final approval and subsequent recording of the BLA documents. The following document(s) was reviewed by the City in granting preliminary approval: 1. Survey prepared by Jay Babcock, submitted to the City on February 21, 2013. 2. Lot closures prepared by Jay Babcock, submitted to the City on February 21, 2013. General Conditions 1. The City has no general conditions on the BLA application. Modifications to the Recording Document The following modifications need to be made to the recording document: 1. Add the File Number, L13-005 to the face of the BLA. 2. Add the following note, "Fire, Park, and Traffic Impact fee may be due at the time of issuance of a building permit on any of the proposed lots. 3. Add the following note, "All new utilities shall comply with the City's underground Ordinance." 4. Add the following note, "All developments on the proposed lots shall be consistent with the Development Agreement, and amendments, in place between the City of Tukwila and Segale Properties, LLC." 5. Add the following note, "At the time of development on any of the parcels subject to this BLA, a geotechnical report may be required." Once the above conditions are satisfied, you may submit for final approval of the BLA. When you resubmit, please provide four copies of the BLA document, one document must contain the original signatures of all individuals and entities which have an interest in the property. Do not fold the copy of the surveyor that has the original signatures. Appeals This short plat approval or any condition placed in decision is appealable to the Hearing Examiner. One administrative appeal of the decision on the short plat is permitted. If no valid appeals are filed within the time limit the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of the Notice of Decision (2/26/13). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. The Notice of Appeal shall state specific errors of fact or errors in application of the law in the decision being appealed; the harm suffered or anticipated by the appellant, and the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 4. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. Recording It is your responsibility to record the City approved BLA document with the King County Department of Records. The BLA is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded originals to the City within four to six weeks at which time your BLA is considered complete and you can obtain individual building permits for each lot. You can shorten this process by hand delivering a copy of the recorded BLA with parcel numbers to the Department. Do not fold or bend the final short plat map that will be recorded with King County. Page 2 of 3 Expiration The final BLA must be filed with the King County Department of Records by February 26, 2014, exactly 12 months from the date of this preliminary approval or the application will expire. Please keep this date in mind in the coming months. The City is in no way obligated to remind you of this expiration date. The City may grant one extension of not more than twelve months. The request for an extension must be made in writing and must be submitted to the City prior to the expiration of the BLA. If the BLA approval expires, subsequent development permits that are related to the short plat shall also expire and any vesting will be lost. First, thank you for agreeing to extend the City's deadline for providing this comment letter to January 7, 2013. In addition, thank you for meeting with City staff on December 7th to discuss the application and staffs initial comments. Many of the comments provided in this letter were discussed during the December 7th meeting. Location of S. 178th Street As you are aware, the City's Capital Improvement Plan calls for the future realignment of S. 178th Street; however, the realignment is not necessary to allow the proposed subdivision to proceed. The City will conduct its review of the proposed plat with the assumption that S. 178th Street will not be relocated, but will also conduct an initial review to ensure that the proposed future realignment does not significantly impact the proposed lot layout. Access from Existing S. 178th Street The civil plans show proposed access points for all the lots in the subdivision, expect for proposed lots 2, 3, 4, 44, 45, and 46. Please update the civil plans to show the proposed access points for these lots. Please note that the access must meet maximum grade of 15%. In order for city staff to recommend to the Hearing Examiner that these lots remain with the preliminary approval, the City would like the following changes made to the plat map: 1. The name of the lots should be changed from "future development tracts" to "non -buildable tract". 2. Update the note on sheet 12 of 13 of the preliminary plat documents as follows: "Non -Buildable Tracts" "Lots, with the acronym NBT, are non -buildable tracts that are not suitable for development due to unavailability of utilities and/or access. No development will occur nor will the City of Tukwila issue any type of development permits, until: a) the property owner is granted approval by the City of Tukwila to remove the non -buildable tract status by going through a plat alteration process pursuant to RCW 58.17.215; and b) utilities and access that meets city of Tukwila's adopted standards are provided to these tracts. The City of Tukwila makes no warranties, representations, or guarantees that a future subdivision, short plat, or plat alteration application will be approved. Any future subdivision, short plat or plat alteration adjustment will have to comply with applicable code provisions at the time of submission of a complete land use application and the development agreement between the City of Tukwila and Segale Properties, LLC." 3. Future Development Tracts 2 and 3 are contiguous and need to be combined into one tract. Existing Structures It appears that new lot lines will go through some existing structures or may not meet setbacks. Outline how you propose to address this situation. Typically, the City requires the removal of all structures that will not meet setbacks from new lots prior to final approval of the plat. The note shown on GR3 is insufficient to address staff concerns and the Hearing Examiner will also likely raise this as a concern. Frontage Improvements on S. 204th Street Per Tukwila Municipal Code (TMC) 17.20.030 (C)(6)(d), half street improvements are required along S. 204`h Street. In lieu of installing these improvements, the City is proposing that Segale Properties, LLC agree to a no -protest LID for improvements to be installed in the future by the City. Park Trails, Pedestrian Connections and North-South Easement Section 4.5.1 of the Development Agreement between the City and Segale Properties, LLC required that a bike and pedestrian connection plan be developed by Segale and submitted for approval by the City's Parks and Recreation Director. This has yet to be accomplished. Additionally, Segale Properties, LLC is required to donate to the City a north -south trail system through the Tukwila South area. This is not shown on the plan. As we have discussed, it seems appropriate to work on the bike and pedestrian plan and the trail donation once the lot layout has been finalized. The City will consider allowing final approval of these parks items to be accomplished as a condition to preliminary approval. Your Development Agreement extension letter to the City Administrator on this matter will be responded to separately. Page 2 of 4 Phasing You have indicated that you intend to seek final approval of the subdivision in phases. Please provide a phasing plan for the subdivision, include approximant dates when you expect each phase to be completed and provide information on what infrastructure will be built with each specific phase. Development Agreement, Environmental Impact Statement, and Preliminary Subdivision Application The preliminary subdivision is being used as way to assist in the development that was agreed to by the City of Tukwila and Segale Properties, LLC through the 2009 Development Agreement and its various amendments. There are many requirements and obligations set forth in the Development Agreement. The City would like to suggest that a note is placed on the face of the plat which states the following: The subdivision shown in this plat is subject to the 2009 Development Agreement between the City of Tukwila and Segale Properties, LLC (KC Recording #20090617000114 ). The Development Agreements sets forth obligation of both the City and Segale Properties and in no way does approval of this subdivision modify or alter the Development Agreement or the obligations of either party under the development agreement. Additionally, the development that is part of the subdivision was subject to review as part of an Environmental Impact Statement. The City would like the following language added to the face of the plat document: The City of Tukwila SEPA responsible official has previously determined that the project creates a probable significant environmental impact and required preparation of an Environmental Impact Statement. Final Environmental Impact Statement (FEIS) dated July 7, 2005 together with the Draft EIS dated April 5, 1005 comprise the environmental impact statement as required by the Washington State Environmental Policy Act (Chapter 43.11, Revised Code of Washington). All development shall comply with the mitigation conditions identified in these environmental documents. Clarification on Minor Items As you are aware, the Hearing Examiner grants preliminary approval of the plat, following a public hearing. Prior to the public hearing, the City will prepare a staff report which will be transmitted to the Hearing Examiner for review. Staff believes that it would be helpful if you could assist the City in providing a brief narrative on the following items: 1. Clarify the three lots that are marked as "exceptions" in the subdivision area. It is staff understands that these lots are currently landlocked and there will be no change in this situation upon approval of the plat. 2. Provide background on the three open space tracts located along the river. 3. Why does lot 39 have a small frontage along Southcenter Parkway? Why not include this area with proposed lot 1? 4. Lot 6, 7 and 9 will change by connecting Segale Drive C to Southcenter Parkway. When is this expected to occur? 5. Located on proposed lot 4 is a gas easement. Please explain the proposed use for this lot and provide a conceptual site plan. Page 3 of 4 Minor Modifications to Plat Document The following notes and modifications need to be added to the plat document: 1. Add the following note, "The City of Tukwila has no responsibility to build, improve, maintain or otherwise serve the private roads or private stormwater facilities located within the plat area". 2. Add the following note, "Fire, Park and Traffic Impact fees will be due at the time of issuance of building permit applications." 3. On Note 2 on page 12 of 13, remove all language prior to "Segale Properties shall not construct...." The added language is not consistent with the Development Agreement. 4. Add the following note, "All new utilities shall comply with the City's underground Ordinance." 5. Add the file #L12-027 to the face of the plat. 6. Update note 2 on sheet 12 of 13 to include successor language. 7. If the BLA for the Johnson Creek tract has been recorded, provide the recording number of the plat. 8. Remove the solid line connecting Southcenter Parkway to S. 180`h Street and S. 200`h Street. 9. Show the Ordinary High Water Mark on the plat drawings and the civil plans. 10.
